Council Chamber, City Hall The meeting was called to order with Mayor Miller presiding. Roll call: Present: Councilmen Long, Palmer, Pearson, White, Mayor Miller Absent: None Present also: W. T. Williams, Jr., City Manager; Doren R. Eskew, City Attorney; Reuben Rountree; Director of Public Works. Invocation was delivered by REV. LEE GELDMETER, St. Luke's Methodist Church, 1306 West Lynn. MR. M. H. CROCKETT, SR., presented a portrait of David Crockett to the City, and gave a history of his life and accomplishments. The Mayor thanked Mr. Crockett for this fine gift, and stated it would be hung in the foyer of the City Hall. MR. DEWEY BRADFORD displayed a picture also of David Crockett and related his plans to have portraits of all the Texas heroes and governors and send them around to the public schools as a traveling exhibit. The paintings were by Charles B. Norman. Councilman White moved that the Minutes of the Special Meeting of September 16th and of the Regular Meeting on September 22nd be approved. The motion, seconded by Councilman Palmer, carried by the following vote: Ayes: Councilmen Long, Palmer, Pearson, White, Mayor Miller Noes: None The Council had before it the following application for change of Zoning: W. J. The motion, seconded by Councilman Pearson, carried by the following vote: Ayes: Councilmen Long, Palmer, Pearson, White, Mayor Miller Noes: None Councilman White offered the following resolution and moved its adoption: (RESOLUTION) WHEREAS, on certain maps or plats of the City of Austin there appears a certain street known and designated as Patton Lane, which extends in a northSouth direction, south of Highway 290 (New Manor Road) approximately 1900 feet, then extends westerly in an east-west direction approximately 1250 feet terminating in a certain public street designated Berkman Drive by the City Council of the City of Austin on September 15, 1955; and, WHEREAS, the present residents and owners of houses facing said northsouth portion of said street have requested that the name of such north-south portion of Patton Lane be changed to Mira Loma Lane; Now, Therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That the name of the north-south portion of Patton Lane, above described, as the same appears on certain maps and plats of the City of Austin, Travis County, Texas, be and the same is hereby changed to Mira Loma Lane; and, BE IT FURTHER RESOLVED: That the City Clerk is hereby authorized and directed to file or cause to be filed a certified copy of this Resolution in the Deed Records of Travis County, Texas. The motion, seconded by Councilman Pearson, carried by the following vote: Ayes: Councilmen Long, Palmer, Pearson, White, Mayor Miller Noes: None 994 999 CITY OF AUSTIN, TEXAS Councilman White offered the following resolution and moved its adoption: (RESOLUTION) WHEREAS, bids were received by the City of Austin on September 27, 1955, for the construction of a reinforced concrete culvert on Berkman Drive at Northridge Drive Easement; and, WHEREAS, the bid of Collins Construction Company in the sum of $6,085.84 was the lowest and best bid therefor, and the acceptance of such bid has been recommended by the Director of Public Works, and by the City Manager; Now, Therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That the bid of Collins Construction Company in the sum of $6,085.84 be and the same is hereby accepted, and W. T. Williams, Jr., City Manager of the City of Austin is hereby authorized and directed to execute a contract on behalf of the City of Austin with Collins Construction Company. The motion, seconded by Councilman Pearson, carried by the following vote Ayes: Councilmen Long, Palmer, Pearson, White, Mayor Miller Noes: None The Mayor announced that paving of 8th and 6th Streets was under way, and that West 7th Street was just about ready, and he suggested that it might be well to have the ordinance prepared declaring the necessity of this paving. Councilman White moved that an ordinance declaring the necessity for paving 8th Street from Congress Avenue to Brazos; East 7th Street from Congress Avenue to Brazos; and 6th Street from Congress to Colorado be prepared. The motion, seconded by Councilman Pearson, carried by the following vote: Ayes: Councilmen Long, Palmer, Pearson, White, Mayor Miller Noes: None The Mayor suggested that the City Manager be instructed to make a contract with HAROLD WISE AND ASSOCIATES with whatever was in the budget less $25,000, for one year's work in which they are supposed to finish the Master Plan. After that, it would be decided whether or not he was to help with the zoning. The Mayor stated that Mr. Wise had agreed to have all the work out by September 1956, and that what he had from the state would be deducted. Councilman Long moved that the City Manager be instructed to draw the contract as outlined by the Mayor, with Mr. Wise, the Master Planner, and that the $25,000 be placed in the unappropriated part of the budget. The motion, seconded by Councilman White, carried by the following vote: Ayes: Councilmen Long, Palmer, Pearson, White, Mayor Miller Noes: None Councilman Long inquired about the widening in the 2700 block of South 1st. The City Attorney explained some complications in the title problems. 1000 1000 CITY OF AUSTIN, TEXAS The Council continued the hearing on improvements of Brentwood Street, Unit 1.. MR. VICTOR ELECKLER appeared stating the street was paved before notice was given, and he asked that no assessment belevied against Lots 12, 13 and 25 of the Frank E. Pease Subdivision. The City Manager explained the legality of the assessment and notices. Mr. Gleckler filed the following statement for the Minutes: "The State of Texas, County of Travis. "September 29, 1955 "To the Honorable City Council of the City of Austin; "Victor Gleckler, representing owners of Brentwood Street property, Lets 12, 13 and 25 of Frank E. Pease Subdivision, described in notice in American-Stateman of September 8, 1955, of hearing to be held on September 22, 1955, being duly sworn, makes affidavit that he visted said lots on the late afternoon of September 21 or September 22, 1955, and that said paving in front of said Lots 12, 13 and 25. of Frank E. Pease Subdivision was apparently completed as of that time. The Council graciously recessed the hearing for affiant because it was impossible for me to attend September 22nd. "It is submitted that attempted lien could not be valid because it would be retroactive legislation by the City Council. "Therefore Affiant petitions the Honorable City Council that it do not attempt to levy any assessment against said abutting property to constitute a first and prior lien upon same, to wit, Lots 12, 13 and 25 of the Frank E. Pease Subdivision of the City of Austin, Travis County, Texas. "(Sgd) Victor Gleckler Victor Gleckler, Affiant. "The State of Texas, County of Travis. "Before me, the undersigned authority, on this day personally appeared Victor Gleckler, known to me to be the person whose name is subscribed to the foregoing instrument and made oath that the statements in same are true in substance and in fact. 1955. The motion, seconded by Councilman Long, carried by the following vote: Ayes: Councilmen Long, Palmer, Pearson, White, Mayor Miller Noes: None CITY OF AUSTIN, TEXAS 1001 1001 Councilman Long read a petition filed by 13 citizens requesting aid in obtaining telephone services in Delwood 4 and Delwood Heights. Councilman Pearson stated he understood the Telephone Company was placing three pay stations in this area to try to relieve the situation until it could get its lines in. The Mayor stated he would call the Telephone Company about this matter. Mayor Miller introduced the following ordinance: AN ORDINANCE AUTHORIZING THE CITY MANAGER TO ENTER INTO A CERTAIN CONTRACT WITH AUSTIN CORPORATION; PROVIDING FOR THE APPROPRIATION OF MONEY PAID TO THE CITY OF AUSTIN UNDER SUCH CONTRACT AND DECLARING AN EMERGENCY. The ordinance was read the first time and Councilman Palmer moved that the rule be suspended and the ordinance passed to its second reading. The motion, seconded by Councilman White, carried by the following vote: Ayes: Councilmen Long, Palmer, Pearson, White, Mayor Miller Noes: None The ordinance was read the second time and Councilman Palmer moved that the rule be suspended and the ordinance passed to its third reading. The ordinance was read the third time and Councilman Palmer moved that the ordinance be finally passed. The City Attorney announced this would become effective October 10, 1955. Councilman White, with regard to the Austin Transit Corporation matter, displayed signs that were in the busses which had been transferred from Waco, and he stated that all of these signs had been taken off the night before. The City Manager presented a request from the Travis-Williamson County Water Control District No. 1, to buy water from the City on the same bases the other districts have purchased it. The Superintendent of the Water Department believed that service could be provided at Burnet Road and Anderson Lane, provided the District would extend the lines from that point. After much discussion Councilman Long moved that the City Manager be instructed to go on and work out the contract and bring it back for Council approval. The motion, seconded by Councilman Pearson, carried by the following vote: Ayes: Councilmen Long, Palmer, Pearson, White, Mayor Miller Noes: None Councilman Long stated that sometime ago she brought up the idea of talking to the people controlling the Emancipation Park and try to obtain the use of the park throughout the year, and that the Recreation Department had been asked to make a study of it. She stated that Mayor Miller had talked to the people in charge and that they were willing for the city to work out an agreement with them on the plan. CouncilmanLong moved that the City Manager be instructed to work with the Recreation Department and bring in an agreement on that project. The motion, seconded by Councilman White, carried by the following vote: Ayes: Councilmen Long, Palmer, Pearson, White, Mayor Miller Noes: None : The Mayor inquired of the City Manager if it were his recommendation that the additional Junior Planner be included in the Budget, and if he thought it would facilitate the work of the zoning, planning, etc. The City Manager stated it was his recommendation. CITY OF AUSTIN, TEXAS 1009 1009 MR. ROSWELL MILLER appeared before the Council stating he owned two lots in Highland Park West, and was going to deed one lot and 5 feet of the other one, and he was informed he had to prepare a short form subdivision plat, and pay a $7.50 filing fee, and he asked the intent of the Council in passing such an ordinance applying to such an item of five feet, and asked that some recommendation be made to let the Planning Department or Building Inspector issue these permits without the red tape and increase in expense to the taxpayer. The Mayor explained the reason for the increase in fees, and the City Manager pointed out the reasons this provision for an amount of only 5' was included. The Mayor stated the matter would be referred to the Legal and Planning Departments and Mr. Miller would be given a written report next week. The Council, after recessing the meeting and going into Executive Session, returned to the Regular Meeting. Councilman Pearson moved that MR. W. T. WILLIAMS, JR. be appointed as permanent City Manager at a salary of $15,000 per year. The motion, seconded by Councilman White, carried by the following vote: Ayes: Councilmen Palmer, Pearson, White, Mayor Miller Noes: Councilman Long Councilman Pearson in his nomination stated he knew that MR. WILLIAMS would do a very, very fine job, and that all of the Department Heads admired him very much, and that he was looking forward to seeing a good job done for the City of Austin. Councilman White, in seconding the motion, stated that he knew that Mr. Williams was going to make Austin as good a City Manager as it had ever had. His father before him had been with the City as City Attorney, and did a good job. MR. BILL WILLIAMS has been City Attorney and promoted to City Manager, and he knows the city if anyone ever knew it, and he felt that he would do a fine job. Councilman Long made the following statement regarding her vote against the motion: "I think Mr. Williams is a very fine person. I think he is a good lawyer. He is predominately a lawyer as a career man rather than a public administrator. He has done a good job since he has been in there, but I feel that we should have a man of longer training in the managerial field, and it is with great regret that I vote 'no'. In the future, I will be helpful to Mr. Williams in any way that I can as a Council member. His wife and family are very good friends of mine, and I am sorry that I cannot act like a man in this particular instance. I have to vote my convictions, and I am sorry." Councilman Palmer made the following statement concerning his vote: "In the short time that I have been on the Council, my dealings with Mr. Williams have been most pleasant and I feel that as long as the Council lays down a policy that Mr. Williams will carry it out, and I vote 'aye'." Mayor Miller made the following statement in his vote: "God willing, and with the support of the people, tax payers, water and light customers, heads of departments, personnel, and the Council, we will want to give CITY OF AUSTIN, TEXAS 1010 1010 good service to the people with the least money. We have a big job; and we never want to leave out any services to which the people have been accustomed or to which they will need. We will all work together. Emma had a right to vote the way of the dictates of her intelligence and conscience, and we will work together, and I vote 'aye'." MR. J. H. McCULLICK appeared before the Council regarding the building line of the proposed building of the Veterans of Foreign Wars on 11th and San Jacinto. Councilman White moved that the construction of this building bringing it two feet closer to the curb line than the property line be authorized The motion, seconded by Councilman Pearson, carried by the following vote: Ayes: Councilmen Long, Palmer, Pearson, White, Mayor Miller Noes: None Councilman White moved that MRS. ELSIE WOOSLEY, City Clerk, be granted an increase in salary of $300, making the total salary $4,500 a year; and MRS. GRACE MONROE an increase of $200, increasing her salary from $3,015 to $3,215 The motion, seconded by Councilman Long, carried by the following per year. vote: Ayes: Councilmen Long, Palmer, Pearson, White, Mayor Miller Noes: None The Council discussed the tax appeals of the AUSTIN NATIONAL BANK and AMERICAN NATIONAL BANK. The Tax Assessor and Collector was present. After detailed discussion, Councilman White moved to reduce the value of the capital stock of the Austin National Bank and American National Bank by 65% of the assessed value of the land upon which they hold leases for this year, with the understanding that the City Manager, City Attorney and Tax Assessor and Collector get some clarification of this by the next tax time. The motion was seconded by Councilman Pearson. At this point Mayor Miller relinquished the Chair and Mayor Pro-tem Pearson presided. Councilman Padmern moved that the hearing on all tax appeals be closed and that the tax roll as adjusted be approved. RIBAR for some assurance that the property between hers and the right of way would not be sold, and he outlined the suggestions at previous meetings, one suggestion being that 1011 1011 CITY OF AUSTIN, TEXAS a contract be entered into with the Ribars that if the City ever were able to sell the property that the Ribars be given first chance at its purchase at the city's appraised price. Her attorney did not recommend that, but now the Ribars stated they would be interested. The City Manager wanted to check with the Council to see if it was still willing for this contract to be made. The City Manager announced the appointment of MR. S. REUBEN ROUNTREE, JR. as Director of Public Works; MR. DOREN R. ESKEW, City Attorney, and MR. TERRELL BLODGETT, as Assistant City Manager. The City Manager stated that McCallum High School had asked permission to string a banner across the Avenue advertising the Prescapades. The Council informally agreed to give them this permission.
