Council Chamber, City Hall The meeting was called to order with Mayor Miller presiding. Roll call: Present: Councilmen Bechtol, Palmer, White, Mayor Miller Absent: Councilman Perry Present also: Reuben Rountree, Jr., Acting City Manager; Doren R. Eskew, City Attorney; Robert A. Miles, Chief of Police City Manager W. T. Williams, Jr., and Assistant City Manager W. T. Blodgett absent. Invocation was delivered by REV. J. PAUL JOYNER, Central Assembly of God. Councilman White moved that the Minutes of the meeting of June 9, 1960, be approved. The motion, seconded by Councilman Palmer, carried by the following vote: Ayes: Noes: Councilmen Bechtol, Palmer, White, Mayor Miller None Absent: Councilman Perry The Council rose in honor and in memory of MR. MARVIN TURNER, who had been with the City of Austin 25 years, and asked that a letter of sympathy be sent to his wife and family expressing regrets of his death. MAYOR MILLER announced that MR. W. L. MAYFIELD had filed a request for withdrawal of his Special Permit at 2815-2823 Hancock Drive. Also in view of this request for withdrawal, MR. T. G. FERGUSON, representing petitioners for zoning the property (2815-2841 Hancock Drive) from "0" Office District to "A" Residence District, requested that this application as well as their petition appealing the decision of the Planning Commission on granting a special permit at 2815-2823 Hancock Drive, be withdrawn. MR. ROBERT SNEED, representing Mr. Lloyd Collins, also verbally asked withdrawal of their appeal, since Mr. Mayfield had decided not to go on with his special permit. Councilman Palmer moved to accept these withdrawls, and asked that the property owners be notified. The motion, seconded by Councilman White, carried by the following vote: Ayes: Councilmen Bechtol, Palmer, White, Mayor Miller Noes: None Absent: Councilman Perry ) C こ CITY OF AUSTIN, TEXAS Mayor Miller introduced the following ordinance: AN ORDINANCE AMENDING CHAPTER 34 OF THE AUSTIN CITY CODE OF 1954 BY ADDING THERETO A NEW SECTION DESIGNATED SECTION 34.13-Α ΤO PROHIBIT FILLING AND TO REGULATE THE MOVING OF EARTH IN AND ALONG CERTAIN PARTS OF THE COLORADO RIVER, AND DECLARING AN EMERGENCY. The ordinance was read the first time and Councilman Palmer moved that the rule be suspended and the ordinance passed to its second reading. The motion, seconded by Councilman Bechtol, carried by the following vote: Ayes: Councilmen Bechtol, Palmer, White, Mayor Miller Noes: None Absent: Councilman Perry The ordinance was read the second time and Councilman Palmer moved that the ordinance be passed to its third reading. MR. KAY MILLER, representing Mr. Watt Schieffer, stated this ordinance would prohibit his client from continuing filling in his lot. The ordinance provisions were explained by the City Attorney. The Council, deferred action on allowing a refund contract between Water Control and Improvement District No. 9 and Barton View, Inc., until next week. Mayor Miller asked for information on the type of electric easement being retained on property to be deeded to Mr. Bascom Giles (property behind Delwood Shopping Center), as Mr. Giles thought there was to be a high-line going through the area. The Acting City Manager stated this was a guy-wire easement only, and that a group was out checking now to see about a rerouting of the line. Action on the sale of city-owned houses and outbuildings at 4100 Manor Road, 3514 Manor Road, and 4102 Manor Road was postponed until the Council could make an inspection of the buildings. MAYOR MILLER submitted the complaint of MR. GREGORY that a street light had been placed on his lot, and he did not want it located there. MR. HERBERT JACKSON made a report on this street light, giving the reason for its being located there. Councilman Bechtol stated he would contact Mr. Gregory about the light. M. CHOTE 2811-2817 San Pedro 2810-16 Salado Street From 1st Height & Area To 2nd Height & Area NOT Recommended by the Planning Commission MR. ARCH BRASWELL, Agent, and MR. WALTER CARRINGTON represented the applicants. Mr. Carrington wanted to build 16 unit, 2 bedroom apartments to rent to married university couples; that he did not want any zoning that would not permit this type of construction, as it would not be economically sound; that there would be plenty of off-street parking; cost of construction would be over $100,000; that the area is now classified as a high density area; the area between 19th and 26th Streets is already 90% 2nd Height and Area; the units would be as sound-proof as modern construction could make them; that if the area were zoned "B" Residence a developer could build a 30 room house and rent it to 60 single students. Mr. Braswell had described the building, and gave the advantages of such a development in the University Area. It was brought out the deed for street widening of Salado, requested some three years ago, was filed 3 weeks ago. Mr. Carrington stated he would be willing to sign a letter of intent or any instrument regarding this development. Opposition was expressed by MR. BILL CARSSOW, Attorney for MR. JAMES RICE, et al, and by MR. & MRS. O.W. REINMUTH, MR. WM. BURFORD, DR. EDENS, MRS. JOHN A. FOCHT, MRS. TIROFF, and others stating the change of zoning would result in further congestion of traffic; would ruin a quiet neighborhood composed of University professors, teachers, or graduate students; that there was no public need for apartments in this area; that 16 apartments could mean 32 cars; and that the property owners wanted to keep this a nich quiet high-class residential area. The Mayor stated in his opinion, since there was no interest in this zoning for three years, that it should start all over; that the deed for street widening was not delivered until May 24th. Councilman White suggested deferring consideration until next week. Councilman Palmer moved to postpone this until next week. It was noted there were deed restrictions, and Mr. Scarborough was asked if he would like to get these cleared through the Court before he went on with his zoning application. Mr. Scarborough stated this change was to permit renting the existing building to doctors, as it was hard to keep the apartments rented for residences, due to heavy traffic in the area. Councilman Bechtol moved to postpone decision for 60 days to give the applicants an opportunity to clear the deed restrictions and the property owners to be notified when this is brought up again. Opposition was expressed by MR. OLIVER W. HARBISON, stating that if this zone is permitted, others will want to put in a flower shop, garage workshop, etc., and that there are shopping centers near by where this shop could be located. Mrs. Drummond stated she had a shop in Cameron Village, but she had three children and wanted to move the shop to her home. The Director of Planning stated there were deed restrictions on this property. Councilman Bechtol moved that the application be denied. The motion, seconded by Councilman White, carried by the following vote: Ayes: Councilmen Bechtol, Palmer, White, Mayor Miller Noes: None Absent: Councilman Perry The Mayor announced that the change had been DENIED. MR. LLOYD DUTY, Attorney, and member of Knebel Post, American Legion, stated this post wanted to buy a place of its own and a service center to be utilized by the scouts, baseball, PTA, and any civic group that wanted to use the building. He listed some property that had been considered, and made inquiry of property that the City might have available for sale, stating the Post would be interested in four or five acres. The property at Berkman Drive and 51st Street was mentioned. The Mayor stated that this property at the head of the Airport was not available, but that the Council would be willing to try to locate some other land, and that it would look around and see what could be suggested. The Acting City Manager stated he had talked with Mrs. W. O. Whiteside about some property she wanted to lease for a little real-estate office, east of and adjacent to Mills Avenue between 34th and 35th Street. Councilman Palmer suggested that she make an offer. The Council recessed about 1:20 P.Μ. RECESSED MEETING 11:00 Α.Μ. Friday June 17, 1960 The meeting was called to order with Mayor Miller presiding. Roll call: Present: Councilmen Bechtol, Palmer, Perry, White, Mayor Miller Absent: None The Council discussed the possible sale of property at 25th and Lamar CITY OF AUSTIN. TEXAS. Boulevard. The City Attorney explained that the title to the property would be involved. The Mayor stated he would go look at the lot and see what it would be worth at this time. The Mayor suggested that on the sales of houses, that it might be well to consider adopting a policy to auction them rather than to advertise for bids. Councilman Palmer offered the following resolution and moved its adoption: (RESOLUTION) WHEREAS, bids were received by the City of Austin on June 14, 1960, for the sale of City-owned houses and outbuildings; and, WHEREAS, such bids had been repeatedly advertised; and, WHEREAS, M. J. Kouri submitted the highest and best bid in the amount of $527.87 on the six room frame house located at 4100 Manor Road; and, WHEREAS, H. E. Stanley submitted the highest and best bid in the amount of $117.00 on the 1 1/2 story seven room frame house and outbuildings located at 3514 Manor Road; and WHEREAS, M. J. Kouri submitted the highest and best bid in the amount of $727.87 on the two story frame house and outbuildings located at 4102 Manor Road; and, WHEREAS, the Director of Public Works has recommended the sale of such improvements to said bidders; Now, Therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That S. Reuben Rountree, Jr., acting City Manager, be and he is hereby authorized to execute contracts of sale for said houses and outbuildings at the above described locations with said bidders. FRANK DENIUS discussed further the contract for the minature train in Zilker Park. The Director of Recreation stated he had looked over the proposed route and he recommended the approximate lay-out. He said the Board also recommended this. The Acting City Manager stated the final design and location would have to be checked and approved. Percentages from the vending machines, souvenirs, etc. were also discussed. The Mayor suggested that since this project had been recommended by the Recreation Director and Parks and Playground Board, that the Council approve it subject to the specifications being worked out. It was decided that final approval of the contract be given next Thursday. The Mayor made an announcement that action of the Council 'gave portended approval of the contract next Thursday subject to approval of specifications, for this minature train, AUSTIN EAGLE RAILROAD.
