Donald Frances is the Contractor for the painting of a building located at 522 Congress Avenue and desires a portion of the sidewalk and street space abutting Lots 4, 5, 6, and the north 16 feet of Lot 3, Block 55, of the Original City of Austin, Travis County, Texas, during the painting of the building, such space to be used in the work and for the storage of materials therefor; therefore BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: 1. THAT space for the uses hereinabove enumerated be granted to said 526 526 CITY OF AUSTIN, TEXAS J. Donald Frances, hereinafter termed "Contractor", upon the following express terms and conditions: (1) That the Contractor will be permitted to erect and maintain a portable scaffold to be moved from time to time within the above described working space as the work requires, enclosing same with a suitable barricade and to protect pedestrians and cars from all harm or damage during the progress of the work. (2) That the Contractor shall place on the outside corners of any walkway, barricades or obstructions, red lights during all periods of darkness and provide lighting systems for all tunnels. (3) That the Contractor shall remove all fences, barricades, loose materials and other obstructions on the sidewalk and street immediately after the necessity for their existence on said sidewalk or street has ceased, such time to be determined by the City Manager, and in any event all such sidewalk, barricades, materials, equipment and other obstructions shall be removed not later than September 5, 1959. (4) That the City reserves the right to revoke at any time any and all the privileges herein granted or to require the erection or installation of additional barriers or safeguards if the conditions demand it. (5) That the Contractor shall furnish the City of Austin a surety bond in the sum of Two Thousand Dollars ($2,000), which shall protect, indemnify and hold harmless the City of Austin from any claims or damages to any person or property that may accrue to or be brought by any person by reason of the exercise or abuse of the privileges granted the Contractor by the City of Austin and shall guarantee the replacement of all sidewalks, pavement and all other public property and public utilities disturbed or removed during the construction work and shall further guarantee the construction of a walkway and other safeguards during the occupancy of the space. 527 _ CITY OF AUSTIN, TEXAS 527 The motion, seconded by Councilman White, carried by the following vote: Ayes: Councilmen Perry, White, Mayor Miller Noes: None Absent: Councilmen Bechtol, Palmer The Assistant City Manager reported to the Council that the Boy Scouts wanted to have a "pot-luck dinner" at the Auditorium, and asked that the City waive its rights of not having food brought in and said thet MR. Councilman White offered the following resolution and moved its adoption: (RESOLUTION) WHEREAS, the City Council of the City of Austin has found that public necessity requires the creation of an East West thoroughfare to connect the Lockhart and Bastrop Highways with the Fredericksburg Road to provide for the free and safe flow of traffic between such highways and intersecting streets within the City of Austin; and, WHEREAS, the City Council has found and determined that public necessity requires the acquisition of the hereinafter described tract of land for right of way to permit the creation and construction of said East to be known as Ben White Boulevard; and, - West thoroughfare, WHEREAS, the City of Austin has negotiated with the owner of said land and has been unable to agree with such owner as to the fair cash market value thereof; Now, Therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That the City Manager be and he is hereby authorized and directed to file or cause to be filed against the owners and lienholders, a suit in eminent domain to acquire fee simple title for said purposes to the following described tract of land: All of Lot 9, Block C of Ford Place No. 1, said Ford Place No. 1 being a subdivision by J. B. Ford and wife, Hattie Ford, of a portion of the Isaac Decker League, in the City of Austin, Travis County, Texas, according to a map or plat of said Ford Place No. 1 of record in Book 4 at page 265 of the Plat Records of Travis County, Texas. The motion, seconded by Councilman Perry, carried by the following vote: Ayes: Councilmen Perry, White, Mayor Miller Noes: None Absent: Councilmen Bechtol, Palmer Councilman White offered the following resolution and moved its adoption: (RESOLUTION) WHEREAS, the City Council of the City of Austin has found that public necessity requires the creation of an East-West thoroughfare to connect the Lockhart and Bastrop Highways with the Fredericksburg Road to provide for the free and safe flow of traffic between such highways and intersecting streets within the City of Austin; and, WHEREAS, the City Council has found and determined that public necessity requires the acquisition of the hereinafter described tract of land for right of way to permit the creation and construction of said East-West thoroughfare, to be known as Ben White Boulevard; and, WHEREAS, the City of Austin has negotiated with the owner of said land and has been unable to agree with such owner as to the fair cash market value thereof; Now, Therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That the City Manager be and he is hereby authorized and directed to file or cause to be filed against the owners and lienholders, a suit in eminent domain to acquire fee simple title for said purposes to the following described tract of land: Three (3) tracts of land; Tract No. 1 being all of Lot 14, Block C, of Ford Place No. 1; Tract No. 2 being all of Lot 13, Block C of Ford Place No. 1; Tract No. 3 containing 0.052 of one acre of land out of Lots 7 and 12, Block C of Ford Place No. 1 said Ford Place No. 1 being a subdivision of a portion of the Isaac Decker League in the City of Austin, Travis County, Texas, according to a map or plat of said Ford Place No. 1 of record in Book 4 at page 265 of the Plat Records of Travis County, Texas; which Lot 14 was conveyed to Roy B. Stewart et ux Gladys Lorina Stewart by Warranty Deed dated July 14, 1950, of record in Volume 1076, at page 250 of the Deed Records of Travis County, Texas; which Lot 13 was conveyed to Roy B. Stewart et ux Gladys Lorina Stewart by Warranty Deed dated June 15, 1950, of record in Volume 1076 at page 252 of the Deed Records of Travis County, Texas; which Lot 12 was conveyed to Roy B. Stewart et ux Gladys Lorina Stewart by Warranty Deed dated March 5, 1954, of record in Volume 1438 at page 522 of the Deed Records of Travis County, Texas; which Lot 7 was conveyed to Roy B. Stewart et ux Gladys Lorina Stewart by Warranty Deed dated January 6, 1955, of record in Volume 1537 at page 506 of the Deed Records of Tavas _ CITY OF AUSTIN, TEXAS 530 530 County, Texas; the said 0.052 of one acre of land out of Lots 7 and 12, Block C being more particularly described by metes and bounds as follows: BEGINNING at an iron stake in the proposed north line of Ben White Boulevard, same being in the curving west line of the said Lot 7, Block C, of Ford Place No. 1, same also being the east line of Merle Drive, said curve having an intersection angle of 270° 00' and a radius of 60.00 feet and from which point of beginning another iron stake at the northwest corner of the said Lot 7 Block C of Ford Place No. 1, same being in the curving east line of Merle Drive bears N 5° 27' E 42.99 feet; THENCE, with the proposed north line of Ben White Boulevard S 59° 57' E 326.43 feet to an iron stake at the point of intersection of the proposed north line of Ben White Boulevard with the west line of Russell Drive, same being the east line of the said Lot 12, Block C of Ford Place No. 1; THENCE, with the east line of the said Lot 12, Block C of Ford Place No. 1, same being the west line of Russell Drive S 29° 27' W 10.17 feet to an iron stake at the southeast corner of the said Lot 12, Block C of Ford Place No. 1; THENCE, with the south line of the said Lot 12, Block C of Ford Place No. 1, same being the north line of the said Lot 13, Block C of Ford Place No. 1, N 60° 12' W 179.45 feet to an iron stake at the southwest corner of the said Lot 12, Block C of Ford Place No. 1; THENCE, with the west line of the said Lot 12, Block C of Ford Place No. 1, same being the east line of Lot 8, Block C of the said Ford Place No. 1 N 29° 44' E 8.85 feet to a nail at the northeast corner of the said Lot 8, Block C of Ford Place No. 1, same being the southeast corner of the aforementioned Lot 7 Block C of Ford Place No. 1; THENCE, with the south line of the said Lot 7, Block C of Ford Place No. 1, N 60° 19' W 147.10 feet to an iron stake at the southwest corner of the said Lot 7, Block C of Ford Place No. 1, same being in the curving east line of Merle Drive, said Curve having an intersection angle of 270° 00′ and a radius of 60.00 feet; THENCE, following the durving west line of the said Lot 7, Block C of Ford Place No. 1 to the left an arc distance of 3.01 feet, the sub-chord of which arc bears N 30° 21' E 3.00 feet to the point of beginning.
