し し CITY OF AUSTIN, TEXAS: RESOLUTION CANVASSING RETURNS AND DECLARING RESULT OF ELECTION THE STATE OF TEXAS I CITY OF AUSTIN I COUNTY OF TRAVIS I ON THIS the 6th day of August, 1960, the City Council of the City of Austin, Texas, convened in Special session, at the regular meeting place thereof in the City Hall, there being present and in attendance the following members, to-wit: TOM MILLER MAYOR HUBERT BECHTOL COUNCILMAN EDGAR PERRY III LESTER PALMER BEN WHITE COUNCILMAN COUNCILMAN COUNCILMAN at which time the following among other business, was transacted, to-wit: Mayor Miller introduced a resolution canvassing returns and declaring result of an election held in the City of Austin on the 6th day of August, 1960. The resolution was read. Whereupon, it was moved by Councilman Bechtol and seconded by Councilman White that the resolution be finally passed and adopted, and said motion carried by the following vote: Ayes: Mayor Miller, and Councilmen Bechtol, Perry, Palmer and White. Noes: None. The Mayor then announced that the resolution had been finally passed and adopted. The RESOLUTION is as follows: "A RESOLUTION by the City Council of the City of Austin, Texas, canvassing returns and declaring results of a bond election held in said City on the 6th day of August, 1960, to authorize the issuance of bonds of the City of Austin; enacting provisions incident and relating to the purpose and object of this resolution and declaring an emergency." WHEREAS, under and by virtue of an ordinance duly passed by the City Council of the City of Austin, Texas, on the 7th day of July, 1960, an election. was held in said City on the 6th day of August, 1960, on eight propositions for the issuance of the bonds of said City of Austin, Texas, in the following amounts and for the following purposes, to-wit: CITY OF AUSTIN, TEXAS $28,000,000 revenue bonds for the purpose of extending and improving the City's Electric Light and Power System; $12,550,000 revenue bonds for the purpose of extending and improving the City's Waterworks System; $ 9,450,000 revenue bonds for the purpose of extending and improving the City's Sewer System; $ 500,000 general bbligation bonds for permanent public improvements, to-wit: constructing and improving municipal airport facilities and acquiring lands and equipment therefor; 150,000 general obligation bonds for permanent public improvements, to-wit: constructing, equipping and improving fire stations in and for the City of Austin and acquiring necessary lands therefor; $ 350,000 general obligation bonds for permanent public improvements, to-wit: enlarging and equipping the public free library system of the City and acquiring necessary lands for expansion thereof; $ 450,000 general obligation bonds for permanent public improvements, to-wit: constructing and improving public parks and public playgrounds of the City of Austin and for constructing, improving and repairing buildings and other recreation facilities of said parks and playgrounds, and for acquiring necessary lands and equipment therefor; $3,550,000 general obligation bonds for permanent public improvements, to-wit; constructing and improving streets including bridges, and drainage incidental thereto in and for said City of Austin and for acquiring necessary lands therefor; AND WHEREAS, on this the 6th day of August, 1960, there came on to be considered the returns of said election; and WHEREAS, upon consideration of the returns of said election, it appears that the same was in all respects legally held, after due notice and had been given, and that the said returns were duly and legally made; and, WHEREAS, it further appears from said returns that there were cast at said election 5567 votes on the proposition for the issuance of $28,000,000 revenue bonds for Electric Light and Power System Extensions and Improvements, of which number 3692 votes were cast "FOR THE ISSUANCE OF $28,000,000 REVENUE BONDS FOR ELECTRIC LIGHT AND POWER SYSTEM EXTENSIONS AND IMPROVEMENTS"; and 1875 votes were cast "AGAINST THE ISSUANCE OF $28,000,000 REVENUE BONDS FOR ELECTRIC LIGHT AND POWER SYSTEM EXTENSIONS AND IMPROVEMENTS"; and, WHEREAS, it further appears from said returns that there were cast at said election 5587 votes on the proposition for the issuance of $12,550,000 revenue bonds for Waterworks System extensions and improvements, of which number 3720 votes were cast "FOR THE ISSUANCE OF $12,550,000 REVENUE BONDS FOR ) ) ) ! | C CITY OF AUSTIN. TEXAS- WATERWORKS SYSTEM EXTENSIONS AND IMPROVEMENTS"; and 1867 votes were cast "AGAINST THE ISSUANCE OF $12,550,000 REVENUE BONDS FOR WATERWORKS SYSTEM EXTENSIONS AND IMPROVEMENTS"; and WHEREAS, it further appears from said returns that there were cast at said election 5585 votes on the proposition for the issuance of $9,450,000 revenue bonds for sewer system extensions and improvements, of which number 3761 votes were cast "FOR THE ISSUANCE OF $9,450,000 REVENUE BONDS FOR SEWER SYSTEM EXTENSIONS AND IMPROVEMENTS", and 1824 votes were cast "AGAINST THE ISSUANCE OF $9,450,000 REVENUE BONDS FOR SEWER SYSTEM EXTENSIONS AND IMPROVEMENTS"; and WHEREAS, it further appears from said returns that there were cast at said elèction 5601 votes on the proposition for the issuance of $500,000 general obligation airport bonds, of which number 3464 votes were cast "FOR THE ISSUANCE OF $500,000 GENERAL OBLIGATION AIRPORT BONDS"; and 2137 votes were cast "AGAINST THE ISSUANCE OF $500,000, GENERAL OBLIGATION AIRPORT BONDS"; and WHEREAS, it further appears from said returns that there were cast at said election 5584 votes on the proposition for the issuance of $150,000 general obligation fire station bonds, of which number 3799 votes were cast "FOR THE ISSUANCE OF $150,000 GENERAL OBLIGATION FIRE STATION BONDS"; and 1785 votes were cast "AGAINST THE ISSUANCE OF $150,000 GENERAL OBLIGATION FIRE STATION BONDS"; and WHEREAS, it further appears from said returns that there were cast at said election 5587 votes on the proposition for the issuance of $350,000 general obligation library bonds, of which number 3470 votes were cast "FOR THE ISSUANCE OF $350,000 GENERAL OBLIGATION LIBRARY BONDS"; and 2117 votes were cast "AGAINST THE ISSUANCE OF $350,000 GENERAL OBLIGATION LIBRARY BONDS"; and WHEREAS, it further appears from said returns that there were cast at said election 5604 votes on the proposition for the issuance of $450,000 general obligation park bonds, of which number 3390 votes were cast "FOR THE ISSUANCE OF $450,000 GENERAL OBLIGATION PARK BONDS"; and 2214 votes were cast "AGAINST THE ISSUANCE OF $450,000 GENERAL OBLIGATION PARK BONDS"; and WHEREAS, it further appears from said returns that there were cast at said election 5586 votes on the proposition for the issuance of $8,550,000 general obligation street improvement bonds, of which number 3719 votes were cast "FOR THE ISSUANCE OF $8,550,000 GENERAL OBLIGATION STREET IMPROVEMENT BONDS" and 1867 votes were cast "AGAINST THE ISSUANCE OF $3,550,000 GENERAL OBLIGATION STREET IMPROVEMENT BONDS"; and WHEREAS, the City Council considers that it is to the best interest of the City and its inhabitants that at the earliest possible date the City provide funds for such purposes, thereby creating an emergency measure for the immediate preservation of the public peace, health and safety of the citizens of the City; now therefore BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: SECTION 1: That the aforesaid election was duly and legally called and notice thereof given in accordance with the laws of the State of Texas and the ordinance calling said election; that said election was held in strict conformity with the Constitution and laws of the State of Texas, and the returns thereof ) =CITY OF AUSTIN, TEXAS. have been properly made to the officials of the City entitled to receive same; that only resident qualified property taxpaying electors of the said City of Austin, Texas, who owned property therein, subject to taxation, and who have duly rendered the same for taxation, were permitted to vote at said election; and, further that said election properly represents the desires of those qualified to vote as aforesaid. SECTION 2: That the proposition to issue the $28,000,000 revenue bonds for the purpose of extending and improving the City's Electric Light and Power System, was sustained by a majority of the qualified electors of said City, voting at said election, who own taxable property in said City, and who had duly rendered the same for taxation, and that the City Council of said City is authorized to issue said bonds and to provide for the payment of the principal of and interest on said bonds in the time and manner prescribed by law. SECTION 3: That the proposition to issue the $12,550,000 revenue bonds for the purpose of extending and improving the City's Waterworks System, was sustained by a majority of the qualified electors of said City, voting at said election, who own taxable property in said City, and who had duly rendered the same for taxation, and that the City Council of said City is authorized to issue said bonds and to provide for the payment of the principal of and interest on said bonds in the time and manner prescribed by law. SECTION 4: That the proposition to issue the $9,450,000 revenue bonds for the purpose of extending and improving the City's Sewer System, was sustained by a majority of the qualified electors of said City, voting at said election, who own taxable property in said City, and who had duly rendered the same for taxation, and that the City Council of said City is authorized to issue said bonds and to provide for the payment of the principal of and interest on said bonds in the time and manner prescribed by law. SECTION 5: That the proposition to issue $500,000 general obligation bonds for permanent public improvements, to-wit: Constructing and improving municipal airport facilities and acquiring lands and equipment therefor, was sustained by a majority of the qualified electors of said City, voting at said election, who own taxable property in said City, and who had duly rendered the same for taxation, and that the City Council of said City is authorized to issue said bonds and to levy and have assessed and collected taxes for the payment of the principal of and interest on said bonds in the time and manner prescribed by law. SECTION 6: That the proposition to issue $150,000 general obligation bonds for permanent public improvements, to-wit: constructing, equipping and improving fire stations in and for the City of Austin and acquiring necessary lands therefor, was sustained by a majority of the qualified electors of said City, voting at said election, who own taxable property in said City, and who had duly rendered the same for taxation, and that the City Council of said City is authorized to issue said bonds and to levy and have assessed and collected taxes for the payment of the principal of and interest on said bonds in the time and manner prescribed by law. SECTION 7: That the proposition to issue $350,000 general obligation bonds for permanent public improvements, to-wit: enlarging and equipping the public free library system of the City and acquiring necessary lands for expansion thereof, was sustained by a majority of the qualified electors of said ت ) CITY OF AUSTIN, TEXAS City, voting at said election, who own taxable property in said City, and who had duly rendered the same for taxation, and that the City Council of said City is authorized to issue said bonds and to levy and have assessed and collected taxes for the payment of the principal of and interest on said bonds in the time and manner prescribed by law. SECTION 8: That the proposition to issue $450,000 general obligation bonds for permanent public improvements, to-wit: constructing and improving public parks and public playgrounds of the City of Austin and for constructing, improving and repairing buildings and other recreation facilities of said parks and playgrounds, and for acquiring necessary lands and equipment therefor; was sustained by a majority of the qualified electors of said City, voting at said election, who own taxable property in said City, and who had duly rendered the same for taxation, and that the City Council of said City is authorized to issue said bonds and to levy and have assessed and collected taxes for the payment of the principal of and interest on said bonds in the time and manner prescribed by law. SECTION 9: That the proposition to issue $8,550,000 general obligation bonds for permanent public improvements, to-wit: constructing and improving streets including bridges and drainage incidental thereto in and for said City of Austin and for acquiring necessary lands therefor, was sustained by a majority of the qualified electors of said City, voting at said election, who own taxable property in said City, and who had duly rendered the same for taxation, and that the City Council of said City is authorized to issue said bonds and to levy and have assessed and collected taxes for the payment of the principal of and interest on said bonds in the time and manner prescribed by law. SECTION 10: That the public importance of this measure and the fact that it is to the best interest of the City and its inhabitants to provide funds for the improvements hereinabove set out, at the earliest possible date for the immediate preservation of the public peace, health and safety of the citizens of the City of Austin, Texas, constitutes an emergency and an imperative public necessity that this resolution shall take effect and be in full force immediately upon its passage, all ordinance and charter rules governing the effective date of any resolution are hereby suspended and this resolution shall take effect and be in force and effect from and after its final passage, and it is so resolved. Eskew City Attorney, City of Austin, Texas درد : CITY OF AUSTIN, TEXAS Councilman Palmer expressed appreciation of the Council and the Administration to the people of Austin for the vote of confidence, and pledged that the money would be spent wisely and judiciously, and only when needed. Councilman Bechtol stated that this was a vote of confidence in the administration of the city, and he wanted to commend the administration in the manner in which they took the bond program to the people. Councilman White stated that Mr. Williams had gone out and made many appearances all over the City, and he was due about seven-eighths of the credit on this issue. The City Attorney noted that in Precinct 321, the key to Ballot Box No.3 and Ballot Box No. 2 were crossed up, and the City Clerk was given the key to Ballot Box No. 3 with the request that she deliver it to the Sheriff and get the other key back. There being no further business, Councilman Bechtol moved that the Council adjourn. The motion, seconded by Councilman Perry, carried by the following vote: Ayes: Councilmen Bechtol, Palmer, Perry, White, Mayor Miller Noes: None The Council adjourned at 10:35 P.M., subject to the call of the Mayor.
