JOHN DAVENPORT reported on the progress of the drive for the Animal Shelter for Austin, stating they wanted to go into the final drive, beginning Monday, June 1lth, and they hoped to start construction in July. MR. GORDON MILLS and MR. TOM BRADFIELD, Humane Society, were also present. Mr. Davenport asked endorsement of the Council of their drive. Wallace Survey unplatted in the City of Austin, Travis County, Texas, and hereby authorizes the said B.O. Doerfler and H. A. Lindell to construct, maintain, and operate a drive-in gasoline filling station and to con- struct curbs, ramps, and sidewalks in conjunction therewith subject to the same being constructed in compliance with all ordinances relating thereto, and further subject to the foregoing attached recommendations and plans. Lindell for permission to construct, maintain and operate a drive-in gasoline filling station and to construct commercial driveways in conjunction therewith upon the property located at the southwest corner of the intersection of Koenig Lane and Chesterfield Avenue, which property fronts 188.29 feet on Koenig Lane and 68.37 feet on Chesterfield Avenue, and being known as a portion of the James P. Wallace Survey unplatted in the City of Austin, Travis County, Texas, and the property upon which this filling station is to be located is owned by B. O. Doerfler and H. A. Lindell, and we hereby advise that the following conditions exist. "The property upon which this filling station is to be located is designated as "C" Commercial Use District upon the zoning maps of the City of Austin. "All drainage, natural or otherwise, from this filling station is to be disposed of in such a manner that such drainage will not flow across the sidewalk area into the street, and furthermore, shall not create a nuisance to others in the neighborhood. It is understood that the disposal of such drainage shall be entirely the responsibility of the property owner. Any waste connection to a storm sewer which empties into an open drainageway shall be discontinued, if the waste becomes a nuisance or damages any property or rights of others in the vicinity of the open drainageway. "We recommend that B. 0. Doerfler and H. A. Lindell be granted permission to construct, maintain, and operate said drive-in gasoline filling station and to construct curbs, ramps, and sidewalks in conjunction therewith subject to the following conditions. "(1) That all buildings and equipment shall be placed inside of the property line; correct lines to be obtained before construction starts or equipment is installed. Lines and grades to be obtained from the Department Of Public Works for entrances and driveways; building lines to be approved by the City Building Inspector. That the applicant shall confer with the Department of Public Works as to future grades of the sidewalks and gutters on the adjacent streets before he starts any construction relative to the filling station. "(2) That only undergound tanks shall be used, and that all pumps shall be so located that it will be impracticable to service motor vehicles therefrom while said motor vehicles are standing on any part of a sidewalk, street, or alley. 380 380 CITY OF AUSTIN, TEXAS "(3) That the gasoline tanks, pumps, and all equipment used in connection with the storage and handling of gasoline shall be an approved type and shall bear the label of Underwriters Laboratories, Inc., and that all construction for the filling station improvements shall be in accordance with the Building Ordinance, the Zoning Ordinance, the Filling Station Ordinance, and in accordance with the ordinance prohibiting the disposal of commercial water or oils upon the City Streets. "(4) That the grades of the station shall be such that no waste water or oils or any floor washings shall ever pass over the City sidewalk area and that all of said oils and water shall be concentrated into a combined grease and sand trap which shall be constructed in accordance with our standard plan 2 H- 146. O. Doerfler and H. A. Lindell to construct, maintain, and operate a drive-in gasoline filling station and to construct curbs, ramps, and sidewalks in conjunction therewith subject to the same being constructed in compliance with all ordinances relating thereto, and further subject to the foregoing attached recommendations and plans. O. Doerfler and H. A. Lindell and we hereby advise that the following conditions exist. "The property upon which this filling station is to be located is designated as Local Retail upon the zoning maps of the City of Austin. "All drainage, natural or otherwise, from this filling station is to be disposed of in such a manner that such drainage will not flow across the sidewalk area into the street, and furthermore, shall not create a nuisance to others in the neighborhood. It is understood that the disposal of such drainage shall be entirely the responsibility of the property owner. Any waste connection to a storm sewer which empties into an open drainageway shall be dis- continued, if the waste becomes a nuisance or damages any property or rights of others in the vicinity of the open drainageway. "We recommend that B. O. Doerfler and H. A. Lindell be granted permission to construct, maintain, and operate said drive-in gasoline filling station and to construct curbs, ramps, and sidewalks in conjunction therewith subject to the following conditions. "(1) That all buildings and equipment shall be placed inside of the property line; correct lines to be obtained before construction starts or equipment is installed. Lines and grades to be obtained from the Department of Public Works for entrances and driveways; building lines to be approved by the City Building Inspector. That the applicant shall confer with the Department of Public Works as to future grades of the sidewalks and gutters on the adjacent streets before he starts any construction relative to the filling station. "(2) That only underground tanks shall be used, and that all pumps shall be so located that it will be impracticable to service motor vehicles therefrom while said motor vehicles are standing on any part of a sidewalk, street, or alley. CITY OF AUSTIN, TEXAS 382 382 "(3) That the gasoline tanks, pumps, and all equipment used in connection with the storage and handling of gasoline shall be an approved type and shall bear the label of Underwriters Laboratories, Inc., and that all construction for the filling station improvements shall be in accordance with the Building Ordinance, the Zoning Ordinance, the Filling Station Ordinance, and in accordance with the ordinance prohibiting the disposal of commercial water or oils upon the City Streets. JOHN LINN SCOTT, Architect, displayed plans for the fire station at Cullen, Reese and Grover. Councilman White noted some changes that should be made, and Mr. Scott made the changes. Councilman White moved that the Council approve the plans as changed. The motion, seconded by Councilman Pearson, carried by the following vote: Ayes: Councilmen Long, Palmer, Pearson, White, Mayor Miller Noes: None Mr. Scott was to come back to the Council when he was ready to set the time for advertising for bids. Councilman Long presented a complaint about the garbage pick-up at the Texaco Stations, in that the trucks would not go on the drives to pick up the garbage, but that instructions had been issued that the stations were to put their garbage on the curb. The Director of Public Works explained the policy, and reported on the three incidents, and that Mr. Edwards, Manager of the Texaco, stated that when he received notice, he would notify all his stations to comply. 383 383 CITY OF AUSTIN, TEXAS The Council publicly heard the following zoning application: T. T. TALLEY By Trueman O'Quinn 1914-16 Lake Austin 501 Arlington From "LR" Local Retail To "C-1" Commercial NOT Recommended by the Planning Commission Mr. Trueman O'Quinn represented the applicant. Mr. Herbert Smartt represented the opposition. MRS. ROBERT E. LEE, and MRS. RUDOLPH E. EGGLING expressed opposition to the change, which they feared would lead to a tavern at this location. After discussion, it was decided to postpone this until the attorneys could work out an agreement that would tie the matter down to where the property could never be used as a tavern. This agreement to be worked out between the Attorneys and the City Attorney. Mayor Miller reported a bad place in the street in the 1400 block of West 5th Street. Mayor Miller asked that all city employees report to the heads of their departments any holes in pavements and streets, and the department heads report it on to the Director of Public Works. Mayor Miller stated it was necessary that extra operators be stationed at the Service Building to take calls during wind storms and emergencies when there are live wires down or service is interrupted, as the people would like to know the status. They call the Council members for information. He suggested having a number listed under the Emergency Calls in the phone directory, where people would known where to call, and be told something generally about the condition. It would be a great service to the people. He suggested a phone with a rotating number, and that possibly someone dispatched from the Police or Fire Departments or some extra man be called in from the Power Plant to answer these calls, as the people were entitled to this service. After discussion Councilman Long moved that the City Manager be instructed to immediately work out with Mr. Kinney, the Police and Fire Departments, a system that when there is an interruption in service that people will know the number; that it will be published in the front page of the phone directory; and that it will be within a reasonable time put on the water and light bills. The motion, seconded by Councilman Palmer, carried by the following vote: Ayes: Councilmen Long, Palmer, Pearson, White, Mayor Miller Noes: None Mayor Miller stated that all departments should be coordinated; that if the Police Department receives radar advice, it should be immediately transmitted to the City Manager. The Council met with the Architects on the Auditorium to discuss the bids and what could be done. Mr. Sutherland stated they had worked with the various contractors and had made a quick list of some things that might 384 384 CITY OF AUSTIN, TEXAS be cut, cutting quality, and from this short study they thought there might be a reduction of $250,000. It was suggested that the Architects study these plans very thoroughly and alter them if possible, and report back in three weeks.
