_ CITY OF AUSTIN, TEXAS MINUTES OF THE CITY COUNCIL CITY OF AUSTIN, TEXAS Recessed Council Meeting of March 30, 1961 April 3, 1961 10:00 Α.Μ. Council Chamber, City Hall 291 291 The meeting was called to order with Mayor Pro-tem Palmer presiding. Roll call: Present: Councilmen Bechtol, Perry, White, Mayor Pro-tem Palmer Absent: Mayor Miller Present also: W. T. Williams, Jr., City Manager; Doren R. Eskew, City Attorney; Reuben Rountree, Jr., Director of Public Works; Robert A. Miles, Chief of Police Mayor Pro-tem Palmer announced this was a continuation of the Thursday, March 30th meeting, and the Council was in session to canvass the returns of the April 1st Council Election. Box No. 4 for each precinct was opened, and unused ballots, mutilated ballots, "Register of Official Ballots", and "Register of Ballots Mutilated and Defaced", were checked. In Ballot Box No. 4, Precinct No. 122, there was found a marked unofficial ballot. Councilman Bechtol stated the presiding judge should be commended for returning the ballot. Councilman Bechtol moved that this unofficial marked ballot be turned over to the City Attorney with the request that he make a full investigation. The motion, seconded by Councilman Perry, carried by the following vote: Ayes: Noes: Councilmen Bechtol, Perry, White, Mayor Pro-tem Palmer None Absent: Mayor Miller Councilman White offered the following resolution and moved its adoption: (RESOLUTION) WHEREAS, by virtue of an election held in the City of Austin, Texas, on the 1st day of April, 1961, for the purpose of electing five Councilmen, the _ CITY OF AUSTIN, TEXAS 292 292 official returns from the election officials and the canvass thereof by the City Council show that there were cast at said election 21,046 votes; and, WHEREAS, said returns, and the canvass thereof, also show that the following named persons severally received the total votes set opposite their names respectively, to wit: Councilman, Place No. 1 Bob Armstrong Mrs. Stuart (Emma) Long Dora H. Palmer received a majority of all votes cast at said election for Councilman Place No. 4, and Edgar H. Perry III received a majority of all votes cast at said election for Councilman, Place No. 5; and, WHEREAS, it appears that no candidate received a majority of all the votes cast at said election for Councilman, Place No. 1, but that Bob Armstrong and Mrs. Stuart (Emma) Long are the two candidates who received in said election the highest number of votes for Councilman, Place No. 1; and, WHEREAS, it appears that no candidate received a majority of all votes cast at said election for Councilman, Place No. 3, but that Louis F. Shanks and Travis LaRue are the two candidates who received in said election the highest number of votes for Councilman, Place No. 3; Now, Therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That, in accordance with said returns, as received and canvassed, the following named persons are hereby declared duly elected and authorized to qualify for the position of Councilman for the City of Austin, for the term of two years beginning May 15, 1961: Place No. 2 - Ben White - Lester E. Palmer Place No. 4 Place No. 5 Edgar H. Perry III AND BE IT FURTHER RESOLVED: That in accordance with said returns, and the canvass thereof, that the two following named persons set opposite the place indicated below are hereby declared to be the two candidates for each such place who received in said election the highest number of votes for each place indicated to which no one was elected and shall be voted on again: Councilman, Place No. 1 Bob Armstrong Mrs. Stuart (Emma) Long Councilman, Place No. 3 Louis F. Shanks Travis LaRue The motion, seconded by Councilman Perry, carried by the following vote: Ayes: Councilmen Bechtol, Perry, White, Mayor Pro-tem Palmer Noes: None Absent: Mayor Miller _ CITY OF AUSTIN、TEXAS 295 295 Mayor Pro-tem Palmer introduced the following ordinance: AN ORDINANCE ORDERING A RUN-OFF ELECTION TO BE HELD APRIL 29, 1961, FOR THE PURPOSE OF ELECTING TWO COUNCILMEN OF THE CITY OF AUSTIN FOR A TERM OF TWO YEARS BEGINNING MAY 15, 1961, DESIGNATING THE POLLING PLACES IN THE VARIOUS PRECINCTS; AND PROVIDING THE PROCLAMATION OF SAID ELECTION; AND DECLARING AN EMERGENCY. The ordinance was read the first time and Councilman White moved that the rule be suspended and the ordinance passed to its second reading. The motion, seconded by Councilman Perry, carried by the following vote: Ayes: Councilmen Bechtol, Perry, White, Mayor Pro-tem Palmer Noes: None Absent: Mayor Miller The ordinance was read the second time and Councilman White moved that the rule be suspended and the ordinance passed to its third reading. The motion, seconded by Councilman Perry, carried by the following vote: Ayes: Noes: Councilmen Bechtol, Perry, White, Mayor Pro-tem Palmer None Absent: Mayor Miller The ordinance was read the third time and Councilman White moved that the ordinance be finally passed. The motion, seconded by Councilman Perry, carried by the following vote: Ayes: Noes: Councilmen Bechtol, Perry, White, Mayor Pro-tem Palmer None Absent: Mayor Miller The Mayor Pro-tem announced that the ordinance had been finally passed. There being no further business, Councilman White moved that the Council adjourn.
