Council Chamber, City Hall The meeting was called to order with Mayor Miller presiding. Roll Call: Present: Councilmen Long, Palmer, Pearson, White, Mayor Miller Absent: None Present also: W. T. Williams, Jr., City Manager; Doren R. Eskew, City Attorney; S. Reuben Rountree, Jr., Director of Public Works. Invocation was delivered by REV. WILLIAM C. BIRKNER, St. John's Methodist Church, 2140 Allendale Road. Councilman White moved that the Minutes of November 10, 1955, be approved. The motion, seconded by Councilman Pearson, carried by the following vote: Ayes: Councilmen Long, Palmer, Pearson, White, Mayor Miller Noes: Nome The Mayor recognized nine Police Recruits attending the Council Meeting and commended the Police Department on the fine job it is doing. MR. W. O. MITTAG, spokesman for a group, requested that the water line being laid on Springdale Road be extended 3000 feet so as to include 16 houses on Pecan Springs Road. He stated this property had been annexed in 1951 and they would like to have this water line to have fire protection and better fire rates. Mr. Davis, Water Superintendent, explained the situation and stated that if this line was extended they would not have better fire protection but they would have better pressure as soon as it is completed. The group was told this would be checked and see what could be done and they would be given an answer within a week. : _ CITY OF AUSTIN, TEXAS 14117 The Council had before it the following zoning application deferred from last week: BAPTIST FOUNDATION OF TEXAS 501-503 Elmwood Place 2803 San Jacinto Blvd. From "B" Residence To "LR" Local Retail Not Recommended by the Planning Commission. Recommended "0" Office The Mayor asked those who wished to grant the change to "O" Office to vote "aye"; those opposed to vote "no". Somerville Co. in the sum of $14,137.00 for the furnishing of both types of poles was the lowest and best bid therefor, and the acceptance of such total bid has been recommended by the Purchasing Agent of the City of Austin, and by the City Manager; Now, Therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That the total bid of Wm. Somerville Co. in the sum of $14,137.00 be and the same is hereby accepted, and W. T. Williams, Jr., City Manager of the City of Austin is hereby authorized and directed to execute a contract on behalf of the City of Austin with Wm. Somerville Co. B. Smith Motors in the sum of $5,867.45 was the.. lowest and best bid therefor, and the acceptance of such bid has been recommended by the Purchasing Agent of the City of Austin, and by the City Manager; Now, Therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That the bid of C. B. Smith Motors in the sum of $5,867.45 be and the same is hereby accepted, and W. T. Williams, Jr., City Manager of the City of Austin is hereby authorized and directed to execute a contract on behalf of the CITY OF AUSTIN, TEXAS 121121 City of Austin with C. B. Smith Motors. The City Manager was requested to check and see if the 1952 truck, that was listed to be traded in, could be used by any of the Departments of the City and if it were more advantageous for the City to keep this truck then add the $350 offered by C. B. Smith Motors to the contract if it were agreeable to them. The motion, seconded by Councilman Long, carried by the following vote: Ayes: Councilmen Long, Palmer, Pearson, White, Mayor Miller Noes: None Councilman White offered the following resolution and moved its adoption: (RESOLUTION) WHEREAS, bids were requested by the City of Austin on October 21, 1955, for the purchase of 40,000 pounds of sodium hexametaphosphate in 100-pound, multi-wall, water-proof paper bags, in carload lots, for use in the Water Filter Plant; and, WHEREAS, the only bid received was that of Maintenance Engineering Company in the sum of $5,648.00 per 40,000-pound car; and, WHEREAS, by purchasing sodium hexametaphosphate in carload lots, the City of Austin can save $361.00 per car over purchasing in truck shipments as the City has done in the past; and, WHEREAS, the City of Austin now has adequate storage space for carload lots; and, WHEREAS, the acceptance of such bid has been recommended by the Superintendent of the Water and Sewage Treatment Department of the City of Austin and by the City Manager; Now, Therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That the bid of Maintenance Engineering Company in the sum of $5,648.00 per 40,000-pound car, be and the same is hereby accepted, and W. The Council set the pay period beginning November 25, 1955 as the effective date. Councilman Long stated she thought this was a great milestone for the city employees and a millstone for the City. The Mayor stated he hoped this would encourage the employees to give a better days work and he stressed courtsey for all employees. The Council discussed the city pension and the City Manager stated the study by the Actuary was expected by the first of the year. Councilman Long moved that the Council send to the Planning Commission an ordinance vacating and closing portion of Perry Lane which lies east of Bull Creek Road and west of Finley Drive, for review and recommendation. The motion, seconded by Councilman Palmer, carried by the following vote: Ayes: Councilmen Long, Palmer, Pearson, White, Mayor Miller Noes: None Councilman Long offered the following resolution and moved its adoption: (RESOLUTION) BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the City Council of the City of Austin hereby approves the property situated on the north side of East Sixth Street as a private gasoline plant consisting of a One thousand gallon tank and electric pump for the sole purpose of servicing their own motor equipment, and from which no gasoline is to be sold, which property is leased by Longhorn Sash & Door Company, and is part of Lot 2, Outlot 9, Division A, of the H & T.C Addition in the City of Austin, Travis County, Texas, and hereby authorizes the said Longhorn Sash & Door Company to operate a private gasoline plant consisting of a one thousand gallon. tank and electric pump for the sole purpose of servicing their own motor equipment, and from which no gasoline is to be sold, subject to the same being operat- ed in compliance with all the ordinances relating thereto, and further subject to the foregoing attached recommendations; and the Building Inspector is hereby authorized to issue an occupancy permit for the operation of this private gasoline plant after full compliance with all the provisions of this resolution, and said permission shall be held to be granted, and accepted subject to all necessary reasonable and proper, present and future regulations and ordinances of the City of Austin, Texas, in the enforcement of the proper police, traffic and fire regulations; and the right of revocation is retained if, after hearing, it is found by the City Council that the said Longhorn Sash and Door Company has failed and refused, and will continue to fail and refuse to perform any such conditions, regulations and ordinances. Williams City Manager Austin, Texas "Dear Sir: "I, the undersigned, have considered the application of Longhorn Sash & Door Company, through their agent Billy McElroy for permission to operate a private gasoline plant consisting of a one thousand gallon underground tank and pump for the sole purpose of servicing their own motor equipment and from which no gasoline is to be sold, upon property located on the north side of East Sixth Street, which property is designated as part of Lot 2, Outlot 9, Division A, of the H & TC Addition, in the City of Austin, Travis County, Texas, and locally known as 2200 East Sixth Street. "This property is located in an "E" Heavy Industrial District and I recommend that this permit be granted subject to the following conditions: "(1) That the gasoline tanks and pumps shall be of an approved type and shall bear the label of the Underwriters Laboratories, Inc., and that all tanks and pumps shall be installed in compliance with the Ordinance governing the storage and handling of gasoline. "(2) That all tanks and pumps shall be located not nearer than 10 feet to the property line and so located that cars stopped for the purpose of unloading or receiving gasoline or other supplies shall not in any way obstruct the free passage of traffic on either the sidewalk, street or alley. "(3) That "NO SMOKING" signs shall at all times be prominently displayed and no person shall be permitted to smoke on the premises where gasoline is handled or stored. "(4) That all fees shall be paid and a permit secured from the Building Inspector's Office before any installation work is started, and that no equipment shall be placed in operation until after final inspection and approval of same. Eckert Building Inspector" The motion, seconded by Councilman Pearson, carried by the following vote: Ayes: Councilmen Long, Palmer, Pearson, White, Mayor Miller Noes: None Councilman Long offered the following resolution and moved its adoption: (RESOLUTION) WHEREAS, the City of Austin executed a lease to all of Lots 2, 3 and 4 =CITY OF AUSTIN, TEXAS 121126 of James Byrnes Subdivision in Austin, Texas, to the Austin Council for Retarded Children by instrument dated February 1, 1954; and, WHEREAS, pursuant to such lease a frame building was placed upon such property for use by the said Austin Council for Retarded Children and is now known as 915 West 282 Street; and, WHEREAS, by Paragraph Six of the said lease, Lessee should have the right to make alterations and additions to such structure provided such alteration or addition be first approved in writing by Lessor; and, WHEREAS, the Austin Council for Retarded Children has requested, in writing, permission to make certain alterations and additions to such structure; Now, Therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That, subject to existing regulations as to building permits, and provided that the applicable zoning regulations as to setback and side yard spac- ing are observed, the Austin Council for Retarded Children be and it is hereby granted permission to make the following alterations and additions to the building at 915 West 28½ Street: 1. Add an additional room on the west side of the building, approximately 14' x 25'; vote: 2. Make minor interior alterations at a cost not to exceed $3,200.00. Edburg, Jr.. 1217 Lynn Avenue Midland, Texas "November 14, 1955 "Members of the Council City of Austin, Texas "Dear Madam and Sirs: "You will recall at the Thursday, October 20, 1955, City Council Meeting, I made a personal appearance to request that consideration be given for relocating of an existing electrical power line and power pole that passes throught the Laguna Vista subdivision. The conclusion reached at this meeting was that the Council would consider my proposal, which is attached, for relocating this facility. CITY OF AUSTIN, TEXAS 4127 "It should be mentioned that immediately following my appearance before the Council, I joined with members of the City of Austin's engineering staff, Messrs. D. C. Kinney, D. A. Conrad, and H. A. Tankersley for the purpose of going to the site of the power line in Laguna Vista. "After studying the terrain and making notes, we returned, and the engineering department designed an alternate route similar to the one submitted herewith. Mr. Tankersley advised me later that the total cost would be approximately $2,200.00. "The advantages of the proposed routing of the power line over the existing line are as follows: "1. It observes the property lines as recognized in the easement that the City of Austin has used for justifying the present line's location. "2. It preserves the principle set forth by the City of Austin for not dividing surveyed lots into smaller segments with power lines and the like. "3. It maintains the customary practice of placing high voltage lines over roadways or alleyways. In this case, the 69,000 volt line follows the roadway, Laguna Vista Drive. "4. It restores the value of Lots 7 through 14 inclusive. Conservative bank valuations for Lots 7, 8 and 9 are $1,000 per lot. If we apply this valuation to the remaining lots, we total $8,000 minimum, a value that can be returned to the property owners. By comparing the real cost of the existing power line, $10,000 (estimated cost to the City of Austin $2,000 and estimated cost to the property owners $8,000) as against the cost of $2,200 for the proposed route, we have a saving of $7,800 to those concerned. "5. It permits the use of building sites that are presently either destroyed or limited. "In closing, I wish to express my sincere thanks to the Members of the City Council and the City of Austin's engineering staff for their attentiveness to my request. "Yours very truly, A. H. Edburg, Jr." "Attachment" The Council agreed if the property owners put up the $2,200 the city would go ahead. The Mayor stated that it was the intention of the City to pick up all dogs on the streets after the 1st of January, either with tags or without. The people in charge of the pound to be notified of this and be prepared to care for them. The City Manager was requested to have estimates prepared of the cost of caring for the dogs at the present city dog pound. The Mayor CITY OF AUSTIN, TEXAS 1128 suggested that if a dog is picked up that has a tag, that the owner be notified. He also suggested if a dog was run over and the city picked it up that the tag and collar be sent to the owner. Mr. L. W. Moody, 1302 South 6th Street, requested stop signs be installed on South 5th Street at Gibson Street; a street light at South 6th and Gibson; storm sewer and paving. The Council referred the request for stop signs to the Traffic Engineer. The Mayor reviewed the present contract with the Gas Company for furnishing gas for the power plant and the proposed contract had been discussed. The Gas Company was asked to have their attorneys present their proposal in writing to the City Manager and City Attorney. It will be studied and an answer given within a reasonable time. The Mayor stated if any other Gas Companies were interested in furnishing the City gas at a fixed price, the City was open. Councilman White moved that the City Attorney be instructed to prepare an ordinance setting up an increase in gas rates for domestic, commercial and' industrial users. The motion, seconded by Councilman Palmer, carried by the following vote: Ayes: Councilmen Palmer, Pearson, White, Mayor Miller Noes: Councilman Long This is a 15 or 16% increase requested by the Gas Company. Councilman Long voted against the motion with the statement that she did not think the increase was justified, that the increase was too high, and the Council had not had the opinion of a rate expert. The Mayor stated the cost of doing business was higher and he thought it would have been a waste of the taxpayers money to hire an expèrt. The Council asked that they be sent copies of the Base Ball Contract and it would be considered next week. Councilman Long inquired about a traffic light being installed at Koenig Lane and Woodrow. She read two letters requesting that something be done at this intersection. The Council joined Councilman White in commending the employees at the Power Plant for working so diligently during a break in a main at the power plant and keeping the water out of the plant. The Council discussed the development of a park in the vicinity of the Interregional Highway Bridge. It was suggested that the City confer with the State and Parks and Recreation Board and see if they would be interested in placing picnic tables and barbecue pits there. Councilman Pearson inquired about the houses that were kept by the City to be placed at this location. _ CITY OF AUSTIN, TEXAS 1121129 Mayor Miller inquired about the plans for widening the Congress Avenue Bridge; he asked that this matter be expedited. The City Manager presented the matter of a lady paying for a water tap on Meadows Street and she wanted to transfer this deposit over to the next street because Meadows Street does not have a line. It was suggested that she leave her deposit and make another one on the other street and also get an easement. The City Manager was to write her.
