Council Chamber, City Hall The meeting was called to order with Mayor Miller presiding. Roll call: Present: Councilmen Long, Palmer, Pearson, White, Mayor Miller Absent: None Present also: W. T. Williams, Jr., City Manager; Doren R. Eskew, City Attorney; Reuben Rountree, Jr., Director of Public Works; Robert A. Miles, Assistant Chief of Police. Invocation was delivered by The REV. EVERETT G. SMITH, Holy Trinity Episcopal Church, Woodland and Summitt Streets. Councilman White moved that the Minutes of the Meeting of March 5, 1959, be approved. The motion, seconded by Councilman Pearson, carried by the following vote: 4 Ayes: Councilmen Long, Palmer, Pearson, White, Mayor Miller Noes: None The Council received the following request from MR. B. I. GASTON, President of the Capitol Aeroneers: "March 9, 1959 511-A Harris Avenue Austin, Texas "The Honorable Mayor Miller and City Council Austin, Texas "Dear Sirs: "On behalf of the Capitol Aeroneers, an Austin model airplane club, I, as president of this organization, am requesting you permission and approval of holding a model airplane contest, open to all A.M.A. members, on July 4, 1959, at the Austin Municipal Airport. 159 159 = CITY OF AUSTIN, TEXAS "The areas of the airport we wish to use are: the grass field southeast of the Ragsdale Office Building, between the old P-38 and the amphibian; also, the ramp area immediately north of the main Ragsdale hangar. 3 "Mrs. Ragsdale and the Ragsdale Flying Service have generously approved this proposal. Col. Murphy also has indicated his approval. "This airplane meet will be under the existing A.M.A. rules, which takes into consideration the important factor of safety. Only A.M.A. members will participate, and each of the members has public liability and property damage insurance. As members of the A.M.A., I can assure you the contest will be sanctioned by the national headquarters and conducted in a business-like manner. 1 "Your consideration of this proposal will be kindly appreciated. "Sincerely, (Sgd) B. I. Gaston B. I. Gaston The A.M.A. is the Academy of Model Aeronautics, a national organization since the middle-thirties. Dr. Walter Good, of Bethesda, Maryland, is the president. 2There are A.M.A. members in San Antonio, Houston, Corpus Christi, Dallas, Fort Worth, and many smaller cities expected to be present. 3All areas for flying have been cleared with the Ragsdale Flying Service." After discussion, Councilman Long moved to grant the permission with the City Manager working out the details. The motion, seconded by Councilman White, carried by the following vote: Ayes: Councilmen Long, Palmer, Pearson, White, Mayor Miller Noes: None MR. GRADY RYLANDER appeared before the Council regarding a traffic hazard at his home at 3409 Foothills Terrace and Edgemont. He stated the cars came down the hill on Edgemont at a terrific speed and were unable to stop, and either go way into his drive or in his yard. He requested permission to build a non-standard curb on the curbline, or behind the curbline, or where the City would give permission. He listed other locations where there were retaining walls or irregular curbs--5500 Caprice; 3416 Hillview on 35th Street; Corner of Townes Lane and Winsted; and 2309 Windsor Road, and others. The Council noted the problem and the Mayor stated it would go out and make another inspection of the situation and see what can possibly be done. Councilman Palmer offered the following resolution and moved its adoption (RESOLUTION) WHEREAS, by resolution adopted on August 14, 1958, the Council authorized James Russell Horton as administrator of Brackenridge Hospital to execute applications to the United States of America for permits to use alcohol, free of tax; and 160 100 CITY OF AUSTIN. TEXAS WHEREAS, since the appointment of a new administrator for Brackenridge Hospital, there has been no person duly authorized to execute such permits, Now, Therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That the duly appointed Administrator of Brackenridge Hospital, by the City Manager from time to time, be and he is hereby authorized to execute in behalf of the City of Austin, applications to the United States of America, for permits to use alcohol, free of tax, in Brackenridge Hospital, a hospital owned and operated by the City of Austin in Austin, Texas. The motion, seconded by Councilman White, carried by the following vote: Ayes: Councilmen Long, Palmer, Pearson, White, Mayor Miller Noes: None Councilman Pearson offered the following resolution and moved its adoption (RESOLUTION) WHEREAS, after an engineering and traffic investigation, the City Council has found that the circumstances are such that the maximum reasonable and safe speed for the operation of vehicles is twenty (20) miles per hour, during the hours from 7:30 A.M. to 4:30P.M., at the following location: ON STREET FROM Oltorf Street South Congress Avenue TO Euclid Street Now, Therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That the City Clerk be authorized and instructed to record this finding in Section 33.39 of the Traffic Register. The motion, seconded by Councilman White, carried by the following vote: Ayes: Councilmen Long, Palmer, Pearson, White, Mayor Miller Noes: None The Council had before it the following tabulation of the bids received for the construction of a low water dam and Holly Street Power Station and for power piping and for power wiring: "March 11, 1959 "Proposals for the Low Water Dam, Contract No. 80 and Holly Street Power Station, Contract No. 64, Site Improvement and Structures, Contract No. 65, Power Piping and Contract No. 66, Power Wiring, were received and publicly opened at 2:00 P.M., March 9, 1959. Zachry Company for a combined contract, consisting of Contract Nos. 64, 65, 66 and 80. Individual unit prices as required by Addendum No. 1 to the specifications were also submitted. However, it was stipulated by Zachry in his proposal that these unit prices were included only for information, and that the contract would be accepted on an all or nothing basis. "It is recommended that the lowest bid be accepted and that Contract Nos. 64, 65, 66 and 80 be awarded to the low bidder, H. B. Zachry Company, for the lump sum bid of $4,416,415.00. Higgins, Chief Power Engineer" 164 164 =CITY OF AUSTIN, TEXAS- The City Manager also read a letter from H. B. Zachry Company, which letter accompanied the bid, and which was referred to on each proposal sheet. A detailed discussion was held on the bids. Inquiry and protest of the "all or none" low bid were made by MR. WARREN, representing the Natkin Company, low on the separate bid on power piping; MR. W. K. JENNINGS, low bidder on separate bid on power wiring; and MR. BILL SHELTON, representative of Farnsworth & Chambers, second low bidder on combined bids on the power plant and third on the dam, stating the combination power plant and dam proposal was a qualified proposal; and as such had rendered an unfair advantage to a low bidder, and also stating that the letter attached to the H. B. Zachry Company bid was not read at the opening of the bids. MR. BUCK AVERY, made inquiry if any written protest had been filed and it was stated one letter from J. M.ODOM GENERAL CONTRACTORS, dated March 10, 1959, had been received by the City Manager. A review of the bids sent out, and of the bid of Combustion Engineers, and other matteräevas made. MR. J. H. BLACKALLER, Vice President, H. B. Zachry Company, made explanations of the various points brought up about their bid. MR. SCHUTZE stated he was present at the bid opening and understood Mr. Zachry to say verbally that the bid was "äll or none", aandithat he had asked Mr. Kinney to look at the proposition to see if there was a quotation on that basis. The letter was with the bid at that time. He made inquiry as to whether or not the bid had been higher than the combination of other bidders, would Mr. Zachry have had the righthef taking any part of the contract that he so desired. The City Attorney stated he would not have been given the opportunity. MR. BLACKALLER stated both union and non-union skilled labor wereworking with the Company, and that it was the Company's intent to give as much business to the suppliers and subcontractors of Austin and employ as many people from this area as they could; that the Company paid the prevailing wage scale or better. MR. HIGGINS, Consulting Engineer, Brown and Root, explained his recommendation. Mayor Miller stated the Council was very much pleased to have these wonderful bids and appreciated the companies' bidding. Councilman Palmer offered the following resolution and moved its adoption (RESOLUTION) WHEREAS, on March 9, 1959, the City of Austin received bids for the construction of a Low Water Dam, Contract No. 80, and Holly Street Power Station, Contract No. 64, for site improvement and structures, Contract No. 65 for power piping and Contract No. 66 for power wiring; and, WHEREAS, the bid of H. B. Zachry in the total sum of $4,416,415.00 was the lowest and best bid therefor, and the acceptance of such bid has been recommended by Brown & Root, Inc. Consulting Engineers for both the Low Water Dam and the Holly Street Power Station, and by the Director of Electric Utility of the City of Austin, and by the City Manager; Now, Therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That the bid of H. B. Zachry in the sum of $4,416,415.00 be and the same is hereby accepted, and W. T. Williams, Jr., City Manager of the City of Austin is hereby authorized and directed to execute a contract on behalf of the City of Austin with H. B. Councilman Pearson offered the following resolution and moved its adoption (RESOLUTION) BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That the application of the City NationalBank of Austin, Texas, to construct and maintain an underground pneumatic tube system in and under a part of that certain alley, locally known as Congress Avenue Alley, said alley lying east of and parallel to Congress Avenue and traversing Block 97 of the Original City of Austin according to a map or plat of said Original City of Austin on file in the General Land Office of the State of Texas; such system not to exceed a width of two (2) feet; the centerline of said assignment being more particularly described as follows: BEGINNING at a point in the east line of said alley and from which point of beginning the point of intersection of the east line of said alley with the south line of East 9th Street bears North 19° 00' East 44.50 feet; THENCE with the centerline of the said strip of land two (2) feet in width, North 71° 00' West 20.00 feet to point of termination on the west line of said alley. be and the same is hereby granted and the Building Inspector is hereby authorized to issue a permit for the construction of such improvement, said grant and permit to be subject to the following conditions: (1) The improvement shall be constructed and maintained in compliance with all ordinances relating thereto. (2) That the Contractor is permitted to construct in his working space a substantial gate which shall be kept closed at all times when not in use, and at all times that such gate is open, the Contractor shall maintain a person at this gate to warn pedestrians and vehicles of approaching trucks. This gate is not to open out so as to impede vehicular or pedestrian traffic. (3) That no vehicles in loading or unloading material at the working space shall park on any part of the street outside of the allotted working space. (4) That "No Parking" signs shall be placed on the street side of the barricades. (5) That the Contractor is permitted to construct a temporary work office within such allotted working space provided such work office is not within 25 feet of any corner street intersection. (6) That the Contractor shall in no way obstruct any fire plugs or other public utilities in the construction of such barricades. (7) That provisions shall be made for the normal flow of all storm waters in the gutter and the Contractor will be responsible for any damage done due to obstruction of any such storm water. (8) That the Contractor shall remove all fences, barricades, loose materials and other obstructions on the sidewalk and street immediately after the necessity for their existence on said sidewalk or street has ceased, such time to be determined by the City Manager, and in any event all such sidewalk, barricades, materials, equipment and other obstructions shall be removed not later than March 28, 1959. (9) That the Contractor shall place on the outside corners of any walkway, barricades or obstructions, red lights during all periods of darkness and provide lighting systems for all tunnels. (12) That any public utility, or public or private property disturbed or injured as a result of any of the activities necessary for the completion of the construction work for said building projects, whether done by the Contractor, City Forces, or public utilities, shall be replaced or repaired at the Contractors expense. (13) That the Contractor shall furnish the City of Austin a surety bond in the sum of Five Thousand Dollars ($5,000) which shall protect, indemnify and hold harmless the City of Austin from any claims or damages to any person or property that may accrue to or be brought by any person by reason of the exercise or abuse of the privileges granted the Contractor by the City of Austin and shall guarantee the replacement of all sidewalks, pavement and all other public property and public utilities disturbed or removed during the construction work and shall further guarantee the construction of a walkway and other safeguards during the occupancy of the space.
