329 369 CITY OF AUSTIN, TEXAS = NOTICE OF SPECIAL MEETING TO THE MEMBERS OF THE CITY COUNCIL OF THE CITY OF AUSTIN: Notice is hereby given that a Special Meeting of the City Council of the City of Austin will be held on the 2nd day of May, 1955, at the Municipal Building, Eighth and Colorado, in Austin, Texas, at 2:00 P.M. for the purpose of canvassing the Returns of a Special Election of the City of Austin, held on April 30, 1955, and declaring the official results. Council Chamber, City Hall The meeting was called to order with Mayor McAden presiding. Roll call: Present: Councilmen Long, Pearson, Thompson, White, Mayor McAden Absent: None The Mayor announced that this meeting was called for the purpose of canvassing the Returns of a Special Election of the City of Austin, held on April 30, 1955, and declaring the official results. The Council canvassed the votes, and Councilman Long offered the following resolution and moved its adoption: (RESOLUTION) WHEREAS a petition of over 400 persons was presented to the Board of Trustees of the Austin Independent School District on the 4th day of April, 1955, in accordance with the terms and provisions of Article 2783c of Vernon's Annotated Revised Civil Statutes of the State of Texas for the purpose of determining whether the Austin Independent School District (also known as the Austin Public Free Schools) shall be divorced from the municipal control of the City of Austin; and WHEREAS in accordance with Article 2783c, said above mentioned petition, together with a certificate by the County Tax Assessor and Collector of Travis County, Texas, that it was signed by at least 100 resident qualified voters of the Austin Independent School District was certified to the City Council of the City of Austin by the Board of Trustees of the Austin Independent School District said certification being in accordance with the laws of the State of Texas; and WHEREAS the City Council of theCity of Austin called a joint meeting of the City Council of the City of Austin and The Board of Trustees of the Austin Independent School District for the 7th day of April, 1955, and said joint meeting was duly held on the 7th day of April, 1955, with all members of the City Council and Board of Trustees present; and : CITY OF AUSTIN, TEXAS 371 371 WHEREAS at said above mentioned joint meeting on the 7th day of April, 1955, it was ordered that an election be held in the Austin Independent School District on the 30th day of April, 1955, upon the proposition of whether or not the Austin Independent School District shall be divorced from municipal control of the City of Austin; and WHEREAS a notice of said election was duly given in the manner required by law, and said election was duly and legally held on the 30th day of April, 1955, and the returns of said election, together with the ballot boxes and other supplies have been duly and legally returned to the City Clerk of the City of Austin; and It appearing that said election was ordered, held and conducted in strict conformity with law, and it appearing from said returns that there were cast at said election 3396 valid and legal votes, of which number there were cast: FOR DIVORCEMENT AGAINST DIVORCEMENT 2728 votes 668 votes THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That said above mentioned election was duly called and notice of said election was given in accordance with law, and that said election was held in accordance with law, and the returns of said election were made in accordance with law, and that at said election 3396 valid and legal votes were cast, of which as shown above the majority voted in favor of divorcement of the Austin Independent School District from municipal control of the City of Austin. The City Clerk is hereby authorized and instructed to deliver to the Board of Trustees of the Austin Independent School District a certified copy of this order canvassing the returns and declaring the result of said election, together with a certified copy of the petition, the certification of said petition to the City Council, the order of election entered by said joint meeting, the notice of election, together with the certificate showing how said notice was made, and the election returns from each of the polling places. The motion, seconded by Councilman White, carried by the following vote: Ayes: Councilmen Long, Pearson, Thompson, White, Mayor McAden Noes: None There being no further business the Council adjourned at about 4:00 P.M. subject to the call of the Mayor.
