Councilman White offered the following resolution and moved its adoption: (RESOLUTION) BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the City Council of the City of Austin hereby approves as a filling station site the property located at the northeast corner of the intersection of Manchaca Road and Fort View Road, which property fronts 125 feet on Manchaca Road and 100 feet on Fort View Read and being known as a part of lot 37, Theodore Low Heights Subdivision in the City of Austin, Travis County, Texas, and hereby authorizes the said Magnolia Petroleum Company to construct, maintain and operate a drive-in gasoline filling station and to construct curbs, ramps and sidewalks in conjunction therewith, subject to the same being constructed in compliance with all ordinances relating thereto, and further subject to the foregoing attached recommendations and plans; and the Building Inspector is hereby authorized to issue an occupancy permit for the operation of this filling station after full compliance with all the provisions of this resolution, and said permission shall be held to be granted and accepted to all necessary, reasonable and proper, present and future regulations and ordinances of the City of Austin, Texas, in the enforcement of the proper Police, Traffic and Fire regulations; and the right of revocation is retained, if after hearing it is found by the City Council that the said Magnolia Petroleum Company has failed and refused and will continue to fail and refuse to perform any such conditions, regulations, and ordinances. E. Fiedler and is under lease to Magnolia Petroleum Company and we hereby advise that the following conditions exist. Lines and grades to be obtained from the Department of Public Works for entrances and driveways, building lines to be approved by the City Building Inspector. That the applicant shall confer with the Department of Public Works as to future grades of the sidewalks and gutters on the adjacent streets before he starts any construction relative to the filling station. "(2) That only underground tanks shall be used and that all pumps shall be so located that it will be impracticable to service motor vehicles therefrom while said motor vehicles are standing on any part of a sidewalk, street or alley. "(3) That the gasoline tanks, pumps, and all equipment used in connection with the storage and handling of gasoline shall be an approved type and shall bear the label of Underwriters Laboratories, Inc. and that all construction of the filling station improvements shall be in accordance with the Building Ordinance, the Zoning Ordinance, the Filling Station Ordinance, and in accordance with the ordinance prohibiting the disposal of commercial water or oils upon the City Streets. "(4) That the grades of the station shall be such that no waste water or oils or any floor washings shall ever pass over the City sidewalk area and that all of said oils and water shall be concentrated into a combined grease and sand trap which shall be constructed in accordance with our standard plan 2 H - - 146. "(5) That all filling station improvements, pump islands, driveways, ramps, gutters, sidewalks and curbs shall be constructed of concrete at the expense of the applicant as set forth upon the plan hereto attached, which plan bears the Department of Public Works file number 2 C 1971. "(6) Expansion joints shall be constructed as shown upon the plan hereto attached marked 2 C 1971 and shall be of the pre-moulded type. - - "(7) When the owner considers that he has complied with all the requirements of the City of Austin for filling stations, he shall apply for a final inspection and upon approval, the Building Inspector shall issue a Certification of Operation before such filling station can be put into service. Eckert Building Inspector" The motion, seconded by Councilman Long, carried by the following vote: Ayes: Noes: Councilmen Long, Palmer, White, Mayor Miller None Absent: Councilman Pearson The Mayor announced receipt of the following letter from the AMERICAN RED CROSS pertaining to water safety on the lake, and thanked the Red Cross for its recommendation and interest: "October 6, 1955 "The Honorable Mayor Tom Miller Mayor of Austin, Texas Municipal Building 124 West 8th Street Austin, Texas "Dear Sir: "The Red Cross Water Safety Committee, comprised of a group of volunteers representing a cross section of community interest in water safety, respectfully brings these matters to your attention as an aftermath of the City Council meeting held in relation to safety and regulations on Lake Austin. 1. At the time of the council meeting pertaining to lake safety, ready acceptance was given to the possibility of a Red Cross Water Safety Patrol on week-ends and holidays, manned by volunteer boat owners trained by Red Cross. Since the Council meeting, it has been learned in a communication from St. Louis, that Red Cross nationally no longer endorses "Red Cross Patrols" on waterfronts as such, preferring that its relationship to such boat patrols be one of training personnel to man the boat patrols. The Red Cross believes that sponsorship and supervision of such patrols should be under such bodies as navigation boards, coast guard units and others already actively related to problems of lake-front areas. "At the present time, the Red Cross Water Safety Service Corps is prepared to begin training of interested boat owners and water-skiers who are regularly on the lake provided that clearance for use of one of the indoor pools at the University of Texas is made. Such training will include water rescues, boat rescues, and general training in water safety and rescue. CITY OF AUSTIN, TEXAS = 1041 2. The Red Cross Water Safety Committee also suggests that a meeting of the City Navigation Board be held as soon as possible, with reppesentative boat owners, water safety personnel and other interested persons. The Committee feèls that meeting and planning during the winter months in preparation for the active spring and summer months is important so that an interpretation of existing navigation rules and provisions can be achieved, with a view to revising and investiga- ting means of providing for stricter enforcement, along with a more simplified and effective method of publicizing them. "At the time of this meeting it is recommended that these matters also be considered: A. Investigation of a possible age limit set for all drivers of boats, in view of increasing lake traffic. B. Additional training of police department personnel manning patrol boats on the lake in water rescue techniques. The members of the police department render a daily, unrecognized community service on Austin's streets because of the Red Cross First Aid training received by all members. Training of personnel on the lakes in life saving techniques is of equal importance. 3. With the approval of the City Council and the cooperation of school personnel, the Red Cross Committee plans these activities regarding water safety in the school system. A. Scheduling Red Cross films on water safety and boat safety in Austin so that they may be shown to all children of junior and high school ages. B. Requesting assembly program dates for early spring so water safety points may be stressed at that time. C. Stressing and publicizing life saving courses which are scheduled annually, an improtant by-product of which is accident prevention. 4. For the information of City Council members, the Red Cross Committees in cooperation with the Jaycee Water Safety Committee, plans a Water Safety show on the lake in early spring, including nationally famous aquatic experts in many fields, as well as, participation of local aquatic and boat clubs. Demonstrations of water rescues, boat rescues, skiing with safety points stressed sail boating skills and safety, canoeing skills and safety, helicopter water rescues, and fire department procedures will be brought out in the show. To further emphasize the beginning of the swimming and boating season and the need for caution, we request that the City Council proclaim a "Water Safety Week" in Austin during the Spring of 1956, at which time, the proposed water safety show will be held. "In presenting these matters to the Council, the Red Cross Water Safety Committee wishes to stress its objective of being of best service to the community and of increasing safety of Austinites in all aquatic activities. Councilman Long moved that their report be accepted and refer it to the Navigation Board and Recreation Department and to express thanks to the Red Cross. The letter was referred to the Recreation Department. The Mayor inquired if the two-hour parking next to the quonset hut by the Police Station had been installed; and if not, would a check be made on this, as the two-hour parking had been authorized. The Mayor submitted a letter regarding cleaning the weeds from Shoal Creek (from Mr. and Mrs. William Harris Bell, 5404 Shoal Creek Boulevard). The letter was referred to the Director of Public Works, who stated work was scheduled on this right away. Councilman White made a report on his inspection of the drainage problem in the alley behind 700 Landon Lane, and suggested that estimates be drawn up on the cost, and submitted to the neighbors. He thought if someone went out and talked to the people, they might be willing to put up their money for the pipe. The Mayor stated this was a situation of long standing, and the people had never been willing to put up the money for the pipe, but the City will have to keep in behind it and see what can be worked out. This was in connection with a request of Mr. Walter Bonugli on October 6th. Councilman Long reported some complaints she had received regarding the asphalt spraying, and the parked cars getting splattered with this spray. Councilman White moved that the BEN HUR be granted permission to have a parade up the Avenue, on October 27th, at 7:30 P.M. The motion, seconded by Councilman White, carried by the following vote: Ayes: Noes: Councilmen Long, Palmer, White, Mayor Miller None Absent: Councilman Pearson Councilman White offered the following resolution and moved its adoption: (RESOLUTION) WHEREAS, the City of Austin, a political subdivision of the State of Texas, owns an airport known as Bergstrom Air Force Base; and, WHEREAS, said City of Austin owns and controls an airport known as Robert Mueller Municipal Airport; and, WHEREAS, airport hazard areas appertaining to such airports are located and exist outside the territorial limits of the City of Austin, and within the territorial limits of the County of Travis, a political subdivision of the State of Texas; and, WHEREAS, the City Council of the City of Austin finds that it is necessary in the interest of the public health, public safety, and general welfare to prevent the creation or establishment of airport hazards within said airport hazard areas; and, WHEREAS, under such circumstances the Legislature of the State of Texas has empowered political subdivisions of the State to create a Joint Airport Zoning Board to promulgate, administer and enforce airport zoning regulations to limit the height of structures and objects and the use of property in the vicinity of airports in the reasonable exercise of the police power; and, CITY OF AUSTIN, TEXAS 1044 WHEREAS, the City Council finds the creation of such a Joint Airport Zoning Board necessary in the interest of the public health, public safety, and general welfare; Now, Therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That by virtue of the authority therein granted, and under the provisions of Acts 1947, 50th Legislature, page 784, Chapter 391 (Vernon's Annotated Civil Statutes, Article 46e), known as the Airport Zoning Act, together with the concurring action of the Commissioners Court of Travis County, Texas, the City of Austin and the County of Travis hereby create a Joint Airport Zoning Board of Austin-Travis County with full power to adopt, administer and enforce airport zoning regulations in the manner and as provided by said Airport Zoning Act; and BE IT FURTHER RESOLVED, that a duplicate original copy of this Resolution, signed by the Mayor and attested by the City Clerk be presented to the Commissioners Court of Travis County, Texas, to make known the desire of the City of Austin to utilize the services of a Joint Airport Zoning Board as contemplated by the Airport Zoning Act.
