11226 CITY OF AUSTIN, TEXAS MINUTES OF THE CITY COUNCIL CITY OF AUSTIN, TEXAS Regular Meeting December 31, 1953 10:00 Α.Μ. Council Chamber, City Hall The meeting was called to order with Mayor Pro-tem Pearson presiding. Roll Call: Present: Councilmen Long, Thompson, White, Mayor Pro-tem Pearson Absent: Mayor McAden Present also: W. E. Seaholm, City Manager; W. T. Williams, Jr., City Attorney; C. G. Levander, Director of Public Works. Councilman Long had a request for a fire plug in the Wheeler Lane and Hickman Avenue area. A fireplug is located at Wheeler Lane and Manor Road, but that is the nearest. Councilman Long had a notation that the street-marker for Sweeney Lane was painted "Schwinge Lane" and was confusing to the people. The City Attorney stated he would look into this, as the Council had adopted a resolution making that change at the request of the residents. Councilman Long moved that the zoning hearing of AREA 13 and AREA 14 be reset for January 28, 1954 at 11:00 A.M. instead of February lith. The motion, seconded by Councilman Thompson, carried by the following vote: Ayes: Councilmen Long, Thompson, White, Mayor Pro-tem Pearson Noes: None Absent: Mayor McAden The City Manager submitted the following: "Memorandum to: Mr. Walter E. Seaholm, Subject: City Manager "December 30, 1953 Bidg received at 10:00 A.M., Tuesday, December 29, 1953, for laying 30" Sewer Line and Excavation of Lake Austin Pump Station Inlet Channel. "Lump sum bids were taken on the laying of the sewer line and unit price CITY OF AUSTIN, TEXAS 12277 bids were taken on the channel excavation, hauling material to the New Filter Plant site, placing material along roadway in Huck's Slough andon riprap to protect the excavation at the intake. Estimated quantities involved under the items for which unit price bids were received were given in the plans and specifications and these estimated quantities were used to arrive at a comparison of the total bids received for the entire project. "Following is a tabulation of the three bids received for the entire project, based on the estimated quantities as set up in the plans and specifications: "Austin Engineering Company, Austin, Texas Collins Construction Company, Austin, Texas Joe Bland Construction Company, Austin, Texas $38,177.00 $58,320.00 $69,622.00 "It is my recommendation that the Austin Engineering Company base bid in the amount of $38,177.00 for laying the 30" sewer line and the excavation of Lake Austin pump station inlet channel, as per plans and specifications, be accepted as the lowest and best bid and that a contract be executed on this basis. "Respectfully, (8gd) A. H. Ullrich A. H. Ullrich, Superintendent, Water and Sewage Treatment Recommended (Sgd) W. E. Seaholm" Councilman Thompson offered the following resolution and moved its adoption: (RESOLUTION) WHEREAS, bids were received by the City of Austin on December 29,1953, for laying the 30" sewer line and the excavation of Lake Austin pump station inlet channel; and, WHEREAS, the bid of Austin Engineering Company in the sum of $38,177.00 for the entire project based on the estimated quantities as set up in the Plans and Specifications, was the lowest and best bid therefor, and the acceptance of such base bid has been recommended by the Superintendent of the Water and Sewage Treatment Plant, and by the City Manager; Now, Therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That the base bid of the Austin Engineering Company in the sum of $38,177.00 be and the same is hereby accepted, and W. E. Seaholm, City Manager of the City of Austin is hereby authorized and directed to execute a contract on behalf of the City of Austin with the Austin Engineering Company for the performance of above described work in accordance with the approved Plans and Specifications. The motion, seconded by Councilman White, carried by the following vote: Ayes: Councilmen Long, Thompson, White, Mayor Pro-tem Pearson Noes: None Absent: Mayor McAden CITY OF AUSTIN, TEXAS 1277278 The City Manager explained a contract with Mr. David Barrow, Austin Corporation for utility improvements from Taylor Slough at Scenic Drive to the West line of Camp Mabry, in the sum of $95, 705.00, the Austin Corporation to deposit $70,000. Councilman Long inquired as to how this would show up in the budget and the City Manager explained the accounting procedures. Councilman Thompson then offered the following resolution and moved its adoption: (RESOLUTION) BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That the City Manager be and he is hereby authorized and directed to enter into a contract on behalf of the City of Austin with the Austin Corporation in accordance with the terms and provisions of a certain contract, copy of which is attached to this Resolution, and marked by the City Clerk for purposes of identification, and the City Clerk is hereby directed to file for permanent record in the office of the City Clerk the attabhed copy of said contract without recordation in the Minutes of the City Council. (Un File Under WATER MAIN EXTENSIONS - Contract File No. ) The motion, seconded by Councilman White, carried by the following vote: Ayes: Councilmen Long, Thompson, White, Mayor Pro-tem Pearson Noes: None Absent: Mayor Mcaden Councilman White offered the following resolution and moved its adoption: (RESOLUTION) : BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That the City Manager be and he is hereby authorized and directed to enter into a contract on behalf of the City of Austin with Austin Corporation in accordance with the terms and provisions of a certain contract, copy of which is attached to this Resolution, and marked by the City Clerk for purposes of identification, and the City Clerk is hereby directed to file for permanent record in the office of the City Clerk the attached copy of said contract without recordation in the Minutes of the City Council. (On File Under WATER MAIN EXTENSIONS - Contract File No. 815-0 ) The motion, seconded by Councilman Thompson, carried by the following vote: Ayes: Councilmen Long, Thompson, White, Mayor Pro-tem Pearson Noes: None Absent: Mayor McAden The City Manager explained this was under the previous subdivision arrangements, as this work was started, but completion was dependent upon the decision of this large trunk line. He stated there was possibly one more contract in this same pending catagory. Mayor Pro-tem Pearson inquired about a big drainage problem in the 49th and Grover area. The Director of Public Works stated the Legislature would have to give easements, and they did not grant the easements. The Hospital Board is not in a position to give easements, but when permission is granted, the work can be done. CITY OF AUSTIN, TEXAS 1279279 Mayor Pro-tem Pearson introduced the following ordinance: AN ORDINANCE AMENDING THAT CERTAIN ORDINANCE ENTITLED: "AN ORDINANCE REGULATING TRAFFIC UPON THE PUBLIC STREETS OF THE CITY OF AUSTIN; PRESCRIBING PENALTIES FOR THE VIDLATION OF SAME; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; AND DECLARING AN EMERGENCY", WHICH ORDINANCE WAS PASSED BY THE CITY COUNCIL OF THE CITY OF AUSTIN, MAY 6, 1937, AND IS RECORDED IN BOOK "K", PAGES 159-179, INCLUSIVE, OF THE ORDINANCE RECORDS OF THE CITY OF AUSTIN BY AMENDING SECTION 12(b) OF ARTICLE III RELATING TO STOP SIGN LOCATIONS; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; DECLARING AN EMERGENCY AND SUSPENDING THE RULE REQUIRING THE READING OF ORDINANCES ON THREE SEPARATE DAYS. The ordinance was read the first time and Councilman Long moved that the rule be suspended and the ordinance passed to its second reading. Councilman Long submitted the complaint from W. L. SCOURTON, 1176 Graham, that he got only once-a-week pick up on garbage; and this past Saturday he was missed completely. She stated she had another complaint on the Saturday pickup, which was missed. The Director of Public Works stated all sections of town were getting twice-a-week pick up at least. Councilman White inquired about the man driving behind the garbage trucks. It was explained he was clocking the different routes for reallocating the time, that it was necessary every two or three years to make such a study as areas were constantly being added. Councilman White inquired about the opening of the Bridge and the completion of the new Police Building. Both are to be opened sometime in January. Councilman Thompson requested that the City Manager hand the Council not later than two weeks from now a statement outlining the techniques he expects to use in making the accounting practices and the budget operation practices conform to the new Charter. CITY OF AUSTIN, TEXAS 128281 Councilman Long inquired about the codification of the ordinances and suggested bringing in a firm to do it. The City Attorney stated 75% of the work on it had been done, but this past year the office had not been able to finish it. Also the Building Code would be about 50% of the code. If the present ordinances were codified with the old building code, and the Council adopted the new one, there would be a lot of additional expense incurred in publishing it. Other ordinances that would be included in it should be revised and are now under study. Councilman Thompson suggested that the City Attorney bring in a recommendation as to what he thought would be necessary to accomplish the codification. The City Attorney stated there would be about a month's work to get the job done. Mayor Pro-tem Pearson inquired of the savings in the runs of the garbage trucks if they were left at the Sanitary Fills instead of being driven back to the incinerator each night. It was stated if they were left out, watchmen would have to be provided. Mayor Pro-tem Pearson introduced the following ordinance: AN ORDINANCE AMENDING THAT CERTAIN ORDINANCE ENTITLED: "AN ORDINANCE ESTABLISHING VOTING PRECINCTS OF THE CITY OF AUSTIN AND FIXING THE BOUNDARIES THEREOF; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; AND DECLARING AN EMERGENCY," WHICH ORDINANCE WAS PASSED BY THE CITY COUNCIL OF THE CITY OF AUSTIN ON JULY 23, 1953, AND RECORDED IN ORDINANCE BOOK "S" AT PAGES 432-449, INCLUSIVE, OF THE ORDINANCE RECORDS OF THE CITY OF AUSTIN, BY AMENDING SECTIONS 33, 34, 35, 36, 37. AND 38 OF SAID ORDINANCE; AND DECLARING AN EMERGENCY. The ordinance was read the first time and Councilman Long moved that the rule be suspended and the ordinance passed to its second reading.
