886 886 CITY OF AUSTIN, TEXAS MINUTES OF THE CITY COUNCIL CITY OF AUSTIN, TEXAS Regular Meeting December 23, 1957 10:00 Α.Μ. Council Chamber, City Hall The meeting was called to order with Mayor Miller presiding. Roll call: Present: Councilmen Long, Palmer, Pearson, White, Mayor Miller Absent: None Present also: W. T. Williams, Jr., City Manager; Robert J. Potts, Jr., Assistant City Attorney; Reuben Rountree, Jr., Director of Public Works. Invocation was delivered by REV. DAVID LARSON, Prince of Peace Lutheran Church, 1635 East Live Oak Street. Councilman White moved that the Minutes of the Meeting of December 19, 1957, be approved. The motion, seconded by Councilman Palmer, carried by the following vote: Ayes: Councilmen Long, Palmer, Pearson, White, Mayor Miller Noes: None MR. DAVID BARROW, representing the Planning Commission, appeared before the Council, stating the Planning Commission had voted that the Council be informed of the rerouting of Balcones Drive as it intersects Burnet Highway and that the Council be asked to contact the Highway Commission and protest the present plans. Mr. Barrow stated it was the thought of the Commission that Balcones Drive should go straight under the Highway as Balcones would be extended, and not have to double back to cross under the railroad overpass. The City Manager displayed plans as submitted by the Highway Department. No action was taken by the Council at this time. Councilman Pearson stated it would be brought up later. No action was taken on appointments to various Boards, whose members' terms had expired or would expire at the beginning of the year. 887 887 CITY OF AUSTIN, TEXAS Councilman Long offered the following resolution and moved its adoption: (RESOLUTION) WHEREAS, after an engineering and traffic investigation, theCity Council has found that because of changed conditions the present maximum reasonable and safe speed for the operation of vehicles at the following location is not now forty-five (45) miles per hour, and that its previous finding of a maximum reasonable and safe speed of forty-five (45) miles per hour for the operation of vehicles at the following location should be deleted from Section 33.40 of the Traffic Register: ON STREET East 7th Street and, FROM Shady Lane TO Airport Boulevard WHEREAS, after an engineering and traffic investigation the City Council has found the present maximum reasonable and safe speed for the operation of vehicles is forty (40) miles per hour at the following location: ON STREET East 7th Street FROM Shady Lane TO Airport Boulevard Now, Therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That the City Clerk be authorized and instructed to record these findings in Section 33.40 of the Traffic Register. The motion, seconded by Councilman White, carried by the following vote: Ayes: Councilmen Long, Palmer, Pearson, White, Mayor Miller Noes: None Councilman White offered the following resolution and moved its adoption: (RESOLUTION) WHEREAS, by instrument dated August 30, 1951, of record in Book 1184, Page 250, Deed Records of Travis County, Texas, the City of Austin was granted a water main easement across that certain tract of land out of the Isaac Decker League Survey No. 20 conveyed to C. N. Eppes by a warranty deed dated September 10, 1919, recorded in Book 313, Page 95, Travis County Deed Records; and, WHEREAS, said water main has been located elsewhere and said easement does not adequately describe the needed location for such water main; and, WHEREAS, the owner of above tract of land has requested that said easementbe released; and, CITY OF AUSTIN, TEXAS 888 888 WHEREAS, the hereinafter described easement is not now needed and will not hereafter be required by the City of Austin; Now, Therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That W. T. Williams, Jr., City Manager, be and he is hereby authorized to execute a release of said water main easement, located on the following described property, to wit: A strip of land ten (10) feet in width, a portion of that certain tract of land out of the Isaac Decker League Survey No. 20 in the City of Austin, Travis County, Texas, conveyed to C. N. Eppes by a warranty deed dated September 10, 1919, recorded in Book 313, Page 95, Travis County Deed Records and being that certain strip of land ten (10) feet in width described in an easement for the construction and maintenance of a water main conveyed to the City of Austin by an instrument dated August 30, 1951, from Edwin Eppes recorded in Book 1184 page 250 Travis County Deed Records, said strip of land ten (10) feet in width is more particularly described as follows: BEGINNING at a point on the west line of the said Eppes tract, same being the east line of Banister Acres, according to a map or plat recorded in Plat Book 4 page 178 Travis County Plat Records from which the northeast corner of Lot 1, Block 4, of said Banister Acres bears South 30° 00' West 7.50 feet; THENCE South 60° 03′ East 90.0 feet to a point; THENCE South 29° 52' East 416.61 feet to point of termination on the east fence line of the said Eppes tract, same being the west fence line of the I. & G. N. Railroad right of way. The motion, seconded by Councilman Palmer, carried by the following vote: Ayes: Councilmen Long, Palmer, Pearson, White, Mayor Miller Noes: None The City Manager submitted for consideration a plan for utility refunds for SOUTHERN OAKS SUBDIVISION located in Water District No. 5. One problem was the approach mains from the city limits to the subdivision, which will be brought into the city, but which is still in Water District No. 5. It was necessary to get permission from the District to serve the subdivision and also permission to serve the territory on both sides of the approach main. He explained that this had been brought up some time ago as to selling lots out of the subdivision, which lots were subject to taxation by the Water District. Mr. Puett had placed this information on record, and had put it on the plat. No action was taken by the Council at this time. The Mayor asked that Mr. Puett come down and discuss it with the Council. Councilman Long stated she saw no objections if the City could get permission from the Water District to serve the property. CITY OF AUSTIN, TEXAS 889 Councilman Palmer offered the following resolution and moved its adoption: (RESOLUTION) WHEREAS, the City Council of the City of Austin has found that public necessity requires the construction of a sanitary sewer line in the City of Austin to provide for the safe elimination of sewage in the West Bouldin Creek drainageway area North of Prather Lane in the City ofAustin; such sanitary sewer line to be constructed from a point on West Bouldin Creek East of the South end of Thornton Road to Porter Junior High School on Prather Lane in such city; and, WHEREAS, the City Council has found and determined that public necessity requires the acquisition of a sanitary sewer easement 10 feet in width, together with a temporary working space easement 10 feet in width across the hereinafter described tract of land for right of way to permit the construction of the aforesaid sanitary sewer line; and, WHEREAS, the City of Austin has negotiated with the owner of said land and has been unable to agree with such owner as to the fair cash market value of such easement; Now, Therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That the City Manager be and he is hereby authorized and directed to file or cause to be filed against all owners and lienholders, a suit in eminent domain to acquire the hereinafter described easement for sanitary sewer purposes across the hereinafter described tract of land; A strip of land ten (10) feet in width, being a portion of the Isaac Decker League, Survey No. 20, in the City of Austin, Travis County, Texas, and being also a portion of Tract No. 1, containing one acre of land, and Tract No. 2, containing one acre of land, conveyed to H. G. Linscomb, by a deed dated February 11, 1952, recorded in Book 1222, page 165, Travis County Deed Records; the centerline of said strip of land ten (10) feet in width being more particularly described as follows: BEGINNING at a point in the West right of way line of the I. & G. N. Railroad, same being in the East line of a one acre tract of land described as Tract No. 1 in a deed of conveyance to H. G. Linscomb recorded in Book 1222, page 165, Travis County Deed Records from which the Northeast corner of said Tract No. 1, same being the Southwest corner of a 1.05 acre tract of land described in a deed as Tract No. 2 conveyed to Winnie L. McCoy recorded in Book 793, page 525, Travis County Deed Records, bears North 17° 29' East 37.43 feet and the Southeast corner of said Tract No. 1, same being the Northeast corner of one acre tract of land described as Tract No. 2 in a deed of conveyance to H. G. Linscomb recorded in Book 1222, page 165, bears South 17° 29' West 44.57 feet; THENCE, North 72° 12' West 228.43 feet to a point; CITY OF AUSTIN, TEXAS= 890 THENCE, North 68° 14' West 306.85 feet to point of termination in the West line of that one acre tract of land described as Tract No. 2 in a deed of conveyance to H. G. Linscomb dated February 11, 1952, recorded in Book 1222, page 165, Travis County Deed Records, same being also in the East line of Thornton Road and from which the Southwest corner of said Tract No. 2 bears South 17° 29 West 37.70 feet and the Northwest corner of said Tract No. 2, same being the Southwest corner of said Tract No. 1 bears North 17° 29' East 44.3 feet; together with a temporary working space easement ten (10) feet in width, parallel and adjacent to each side of the above described easement; such temporary working space easement to terminate upon completion of the indicated sanitary sewer line. The motion, seconded by Councilman Long, carried by the following vote: Ayes: Councilmen Long, Palmer, Pearson, White, Mayor Miller Noes: None The Council had under consideration bids for seating and for stage equipment for the Auditorium. MR. WOLF E. JESSEN, Architect, submitted the recommendation of the Architects as follows: "December 16, 1957 "The Honorable City Council City of Austin, Texas "Re: Stage Equipment and Seating For Convention Center & Municipal Auditorium, Austin, Texas "Gentlemen: "After much investigation of submissions by bidders, a copy of whose bids are attached together with a Comparison of Bids made by the Architects, * we recommend that awards be made as follows, the total to be bought from an allowance of $144,000.00 set up for these two items. "I. Stage Equipment A. Award No. 1: To Houston Scenic Studios (low bidders) 1. Asbestos Curtain 2. Stage Draperies 3. Sound Panels Total $3,966.00 8,397.00 1,995.00 $14,358.00 B. Award No. 2: to Joseph Vasconcellos, Inc., Long Island City, Ν.Υ. (low bidder on) 1. Stage Equipment and Rigging$22,765.00 (and second bidder on) 2. House Draperies* $ 1,815.00 $24,580.00 *Low bidder on this item was Stage Decorators & Supplies of Greensboro, CITY OF AUSTIN, TEXAS 891 891 N.C. at $1,698.00. It is our recommendation that in order to simplify administration and reduce the number of contracts involved that this bid be passed over in favor of the second bidder. "A total on Stage Equipment of $38,938.00. "II. Seating A. Included in this item are four bids as follows: 1. Fixed seating for balcony, 1,428 seats. 2. Portable seating for main floor, bid for three possible arrangements of seats which vary in number thus; 2,408 seats, 3029 seats and 3,157 seats. 3. Total number of seats bid 4,585 seats. B. The method of taking bids was to specify the chair of one manufacturer and to allow by specification anyone to submit any seat for consideration. As expected a wide range of proposals were received. Many conferences were held with all the bidders at which each submission was thoroughly examined and discussed, each bidder having an opportunity to demonstrate all the advantages of his chair. The most meritorious of these have been compared on the attached chart as regards to price, construction, storage required, general appearance and comfort. C. Recommendation: After careful examination and consideration of the fact that all our effort to date is aimed at the comfort of the patron who will come to sid in the auditorium for 2 or 3 or more hours in the chairs which will be furnished, it is our opinion that comfort is the prime factor in determination, and all other things being equal and within the overall budget requirements, the most comfortable chair should be bought. D. Total budget for Stage Equipment and Seating is $144,000.00. E. An examination of the Seating Plan shows that a maximum of 3,157 seats is possible on the main floor, using 34" spacing in rows from seat back to seat back. Under these conditions it is considered that the independent-fold feature of the seat is essential to allow passing down the rows. A study of the plan, increasing the spacing the rows from 34" to 36", thus eliminating the necessity of the independentfold feature of the seat, shows a revised maximum number of seats of 2,905 seats on the main floor. This 2,905 added to the 1,428 of the balcony still give a total of 4,333 seats in the theater section of the auditorium. F. Our first recommendation then is this 1. From the Comparison of Bids, accept listing number "8", the bid of American Seating Company, using a non-independent-fold seat upholstered in nylon, but reduced to a new number of 2,905 which on the basis of per chair cost of $25.00 will mean the award 897 892 CITY OF AUSTIN, TEXAS of a contract of $72,625.00. For your information, a similar reduction in number of the other bidders indicate the following: Bela Chair @ $20.60/chair =- Ideal Chair@ $20.97/chair = $59,843.00 $60,917.85 2. The American Seating Company chair offers an advantage in storage in that its folded height is 36-1/4"in contrast to 39-1/2" and 40" for the other chairs, the lower height allowing stacking 3 high for storage in the ceiling height available in the basement. G. Our second recommendation is that the fixed seating be awarded to American Seating Company on the basis of listing number "16" using nylon upholstery for the sum of $35,757.12. "III. MR. WOODS, Modern Sales and Service, Inc., summed up the advantages of the chair manufactured by INTERNATIONAL, permanent installation only. MR. DON ABEL, represented the PEABODY COMPANY, manufacturers of fixed seating, and BE LA, portable seating. MR. BICKLEY, Houston, Texas, represented IDEAL COMPANY for portable seating; as to the permanent seating, his bid was high and he did not demonstrate the fixed chair in detail. MR. KEENAN, Dallas, represented the American Seating Company and pointed out the advantages of both the fixed and portable seats. The Mayor announced that people of various organizations-- Chamber of Commerce, Symphony, Labor Organizations, Little Theatre, Junior Chamber of Commerce, Schools, and others, be invited to come in and look over the various seating units, and the Council would award the bids about the middle of January. No action was taken on awarding the bids for the stage equipment, and the matter was postponed until next week.
