135 135 CITY OF AUSTIN, TEXAS MINUTES OF THE CITY COUNCIL CITY OF AUSTIN, TEXAS Regular Meeting February 09, 1961 10:00 Α.Μ. Council Chamber, City Hall The meeting was called to order with Mayor Pro-tem Palmer presiding. Roll call: Present: Councilmen Bechtol, Perry, White, Mayor Pro-tem Palmer Absent: Mayor Miller Present also: W. T. Williams, Jr., City Manager; Doren R. Eskew, City Attorney; Reuben Rountree, Jr., Director of Public Works; Robert A. Miles, Chief of Police Invocation was delivered by DR. FRED BROOKS, Pastor Emeritus, First Presbyterian Church. MR. SHERMAN BIRDWELL, Cooks Funeral Home, spokesman for a majority of the white funeral homes in Austin, proposed that some type of regulation or ordinance be passed that would provide that the ambulance service nearest an accident or for an occasion requiring emergency service be called by the Police Department. He read a petition signed by three of the five white funeral home directors, reviewing the agreement to a rotation system for handling emergency ambulance calls, and listed the unsatisfactory items of this system, and suggested a zoning plan be established whereby the ambulance nearest the accident be used. Opposition was expressed by MR. VILLASENOR, Mission Funeral Home, who said after studying the situation to where his Funeral Home was involved, he saw that it would be best for him at this time to oppose the zoning system. MR. JACK CORLEY, Weed-Corley Funeral. Home, stated he thought the zoning system would best serve the citizens of Austin, and made reference to two specific cases in his neighborhood, where his firm was not allowed to make an emergency call, as in one case the South Austin firm was making it, and in the other, the Mission Funeral Home from East Austin had been cleared to make the call. MR. CLAY, Wilke-Clay, favoring the zoning system, said the Funeral Homes did not rely on ambulance business to make a living. MR. JOE MANOR, Hyltin-Manor, opposed the zoning system, stating it was not workable in cities using it, and many cities were not using the system at all. He said the rotation plan was working fairly well, and described the method used now. He stated that zoning ambulance service was interferring with private enterprise. MR. BOB LONG, Attorney for Mr. Manor, opposed a zoning proposal and stated they were opposed to the governing body's dividing up business and dividing men's dollars. He said the Council could regulate speeds and enforce traffic laws, but that was all it could do with reference to ambulances. The City Attorney CITY OF AUSTIN, TEXAS 136 136 explained there was no provision in the ordinance to which reference had been made to the rotation plan, which was a voluntary agreement between those operating ambulance services. He explained the provisions of the ordinance as pertain- ed to emergency and non-emergency runs; and he discussed briefly provisions of a draft of an ordinance. No action was taken by the Council at this time. Mayor Pro-tem Palmer stated the Council would look into this and see what could be worked out, and inquired if there was any hope that the ambulance operators could work it out on a voluntary basis. Mr. Birdwell said three out of five were in favor of the zoning system already. Councilman White stated he saw no reason why they could not get together and all work out their own proposition. 11 The Council opened the hearing on the appeal of MILTON TURNER from the Planning Commission decision on granting a Special Permit for the City of Austin Service Center. The City Manager pointed out the need for such a center in the area, and described the types of service that would be furnished from this site, and the types of equipment that would be located there. The Director of Public Works displayed a plat showing areas to be sodded, location of planting strips, etc. The Director of Planning listed the conditions to be met. MR. BOB SNEED, representing MR. MILTON TURNER who owned property on two sides of this proposed center, opposed the location at this site, as it would mean the installation of either an industrial usage or commercial usage in an area in its entirety "A" residential. Objection was expressed also on the fact this heavy equipment would be leaving the center during the same time the small children would be leaving and returning from school, and opposition was made to a temporary paving rather than permanent type of paving on this narrow street. Mr. Sneed asked that this proposed installation be looked at, not on the basis that it is the City of Austin, but on the basis as if it were a private concern, because the effect on the adjoining property owners would be the same. He said it was their feeling that this would be the same as granting a "D" Industrial Zone, and asked that the special permit be denied. MR. CECIL ROTSCH, representing MRS. WALDO FORSTER, opposed the granting of the special permit on the grounds it would be detrimental to her home. He complained about the existing water tower and its appearance; of the ground sloughing off and causing soil to wash off the Forster property; of the ugly manner in which the site had been kept; and he asked that the Council deny placing this Center in the residential section. MAYOR PRO-TEM PALMER stated the character of South Ist Street is changing, and residential use would not be considered the highest and best use for this neighborhood, and the property would become more valuable as commercial. The City Manager pointed out the advantages to the neighborhood that placing this Center would effect; and stated as to any other site, there was a tremendous area in South Austin which is residential, and this particular location is somewhere near the center. MR. W. A. McANGUS, representing the Dave McAngus Estate, agreed that the site needed beautifying and a fence. MRS. ELLIS, who had eleven rent houses and 10 acres on South 2nd and Center, was present. The Council agreed to meet the group at 2:00 P.M. this date. MR. HERBERT MEYER, spokesman for a group, read a petition signed by property owners and renters in the 800 and 900 blocks on West 6th Street requesting two-hour parking on West 6th. He asked that each block be considered separately. Mr. Meyer was asked if the group would object to one-hour parking meters, and Mr. Meyers replied that would be fine. Mayor Pro-tem Palmer stated the Council would check with the City Manager and see what can be worked out on this. _ CITY OF AUSTIN, TEXAS 137 137 MR. EUGENE HENRY appeared to inform the Council of his plans for establishing the Industrial Enterprise and later the Industrial Rehabilitation Center for men and women that are being released from Prison and who want to better themselves; or for alcoholics who want to be helped with their drinking problems. He described the operations to be conducted in the center, and showed plans of the buildings. There will be a body fender and paint shop; welding shop, heavy equipment repair shop. Mr. Henry asked for any suggestions the Council might offer. The City Attorney made inquiry as to his complying with the zoning ordinance, and Mr. Henry stated he had checked into this and was in compliance. Mayor Pro-tem Palmer stated it was certainly a worthwhile project. The Chief of Police said he was for anything that would provide a livable wage and opportunity for these people. Mr. Henry explained the manner in which the people would be selected. The City Attorney explained the Solicitation Ordinance provisions. Mayor Pro-tem thanked him for coming down. MR. BOB ARMSTRONG appeared before the Council and made the following statement: "Upon my return after a week's absence from Austin recently, I heard that it had been announced that I was a possible candidate for the City Council. "From the personal visits, letters, telephone calls and the numerous names on the petitions that have been circulated urging me to be a candidate, I have decided to comply with my friends' wishes. "I have lived in Austin for 41 years and never expect to live anywhere else. "I hereby pledge my total cooperation with the other elected councilmen for the betterment of our good city. "I would like to state that I am not representing any individuals or special interests. "Since Hub Bechtol is not running for re-election, I am filing for that place." The Council recessed until about 2:30 P.M. Recessed Meeting At 2:30 P.M. the Council resumed its business. The 2:30 Ρ.Μ. Councilman Bechtol announced that next Thursday, February 16th, at 2:00 P.M. the University of Texas School of Architecture would have models on the Lake Front Development for display at the Auditorium, and the Recreation Department, the Recreation Board, Planning Department and Planning Commission are in- vited to be present. This is a joint display by the Planning Department and the School of Architecture. _ CITY OF AUSTIN, TEXAS 138 138 The Council received a petition regarding a little foot bridge at Sarah Drive and Berger Street across Boggy Creek, and referred it to the City Manager. Councilman White moved that the minutes of the meeting of February 2, 1961 be approved. FRANK DENIUS displayed a plat showing changes made in the location of the minature train track of the Austin Eagle Railroad, stating this change had been approved by the Director of Recreation subject to approval by the Council. He stated he would be back with the specific plans. The Mayor Pro-tem stated this plan was the better plan. Mr. Denius stated the train would be in operation by April 1st. MR. ALLAN RUSSELL, Austin Baseball Club, explained some of the business matters of the Club regarding baseball for the coming year, and some proposed changes he would like to put into effect. He listed some items which needed repairing--bleachers were rough, fence needed repairs, and the roof needed to be fixed. He said vandals were tearing the fence down, and breaking the lights. He asked that some concession be made on the rent. Mayor Pro-tem Palmer asked if someone could be assigned to check the condition of the fence, roof, and places that needed repairing, and get a tentative estimate on what expense was to be expected. He told Mr. Russell that the utilities would have to be paid out of the ticket sales. Councilman Bechtol inquired about the arrangement with Mr. Russell and the Junior High Schools in using the ball field during the winter Mr. Russell stated only very minor damage had been done to the field. Councilman Bechtol stated this could be repaired and the School System would take care of that part. The Director of Public Works was asked to check the needed repairs. Later in the meeting, Councilman Perry moved that MR. ALLAN RUSSELL be granted permission to use the ball park for sponsoring the Championship fight on March 13th. RUSSELL stated he would get more information to submit on his request to use the Ball Park for a Rodeo, for which the Ball Club would receive 10% of the gross. Councilman White moved the Council grant MRS. CLAUDIA McPHAUL permission to withdraw the following zoning application: MRS. CLAUDIA MCPHAUL 3414 (3502) E. 12th Street From "A" Residence To "B" Residence NOT Recommended by the Planning Commission. Reuben Rountree, Jr. Director of Public Works" Councilman Perry offered the following resolution and moved its adoption: (RESOLUTION) WHEREAS, bids were received by the City of Austin for the construction of three reinforced concrete culverts and open channel excavation in connection with two, being located on Joe Sayers Avenue at Theckla Terrace Easement and on East 17th and East 18th Streets between Maple Avenue and Singleton Avenue Contract Number 61-D-1; and, WHEREAS, the bid of Miller's Concrete Contractors, in the sum of $9,700.00, was the lowest bid therefor, and the acceptance of such bid has been recommended by the Director of Public Works of the City of Austin, and by the City Manager; Now, Therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That the bid of Miller's Concrete Contractors, in the sum of $9,700.00, be and the same is hereby accepted, and W. T. Williams, Jr., City Manager of the City of Austin, is hereby authorized to execute a contract on behalf of the City of Austin with Miller's Concrete Contractors. Councilman White moved that the City Manager be instructed to have an ordinance drawn prohibiting loitering and fishing from all bridges across the Colorado River. The motion, seconded by Councilman Perry, carried by the following vote: Ayes: Noes: Councilmen Bechtol, Perry, White, Mayor Pro-tem Palmer None Absent: Mayor Miller The Council discussed improvements on the bridges, and it was suggested that the City Manager investigate and report back in two weeks on his ideas and how the improvements should be done. Councilman Bechtol moved that the City Manager be instructed to install one Longhorn-Chisholm Trail Plaque at each end of the new Low Water Dam on the buttresses on each end of the west side of the dam at the south and north ends of the dam, adjacent to the plaque at the north end and to the west of the plaque and at the other end about equal height. The motion lost for lack of a second. Mayor Pro-tem Palmer asked that before they were placed, that the location on the north side be checked again, as he believed the plaque would be hidden. Councilman White stated he would recheck. The City Manager explained the Recommendation of the Director of Nurses to the Hospital Board, regarding recommended changes in tuition and fees, dated January 27, 1961. He stated it was desired to put these into effect for the September 1, 1961 class. He explained the proposed policy on contracts for Nurses' Training. The Council took no action at this time. The Council discussed the recommendation of the Administrator of the T. B. Sanatorium, the Hospital Administrator, and the Board to increase the rates for certain rooms at the T. B. Sanatorium. The City Manager stated there were 24 rooms involved here. Councilman Perry moved that the recommendation of the T. B. Sanatorium Hospital Administrator, Hospital Advisory Board, Hospital Administrator, and the City Manager, be accepted. The motion lost for lack of a second, as the Council wanted to postpone action until next week. Councilman Bechtol moved that the City of Austin join the UNITED STATES CONFERENCE OF MAYORS, and that the dues of $500.00 for 1961-1962 be remitted. The motion, seconded by Councilman White, carried by the following vote: Ayes: Councilmen Bechtol, Perry, White, Mayor Pro-tem Palmer Noes: None Absent: Mayor Miller Councilman White suggested that each year this be brought before the Council for approval. CITY OF AUSTIN, TEXAS 146 146 Mayor Pro-tem Palmer read a letter received from one outside the United States, and the letter was referred to the Police Department. The Council again discussed the property for the South Austin Service Center. No decision was made. The City Manager called attention to the filing of the STATUS OF WATER AND SANITARY SEWER CONTRACT PROJECTS AS OF FEBRUARY 1, 1961, and the STREET PAVING SUMMARY, FISCAL YEAR 1960-61. The City Manager reported a problem involved with the gravel operation down the river, which was under contract at the time the area was annexed. The City Attorney stated all of this was in the contract between the City and Mr. Zachry, and the property was leased for a certain purpose, and Mr. Zachry was told exactly how the operation could be done, and where he could run the gravel; that everything was spelled out in the contract, and all of that was done before the property was annexed. The City Manager stated this was a temporary operation. Councilman Bechtol brought up the matter of contracting a line do BluffingIt ton; and that on April 1st, Mr. Zachry intends to start dredging upstream. was his understanding this new line coming from Bee Creek Road would be under way by the time the dredging started. He stated the contract provided that the Construction Company was to salvage the existing line, and the time schedule is getting close. He asked the City Manager to check into this. The Council discussed paving the 13th Street Alley between Nueces and Rio Grande, and the Crestwood Road Serviceway. The City Manager recommended vacating the public interest in the alleys that are being used as thoroughfares rather than alleys, and letting the property owners close the alley and stop the traffic. The property owners could either leave the alley open; they could close one end, or could close the alley in the middle, and still stop the traffic. Mayor Pro-tem Palmer suggested that the property owners bring in a request to vacate the alley. The City Manager stated a check would be made with the Fire Chief to see if he would need to bring his vehicles in through the alley. Discussion also was the paving of the alley between East Avenue and Comal, south of Manor Road. The Director of Public Works pointed out that Comal Street was scheduled in the next paving program, and the paving of this street together with the alley would be a little hard on the property owners. He was asked to contact Mr. Fritz Bollman and explain this matter, and suggest that the best way would be for them to pave on a voluntary basis. The City Attorney displayed a plat of the Brackenridge Tract, showing an area of about eleven acres, which the University would like to have released so the President's home could be built on the location. Also there is a step-down transformer bank located on part of the land not being used for golf course purposes. The City Attorney stated this would not be needed after July 1962, This location is approximately where Robin Hood and Raleigh come into Enfield Road. He stated the University would like to have this release to them. CITY OF AUSTIN, TEXAS 142 147 Councilman Perry offered the following resolution and moved its adoption: (RESOLUTION) WHEREAS, the Board of Regents of the University of Texas has agreed to the location of a stepdown transformer bank on a certain tract of University owned property; and, WHEREAS, the Board of Regents of the University of Texas has requested that the City of Austin execute an Agreement concerning the location of such stepdown transformer bank; Now, Therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That W. T. Williams, Jr., City Manager, be and he is hereby authorized and directed to execute an Agreement in accordance with the terms and provisions of a certain Agreement, a copy of which is attached to this Resolution, and marked by the City Clerk for purposes of identification, and the City Clerk is hereby directed to file for permanent record in the office of the City Clerk the attached copy of said agreement without recordation in the Minutes of the City Council. The motion, seconded by Councilman Bechtol, carried by the following vote: Ayes: Councilmen Bechtol, Perry, White, Mayor Pro-tem Palmer Noes: Absent: None Mayor Miller Councilman Perry offered the following resolution and moved its adoption: (RESOLUTION) WHEREAS, by instrument dated May 31, 1924, the Board of Regents of the University of Texas leased a portion of the land known as the Brackenridge Tract to the City of Austin for use as the Austin Municipal Golf Course; and, WHEREAS, the University of Texas is presently desirous of constructing a new home for its President at the southwest corner of the intersection of Enfield Road and Exposition Boulevard, in the City of Austin; and, WHEREAS, the City Council of the City of Austin deems it to be in the public interest to release the area necessary for the construction of such new home for the President of the University of Texas from the terms of the aforementioned lease; Now, Therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That W. T. He stated that building permits should not be issued on this property and that the possibility of buying the property should be investigated. After discussion, Councilman Bechtol moved that the City Manager be instructed to explore the idea and get some prices on the acquisition of that land, and tell the Building Inspector's Office to withhold building permits stating that the City is interested in асquiring the property. CUNNINGHAM from Louisiana had contacted the Electric Utilities Director regarding the old generator, stating the Westinghouse representatives and others said it did meet the representations that the City had made, and they were ready to take it and wanted an invoice. The City Manager read a letter received in reply to one mailed out, regarding the small generators, and the 1934 unit. This letter listed several ways to sell the generator, and this dealer wanted the exclusive right. Councilman Bechtol moved that the Council accept the offer made by MR. CUNNINGHAM, for the 1929 model generator.
