CITY OF AUSTIN, TEXAS MINUTES OF THE CITY COUNCIL CITY OF AUSTIN, TEXAS Regular Meeting October 03, 1957 10:00 Α.Μ. Council Chamber, City Hall 757 757 The meeting was called to order with Mayor Miller presiding. Roll call: Present: Councilmen Long, Palmer, Pearson, White, Mayor Miller Absent: None Present also: W. T. Williams, Jr., City Manager; Doren R. Eskew, City Attorney; Reuben Rountree, Jr., Director of Public Works. Invocation was delivered by REV. M. P. BURTON, Grace Methodist Church, 201 East Monroe Street. Councilman White moved that the Minutes of the meeting of September 26, 1957, be approved. The motion, seconded by Councilman Palmer, carried by the following vote: Ayes: Councilmen Long, Palmer, Pearson, White, Mayor Miller Noes: None MR. TRUEMAN E. O'QUINN appeared before the Council with reference to the sale and transfer of franchise of OWL TAXI SERVICE to K. M. FISHER. He stated the 24 cars involved would be operated under the Yellow Cab group. Full discussion was held covering the franchises, the contract with cab drivers using their cars, and careful selection of cab drivers. Mayor Miller then introduced the following ordinance: AN ORDINANCE APPROVING TRANSFER OF THE FRANCHISES HELD BY OWL TAXI SERVICE, INC., AND V. R. MOORE, TO K. M. FISHER, EFFECTIVE 12:00 MIDNIGHT, SEPTEMBER 30, 1957; AUTHORIZING OPERATION OF ALL OF THE OWL TAXI SERVICE TAXICABS UNDER THE NAME OF YELLOW CAB COMPANY; PROVIDING THAT THE COLOR SCHEMES AND PATTERNS OF SUCH TAXICABS SHALL BE CONVERTED WITHIN NINETY DAYS AFTER DATE OF THIS ORDINANCE; AND DECLARING AN EMERGENCY. The ordinance was read the first time and Councilman White moved that the rule be suspended and the ordinance passed to its second reading. The motion, seconded by Councilman Pearson, carried by the following vote: CITY OF AUSTIN, TEXAS 758 758 Ayes: Councilmen Long, Palmer, Pearson, White, Mayor Miller Noes: None The ordinance was read the second time and Councilman White moved that the rule be suspended and the ordinance passed to its third reading. The motion, seconded by Councilman Pearson, carried by the following vote: Ayes: Councilmen Long, Palmer, Pearson, White, Mayor Miller Noes: None The ordinance was read the third time and Councilman White moved that the ordinance be finally passed. Councilman Pearson brought up the request of MR. STEVE TARTER to buy the franchise of Shugart Taxi. Councilman Pearson moved that the City Manager be instructed to bring in an ordinance making the transfer, provided all qualifications that are inherent in the ordinance for a franchise for taxicabs are carried out. The motion, seconded by Councilman White, carried by the following vote: Ayes: Councilmen Long, Palmer, Pearson, White, Mayor Miller Noes: None It was requested that Mr. Tarter come up next week when this ordinance is considered. 1 MR. HENRY BECK made a complaint about the lack of enforcement of the dog ordinance in the vicinity of the Robert E. Lee School. He stated there were from three to six dogs running loose most of the time in this area. The Mayor stated many dogs had been destroyed; many had been impounded and their owners had reclaimed many; and suggested that Mr. Beck report the running loose of these stray dogs to the Police Department. MR. BECK asked that the City ask the Texas League of Municipalities to legislate for cities' receiving a part of the gasoline tax, as most of the gasoline was used for driving on the city streets rather than on highways. Review of the cities' efforts in this line was given. MR. PHILLIP BAKER appeared before the Council stating as he made payments to apply on his real estate taxes, the money was credited to taxes on old cars in 1939 and 1926. The City Manager explained the procedure. He stated if he were paying taxes which he did not owe, adjustments could be made, and that would be checked into for him. The Mayor told Mr. Baker that this would be followed up for him, and he would be notified. CITY OF AUSTIN, TEXAS 761 761 WHEREAS, the bid of Lee Maners in the sum of $68,760.64 was the lowest and best bid therefor, and the acceptance of such bid has been recommended by the Director of Public Works of the City of Austin, and by the City Manager; Now, Therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That the bid of Lee Maners in the sum of $68,760.64 be and the same is hereby accepted, and W. T. Williams, Jr., City Manager of the City of Austin is hereby authorized and directed to execute a contract on behalf of the City of Austin with Lee Maners. The motion, seconded by Councilman Palmer, carried by the following vote: Ayes: Councilmen Long, Palmer, Pearson, White, Mayor Miller Noes: None Councilman Pearson inquired if it would be well that the paving contractors post bond that they will maintain a street for a year after they pave it. Discussion was held on this, covering reasons why there were needed repairs and suggestions that had been made for correcting the weaknesses--run laboratory tests and enforce specifications. The trouble was not only local, but elsewhere. In backfills, one suggestion was to specify what was needed, and let the contractor meet the specifications instead of specifying how the work must be done. Increase in inspections was suggested also. Mayor Miller made inquiry of prequalifying contractors who bid for city work, and inquired if moral responsibility, proof of workmanship in the past could be required as well as financial responsibility. Councilman Long offered the following resolution and moved its adoption: (RESOLUTION) WHEREAS, after an engineering and traffic investigation, the City Council has found that traffic conditions are such that an urgent need for enforcement of strict limits upon the time of parking of vehicles at the location hereinafter described upon the street makes it advisable to use mechanical devices in such enforcement, and has found that such location should be removed from Parking Meter Zone 60 and placed in Parking Meter Zone 120, such location being described and located as follows: ON SIDE Twenty-First Street South Now, Therefore, FROM TO Guadalupe Speedway BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That the location upon the street of the City of Austin as above described be and it is hereby removed from Parking Meter Zone 60 and placed in Parking Meter Zone 120, and that the City Clerk be, and she is hereby authorized and instructed to record this finding in Section 33.43 of the Traffic Register. _ CITY OF AUSTIN, TEXAS 762 762 The motion, seconded by Councilman White, carried by the following vote: Ayes: Councilmen Long, Palmer, Pearson, White, MayorMiller Noes: None The City Manager submitted a sketch showing a proposed location for offices of the Recreation Department on the north side of the Butler soft ball field No. 2, on the proposed extension of Robert E. Lee Road. The Council wanted to go look at this location. The Council approved the absence of JUDGE DAUGHERTY to attend a conference on Traffic Court Judges and Prosecutors at Northwestern University in Chicago. Councilman Pearson moved that MR. JOHN BRADY be appointed to serve as judge while Judge Daugherty attended this conference. The motion, seconded by Councilman Palmer, carried by the following vote: Ayes: Councilmen Palmer, Pearson, White, Mayor Miller Noes: Councilman Long The City Manager submitted a plan for extending Shoal Creek Boulevard south to 34th Street, and exchanging some right-of-way on the west side for property on the east side of Shoal Creek. He thought it was a matter of trading new right-of-way for old, and inquired of the Council if he should go ahead with the plans. The Council informally agreed that he see what could be worked out and bring back the plans to the Council. The Council received notice from the City Manager that the following applications for change of zoning had been referred to the Plan Commission and set for public hearing before the City Council for November 7, 1957: W.
