CITY OF AUSTIN, TEXAS- 116 1116 MINUTES OF THE CITY COUNCIL CITY OF AUSTIN, TEXAS Regular Meeting December 31, 1959 10:00 Α.Μ. Council Chamber, City Hall The meeting was called to order with Mayor Miller presiding. Roll call: Present: Councilmen Bechtol, Palmer, Perry, White, Mayor Miller Absent: None Present also: W. T. Williams, Jr., City Manager; Doren R. Eskew, City Attorney; Reuben Rountree, Jr., Director of Public Works; Robert A. Miles, Chief of Police As to the matter of the Cafeteria at the Airport, the City Manager stated the Administrator at the Airport, the Director of Public Works, and Assistant City Attorney had looked into the matter. The present operator was unable to continue, and Mr. Winters had proposed to take over the equipment and continue to operate the restuarant for the remainder of the lease term. The City Manager stated that when the lease expired in June of 1960, that he would recommend the lease be extended on a monthly basis until the new terminal was completed. He listed the obligations of the present operator as far as the city was concerned, stating that Mr. Winters would pay the utility bill. After detailed discussion, Councilman Palmer moved that the City Manager be authorized to negotiate with Mr. Winters as explained this morning. The motion, seconded by Councilman Bechtol, carried by the following vote: Ayes: Councilmen Bechtol, Palmer, Perry, White, Mayor Miller Noes: None Later in the meeting, Councilman Palmer offered the following resolution and moved its adoption: (RESOLUTION) BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That the City of Austin hereby consents to the transfer and assignment of that certain lease agreement dated July 1, 1955, between the City of Austin and Elmer Burch, for the operation of a cafe in the Administration Building at the Austin Municipal Airport, to Claus Winter by T. H. Echelmeyer effective as of the 1st day of January, 1960; and =CITY OF AUSTIN, TEXAS 171117 BE IT FURTHER RESOLVED that all of the equipment, furniture and fixtures belonging to the present Lessee is hereby released from the landlord's lien of the City of Austin for rent accruing prior to January 1, 1960, but without releasing the debt due and owing to the City of Austin by T. H. Echelmeyer; said lease agreement from and after June 30, 1960, to be a month to month rental agreement until terminated at the election of the City Council. STANLEY SMITH appeared before the Council regarding a tax matter on property on the Old Webberville Road and Airport Boulevard, of which he had sold one-third undivided interest to Mr. Haggen in Houston. He then traded some of the property for the 75' facing on Airport Boulevard, and the rendition for taxes for the 75' was picked up in his name, but the other was taken out of his rendition. The Tax Assessor explained the procedure in the Tax Department, and stated that Mr. Smith had not rendered the property for the years in question, and since it had not been rendered, it had been assessed. The matter was discussed. The City Manager stated nothing could be done about the penalty and interest. Mr. Smith stated he would pay the taxes, but did not want to pay the penalty and interest. The Mayor asked him to proceed with paying the taxes, and take it up with the group in Houston; and let him know. MR. H. C. BELL, Central Texas Equipment Company, appeared again before the Council regarding paving a dreveway on their property and having head-in parking, which parking area would be partly on sidewalk area, but which area they had been using now for years. The Mayor asked that the Engineering Department stake it off where the cars will hang over the sidewalk area, and the Council would go out again and see exactly how it would be after it is staked off, and try to work it out someway. MR. EDMUNDS TRAVIS submitted a "Request for Certification by the City Clerk as to the Sufficiency of an Initiative Petition in compliance with Art. IV, Section 4, of the City Charter." (On File under PETITIONS Hancock Tract) - Councilman White moved that the Minutes of the Meetings of December 17, 1959, and December 23, 1999, be approved. The motion, seconded by Councilman Bechtol, carried by the following vote: Ayes: Councilmen Bechtol, Palmer, Perry, White, Mayor Miller Noes: None The Council recessed until 4:00 Ρ.Μ. 1118 1118 CITY OF AUSTIN, TEXAS RECESSED MEETING 4:00 Ρ.Μ. MR. RAYMOND RICE, Graduate student of the University of Texas, with majors in Sociology, Psychology and Criminology, asked that emergency measures be taken to stop the showing of an immoral picture show at one of the Theaters. He requested that a city ordinance be passed to cover such as he had been through all other channels of government, and found there was no way to prohibit these immoral pictures from being shown. The Chief of Police stated an agreement had been worked out with some of the theatres that the Vice Squad would be called in on any questionable pictures before they were scheduled, and that the department would try to work this out with the other theatres. Mayor Miller personally called the manager of the theatre, and stated there would be only adults admitted; and that the enforcement officers would be there; that there had been no complaints in a year or so along this line, and thanked Mr. Rice for his interest. Councilman White offered the following resolution and moved its adoption: (RESOLUTION) BEIT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the City Council of the City of Austin hereby approves as a filling station site the property located at the northwest corner of Koenig Lane and Woodrow Avenue, which property fronts 164.10 feet on Koenig Lane and 134.56 feet on Woodrow Avenue, being known as Lots 24, 34 and the east 4.8 feet of Lot 33 of Block X of Violet Crown Heights Section Two in the City of Austin, Travis County, Texas, and hereby authorizes the said Texaco, Inc. as agent for the owners to construct, maintain, and operate a drive-in gasoline filling station and to construct curbs, ramps, and sidewalks in conjunction therewith subject to the same being constructed in compliance with all ordinances relating thereto and further subject to the foregoing attached recommendations and plans. It is understood that the disposal of such drainage shall be entirely the responsibility of the property owner. "We recommend that Texaco, Inc. as agent for the owners be granted permission to construct, maintain, and operate said drive-in gasoline filling station and to construct curbs, ramps and sidewalks in conjunction therewith subject to the following conditions. "(1) That all buildings and equipment shall be placed inside of the property line; correct lines to be obtained before construction starts or equipment is installed. Lines and grades to be obtained from the Department of Public Works for entrances and driveways; building lines to be approved by the City Building Inspector. That the applicant shall confer with the Department of Public Works as to future grades of the sidewalks and gutters on the adjacent streets before he starts any construction relative to the filling station. "(2) That only underground tanks shall be used, and that all pumps shall be so located that it will be impracticable to service motor vehicles therefrom while said motor vehicles are standing on any part of a sidewalk, street, or alley. "(3) That the gasoline tanks, pumps, and all equipment used in connection with the storage and handling of gasoline shall be an approved type _ CITY OF AUSTIN, TEXAS 11241124 and shall bear the label of Underwriters Laboratories, Inc., and that all construction of the filling station improvements shall be in accordance with the Building Ordinance, the Zoning Ordinance, the Filling Station Ordinance, and in accordance with the ordinance prohibiting the disposal of commercial water or oils upon the City Streets. "(4) That the grades of the station shall be such that no waste water or oils or any floor washing shall ever pass over the City sidewalk area and that all of said oils and water shall be concentrated into a combined grease and sand trap which shall be constructed in accordance with our standard plan 146. 2 -H- "(5) That all filling station improvements, pump islands, driveways, ramps, gutters, sidewalks, and curbs shall be constructed of concrete at the expense of the applicant as set forth upon the plan, hereto attached, which plan bears the Department of Public Works file number 2 - 1696. - H "(6) Expansion joints shall be constructed as shown upon the plan, hereto attached, marked 2 - H - 1696 and shall be of the premoulded type. "(7) When the owner considers that he has complied with all the requirements of the City of Austin for filling stations, he shall apply for a final inspection, and upon approval, the Building Inspector shall issue a Certification of Operation before such filling station can be put into service. He said he thought a person could be found who was working in that capacity with a utility company. The Mayor suggested that the matter be laid over until next week; and that the person come in Tuesday when the Hospital Consultant came in. MR. DAVID BARROW appeared before the Council expressing appreciation for the work of the Council. MR. DAVID BARROW discussed the tax assessments on property outside the city limits, but in the independent school district. Councilman Bechtol moved that the value of the property of MR. C. R. The motion, seconded by Councilman Palmer, carried by the following vote: Ayes: Councilmen Bechtol, Palmer, Perry, White, Mayor Miller Noes: None The City Manager stated that Mr. Bluestein had contacted him wanting to know if the City would be willing to contract with the Highway Department to provide the usual maintenance and operation of street lighting at this Bergstrom Field intersection if the Highway Department installed the lighting. He said Mr. Bluestein had made inquiry but he had not yet submitted his proposal to the Highway Department. The City Manager stated that Mr. Landon Bradfield had requested that he submit his request that the public hearing on street-lighting in subdivisions be postponed for one or two weeks. The Council postponed the hearing originally set for January 7th to JANUARY 21st, 1960. CITY OF AUSTIN, TEXAS 1132 1132 The Council, on Councilman White's motion, by rising vote, expressed its appreciation to the City Manager, the Heads of the Departments, and the workers throughout for the fine cooperation they had given the Council during the year 1959, and wishing them a happy and properous 1960. The City Manager stated that the whole administration had enjoyed working with the Council during the past year.
