9191 CITY OF AUSTIN, TEXAS MINUTES OF THE CITY COUNCIL CITY OF AUSTIN, TEXAS Special Meeting February 01, 1954 10:00 A. M. Council Chamber, City Hall On this, the 1st day of February, 1954, pursuant to a call for the purpose of transacting the business hereinafter recorded, the City Council of the City of Austin, Texas, convened in Special Session, at the regular meeting place thereof, in the City Hall. The meeting was called to order, with Mayor McAden presiding. The roll was called, showing the following: Present: Councilmen Long, Pearson, Thompson, White, Mayor McAden Absent: None Thereupon, the Council proceeded to canvass the returns of the bond election held on the 30th day of January, 1954. Upon the completion of the canvass, Councilman White offered the following resolution and moved its adoption: "A RESOLUTION by the City Council of the City of Austin, Texas, canvassing returns and declaring results of bond election held in said City on the 30th day of January, 1954, to authorize the issuance of revenue bonds of the City of Austin in the following amounts and for the following purposes: (1) $6,190,000 revenue bonds for the purpose of pay- ing off, refunding and cancelling an equal amount of the outstanding indebtedness of the City's Electric Light and Power, Waterworks and Sewer Systems; (2) $9,110,000 revenue bonds for the purpose of extending and improving the City's Electric Light and Power System; (3) $3,200,000 revenue bonda for the purpose of extending and improving the City's Waterworks System; (4) $1,500,000 revenue bonds for the purpose of extending and improving the City's Sewer System; and (5) $1,750,000 revenue bonds for the purpose of building a municipal auditorium; enacting provisions incident and relating to the purpose and object of this resolution; and declaring an emergency." CITY OF AUSTIN. TEXAS 92 92 WHEREAS, under and by virtue of an ordinance duly passed and adopted by the City Council of the City of Austin, Texas, on the lith day of January, 1954, an election was held in said City on the fifth Saturday in January, 1954, the same being the 30th day of January, 1954, on five propositions for the issuance of the bonds of said City, in the following amounts and for the following purposes, to wit: $6,190,000 revenue bonds for the purpose of paying off, cancelling and refunding a like amount of the out- standing indebtedness of the City's combined Electric Light and Power, Waterworks and Sewer Systems; $9,110,000 revenue bonds for the purpose of extending and improving the City's Electric Light and Power System; $3,200,000 revenue bonds for the purpose of extending and improving the City's Waterworks System; $1,500,000 revenue bonds for the purpose of extending and improving the City's Sewer System; and $1,750,000 revenue bonds for the purpose of building a Municipal Auditorium; AND WHEREAS, on this the 1st day of February, 1954, there came on to be considered the returns of said election, and this City Council has determined that this resolution be passed as an emergency measure; and, WHEREAS, upon consideration of the returns of said election, it appears that the same was in all respects legally held, after due notice had been given, and that the said returns were duly and legally made; and, WHEREAS, it further appears from said returns that there were cast at said election 10,506 votes on the proposition for the issuance of $6,190,000 revenue bonds for the purpose of paying off, cancelling and refunding a like amount of the existing indebtedness of the combined system, of which number 8,513 votes were cast "FOR THE ISSUANCE OF $6,190,000 REVENUE BONDS AND PLEDGING THE REVENUES OF THE CITY'S COMBINED ELECTRIC LIGHT AND POWER, WATERWORKS AND SEWER SYSTEM TO THE PAYMENT THREOF, FOR THE PURPOSE OF PAYING OFF, CANCELLING AND REFUND ING A LIKE AMOUNT OF THE EXISTING INDEBTEDNESS OF SAID COMBINED SYSTEM, AS SUBMITTED IN PROPOSITION NO. 1"; and 1,993 votes were cast "AGAINST THE ISSUANCE OF $6,190,000 REVENUE BONDS AND PLEDGING THE REVENUES OF THE CITY'S COMBINED ELECTRIC LIGHT AND POWER, WATERWORKS AND SEWER SYSTEM TO THE PAYMENT THEREOF, FOR THE PURPOSE OF PAYING OFF, CANCELLING AND REFUNDING A LIKE AMOUNT OF THE EXISTING INDEBTED- NESS OF SAID COMBINED SYSTEM, AS SUBMITTED IN PROPOSITION NO. 1"; and, CITY OF AUSTIN, TEXAS 93 93 WHEREAS, it further appears from said returns that there were cast at said election 10,477 votes on the proposition for the issuance of $9,110,000 revenue bonds for thepurpose of extending and improving the City's Electric Light and Power System, of which number 8,444 votes were cast "FOR THE ISSUANCE OF $9,110,000 REVENUE BONDS AND PLEDGING THE REVENUES OF THE CITY'S COMBINED ELECTRIC LIGHT AND POWER, WATERWORKS AND SEWER SYSTEM TO THE PAYMENT THEREOF, FOR THE PURPOSE OF EXTENDING AND IMPROVING THE CITY'S ELECTRIC LIGHT AND POWER SYSTEM, AS SUBMITTED IN PROPOSITION NO. 2"; and 2,033 votes were cast "AGAINST THE ISSUANCE OF $9,110,000 REVENUE BONDS AND PLEDGING THE REVENUES OF THE CITY'S COMBINED ELECTRIC LIGHT AND POWER, WATERWORKS AND SEWER SYSTEM TO THE PAYMENT THEREOF, FOR THE PURPOSE OF EXTENDING AND IMPROVING THE CITY'S ELECTRIC LIGHT AND POWER SYSTEM, AS SUBMITTED IN PROPOSITION NO. 2"; and, WHEREAS, it further appears from said returns that there were cast at said election 10,483 votes on the proposition for the issuance of $3,200,000 revenue bonds for the purpose of extending and improving the City's Waterworks System, of which number 8,483 votes were cast "FOR THE ISSUANCE OF $3,200,000 REVENUE BONDS AND PLEDGING THE REVENUES OF THE CITY'S COMBINED ELECTRIC LIGHT AND POWER, WATERWORKS AND SEWER SYSTEM TO THE PAYMENT THEREOF, FOR THE PURPOSE OF EXTENDING AND IMPROVING THE CITY'S WATERWORKS SYSTEM, AS SUBMITTED IN PROPOSITION NO. 3"; and 2,000 votes were cast "AGAINST THE ISSUANCE OF $3,200,000 REVENUE BONDS AND PLEDG ING THE REVENUES OF THE CITY'S COMBINED ELECTRIC LIGHT AND POWER, WATERWORKS AND SEWER SYSTEM TO THE PAYMENT THEREOF, FOR THE PURPOSE OF EXTENDING AND IMPROVING THE CITY'S WATERWORKS SYSTEM, AS SUBMITIED IN PROPOSITION NO. 3"; and, WHEREAS, it further appears from said returns that there were cast at said election 10,476 votes on the proposition for the issueance of $1,500,000 revenue bonds for the purpose of extending and improvingthe City's Sewer System, of which number 8,493 votes were cast "FOR THE ISSUANCE OF $1,500,000 REVENUE BONDS AND PLEDGING THE REVENUES OF THE CITY'S COMBINED ELECTRIC LIGHT AND POWER, WATERWORKS AND SEWER SYSTEM TO THE PAYMENT THEREOF, FOR THE PURPOSE OF EXTENDING AND IMPROV ING THE CITY'S SEWER SYSTEM, AS SUBMITTED IN PROPOSITION NO. 4"; and 1,983 votes were cast "AGAINST THE ISSUANCE OF $1,500,000 REVENUE BONDS AND PLEDGING THE REVENUES OF THE CITY'S COMBINED ELECTRIC LIGHT AND POWER, WATERWORKS AND SEWER SYSTEM TO THE PAYMENT THEREOF, FOR THE PURPOSE OF EXTENDING AND IMPROVING THE CITY'S SEWER SYSTEM, AS SUBMITTED IN PROPOSITION NO. 4"; and, WHEREAS, it further appears from aid returns that there were cast at said election 10,483 votes on the proposition for the issuance of $1,750,000 revenue bonds for the purpose of building a municipal auditorium, of which number 8,428 votes were cast "FOR THE ISSUANCE OF $1,750,000 REVENUE BONDS AND PLEDGING THE REVENUES OF THE CITY'S MUNICIPAL AUDITORIUM, AND AT THE DISCRETION OF THE CITY COUNCIL, THE REVENUES OF THE CITY'S MUNICIPAL COLISEUM TO THE PAYMENT THEREOF, FOR THE PURPOSE OF BUILDING A MUNICIPAL AUDITORIUM, AS SUBMITTED IN PROPOSITIÓN NO. 5"; and 2,055 votes were cast "AGAINST THE ISSUANCE OF $1,750,000 REVENUE BONDS AND PLEDGING THE REVENUES OF THE CITY'S MUNICIPAL AUDITORIUM, AND AT THE DISCRETION OF THE CITY COUNCIL, THE REVENUES OF THE CITY'S MUNICIPAL COLISEUM TO THE PAYMENT THEREOF, FOR THE PURPOSE OF BUILDING A MUNICIPAL AUDITORIUM, AS SUBMITTED IN PROPOSITION NO. 5"; Therefore, CITY OF AUSTIN, TEXAS 94 94 BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: I. That the aforesaid election was duly and legally called and notice thereof given in accordance with the laws of the State of Texas, and the ordinance calling said election; that said election was held in strict conformity with the Constitution and laws of the State of Texas, and the returns thereof have been properly made to the officials of the City entitled to receive same; that only resident qualified property taxpaying voters of said City, who own property therein subject to taxation, and who have duly rendered the same for taxation, were permitted to vote at said election; and further, that said election properly represents the de sires of those qualified to vote as aforesaid. II. That the proposition to issue the said $6,190,000 revenue bonds for the purpose of paying off, cancelling and refunding a like amount of the existing indebtedness of the City's combined Electric Light and Power, Waterworks and Sewer System, was sustained by a majority vote of the qualified voters of aid City, vot. ing at said election, who own taxable property in said City and who have duly ren dered the same for taxation, and that the City Council of said City is authorized to issue said bonds and to encumber the revenues of the City's combined Electric Light and Power, Waterworks and Sewer System for the purpose of securing the payment of the principal of and interest on said bonds at maturity, as prescribed by law. III. That the proposition to issue the said $9,110,000 revenue bonds for the purpose of extending and improving the City's Electric Light and Power System, was sustained by a majority of the qualified voters of said City, voting at said election, who own taxable property in said City and who have duly rendered the same for taxation, and that the City Council of said City is authorized the issue said bonds and to encumber the revenues of the City's combined Electric Light and Power, Waterworks and Sewer System for the purpose of securing the payment of the principal of and interest on said bonds at maturity, as prescribed by law. IV. Thatthe proposition to issue the said $3,200,000 revenue bonds for the purpose of extending and improving the City's Waterworks System, was sustained by a majority of the qualified voters of said City, voting at said election, who own taxable property in said City and who have duly rendered the same for taxation, and that the City Council of said City is authorized to issue said bonds and to encumber the revenues of the City's combined Electric Light and Power, Waterworks and Sewer System for the purpose of securing the payment of the principal of and interest on said bonds at maturity, as prescribed by law. CITY OF AUSTIN, TEXAS 9595 V. That the proposition to issue the said $1,500,000 revenue bonds for the purpose of extending and improving the City's Sewer System, was sustained by a majority of the qualified voters of said City, voting at said election, who own taxable property in said City, and who have duly rendered the same for taxation, and that the City Council of said City is authorized to issue said bonds and to encumber the revenues of the City's combine Electric Light and Power, Waterworks and Sewer System for the purpose of securing the payment of the principal of and interest on said bonds at maturity, as prescribed by law. VI. That the proposition to issue the said $1,750,000 revenue bonds for the purpose of building a municipal auditorium was sustained by a majority of the qualified voters of said City, voting at said election, who own taxable property in said City, and who have duly rendered the same for taxation, and that the City Council of said City is authorized to issue said bonds, and to encumber the revenues of the City's municipal auditorium, and at its discretion, the revenues of the City's municipal coliseum, for the purpose of securing the payment of the principal of and interest on said bonds at maturity, as prescribed by law. VII. The public importance of this measure and the fact that it is to the best interest of the City to canvass the returns and declare the result of the aforesaid bond election at the earliest possible date for the immediate preservation of the public peace, property, health and safety of the citizens of the City of Austin, Texas, constitutes an emergency and an imperative public necessity that this Resolution shall take effect and be in full force immediately upon its passage, all Charter rules governing the effective date of any ordinance or resolution are hereby suspended and this Resolution shall take effect and le in force from and after its final passage, and it is so resolved. The motion was seconded by CouncilmanThompson, and the motion, carrying with it the adoption of the resolution, prevailed by the following vote: Ayes: Councilmen Long, Pearson, Thompson, White, Mayor McAden Noes: None The Mayor then announced that the resolution had been adopted. Councilman Long moved that all the projects as outlined in the bond election and the map, be made a part of the official Minutes of this meeting so that there would be an official record of those projects outlined. Estimated Cost 227,000 POWER PLANT -- This project includes the addition to present Power Plant building and intake tower at the river, the installation of two200,000 lbs. per hour steam boilers, two--20,000 KW turbo- generators, two--17,000 square feet condensors, electrical switchgear, and other appurtenances necessary for modern steam plant. Councilman Pearson suggested that there should be an understanding by all the people that in the early part of 1955, it would be necessary to have a school bond and street bond election, and he would like for the study to be made and that the Council be kept informed so that it could keep the people informed all along.
