Council Chamber, City Hall 356 The meeting was called to order with Mayor Miller presiding. Roll call: Present: Absent: Councilmen Palmer, Pearson, White, Mayor Miller Councilman Long Present also: W. T. Williams, Jr., City Manager; Doren R. Eskew, City Attorney. The Mayor announced that this meeting was called for the purpose of canvassing the returns of the Special Election held May 24, 1958. The Council canvassed the returns, and Councilman Palmer offered the following resolution and moved its adoption: (RESOLUTION) WHEREAS, under and by virtue of Ordinance No. 580501-B, duly passed and adopted by the City Council of the City of Austin, Texas, on the 1st day of May, 1958, and of record in Ordinance Book 58 of the Ordinance Records of the City of Austin, Texas, an election was held in said City on the fourth Saturday in May, 1958, the same being the 24th day of May, 1958, on the following proposition for the issuance of bonds of said City, in the following amount and for the following purpose, to wit: PROPOSITION "SHALL the City Council of the City of Austin be authorized to issue TWENTY MILLION DOLLARS ($20,000,000.00) of revenue bonds of said City for the purpose of extending and improving the City's Electric Light and Power System, and acquiring lands and equipment therefor; said bonds to mature serially over a period not to exceed thirty (30) years from their date, and to bear interest at a rate not to exceed FOUR PER CENTUM (4%) per annum, payable annually or semiannually; said revenue bonds to be special obligations of the City of _ CITY OF AUSTIN, TEXAS 35337 Austin, payable as to both principal and interest from and secured by a first lien on and pledge of the revenues of the combined Electric Light and Power System, Waterworks System and Sewer System, after deduction of reasonable operation and maintenance expenses, as said expenses are defined by statute, said bonds to be on a parity with all outstanding obligations of like character?" FOR issuance of bonds under above Proposition AGAINST issuance of bonds under above Proposition AND WHEREAS, on this the 26th day of May, 1958, there came on to be considered the canvassing of the returns of said election; and, WHEREAS, it appears that said election was in all respects legally held, after due notice had been given, and that the said returns were duly and legally made; and, WHEREAS, the City Council of the City of Austin has this day canvassed the official returns of said election as made and reported by the officers of said election of the various voting precincts of said City and has found that the returns of said election show, as set out in the tabulation below, in each and every voting precinct, the number of affirmative votes and the number of negative votes cast on said proposition submitted at said election, and, as determined from said returns, the total number of affirmative votes and the total number of negative votes cast at said election said proposition submitted thereat are shown in the tabulation set out below, to wit: Precinct For Against Majority 121 Ward Memorial Church 36 1 35 122 Pan American Rec. That the aforesaid election was duly and legally called and notice thereof was given in accordance with the laws of the State of Texas, and the returns thereof have been properly made to the officials of the City entitled to receive same; that only resident qualified property taxpaying voters of said City, who own property therein subject to taxation, and who have duly rendered the same for taxation, were permitted to vote at said election; and further that said election represents the desires of those qualified to vote as aforesaid. II. That more than a majority of all the votes cast at said election were votes affirmatively for said proposition submitted as hereinabove set out, and that said proposition submitted as hereinabove set out received the number of affirmative votes and the number of negative votes at said election as shown in the tabulation hereinabove set out. The motion, seconded by Councilman White, carried by the following vote: Ayes: Councilmen Palmer, Pearson, White, Mayor Miller Noes: None Absent: Councilman Long There being no further business, the Council adjourned at 4:45 P.M., subject to the call of the Mayor.
