Councilman White offered the following resolution and moved its adoption: (RESOLUTION) WHEREAS, Richard Schmidt and Adolph Schmidt are the Contractors for the demolition of a building located at 212 West 7th Street and desires a portion of the sidewalk and street space abutting lots 1 and 2, Block 82, of the Original City of Austin, Travis County, Texas, during the demolition of the building, such space to be used in the work and for the storage of materials therefor; therefore BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: 1. THAT the above privileges and allotment of space are granted to the said Richard Schmidt and Adolph Schmidt, hereinafter termed "Contractor", upon the following express terms and conditions: (1) That the Contractor shall erect and maintain continuously in good condition during the use of said space hereby allotted, a substantial walkway at least 4 feet wide in the clear on the inside and at least 8 feet high. The same to be covered solidly on the street side with boards to a height of 4 feet above pavement and on the building side to be covered solidly with boards to a height of 8 feet. The top of the walkway shall be covered solidly with boards at least 2 inches thick, which shall be supported at intervals sufficiently close to prevent sagging of the roofing boards. The roof of said walkway shall be covered with a roofing material which will prevent leaking of the roof and provide a dry walkway at all times. No wood strips or obstructions of any kind shall be permitted along the pavement within the walkway, and at any time in the opinion of the City Officials it becomes necessary for any reason to install a board floor within the walkway the Contractor shall upon notice from the Building Inspector immediately place such a wood floor and substantially support same to prevent sagging under load. (2) That the Contractor is permitted to construct in his working space a substantial gate which shall be kept closed at all times when not in use, and at all times that such gate is open, the Contractor shall maintain a person at this gate to warn pedestrians and vehicles of approaching trucks. This gate is not to open out so as to impede vehicular or pedestrian traffic. (3) That no vehicles in loading or unloading material at the working space shall park on any part of the street outside of the allotted working space. (4) That "No Parking" signs shall be placed on the street side of the barricades. (5) That the Contractor is permitted to construct a temporary work office =CITY OF AUSTIN. TEXAS. こ within such allotted working space provided such work office is not within 25 feet of any such corner street intersection. (6) That the Contractor shall in no way obstruct any fire plugs or other public utilities in the construction of such barricades. (7) That provisions shall be made for the normal flow of all storm waters in the gutter and the Contractor will be responsible for any damage done due to obstruction of any such storm water. (8) That the Contractor shall place on the outside corners of any walkway, barricades or obstructions, red lights during all periods of darkness and provide lighting systems for all tunnels. (9) That the Contractor shall remove all fences, barricades, loose materials and other obstructions on the sidewalk and street immediately after the necessity for their existence on said sidewalk or street has ceased, such time to be determined by the City Manager, and in any event all such sidewalk, barricades, materials, equipment and other obstructions shall be removed not later than February 21, 1961. (10) That the City reserves the right to revoke at any time any and all the privileges herein granted or to require the erection or installation of additional barriers or safeguards if the conditions demand it. (11) That the use and enjoyment of the spaces herein granted shall not be exclusive as against public needs, and the City, in making such grant reserves the right to enter and occupy any part or all of said space any time with its public utilities, or for other necessary public purposes. (12) That any public utility, or public or private property disturbed or injured as a result of any of the activities necessary for the completion of the construction work for said building projects, whether done by the Contractor, City Forces, or public utilities, shall be replaced or repaired at the Contractors expense. That the Contractor shall furnish the City of Austin a surety bond in the sum of Two Thousand Dollars ($2,000) which shall protect, indemnify and hold harmless the City of Austin from any claims or damages to any person or property that may accrue to or be brought by any person by reason of the exercise or abuse of the privileges granted the Contractor by the City of Austin and shall guarantee the replacement of all sidewalks, pavement and all other public property and public utilities disturbed or removed during the construction work and shall further guarantee the construction of a walkway and other safeguards during the occupancy of the space. Councilman White offered the following resolution and moved its adoption: (RESOLUTION) WHEREAS, after an engineering and traffic investigation, the City Council has found that the circumstances are such that the maximum reasonable and safe speed for the operation of vehicles at the following location is greater than thirty (30) miles per hour; and, WHEREAS, after said investigation the City Council has found that the maximum reasonable and safe speed for the operation of vehicles is thirty-five (35) miles per hour at the following location: and, ON STREET FROM TO East Riverside Drive East line of Summit Street City limit line east of Parker Lane WHEREAS, after an engineering and traffic investigation the City Council has found the present maximum reasonable and safe speed for the operation of vehicles is fifty (50) miles per hour at the following locations: ON STREET East Riverside Drive East Riverside Drive Now, Therefore, FROM City Limit Line west of Kirksey Drive TO City Limit Line at Country Club Road City Limit Line City Limit Line east at Clubview Avenue City Limit Line east of easterly Vargas Road BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That the City Clerk be authorized and instructed to record this finding in Section 33.40 of the Traffic Register. He pointed out the location, stating the area was entirely removed from any present part of the city, and that a portion of the highway to the subdivision would have to be annexed, and that the area could not now be served by sewer. He stated the ت =CITY OF AUSTIN, TEXAS. subdivider had requested that the subdivision be brought in the city. The Director of Planning stated this was an approved and recorded subdivision with plat restrictions prohibiting the use of the property until water and sewer were available. The City Manager said it would be from two to four years beforesewer would be available. The Water Superintendent stated if the developer, Mr. Puett, wanted to put in an approach water main, it would be around $50,000. The exclusive distributor for this area is Girard Machinery andSupply Company of San Antonio. "Invitation to bid was sent to two other machinery dealers, but the only bid received was from Girard Machinery at a price including trade in of the City's 1954 machine at price of $30,097.00 less a 2% cash discount of $601.94 in 10 days. "It is recommended that order be awarded Girard Machinery and Supply Company for this machine. "W. T. Williams, Jr., City Manager" The Director of Public Works described the machine and the type of work it could do. The Council discussed the purchase of the machine, the work it could do in comparison to other machines, and the price. Councilman White offered the following resolution and moved its adoption: (RESOLUTION) WHEREAS, bids were invited by the City of Austin for the furnishing of The Warner-Swazey Company of Cleveland, Ohio, excavating and grading machine for use by the Street and Bridge Division of the City of Austin; and, WHEREAS, the bid of Girard Machinery and Supply Company, the only maker of such machine, in the sum of $29,495.06 and trade-in was the only bid received; and the acceptance of such bid has been recommended by the City Manager; Now, Therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That the bid of Girard Machinery and Supply Company in the sum of $29,495.06 be and the same is hereby accepted, and W. COUNCILMAN WHITE stated the Optimist Club that had been selling Christmas trees along Lamar from 28th to 27th Street had requested that they be permitted to sell the Christmas trees at that site again. Councilman White moved that they be granted permission to use that location. DAVID BARROW made a report to the Council regarding the matter the Council had referred to the Planning Commission concerning the inclusion of beauty shops in "A" Residence District. He stated it had been suggested that beauty shops be allowed in "A" Residence under special permits, but the Planning Commission, after consideration, recommended that it would be better to permit the shops in "A" in ever case where they met certain requirements, and listed those requirements as follows: Beauty Shop, subject to the following conditions: (1) It be located within or attached to the main dwelling. (2) It be operated by members of the resident family with no outside employees. (3) It not utilize more than twenty-five percent of the gross floor area of the residence structure, but not to exceed three hundred square feet. (4) That there be no signs, advertising devices or displays to create outside the building any external evidence of the beauty shop operation. (5) That one off-street parking space for customers be provided in addition to that required for the residence. This shall not be located within the required front yard or side yard along a street. The Council discussed the matter in great detail with the City Attorney, the Planning Director, and Building Inspector. Councilman Bechtol moved that the City Attorney be instructed to prepare an ordinance amending the present ordinance along the suggestions of the Planning Commission, and that the Planning Commission be congratulated for again coming up with a fine suggestion. The amount is $5,443.55 above the original contract based on unit prices quoted in the bid. VIC MATHIAS, Secretary, and MR. TOM PERKINS, member of the Industrial Relations Committee, of the Chamber of Commerce, to present their plan of attracting industry to Austin, since the City also had that as an objective. MR. PERKINS submitted the colorful brochure which he believed would meet competition in the field, and would attract attention of the person to whom the brochure is sent. He stated outside funds had been raised, but the Chamber of Commerce needed help on the printing. He submitted a written request, pointing out that Chamber of Commerce would print the color cover, furnish plastic binders, provide copy for insert material on all sections except those to be furnished by the City and University, make finished copies available to City officials and departments, and conduct direct mail campaigns to prime industrial prospects encouraging them to locate in Austin. The request was that the City print insert and index pages for brochures from copy supplied by Chamber, the number of copies of each sheet would vary depending on how soon it would be outdated. Maximum number of prints of any individual sheet at this time would be 2,500. He asked that an agreement be made with the City whereby the City print shop would reproduce needed copies of above material as supply is depleted. The Council discussed the matter of attracting industry, generally, and of using this brochure in conjunction with the Chamber of Commerce The City Manager discussed the scheduling of this printing to fit in with the schedules of the Print: Shop. After discussion, Councilman White moved that the City Manager be authorized to work along with the Chamber of Commerce in the preparation of this matter and the printing of it to be fitted in with the City's schedules. GREER, Engineer of Traffic of State Highway Department, and immediate Past Member of the Board of Directors of the Institute of Traffic Engineers, paid tribute to the Council, the City Manager, and the Traffic Engineer for a job well done, and stated the City was fortunate in having a gentleman like MR. WALTER KLAPPROTH as its Traffic Engineer. Mr. Greer presented on behalf of the Institute of Traffic Engineers, an award to MAYOR PRO-TEM PALMER who in turn presented it to theCity Manager for the Traffic Engineer. MR. DON HILL, Director of the National Safety Council presented awards for Maintaining Accident Records, and for Police Traffic Supervision, which were accepted by POLICE CHIEF MILES, CAPTAIN BIGGERSTAFF, and LIEUTENANT FANN. Also presented was an award on School Safety Education presented to MR. JOHN KEEL, Director of Safety Education in the Austin Public Schools. MR. TRAVIS LARUE, Citizens Traffic Safety Committee was present. MR. HILL submitted the Annual Inventory of Traffic Safety Activities, in which the City of Austin had special recognition, and the points of excellence, the areas that needed improvements, and submitted suggestions. MR. SAEGERT, Chamber of Commerce, was present representing the Citizens Safety Council. The Mayor Pro-tem thanked Mr. Greer and Mr. Hill for presenting the awards and this report. SHANE, Mayor Pro-tem Palmer asked that the Department of Public Works make a check of the drainage problem at 2511 Woodmont Councilman White asked that the drainage problems at 10ll Possum Trot be checked. This is the property of MRS. CATHERINE SMOTHERS. The Assistant City Manager submitted a letter to be sent by Mayor Pro-tem Palmer regarding recertification of the workable program. After discussion, Councilman Bechtol moved that the City Attorney be permitted to dispose of the forty-one (41) copies of the property-owners list at $100.00 per copy. The motion, seconded by Councilman Perry, carried by the following vote: Ayes: Councilmen Bechtol, Perry, White, Mayor Pro-tem Palmer Noes: None Absent: Mayor Miller The Assistant City Manager brought up for discussion the Auditorium Concession, stating MR. VINCE LAROCCA who was interested in taking the concession, was working out the details of financing. He said Mr. LaRocca would pay the same percentage as provided in the present contract, 25%. Additional percentages to apply on the equipment were discussed. Finally, it was suggested that the 25% be paid as now provided; that 2% be paid the first year on the principle for the equipment; three percent for the next two years, and the unpaid balance due on or before January 1, 1964, at five percent (5%) interest. Councilman Bechtol moved that the City Manager be instructed to enter into this contract with MR. LAROCCA, and that the unpaid balance on equipment be due January 1, 1964.
