Councilman White moved that the minutes of the Meetings of March 9th and March 16th be approved. Councilman Bechtol offered the following resolution and moved its adoption: (RESOLUTION) WHEREAS, a certain drainageway and public utility easement, ten (10.00) feet in width was reserved and dedicated to the public in, upon and across the south portion of Lot 7, Block M. Garden Oaks, Section 1, a subdivision of a portion of the Isaac Decker League in the City of Austin, Travis County, Texas, according to a map or plat of said Garden Oaks, Section 1, of record in Book 9, at page 175 of the Plat Records of Travis County, Texas; and, WHEREAS, the owner of the hereinafter described portion of said above described premises has requested that such portion be released from said drainageway and public utility easement; and, CITY OF AUSTIN, TEXAS 249 249 WHEREAS, the hereinafter described portion of the above described easement is not now needed and hereafter will not be required by the City of Austin; Now, Therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That W. Councilman Bechtol stated he received a number of calls regarding using the hot-mix on this. He stated he understood it would cost about $9,600 additional to put hot mix on it. The Director of Public Works made a report on the decision to use the double penetration, in that there would be a savings on the difference in the two types; that from a maintenance standpoint, it is cheaper on the double than on the hot mix; and some paving will have to be torn out when the outfall sewer went in. MR. McKOWN appeared in the interest of this paving, stating this drive would have commercial vehicles going over it all the time, and stated there was a difference of only $10,000 in the better type of pavement. Instead of setting up bids for three months supplies, the Hospital estimated what the quantity would be and asked for bids on specific numbers of cases which would last for the three months period. Councilman Bechtol suggested that the bids be submitted in the manner as is usually done. He made reference to the Board Minutes of the Hospital Board and said the Administrator had stated he checked with the vendors on the staples and there was a mark-up from four to six percent. These low bids were running from 9% to 30% savings over what was being paid before. The Council briefly discussed the grade of staples. Councilman Bechtol stated he would like for it to be noted in the Minutes that there had been a savings far above what had been claimed, and that was from 9% to 30%. After discussion, Councilman White moved that the City Manager be instructed to proceed with the lowest and best bids. Mayor Pro-tem Palmer suggested that the City Manager check with the Hospital Board and Administration and come in with a recommendation on the grade and quality that is being used at the Hospital. He suggested also that a check be made with the doctors. The Council went over additional figures submitted by Mr. Fisher regarding a change of rate to be charged for the Yellow Cab Company. Mr. Fisher stated the salvage value listed was that which he was permitted to report on his income tax forms. He explained his bookkeeping methods as to tires on rented cabs in that the company was charged for the tires when the car was received. He stated the company did not pay rental by the automobile but by the revenues. Mayor Protem Palmer asked if he would give an approximation of what additional revenue would amount to by reducing from one and a fourth miles to two-thirds miles on the 45 meter charge. Mr. Fisher stated 38% to 40% of the trips were those at the 45% figure; and in this increase, it would run between seven and ten percent overall. The Council asked him to submit a figure which would give a three to five percent increase. Mr. Fisher mentioned that 40% of the increase would go to the driver, and 2% to the city. Councilman Bechtol asked Mr. Fisher what would a proposal be for a rate schedule of 45 for 2/3 of a mile, or possible 45¢ for 4/5 of a mile and five cents for a third of a mile, etc. Mr. Fisher stated he would then have to come back next year for another request for change of rate. After more study of his statement, the Mayor Pro-tem stated the Council would consider the figures very carefully; and in the very near future give him an answer. The City Manager reported that specifications were ready to take bids on auxiliary switch gear, substation additions, isolated phase bus, and power transformers for the new generation unit at the Holly Street Power Plant, and it was desired to open bids on April 13th. Councilman Perry moved the Council authorize the City Manager to circularize the industry for bids on this equipment to be opened at 10:00 A.M., April 13th, 1961, in the Council Chamber. The motion, seconded by Councilman Bechtol, carried by the following vote: Ayes: Noes: Councilmen Bechtol, Perry, White, Mayor Pro-tem Palmer None Absent: Mayor Miller The City Manager reported that the Recreation Board had recommended a change in the fees at Caswell Tennis Center. He made a report on further study which resulted in a recommendation of the establishment of a family fee on an annual or semi-annual basis, thus possibly increasing the usage of the Courts. The City Manager stated he recommended the family rate, but would not recommend a reduction in rates. He stated it had also been suggested that the $1.00 tournament fee be abolished. After much discussion, Councilman Perry moved to continue = CITY OF AUSTIN. TEXAS 257 257 the rates as they were in 1960 with the addition of the family membership fee, which would be $75.00 annually, $50.00 for the first six months, and $25.00 for the second six months; and that the individual hourly fee of 75 per senior and 50 per junior, be extended to an hour and a half. The Library group had found these operations to be very good and to be the best type of extension that could be conducted other than building branch libraries about town. He pointed out the advantages of renting space for this particular service, in that operations from community centers could be abandoned or relocated should there be a population shift or any other reason that one of the locations might become less popular: and that in each case the center would donate some space; but as the facility increased, more space would have to be requested, and it would more than likely have to be rented. The City Manager stated that space at Twin Oaks was donated; the space at Highland Park West was rented for $100.00 per month, but $55.00 of that is donated by the owner, and $45.00 is being paid by the Friends of the Library. Additional space is needed in the Northwest Shopping Center, but the owner cannot donate more space than he has now provided. The City Manager asked if the City, as a matter of policy, should provide for renting space in community centers. He mentioned that for years it had been concluded that city activities would be conducted in city-owned facilities; but these libraries may be transitory. Councilman Bechtol stated he did not know whether or not this will increase the budget. He said he did not believe the library operations were transitory. He said he would be willing to say he would look at some of these requests as they came up, but he would not be willing to adopt a policy on it. The City Manager stated the Library was not asking for a policy to permit it to henceforth rent space, but is asking that the Council recognize there is a difference between this operation and the type that the Coun- cil has announced its opposition to housing the activities in other than city facilities. Councilman Bechtol stated he would be willing to look at each individual one as it came up, but he wanted it understood there was not an increase in =CITY OF AUSTIN, TEXAS 228 258 the budget being authorized. The City Manager stated that in the next budget, there may be a request of $45.00 monthly to relieve the Friends of the Library of that payment which they have been making for the last three years. Councilman Bechtol suggested building book-mobiles to set up in these shopping centers. It was explained that Capitol Plaza had no space for a branch library, and that was the reason for locating this book trailer there. The City Manager suggested that the Council's policy might be stated that in renting space, it would be at reduced rental rates, or a fair portion of the space provided would be donated; and each request would rest on its own needs. Mayor Palmer suggested that between now and the time the budget is adopted, the City Manager could come up with a recommended figure that the Council could act on at that time, and he inquired if this were agreeable that the City Manager study this further with the Library, and come in with specific recommendations. Councilmen Perry and White stated that was all right with them. Councilman Bechtol said he was not in agreement with adopting a policy permitting renting space in all the shopping centers, because it would be favoring an increase in the budget. He said if the Library could show where it could operate cheaper, and if it could justify the services in the area, and justify operating cheaper by renting in a shopping center rather than a book-mobile or permanent facility, then the Council could look at it from that basis. The Council took no action at this time. The City Manager submitted the request from GOVERNOR PRICE DANIELS, and the Executive Director of the State Building Commission, for a variance in the sidewalk requirements for the new state building to be located on the west side of Congress and 15th. He said the proposal was to locate the sidewalk against the curb. Councilman White moved the Council grant the STATE OF TEXAS BUILDING COMMISSION a variance in locating sidewalks along the curb of Colorado Street and West 15th Street, and approve the granite service entrance walls on the Colorado Street side of the building, as requestin in letter of March 20, 1961. The motion, seconded by Councilman Perry, carried by the following vote: Ayes: Councilmen Bechtol, Perry, White, Mayor Pro-tem Palmer None Noes: Absent: Mayor Miller The City Manager stated there was a petition addressed to the Council from property owners in the 4500 block between Avenue D and Speedway, regarding the flow of Waller Creek in that block. They claim their property has been flooded from time to time, and ask that some relief be given. The City Manager stated efforts had been made to do work in that block for some 12 to 15 years, but the property owners would not let them get in. The Director of Public Works stated there were some easements in there, but there had been trouble getting them, but they had been able to obtain a few within the last year. Mayor Pro-tem Palmer asked that a check be made to see if there were the necessary easements, and if they could be given a little relief. The Council recessed until 2:30 P.M. _ CITY OF AUSTIN, TEXAS- 259 259 RECESSED MEETING The Council resumed its business at 2:30 Ρ.Μ. 2:30 P.M. Councilman White offered the following resolution and moved its adoption: (RESOLUTION) BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN THAT the City Council of the City of Austin hereby approves as a filling station site the property located at the southwest corner of Reinli Street and Interstate Highway No. 35; which property fronts 91.79 feet on the proposed south line of Reinli Street and 183.87 feet on Interstate Highway No. 35 being known as a portion of Lot 41, Duval Heights, in the City of Austin, Travis County, Texas and hereby authorizes the said Texaco, Inc. to construct, maintain, and operate a drive-in gasoline filling station and to construct curbs, ramps, and sidewalks in conjunction therewith subject to the same being constructed in compliance with all ordinances relating thereto, and further subject to the foregoing attached recommendations and plans. The Building Inspector is hereby authorized to issue an occupancy permit for the operation of this filling station after full compliance with all the provisions of this resolution, and said permission shall be held to be granted and accepted to all necessary, reasonable and proper, present and future regulations and ordinances of the City of Austin, Texas, in the enforcement of the proper Police, Traffic and Fire regulations; and the right of revocation is retained, if after hearing it is found by the City Council that the said Texaco, Inc. has failed and refused and will continue to fail and refuse to perform any such conditions, regulations, and ordinances. Williams, Jr. City Manager Austin, Texas "Dear Sir: "March 23, 1961 "We, the undersigned, have considered the application of Texaco, Inc. as agent for the owner for permission to construct, maintain and operate a drive-in gasoline filling station and to construct commercial driveways in conjunction therewith upon the property located at the southwest corner of Reinli Street and Interstate Highway No. 35; which property fronts 91.79 feet on the proposed south line of Reinli Street and 183.87 feet on Interstate Highway No. 35 being known as a portion of Lot 41, Duval Heights, in the City of Austin, Travis County, Texas, and the property upon which this filling station is to be located is under option to Texaco, Inc. and is owned by Watt Schieffer. We hereby advise the following conditions exist. CITY OF AUSTIN, TEXAS 260 260 "The property upon which this filling station is to be located is designated as "C" Commercial Use District upon the zoning maps of the City of Austin. "All drainage, natural or otherwise, from this filling station is to be disposed of in such a manner that such drainage will not flow across the sidewalk area into the street, and furthermore, shall not create a nuisance to others in the neighborhood. It is understood that the disposal of such drainage shall be entirely the responsibility of the property owner. Any waste connection to a storm sewer which empties into an open drainageway shall be discontinued, if the waste becomes a nuisance or damages any property or rights of others in the vicinity of the open drainageway. "We recommend that Texaco, Inc. be granted permission to construct, maintain, and operate said drive-in gasoline filling station and to construct curbs, ramps and sidewalks in conjunction therewith subject to the following conditions. "(L) That all buildings and equipment shall be placed inside of the property line; correct lines to be obtained before construction starts or equipment is installed. Lines and grades to be obtained from the Department of Public Works for entrances and driveways; building lines to be approved by the City Building Inspector. That the applicant shall confer with the Department of Public Works as to future grades of the sidewalks and gutters on the adjacent streets before he starts any construction relative to the filling station. "(2) That only underground tanks shall be used, and that all pumps shall be so located that it will be impracticable to service motor vehicles therefrom while said motor vehicles are standing on any part of a sidewalk, street, or alley. "(3) That the gasoline tanks, pumps, and all equipment used in connection with the storage and handling of gasoline shall be an approved type and shall bear the label of Underwriters Laboratories, Inc., and that all construction of the filling station improvements shall be in accordance with the Building Ordinance, the Zoning Ordinance, the Filling Station Ordinance, and in accordance with the ordinance prohibiting the disposal of commercial water or oils upon the City Streets. "(4) That the grades of the station shall be such that no waste water or oils or any floor washings shall ever pass over the City sidewalk area and that all of said oils and water shall be concentrated into a combined grease and sand trap which shall be constructed in accordance with our standard plan 2-H-146. "(5) That all filling station improvements, pump islands, driveways, ramps, gutters, sidewalks, and curbs shall be constructed of concrete at the expense of the applicant as set forth upon the plan, hereto attached, which plan bears the Department of Public Works file number 2-H-1843. "(6) Expansion joints shall be constructed as shown upon the plan, hereto attached, marked 2-H-1843 and shall be of the premoulded type. "(7) When the owner considers that he has complied with all the requirements of the City of Austin for filling stations, he shall apply for a final CITY OF AUSTIN, TEXAS 261 261 inspection, and upon approval, the Building Inspector shall issue a Certification of Operation before such filling station can be put into service. He stated if Texaco would make a legal agreement to join with WATT SCHIEFFER in a short form subdivision and dedicate a 15' strip of right-of-way, and in turn, MR. SCHIEFFER would make a se- cond agreement, which may involve a deposit of some $2700 for extension of water and sewer mains to the inside tract, the matter could be concluded. When the agreements are made, the building permit can be released, and then later the short form subdivision can come in. The Mayor Pro-tem introduced the following ordinance at 2:38 P.M.: AN ORDINANCE PROVIDING FOR THE EXTENSION OF CERTAIN BOUNDARY LIMITS OF THE CITY OF AUSTIN AND THE ANNEXATION OF CERTAIN ADDITIONAL TERRITORY CONSISTING OF 217 ACRES OF LAND, MORE OR LESS, SAME BEING IN TRAVIS COUNTY, TEXAS; WHICH SAID ADDITIONAL TERRITORY LIES ADJACENT TO AND ADJOINS THE PRESENT BOUNDARY LIMITS OF THE CITY OF AUSTIN, IN PARTICULARS STATED IN THE ORDINANCE. The ordinance was read the first time and Councilman Bechtol moved that the ordinance be passed on its first reading. Councilman Bechtol moved that the AUSTIN POLICE ASSO- CIATION be notified that they have permission to construct a practice field immediately adjacent to the present R. D. THORP FIELD with the understanding that they put only improvements on it that may be readily removed. The City Attorney stated many calls were being received from Election Judges appointed for the coming Council Election, regarding the necessity of additional help due to the fact the County School Board election was being held simul- taneously with the Council election. Mayor Pro-tem Palmer introduced the following ordinance: AN ORDINANCE APPOINTING ADDITIONAL ELECTION CLERKS TO SERVE AT THE VARIOUS POLLING PLACES AT THE REGULAR MUNICIPAL ELECTION TO BE HELD ON THE 1ST DAY OF APRIL, 1961; AND DECLARING AN EMERGENCY. The ordinance was read the first time and Councilman Perry moved that the ordinance be passed to its second reading. H. G. WEST for exchange of property with the City, because the City is interested in acquiring some land from him, and has authorized the condemnation of the right-of-way on South First. The City Attorney said Mr. West asked if the City would be willing to trade him some land adjacent to another piece of land which he owns in lieu of condemning the land which is needed on South 1st Street. He reported there was a 14' strip alley of which 10' was vacated and Mr. West was conveyed 4468 square feet of the alley, and he gave more than 10' off of Oltorf. The trade was 4468 square feet for 5253 square feet. The City Attorney stated on the right-of-way on South 1st Street, Mr. West wants to trade feet for feet, and our land is more valuable than the land to be acquired from him. He said Mr. West had asked that this be presented to the Council. The Mayor Pro-tem stated the Council would make a personal inspection of the CITY OF AUSTIN, TEXAS 262 263 two tracts of land. Discussion of a storm sewer was held. The City Manager pointed out there was a possibility that the strip of land would be needed for storm sewer in connection with paving. The Mayor Pro-tem stated that if we need that property, then go on with the condemnation, and get what was needed and hold on to the other. The City Attorney made a report on the status of the United Federal Life Insurance Company tax appeal on its taxable assets. After discussion, Councilman Perry moved the Council set the value of the property at $37,500.00.
