89.2 892 CITY OF AUSTIN. TEXAS MINUTES OF THE CITY COUNCIL CITY OF AUSTIN, TEXAS Regular Meeting November 19, 1953 10:00 Α.Μ. Council Chamber, City Hall The meeting was called to order with Mayor McAden presiding. Roll Call: Present: Councilmen Long, Pearson, Thompson, White, Mayor McAden Absent: None Present also: W. E. Seaholm, City Manager; W. T. Williams, Jr., City Attorney; C. G. Levander, Director of Public Works. Invocation was delivered by REV. LORY HILDRETH, Hyde Park Baptist Church. Councilman White moved that the Minutes of November 12th be approved. The motion, seconded by Councilman Pearson, carried by the following vote: Ayes: Councilmen Long, Pearson, Thompson, White, Mayor McAden Noes: None MR. ARTHUR DEWITTY, Travis County Voter's League, submitted some results of some surveys made by this League, and some recommendations concerning paving, development of the former Anderson Stadium and Olive Street School Areas, employment by The City, elimination of substandard housing that present health and fire hazards, equal school facilities. He asked that something be done about the Bridge on Rosewood Avenue for the safety of the school children. It was stated the Bridge was under consideration and bids would be taken in December and work started shortly after. Sidewalks were also being provided over this bridge. The Mayor thanked Mr. DeWitty. Councilman Long suggested that the Council make a study of this and report back to Mr. DeWitty so that he could report back to his organization. Councilman Thompson suggested that some of the matters be also presented to the School Board. (Memorandum submitted by Mr. DeWitty on file in the City Clerks Office under TRAVIS COUNTY VOTER'S LEAGUE) 893 893 CITY OF AUSTIN, TEXAS The Mayor announced that Mrs. J. C. Cascio, 5612 Bullcreek Road, had asked the Council to defer action on her request for a day nursery at this location at this time. The Council therefore took no action, and the neighbors will be notified again before this is brought up. (NOTE-Mrs. Cascio called in later and withdrew this.) MR. FREDERICK EBY, JR., asked for extension of time of 30 days for his moving the buildings located at the Veterans' Housing Project on Hargraves. The City Attorney explained that his office was working on an agreement with Mr. Eby and a contract would come before the Council shortly for its approval, and this time limit could be included in the Contract. The City Manager stated this would be worked out. Councilman Long offered the following resolution and moved its adoption: (RESOLUTION) WHEREAS, Mrs. Bertha Jeffreys has made application in writing for permission to use and maintain in her residence a Childrens Nursery, complying with all the City and State regulations, on Lot 15, in the Robert Mueller Subdivision, in the City of Austin, Travis County, Texas, the same being on the south side of West 35th Street, and locally known as 707 West 35th Street, which property is located in an "A" Residence District and under Section #4, Item 13a of the Zoning Ordinance requires a special permit from the City Council; and WHEREAS, this application has been considered and approved by the City Council of the City of Austin, therefore BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That permission for the use and maintenance of a Childrens Nursery at the location described above be granted to Mrs. Bertha Jeffreys. vote: The motion, seconded by Councilman Thompson, carried by the following Ayes: Councilmen Long, Pearson, Thompson, White, Mayor McAden Noes: None The Council took no action on the original zoning of AREA 8, Industrial Area east of old city limit line north of Colorado River to Jain Lane, to allow time for more study. The following ordinance was brought up for its third reading: AN ORDINANCE AMENDING THAT CERTAIN ORDINANCE ENTITLED: "AN ORDINANCE REGULATING TRAFFIC UPON THE PUBLIC STREETS OF THE CITY OF AUSTIN, PRESCRIBING PENALTIES FOR THE VIOLATION OF SAME, REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES 894 894 CITY OF AUSTIN. TEXAS IN CONFLICT HEREWITH, AND DECLARING AN EMERGENCY," WHICH ORDINANCE WAS PASSED BY THE CITY COUNCIL MAY 6, 1937, AND IS RECORDED IN BOOK "K", PAGES 159-179, INCLUSIVE, OF THE ORDINANCE RECORDS OF THE CITY OF AUSTIN, BY AMENDING SECTION 13(b) OF ARTICLE III, RELATING TO LEFT TURNS AT CERTAIN INTERSECTIONS OF SAID ORDINANCE; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; AND DECLARING AN EMERGENCY. TEXAS 896 Councilman White offered the following resolution and moved its adoption: (RESOLUTION) WHEREAS, bids were received by the City of Austin on November 3, 1953, for two vertical type non-clogging Sewage Pumps - one with a capacity of 4,000 gal.per minute and the other with a capacity of 5,000 gallons per minute; and, WHEREAS, the bid of Fairbanks, Morse and Company in the total low bid of $8,010.00 for the two pumps was the lowest and best bid therefor, and the acceptance of such bid has been recommended by the Director of Public Works of the City of Austin, and by the City Manager; Now, Therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That the bid of Fairbanks, Morse & Company in the total sum of $8,010.00 be and the same is hereby accepted, and W. E. Seaholm, City Manager of the City of Austin is hereby authorized and directed to execute a contract on behalf of the City of Austin with Fairbanks, Morse & Company for the purchase of the above described pumps. Councilman Pearson commended the group for their efforts in getting Austin selected as this experimental site, as Austin would get a million dollars worth of advertisement. Mr. Burns noted that Mr. Ned Cole was the one instrumental for getting this in Austin, and he suggested that the Council should write Mr. Cole to thank him for his efforts. Councilman Thompson inquired about traffic controls at 8th and San Jacinto The City Manager stated stop signs would be placed on 8th, but 8th would have to be paved and it would then require a traffic light. Councilman Long inquired about the light just past Montopolis Bridge. The City Manager stated that was now being installed. 400 900 CITY OF AUSTIN, TEXAS - The Planning Engineer explained in detail the recommendations of the Planning Commission regarding the ZONING ORDINANCE INTERIM REVISIONS. (A copy of the proposals as explained in detail is on file) The Council took no action and deferred the matter until it had more time to study the proposals. Councilman Pearson remarked alsothat the beer and liquor questions should not be a part of zoning. Councilman Long suggested a referandum, similar to the one held in El Paso. The City Manager reported the necessity of condemning some property with regard to opening Burnet Road from 42nd Street to 44th Street as petitioned for and as authorized by the Council previously. Councilman Pearson moved that the City Manager be authorized to proceed with condemnation. CITY OF AUSTIN, TEXAS 901 901 Councilman Thompson offered the following resolution and moved its adoption: (RESOLUTION) WHEREAS, the City Council of the City of Austin has found that public necessity requires the opening, construction and maintenance of an additional street, highway, and freeway in the City of Austin extending from its north limits to its south limits, said street, highway and freeway being commonly known as "Interregional Highway"; and, WHEREAS, the City Council has found and determined that the hereinafter described land is suitable for such purpose and that it is necessary to acquire said land for such street, highway and freeway; and, WHEREAS, The City of Austin has negotiated with the owner of such land and has been unable to agree with such owner as to the fair cash market value thereof, Now, Therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That the City Manager be and he is hereby authorized and directed to file or cause to be filed against all owners and lienholders, a suit in eminent domain to acquire fee simple title for said purpose to the following described tract of land: All of Lot 9 of W. O. The motion, seconded by Councilman Long, carried by the following vote: Ayes: Councilmen Long, Pearson, Thompson, White, Mayor McAden Noes: None Councilman Thompson offered the following resolution and moved its adoption: (RESOLUTION) WHEREAS, the City Council of the City of Austin has found that public necessity requires the opening, construction and maintenance of an additional street, highway, and freeway in the City of Austin extending from its north limits to its south limits, said street, highway and freeway being commonly known as "Interregional Highway"; and WHEREAS, the City Council has found and determined that the hereinafter described land is suitable for such purpose and that it is necessary to acquire said land for such street, highway and freeway; and, WHEREAS, the City of Austin has negotiated with the owner of such land and has been unable to agree with such owner as to the fair cash market value thereof, Now, Therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That the City Manager be and he is hereby authorized and directed to file or cause to be filed against all owners and lienholders, a suit in : CITY OF AUSTIN, TEXAS 903 903 eminent domain to acquire fee simple title for said purpose to the following described tract of land: All of Lot 5 of W. O. Harper Subdivision, a resubdivision of a portion of Colorado River Park Addition, a subdivision of a portion of the Santiago Del Valle Grant in the City of Austin, Travis County, Texas, according to a map or plat of said Colorado River Park Addition of record in Book 2, page 220, Plat Records of Travis County, Texas, a map or plat of said W. O. Harper Subdivision being of record in Book 3, page 92, Plat Records of Travis County, Texas, which Lot 5 was conveyed. to James M. Davis, et ux, by warranty deed dated October 29, 1941, of record in Volume 683, page 240, Deed Records of Travis County, Texas. The motion, seconded by Councilman Long, carried by the following vote: Ayes: Councilmen Long, Pearson, Thompson, White, Mayor McAden Noes: None The City Manager presented the request of the AUSTIN COUNCIL FOR RETARDED CHILDREN for one of the houses on Franklin Street, which house had to be purchased by the City; and which the Council for Retarded Children wants to move to City owned property and placed next to the building of the Travis County Society for Crippled Children, on 28th Street. Councilman Pearson moved that the City Manager be authorized to enter into an agreement to loan the Austin Council of Retarded Children the house located on Franklin Street to be moved by them and placed on city property, all costs to be borne by the Austin Council of Retarded Children, as outlined by the City Manager. The motion, seconded by Councilman White, carried by the following vote: Ayes: Councilmen Long, Pearson, Thompson, White, Mayor McAden Noes: None Councilman Long reported a traffic need at the intersection of Eilers and 53rd Street for stop signs, as traffic came from three different directions, and people were stopped on the Railroad Track. She asked that this be referred to the Traffic Engineer. Councilman Long submitted the request of G. C. REEVES, 3811 Bailey Lane for street light on 39th and Bailey, as the nearest light was on Alice and 38th. She asked if this light could be installed. Councilman Long inquired about the study for the traffic light on San Jacinto in front of the Museum. The City Manager stated the study had been made and he would have a report this coming week. Councilman White inquired if the City Employees had been given Friday after Thanksgiving as a Holiday. The City Manager stated that Friday, December 26 was given last year, but not after Thanksgiving. 904 904 CITY OF AUSTIN, TEXAS Councilman Long inquired about the Budget. The City Manager stated it would be filed with the City Clerk this date, and filed with the Council next Wednesday.
