Council Chamber, City Hall The meeting was called to order with Mayor McAden presiding. Roll Call: Present: Councilmen Long, Pearson, Thompson, White, Mayor McAden Absent: None Present also: W. E. Seaholm, City Manager; W. T. Williams, Jr., City Attorney; C. G. Levander, Director of Public Works. Invocation was delivered by REV. M. C. DEASON, Chancery Office. Councilman Thompson moved that the Minutes of the Meetings of December 17th, 18th, 22nd, 23rd, and 31st be approved. The motion, seconded by Councilman Pearson, carried by the following vote: Ayes: Councilmen Long, Pearson, Thompson, White, Mayor McAden Noes: None MR. CARL HARDIN, JR., Travis County Chapter, National Foundation of Infantile Paralysis, invited the Council to the opening of this campaign at 9:30 A.M., Friday, January 15th. MRS. MATTIE DAVIS, 3209 East 16th Street, presented the following petition signed by approximately 19 citizens: "Members of the City Council City of Austin, Travis County "Dear Sirs: "January 7, 1954 "We the undersigned homeowners do hereby petition you to grant us in the McKinley Heights Addition, in the vicinity between Airport Boulevard and Tillery street, including the streets 142, 16th, 17th and 18: "1. A storm sewer, beginning at the intersection of Airport Boulevard CITY OF AUSTIN. TEXAS 2 and 16th street, extending along 16th through the intersection of 16th and Tillery, out into the wooded area. This is in order to prevent water from washing away property along 16th and the intersection of Tillery. "2. A city sewerage system throughout the entire above mentioned area. "3. Streets lights at the intersections of Tillery with the following: 14½ St., 16th St., 17th St., and 18th St." The City Manager stated this was included as a part of the bond project, and explained the proposal as set up, stating it was a $150,000 project beginning from the Sewage Plant. The Director of Public Works stated the project, was spread over about three years, and would take care of the problem on Ledesma, east and north of Govalle. Councilman Long inquired about pump stations. The Director of Public Works explained the problem in this connection. Councilman Long inquired about the street lights in that area, and the City Manager stated this would be accomplished much quicker. The Mayor stated the three-year time was the maximum, and maybe the work could be done before then, and explained this was included in the proposed revenue bond issue. Councilman White offered the following resolution and moved its adoption: (RESOLUTION) WHEREAS, Southern Union Gas Company has presented to the City Council tentative maps or plans showing the proposed construction of its gas mains in the streets in the City of Austin hereafter named, and said maps or plans have been considered by the City Council; therefore BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT Southern Union Gas Company be and the same is hereby permitted to lay and construct its gas mains in and upon the following streets: (1) A gas main in WOODROW AVENUE, from Ruth Avenue to Justin Lane, the centerline of which gas main shall be 6.5 feet west of and parallel to the east property line of said WOODROW AVENUE. Said gas main described above shall have a cover of not less than 2½ feet. (2) Aggas main in HARMON AVENUE, from East 53rd Street to East 58 Street, the centerline of which gas mains shall be 6 feet west of and parallel to the east property line of said HARMON AVENUE. Said gas main described above shall have a cover of not less than 2 feet. (3) A gas main in East 53½ STREET, from Airport Boulevard to Harmon Avenue, the centerline of which gas main shall be 19 feet north of and parallel to the centerline of said EAST 53 STREET. Said gas main described above shall have a cover of not less than 2½ feet. = CITY OF AUSTIN, TEXAS 03 3 (4) A gas main in AIRPORT BOULEVARD, from East 532 Street, northerly 79 feet, the centerline of which gas main shall be 12 feet west of and parallel to the east property line of said AIRPORT BOULEVARD. Said gas main described above shall have a cover of not less than 22 feet. (5) A gas main across AIRPORT BOULEVARD at a location 79 feet north of and parallel to East 532 Street. Said gas main described above shall have a cover of not less than 2½ feet. (6) A gas main in AIRPORT BOULEVARD, from Bruning Avenue northerly 57 feet, the centerline of which gas main shall be 9 feet east of and parallel to the west property line of said AIRPORT BOULEVARD. Said gas main described above shall have a cover of not less than q feet. (7) A gas main in BRUNING AVENUE, from East 53rd Street to Airport Boulevard, the centerline of which gas main shall be 16 feet south of and parallel to the north property line of said BRUNING AVENUE. Said gas main described above shall have a cover of not less than 2½ feet. THE Southern Union Gas Company is hereby put upon notice that the City of Austin does not guarantee that the space assigned above is clear from other underground utilities, but is based upon the best records we have at hand, and that the minimum depth stated does not have any reference to the fact that greater depths may not be required at special points. When the Southern Union Gas Company requires definite information upon the ground as to elevations or working points from which to base the location of their assignments, they shall apply to the Department of Public Works not less than three (3) days before. such information is required. The Southern Union Gas Company is further put upon notice that they will be required to bear the expense of repairs or replacement of any underground utility damaged during the construction of lines named in this resolution. AND THAT whenever pavement is cut in the vicinity of a fire plug, water must be used at intervals during the course of backfilling of the ditches. THAT the work and laying of said gas mains, including the excavation in the streets, and the restoration and maintenance of said streets after said mains have been laid shall be under the supervision and direction of the City Manager, and under all the pertinent terms and conditions of the certain franchises granted to said company by the City of Austin. vote: The motion, seconded by Councilman Pearson, carried by the following Ayes: Councilmen Long, Pearson, Thompson, White, Mayor McAden Noes: None CITY OF AUSTIN. TEXAS 4 Councilman Long offered the following resolution and moved its adoption: (RESOLUTION) BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the City Council of the City of Austin hereby approves the erection of a boat dock on the property owned by Chester A. Freund as described in the Travis County Deed Records and located up-stream from the westerly extension of the south line of Windsor Road near Quinlan Park, and hereby authorizes the said Chester A. Freund to construct, maintain and operate this boat dock subject to same being constructed in compliance with all the ordinances relating thereto and further subject to the foregoing attached recommendations; and the Building Inspector is hereby authorized to issue an occupancy permit for the erection of this boat dock after full compliance with all the provisions of this resolution. Said permission shall be held to be granted and accepted subject to all necessary, reasonable and proper, present and future regulations and ordinances of the City of Austin, Texas, in the enforcement of the proper police, fire and health regulations and the right of revocation is retained if, after hearing, it is found by the City Council that the said Chester A. Freund, owner of a piece of property located up-stream from the westerly extension of the south line of Windsor Road near Quinlan Park and listed in the Travis County Dead Records, for permission to construct and maintain a boat dock projecting out into the lake approximately 40 feet. The construction details meeting all requirements and the Lake Austin Navigation Board having considered and approved this project, I therefore recommend that if Chester A. Freund is granted his request by the City Council, that it be subject to the following conditions: "(1). That nothing but cresoted piles, cedar piles or concrete piles, substantially braced to withstand wind and water pressure, be used in the construc- tion and that no structure shall be nearer than ten feet to any side property line of the owner or applicant. "(2). That no business, such as a restaurant, dance hall, concession stand, or any other enterprise for the sale of ggods, wares and merchandise, except marine supplies and tackle, and no living quarters of any character, shall be erected on any pier, dock, wharf, float, island, piling or other structure extending into or above Lake Austin. "(3). That every structure shall be equipped with proper lights whichshow all around the horizon for night use and shall be equipped with flags or other warnings for daylight use. TEXAS 10 10 The Mayor announced the change had been granted and an ordinance would be drawn. AREA 7-Montopolis Area Original Zoning was before the Council. The Planning Engineer further explained the recommendation of the Planning Commission. (Recorded in full in the Minutes of December 23, 1953.) Councilman Long moved that the original zoning of Area 7, recommended by the Plan Commission, be amended to extend the "C" Commercial, 6th Height and Area on the Bastrop Highway out to and including the "Y", extending into the "Y" 300'. The motion, seconded by Councilman White, carried by the following vote: Ayes: Councilmen Long, White, Mayor McAden Noes: Councilmen Pearson, Thompson Councilman Long moved that the original zoning recommendation of the Planning Commission be amended to make now existing businesses "C" Commercial in this area. (Area 7). The motion, seconded by Councilman White, carried by the following vote: Ayes: Councilmen Long, White, Mayor McAden Noes: Councilmen Pearson, Thompson Councilman Pearson stated this would leave it too-wide open. The Planning Engineer asked for clarification as to the locations such as No. 15, which was a commercial use, if it would include the large area of approximately 800'. The City Attorney stated it would probable include the whole tract. Conncilman Long moved that the original zoning of the Montopolis Area No. 7 as recommended by the Planning Commission and amended by the Council, be adopted. The following supplemental recommendation, dated December 23, 1953, was received from the Planning Commission: "Subject: WHELESS SCHOOL AREA (Area 12) "Subsequent to its recommendation on the Wheless School Area, Mr. Vernon Cook appeared before the Commission requesting that the E. L. Walton 0.5 acre tract and the Vernon Cook 1.03 acre tract at the southwest corner of the intersection of Wheless Lane and Old Manor Road and a 2.45 acre tract at the northeast corner of the intersection of Walnut Hills Drive and Old Manor Road be established in a commercial classification. "It willbe recalled that the Commission, in its original recommendation, inCITY OF AUSTIN. TEXAS 11 dicated that no one had appeared regarding a business location in this area and that the Commission was of the opinion that such a location should not be recommended on until someone had indicated his desires. "After careful consideration of both locations, it was the Commission's opinion that each could properly function as business area, each serving its om distinct district as the land around is subdivided and built up in residences. Therefore it was voted to recommend to the City Council that it include in the establishing of Original Zoning for the Wheless School Area (Area 12) the tracts above named as "C" Commercial and Sixth Height and Area District." Councilman Long moved that the proposal of the Planning Commission be amended to include the supplemental recommendation to the Council. The ordinance was read the first time and Councilman Pearson moved that the rule be suspended and the ordinance passed to its second reading. The motion, seconded by Councilman White, carried by the following vote: Ayes: Councilmen Long, Pearson, Thompson, White, Mayor McAden Noes: None The Mayor announced the ordinance had been finally passed. *Councilman Long made the following statement regarding her vote: "My vote to submit the bond issue to the people certainly is not an endorsement of it, but I would not vote against submitting something to the people that the rest of the Council members feel should be submitted. I will vote to submit this." **Councilman Pearson made the following statement regarding his vote: "I feel it is something we should endorse in its entirety. The progress of Austin hinges on our moving forward and having the necessary utilities to meet our ever increasing demands and the increasing population, and I certainly endorse it overwhelmingly." Councilman Thompson made the following statement: "This Council is obligated to vote for it if they think it is for the best interest of this City, and vote against it if they do not think it is for the best interest of the City." The Mayor announced that the three former Mayors would act as Con Chairmen of the Revenue Bond Committee, and that a meeting of this Committee was called for Menday, 7:30 P. M. at the Auditorium at the Public Library Building. He announced that Mr. Mike Butler would head a finance committee composed of Messrs. Howard Cox, Wilford Turner, Willard Houser, John Aycock, Pope to assist in raising funds for publicity in this coming revenue bond election. Councilman White offered the following resolution and moved its adoption: (RESOLUTION) WHEREAS, bids were received by the City of Austin on Pneumatic Tube System and Elevators and Dumbwaiters to be installed in the Addition to Brackenridge Hospital; and, WHEREAS, Otis Elevator Company's Bid No. 5 in the amount of $82,705.00 and R. B. Buchholtz, Company's Bid No. 6 in the amount of $25,765.00 were the lowest and best bids therefor, and the acceptance of such bids has been recommended by the Architect and the Administrator of Brackenridge Hospital CITY OF AUSTIN. TEXAS 14 14 and by the City Manager; Now Therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That Bid No. 5 of Otis Elevator Company in the sum of $82,705.00 and Bid No. 6 of R. B. Buckholtz Company in the sum of $25,765.00 be and the same are hereby accepted, and W. E. Seaholm, City Manager of the City of Austin is hereby authorized and directed to enter into contracts with said parties. vote: The motion, seconded by Councilman Pearson, carried by the following Ayes: Councilmen Long, Pearson, Thompson, White, Mayor McAden Noes: None Councilman Long inquired about the possibility of a fire plug on Wheeles Lane and Hickman Lane. The City Manager stated he had a report on this ready to send out--that the cost would run around $4,500.00. Councilman Long asked if it could be put in. The City Manager stated he could not say, as what developed in the revenue bond might influence the situation. Councilman Long read a letter from the City Manager/regarding cancellation of employee $150 accident coverage, dated December 30, 1953. The City Manager stated this coverage was not included in the original specifications, but they had submitted it. It was a supplement to the original contract. Councilman Thompson suggested if this Insurance Company was going to change their contract, that other insurance companies should look into it. Councilman Pearson suggested that Councilman Thompson look into this matter and he and the City Manager report back on it. Councilman Long moved that the Council ask Councilman Thompson to make a study of this and present them a recommendation. The motion, seconded by Councilman White, carried by the following vote: Ayes: Councilmen Long, Pearson, White, Mayor MeAden Noes: None Present but not voting: Councilman Thompson Councilman Thompson inquired about the status of the signal light to be installed by the Railroad Companies at their crossing. Councilman Thompson moved that the City Manager be instructed to have the City Attorney prepare an ordinance to be submitted at the next Council meeting for passage, to provide that the railroads will stop all trains approaching Springdale Road until such time as they have installed safety devices adequate to remove the hazard to life and limb of Austin Citizens. The motion, seconded by Councilman Long, carried by the following vote: Ayes: Councilmen Long, Pearson, Thompson, White, Mayor McAden Noes: None Councilman Long stated there was a great deal of trouble getting citizens to obey some of the traffic and safety laws, and she had noted that in Johnstown, Pa., a new plan dealing with parking violators was working out CITY OF AUSTIN, TEXAS 1515 very satisfactorily--different colored tickets were handed those overparking, and they carried a $1.00 fine --$3.00 if not paid within 72 hours. Another Colored ticket was given those classified as deliberately parking in restricted zones etc--this fine was $3.00 or $6.00 if not paid within 72 hours. The City Attorney stated the present ordinance now provided fines up to $200.00, for offenses which the Council has defined. The City Clerk was asked to write for copies of this ordinance in Johnstown. Councilman White stated he had had many complaints about cars parking in the alleys with little enforcemant. One person reported to him there were cars in an alley--his car was ticketed, and other cars stayed there for an hour and were not given any tickets. The City Manager stated he would check this. Councilman White inquired about the proposal underway to permit MR. MARION FOWLER to dock his big boat on this side of the Lake. The CityManager stated this would not be a place to dock the boat, but only used for loading and unloading passengers. It would be next to the Police dock, and it would be easily controlled at this point. It would require the city placing about four or five poles to protect the police dock. The Mayor called a meeting for 10:00 A.M., Monday, January lith, for the purpose of selecting Election officials for the Revenue Bond Election.
