1063 CITY OF AUSTIN, TEXAS MINUTES OF THE CITY COUNCIL CITY OF AUSTIN, TEXAS Regular Meeting October 27, 1955 10:00 Α.Μ. Council Chamber, City Hall The meeting was called to order with Mayor Miller presiding. Roll call: Present: Councilmen Long, Palmer, Pearson, White, Mayor Miller Absent: None Present also: W. T. Williams, Jr., City Manager; Doren R. Eskew, City Attorney; Reuben Rountree, Jr., Director of Public Works. Invocation was delivered by FATHER FRANCIS W. SULLIVAN, St. Mary's Cathedral, 209 East 10th Street. Councilman White moved that the Minutes of October 20th be approved. The motion, seconded by CouncilmanPalmer, carried by the following vote: Ayes: Councilmen Long, Palmer, Pearson, White, Mayor Miller Noes: None MR. NICKEY MORRIS, MISSES JUDY GILLESPIE and ANN BLOMQUIST, and MR. CHAD BOWMAN, students from O'Henry Junior High School, requested that October 29th be declared Halloween, or Trick and Treat Night. Councilman White moved that the request be granted. The motion, seconded by Councilman Long, carried by the following vote: Ayes: Councilmen Long, Palmer, Pearson, White, Mayor Miller Noes: None MR. JOHN WAGGONER, 709 Justin Lane, appeared before the Council asking for paving on Justin Lane from Lamar to Burnet Road. The group had the middle part of the area signed up over 80%, but the two approaches had not been signed up. Justin Lane is to be 40' wide, and he asked that the City participate in the paving over the 30' width. The City Manager explained the policy adopted CITY OF AUSTIN, TEXAS = 1064 in this regard. The Mayor stated that the City by participating in the intersections and engineering, would not be able to pay 25% of the rest of the paving on this street. The City Manager outlined the costs of the drainage work necessary in Grover and Yeates. The Council informally agreed to go on with the drainage costs and assess the people that did not sign up, but urged Mr. Waggoner to contact them and see if they would come in on a voluntary plan. The Director of Public Works stated he would go ahead and get the bids for them, so that they would know. Councilman White offered the following resolution and moved its adoption: (RESOLUTION) WHEREAS, on the 4th day of October, 1955, bids were received by the City of Austin for the construction of an Austin Health Center to be located at 14th and Sabine Streets; and, WHEREAS, the bid of Moore Construction Company in the sum of $158,000.00 was the lowest and best bid for the General Construction; and, WHEREAS, the bid of Porter Plumbing in the sum of $12,274.00 was the lowest and best bid for the plumbing to be installed in said Austin Health Center; and, WHEREAS, the bid of A. C. Stradtmann in the sum of $48,985.00 was the lowest and best bid for the installation of heating and air-conditioning; and, WHEREAS, the bid of A. A. Electric Company in the sum of $21,954.00 was the lowest and best bid for the electrical work to be done; Now, Therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That said bids of Moore Construction Company, Porter Plumbing, A. C. Stradtmann and A. A. Electric be and the same are hereby accepted, and W. T. Williams, Jr., City Manager, be and he is hereby authorized and directed to enter into contract with said companies. The motion, seconded by Councilman Pearson, carried by the following vote: Ayes: Councilmen Long, Palmer, Pearson, White, Mayor Miller Noes: None Councilman Pearson submitted a petition from property owners across the street from McCallum High School, who are very anxious to get the paving done. The School authorities said they were ready to do their part. The other property owners are now being contacted to come in on the paving. Councilman Pearson stated he had contacted the President of the School Board, and he said that anytime the City wanted to pave, that the School system would go on with its part. Work on the petitions will be continued. Mayor Miller brought up the following ordinance for its third reading: AN ORDINANCE AMENDING THAT CERTAIN ORDINANCE PASSED BY THE CITY COUNCIL OF THE CITY OF AUSTIN, TEXAS, JULY 17, 1941, AND RECORDED IN ORDINANCE CITY OF AUSTIN, TEXAS 1065 BOOK "L", PAGES 152-174, INCLUSIVE, OF THE ORDINANCE RECORDS OF THE CITY OF AUSTIN, WHICH ORDINANCE WAS AMENDATORY OF THAT CERTAIN ORDINANCE ESTABLISHING ZONING REGULATIONS AND DISTRICTS IN ACCORDANCE WITH A COMPREHENSIVE PLAN PASSED BY THE CITY COUNCIL,.. Tocker, to the City of Austin of One Dollar ($1.00) and other good and valuable consideration, the following described tract of land: 601 square feet of land same being out of and a part of Lot 6, Theodore Low Heights, a subdivision of a portion of the George W. Spear League in the City of Austin, Travis CITY OF AUSTIN, TEXAS 110/71 County, Texas, according to a map or plat of the said Theodore Low Heights of record in Book 3 at page 87 of the Plat Records of Travis County, Texas, which Lot 6 was conveyed to the City of Austin by warranty deed dated May 31, 1948, of record in Volume 912 at page 95 of the Deed Records of Travis County, Texas; said 601 square feet of land is more particularly described by metes and bounds as follows: BEGINNING at a steel pin set on the south line of Lot 6 of the said Theodore Low Heights Subdivision, said steel pin being on the east line of Lamar Boulevard which east line of Lamar Boulevard is a curve whose angle of intersection is 46° 27', whose tangent distance is 162.16 feet and whose radius is 377.90 feet, and from which place of beginning a steel pin at the point of revèrse curvature between the aforementioned curve and a curve to the left whose angle of intersection is 45° 16' whose tangent distance is 184.94 feet, and whose radius is 443.56 feet bears S. 77° 18' W. 10.38 feet; THENCE, following said curving east line of Lamar Boulevard to the left an arc distance of 13.52 feet the sub-chord of which arc bears N 75° 29' Ε. 13.52 feet to a steel pin set at the point of reverse curvature between the aforementioned curve and a curve to the right whose angle of intersection is 60° 22', whose tangent distance is 15.05 feet, and whose radius is 25.88 feet; THENCE, following said curve to the right an arc distance of 27.28 feet the long-chord of which are bears S. 75° 22' E. 26.02 feet to a steel pin at the point of compound curvature between the aforementioned curve and a curve whose angle of intersection is 75° 33' whose tangent distance is 13.50 feet and whose radius is 17.44 feet; THENCE, following said curve to the right an arc distance of 23.00 feet the long-chord of which arc bears S. 7° 24' E. 21.37 feet to a steel pin on the south line of Lot 6; THENCE, with the south line of Lot 6 N. 59° 34' W. 47.52 feet to the point of beginning. Wise, Associates, for services in the development of a Master Plan for the City of Austin; and, WHEREAS, by mutual agreement such contract is intended to be renewed and extended; and, WHEREAS, the said Harold F. Wise, Associates, have agreed to complete CITY OF AUSTIN, TEXAS 1072 and present the Master Plan for a consideration of $23,450.00; Now, Therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That W. T. Williams, Jr., City Manager, be and he is hereby authorized on behalf of the City of Austin to execute such renewal of such contract with Harold F. Wise, Associates. The motion, seconded by Councilman White, carried by the following vote: Ayes: Councilmen Long, Palmer, Pearson, White, Mayor Miller Noes: None Councilman Pearson offered the following resolution and moved its adoption: (RESOLUTION) WHEREAS, heretofore the Legislature had forbidden cities to contribute in excess of three (3%) per cent of the Fire Department's annual payroll for retirement purposes in the Firemen's Relief and Retirement Fund; and, WHEREAS, the 54th Legislature has amended said law and now permits cities to contribute greater sums; and, WHEREAS, it is the desire of the City Council to contribute an amount equal to the annual contributions made by firemen in the employment of the City of Austin in a total amount not to exceed four (4%) per cent; Now, Therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That W. T. Williams, Jr., City Manager, be and he is hereby authorized to deposit to the credit of the Firemen's Relief and Retirement Fund an amount equal to the annual contributions made by fully paid firemen in the employment of the City of Austin not to exceed four (4%) per cent of the Fire Department's annual payroll. The motion, seconded by Councilman Pearson, carried by the following vote: Ayes: Councilmen Long, Palmer, Pearson, White, Mayor Miller Noes: None Councilman Long offered the following resolution and moved its adoption: (RESOLUTION) WHEREAS, bids were received by the City of Austin on October 25, 1955, for the construction of approximately one block of pavement andaccessories known as Assessment Paving Contract Number 55-A-6, Units 1 through 4; and, WHEREAS, the bid of Raymond Canion in the sum of $1,678.90 was the lowest and best bid therefor, and the acceptance of such bid has been recommended by the Director of Public Works, and by the City Manager; Now, Therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That the bid of Raymond Canion in the sum of $1,678.90 be and the same is hereby accepted, and W. T. Williams, Jr., City Manager of the City of Austin is hereby authorized and directed to execute a contract on behalf of the City of Austin with Raymond Canion. date. Spear League in the City of Austin, Travis County, Texas and being of record in Book 7 at page 81 of the Plat Records of Travis County, Texas; and, WHEREAS, the owner of the hereinafter described premises has requested that said public utility easement located thereon be released; and, WHEREAS, the hereinafter described easement is not now needed and hereafter will not be required by the City of Austin; Now, Therefore, CITY OF AUSTIN, TEXAS 11074 BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That W. T. The motion, seconded by Councilman White carried by the following vote: Ayes: Councilmen Long, Palmer, Pearson, White, Mayor Miller Noes: None Mayor Miller urged that everyone drive more carefully and especially over Halloween. The City Manager submitted a request from the Recreation Director that a letter be sent through the schools surrounding the new Recreation Center, and get the students to suggest names for the Center. The Council discussed publicly acknowledging the student whose suggested name was chosen. After more, discussion, Councilman Long moved that the request of Mr. Sheffield be granted. The motion, seconded by Councilman Palmer, carried by the following vote: Ayes: Councilmen Long, Palmer, Pearson, White, Mayor Miller Noes: None (Letter on file under RECREATION) The City Manager submitted the following recommendation from the Director of Public Works: "Salvage at Sanitary Fill "Mr. I. A. Whitaker of the Austin Paper Stock Company, 309 East 4th Street, was in our office Tuesday, October 25th, and presented an offer to salvage some paper, cardboard and rags from the City's sanitary fill sites. Mr. Whitaker has offered to pay to the City of Austin $150.00 per month for this salvage right. This would be on a trial basis for six months in order that he might determine the value of this salvage material. Mr. Whitaker agrees that at the end of six months, the price may be increased if the salvage value is greater or perhaps decreased accordingly. CITY OF AUSTIN, TEXAS 1075 "We believe that this salvage operation, as performed as Mr. Whitaker proposes, will not hinder or hold up City crews or trucks. We believe the proposition would be fair and recommend that this operation start on November 1, 1955, for a trial period of six months." Councilman Pearson moved that Mr. Whitaker be given a 90 day contract for $150.00 a month on salvage operations at the three sanitary fills, effective November 1st. The motion, seconded by Councilman White, carried by the following vote: Ayes: Councilmen Long, Palmer, Pearson, White, Mayor Miller Noes: None The City Manager reported a new sanitary fill at St. Elmo and east of the Interregional Highway, replacing the one at St. Edwards University. Councilman Palmer inquired about the progress of the swimming pool at the northwest park. The City Manager stated plans would be ready by December 1st, and it was hoped to have the pool ready by spring. Councilman Palmer noted that many of the large oak trees in Zilker Park were dying, and asked that something be done to try to save those trees. Mayor Miller stated the City was going to have to go on with the enforcement of its ordinance, picking up all dogs running loose about the first of January, and suggested making arrangements about 30 days ahead of time and notifying the people. The Humane Society probably would not be ready to take over by that time, and the City would have to go ahead with it. The Council asked that the Auditor be contacted to see about the Audit for 1956. WILLIS LEA, represented the Company as General Attorney and Vice President; and MR. FRANK DENIUS, attorney and also member of the Board of Directors, was present. MR. MCELFRESH, MR. REED, MR. BRANDT, and MR. LAWLOR went over schedules and data of the Southern Union Gas Company. After much discussion, the Gas Company made adjustments in the increase of the commercial and industrial rates. The Mayor stated the Council would like to study these figures as submitted in the hearing and adjusted, and check them and check the rate of return--check the taxes, the capital value and go over all the facts. He complimented the Company on its presentation of their case, and also on the good service it has given the City. The Council met in a Safety Meeting with State, County, and City officials. Chiefs of Police from surrounding cities and from the University of Texas, the Sheriff, District Attorney, Representatives from the Highway Department; from the Red Cross, Civic Clubs, Austin Transit, from the Chamber of Commerce, Women's organizations, fleet groups, ambulance drivers, and others, were present. CITY OF AUSTIN, TEXAS 1077 MR. CHARLES STAMP, Vice President of the Texas Safety Association, and CAPTAIN JIM MUSICK, Manager of Texas Safety Association spoke about Safety Driving Day and outlined the program for this period. CAPTAIN ROGERS displayed the award by the National Safety Council and the International Association of Chiefs of Police, which the Austin Police Department had won as first place for fleet traffic safety; having driven 1,332,000 miles in the year with less accidents than any other fleet. The Mayor complimented the Police Department and was happy it had won this award. There being no further business the Council adjourned at 5:35 P.M. subject to the call of the Mayor.
