Council Chamber, City Hall The meeting was called to order with Mayor Miller presiding. Roll call: Present: Councilmen Long, Palmer, Pearson, White, Mayor Miller Absent: None Present also: W. T. Williams, Jr., City Manager; Doren R. Eskew, City Attorney; Reuben Rountree, Jr., Director of Public Works. Invocation was delivered by MR. HAROLD KILPATRICK, Texas Council of Churches, 504 West 24th Street. Councilman Whit e moved that the Minutes of the meeting of November 7, 1957, be approved. The motion, seconded by Councilman Pearson, carried by the following vote: Councilmen Long, Palmer, Pearson, White, Mayor Miller Ayes: Noes: None MR. KENT RIDER, President, Chamber of Commerce, stated there was a delegation present from the Junior and Senior Chambers of Commerce. MR. JOE CROW submitted a further request for lease of the property at 1st and Congress for building quarters for the Junior and Senior Chambers of Commerce, and asked that the City have a bill introduced in the Legislature, authorizing a lease of a certain amount of this property to the Chambers of Commerce. Plans of the building were displayed. MR. LOUIS GOLDBERG believed this legislative plan was favorable to the Governor and the Senator from this district. MR. MOTON CROCKETT, JR., President, Junior Chamber of Commerce, endorsed the request. The Council discussed this with the group, and the Mayor stated the Council would go into this further, and give them an answer. MR. LEONARD GUERRO appeared before the Council with the request that it rescind its action annexing property off the Manchaca Read a little past the Williamson Creek Bridge, or provide city services. MR. ED HAMEL was his spokesman, and asked if the City could give him some kind of concession as he was not getting any city services and was still a part of the Water district. His taxes were $280.28, school and city. Councilman Long moved that the City Manager be CITY OF AUSTIN, TEXAS 804 804 instructed to have this matter studied and report back to the Council for action. The motion, seconded by Councilman Palmer, carried by the following vote: Councilmen Long, Palmer, Pearson, White, Mayor Miller Ayes: Noes: None MR. H. P. ALLEN appeared requesting that the Council set the application of AUSTIN NATIONAL BANK, TRUSTEE, for "C-2" classification of the triangle between Interregional Highway, Cameron Road, and East 51st Street for rehearing, as he did not receive a notice. His written request stated he had purchased the properties within 200' of this property this year and his name was not on the tax rolls for 1957. Other property that he owned was just beyond 200' from the triangle. He stated that any kind of a building located on this triangle would add to the traffic hazard; that the change of zoning would depreciate the value of his property directly across the street; and that he was opposed to liquor traffic. He did not think the people in opposition were able to come to the hearing as they were working people and felt that possibly some one would go to the hearing in opposition. MRS. HERBERT DEASON, and MRS. MONTE MCCLELLAN appeared in opposition to the zoning change. REV. GRIFFITH, Memorial Methodist Church, and two other ministers appeared in opposition to a change of zoning. MR. TRUEMAN E. O'QUINN, Attorney for the applicant, stated the plans for the building complied with everything the Traffic Department, the Building Inspector, and the Zoning Ordinance required. The Council deferred action on the pending ordinance until next Thursday to look into the matter, and asked that Mr. Allen get with the owner of the property to see if he would be willing to withdraw the application. Said gas main described above shall have a cover of not less than 2 feet. 809 809 _ CITY OF AUSTIN, TEXAS 810 810 THE Southern Union Gas Company is hereby put upon notice that the City of Austin does not guarantee that the space assigned above is clear from other underground utilities, but is based upon the best records we have at hand, and that the minimum depth stated does not have any reference to the fact that greater depths may not be required at special points. When the Southern Union Gas Company requires definite information upon the ground as to elevations or working points from which to base the location of their assignments, they shall apply to the Department of Public Works not less than three (3) days before such information is required. The Southern Union Gas Company is further put upon notice that they will be required to bear the expense of repairs or replacement of any underground utility damaged during the construction of lines named in this resolution. AND THAT whenever pavement is cut in the vicinity of a fire plug, water must be used at intervals during the course of backfilling of the ditches. The motion, seconded by Councilman Pearson, carried by the following vote: Ayes: Councilmen Long, Palmer, Pearson, White, Mayor Miller Noes: None Councilman White offered the following resolution and moved its adoption: (RESOLUTION) WHEREAS, by Minute Order No. 43066 the Texas Highway Commission on November 1, 1957, ordered that a grade separation and approaches be constructed on U.S. Highway 290 at the Missouri Pacific Railway crossing on South Lamar Boulevard at an approximate estimated cost of $500,000 including right of way and that the State Highway Department bear 40%of the cost of the total project on condition that the City of Austin bear 40% of the cost and the Missouri Pacific Railway Company bear 20% of the cost, subject to the acceptance of such proposal by the City of Austin and the Missouri Pacific Railway Company; Now, Therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That the proposal for the construction of the grade separation and approaches on U.S. Highway 290 at the Missouri Pacific Railway crossing on South Lamar Boulevard contained in Texas Highway Commission Order No. 43066 dated November 1, 1957 be accepted by the City of Austin and that the City. Manager be directed to inform the Texas Highway Commission of such acceptance by the City of Austin. A. H. RITTER to change shore line of property on Lake Austin, as it wanted to go look at the property and surrounding areas. The Assistant City Manager stated bids had been received for seats and stage equipment for the Auditorium. The low bid did not meet specifications as the seats had no arms. It was recommended that the low bid on the chairs with no arms not be considered. The Council all stated it was their desire in the beginning to have the regular opera chairs with arms. Councilman Long moved that the Regular Meeting date be set for Wednesday, November 27th instead of Thanksgiving. The motion, seconded by Councilman Palmer, carried by the following vote: Ayes: Councilmen Long, Palmer, Pearson, White, Mayor Miller Noes: None The Council received a final draft of the wording on the Plaque for the Auditorium. In this line, the Mayor stated there must be a plaque dedicating the Auditorium to the citizens and taxpayers of the City of Austin. The City Attorney was requested to bring in a brief on this. The Director of Public Works gave a report on Paving of 49½ Street, in that 68.4% had signed up. He explained the previous efforts of getting the street paved in 1956, and some had withdrawn their checks. The paving had never been abandoned; but now with the 68.4% and possibility of others coming in, it was hoped to go on with the paving. The Council was favorable to paving at this figure and assessing the rest. Discussion was held on the condition of some streets. It was pointed out that the area along Bridle Path on into Enfield needed maintenance. The Director of Public Works reported on the sealcoating, and stated the next program would be with limestone from Uvalde and would not be do dusty. CITY OF AUSTIN, TEXAS 813 813 The Council received a report from the Director of Public Works on the paving of Hancock Drive from Shoal Creek Boulevard to Burnet Highway. By combining the portion of Hancock Drive from Finley Drive to the Railroad only 74% can be signed up. It was his recommendation that the paving of Hancock Drive be between Finley Drive and the Railroad. The Council informally agreed. The Director of Public Works stated Mr. Lindsey, who ownes a lot at the southeast corner of 38th and Lamar, wanted to rent the lot for selling Christmas trees, and he wanted to use the little narrow strip of land between his lot and the street. Councilman Palmer moved that a formal ordinance be brought in declaring the necessity of paving certain streets as submitted by the City Manager through a memorandum from S. The motion, seconded by Councilman Pearson, carried by the following vote: Ayes: Councilmen Long, Palmer, Pearson, White, Mayor Miller Noes: None The Council discussed with the Director of Recreation the plans for the year and individually expressed general satisfaction of the plans for capital improvements. The Council considered the appeal of J. D. CONNOLLYand W. W. PATTERSON from the Board of Equalization on the value of the real property in Block 85, Original City of Austin; and fixed the assessed valuation of the land at $397,070.00, and the improvements at $2,790.00 or a total assessed valuation of $399,800.00.
