Council Chamber, City Hall The meeting was called to order with Mayor Pro-tem Palmer presiding. Roll call: Present: Councilmen Bechtol, Perry, White, Mayor Pro-tem Palmer Absent: Mayor Miller Present also: W. T. Williams, Jr., City Manager; Doren R. Eskew, City Attorney; Reuben Rountree, Jr., Director of Public Works; Robert A. Miles, Chief of Police. Councilman White moved that the Council approve the Minutes of the Meetings of February 23, 1961, and of March 1, 1961. The motion, seconded by Council man Perry, carried by the following vote: Ayes: Councilmen Bechtol, Perry, White, Mayor Pro-tem Palmer Noes: None Absent: Mayor Miller The City Manager asked for clarification of the length of time of the lease with the Red Cross. Councilman Bechtol stated all had agreed that the area was changing, and that if the five year period would be satisfactory, the lease be drawn for that period; but if not, the lease could be made for ten years. Councilman White moved if the five year period were not satifactory, that the contract could be made for a ten year period. FRANK DENIUS submitted final plans of the AUSTIN EAGLE RAILROAD track through Zilker Park. Discussion was held on the advisability of a fence between the track and the little play area; about the cut of the tunnel; about the depth of the tunnel being enough to keep the contour of the ground about the same or not over four feet; about a suggestion of constructing the little station in keeping with the construction of the other buildings, or a wooden building designed as an old type of depot; and other items. Councilman Bechtol moved that subject to the conditions set forth in the contract, that the lay-out by the AUSTIN EAGLE RAILROAD be authorized. BEFORE THE CITY COUNCIL OF AUSTIN, TEXAS =CITY OF AUSTIN, TEXAS 213 213 APPLICATION FOR INCREASE IN RATES "TO THE HONORABLE MAYOR AND CITY COUNCIL: "The Yellow Cab Co. of Austin, Inc., and Checker Cab Co. of Austin, Inc., jointly and severally, respectfully file this their application for an increase in rates to be charged for the transportation of passengers for hire within the city limits of Austin, and as a basis therefor would show the Council: 1. "The rates now authorized and required under the ordinances of the City of Austin for taxicab transportation are presently below that authorized and charged in cities of comparable size and under comparable conditions. 2. "The applicants herein would show that, at the rates now authorized and required, the cost of operation exceeds the income from the transportation of passengers, although their operations have been efficiently and carefully run in a businesslike manner. 3. CHARLES HERRING, represented the Yellow Cab Co. of Austin, Inc., and Checker Cab Co. of Austin, Inc., in making a request for change of rate to drop CITY OF AUSTIN, TEXAS 214 214 the one and a fourth mile at .454 to two-thirds of a mile for .454 and leaving the remainder of the rates as they are now. He said the two companies were owned by MR. K. M. FISHER and MR. J. P. FISHER, and there are 55 cabs operated. Mr. Herring estimated the capital assets invested in Austin somewhere between $150,000 and $200,000. He said this business was a $535,447 operation in Austin for the last fifteen months' period, and was showing a loss in operation of $10,136. He stated the rates now in effect were established in 1954. He had statistics of increased costs in gas and oil, repair and maintenance, tires, taxes, insurance, and normal increases of 1960 over 1959. Mr. Herring listed percentage figures on expenditures and revenues for the last three years, showing a gradual increase in 1960 of cost of operation which went up faster than the revenue, as follows: Using 1957 as base period 100%: Year 1958 1959 1960 Revenue 116.29% 134.42 139.59 Expenditure 119.89% 128.23 144.95 Mr. Herring stated the proposed rate would be lower than all of the towns on which comparison was shown in the chart, even if the increase were granted at the two mile limit. The rates would still be five cents less than those cities listed. Mr. Herring said he believed an increase was justified, and listed the distribution of the increase as 40% would go for labor; 2% gross receipts tax to the City; and 58% to the Companies so they could try to bring the operating income above the operating expenses. Mayor Pro-tem Palmer inquired if any company had opposition to this change of rate. MR. ROY VELAQUES stated he agreed with the 45 charge for the first two-thirds mile. In discussing the gasoline and oil increases, Councilman Bechtol asked if these figures could be broken down on a per mile figure and stated the figures were meaningless unless they were tied down to some common denominator. MR. FISHER, one of the owners, discussed those figures. Mr. Bechtol stated the percentage figures were interesting, but the rest he could not go along with. He said the only way a rate increase could be justified would be on the return on the investment, and it would be necessary to have figures which would substantiate return on investment, and this would mean a more detailed schedule on expenses, a depreciation schedule, etc. MAYOR PRO-TEM PALMER asked that the break-down on the expenses and total revenue be submitted, as it was not shown how much was charged as Administration that might be going elsewhere, and just how much the operations are locally. Mr. Fisher stated the Auditor received a monthly report on the operations. Mayor Pro-tem Palmer stated the Council would look into these and get in touch with Mr. Herring. Councilman Bechtol, in regard to the taxi-cab operations, stated the public was aware that the taxi-cab industry in Texas had been in bad condition. He said he was disappointed in one phase of the operation, and that was the drivers do not have proper uniforms to identify themselves with the Cab companies. Mayor Pro-tem Palmer said there were complaints that the drivers were wearing sport shirts and no cap and no identification, and the ordinance was going to have to be enforced more rigidly. Councilman White suggested that they could at least wear a cap. Mayor Pro-tem Palmer inquired if there were any citizens that would like to be heard at this rate increase hearing. There were none. Mr. Herring thanked the Council for this time. CITY OF AUSTIN, TEXAS 215 215 MR. HOWARD CLAGGETT appeared before the Council regarding his request for permission to do dirt work on property on the Town Lake and reported on a meeting he had with the City Attorney. Aerial photographs of the area were shown by the City Attorney. After a long discussion, Mayor Pro-tem Palmer suggested that Mr. Clagget come up with an agreed boundary line and then the Coun- cil could act on his request. The City Attorney stated there was no way for him to obtain a boundary line along this water course that is going to be a perpetual boundary line except by an agreement. Mayor Pro-tem Palmer stated if the Council were able to give him an answer, he would not close the discussion, but the matter had resolved itself into a legal question. Mr. Claggett thanked the Council for being so attentive to his problems. The Council discussed the bids for passenger cars for the various departments. The tabulation of bids is on file in the City Clerk's Office under "CITY CARS." The Assistant City Manager went over each bid in detail and reported on the use of the additional cars being purchased. He said he had agreed at the time on the annexation of the property so that Mr. Puett could go ahead with his subdivision, but that he had also stated he would not enter into a refund contract, as he felt that the developer was not entitled to any more consideration in that area until the problems were worked out. Councilman Bechtol moved that the motion be tabled. Councilman White submitted the request of POTENTATE HEINSLEY for a parade on the 21st day of April at 4:00 P.M., starting at the Shrine Temple, proceeding CITY OF AUSTIN. TEXAS: 222 222 down Guadalupe to 11th and on down to Congress and to the bridge and back. Councilman White moved that the request be granted and that Potentate Heinsley check with the Chief of Police. The motion, seconded by Councilman Perry, carried by the following vote: Ayes: Noes: Councilmen Bechtol, Perry, White, Mayor Pro-tem Palmer None Absent: Mayor Miller Mayor Pro-tem Palmer stated that some arrangements that had been worked out at the Airport were not satisfactory to all, and the matters were referred to the City Manager and Director of Aviation to work out. The City Manager stated a short time ago the Council approved a new arrangement with the Schools regarding participation in acquiring and developing playgrounds, and there are several playgrounds which the schools had acquired years ago--ST. JOHNS, RILEY, ST. ELMO, T. A. BROWN, and OAKSPRINGS. The City Manager reviewed the present policy, and gave the status of the playgrounds at these named schools, in that the land had been acquired, considerable site work done; and in each case no division was made between the portion of the costs that applied to the free play area and the portion that would apply to the other work. It was kept on the site as a whole. He listed the amount of costs and site work on these school grounds and the costs of the property and the amount of acreage. He stated the formula set up would apply to any future site work, but it could not be applied to this. Councilman Bechtol moved that the City Manager be authorized to work this out with the School Board as to these particular sites. The Council recessed until 3:00 P.M. RECESSED MEETING 3:00 Ρ.Μ. At 3:00 P.M. the Council resumed its business. The City Manager gave a report on his trip to New York along with MR. W. A. JACKSON, MR. JOE HUFFMAN, and representatives of DUMAS, HUGUENIN and BOOTHMAN, in contacting STANDARD & POOR'S CORPORATION, DUN & BRADSTREET, INC. and MOODY'S INVESTMENTS. The City Manager's report was very detailed. Mayor Pro-tem Palmer stated this was a fine report and that the City Manager and his staff did an excellent job in compiling this information. The Director of Aviation discussed bids for a music system at the Airport as received from MARLIN GROSS WIRED MUSIC, CAPITAL MUSIC SERVICE, and MUSIC FOR BUSINESS. The lowest and best bid was from MUSIC FOR BUSINESS at $23.15 a month which would include service. He recommended this bid, and explained that this service would in turn be used as a central announcement service, and would be charged to those using it as such, and would be a profit to the city. Councilman Perry moved that the City Manager be authorized to enter into a contract with MUSIC FOR BUSINESS under the terms the Director of Aviation has outlined. The City Attorney stated there were other cases similar to this; and at the time this claim came up he was out of the City and had not gone into it yet. Mayor Pro-tem Palmer read a letter from PRESIDENT KENNEDY asking that the community accelerate any building projects that would help reinvigorate employment. The Council discussed the purchase of some property north of the old Power Plant, and the City Manager and Councilman White were asked to negotiate with the owners. Mayor Pro-tem Palmer inquired of MR. BILL WARD about the acquisition of two tracts of land at the Airport. Mr. Ward made a report on this.
