EDWARD ROBINSON, Wilshire Presbyterian MAYOR PRO-TEM PALMER stated Austin had been singularly honored by awards earned by various Department Heads, and pointed out the City was competing with private industry. These awards were issued at the 22nd Safety Conference in Houston. Mayor Palmer noted besides reducing the cost and human suffering to the workers, there was a financial savings to the city. In 1952, the direct cost of accidents cost the City $114,900. In 1960 the direct cost was $37,700. CAPTAIN JIM MUSIC commended the City in its safety conciousness. The City Manager stated this program consisted of indivi- dual participation, and stated the organization of the Safety Program was a part of the Personnel Department with MR. FRANK BEARDSLEY as director. He said many visitors from other cities came to see about the operation of the safety program so they could set up such a program in their city. MR. KEN NORDEMAN appeared before the Council requesting permission to park a "covered wagon" in front of the Co-Op, for publicity purposes in connection with the Varsity Carnival in which the ACACIA FRATERNITY will participate in a show, "The Alamo". Their original request to take the covered wagon out at nights, was withdrawn due to safety problems. He stated permission from the Co-Op, and the Chairman of the Varsity Carnival had been obtained. He stated the proceeds would go for charitable purposes. Councilman Bechtol moved that since this was in keeping with the policy, and was determined to be a charitable organization, that the ACACIA FRATERNITY be granted permission to park the "covered wagon", as requested. EUGENE SANDERS appeared before the Council in the interest of the Pan American Center's sponsoring a show in the Auditorium on April 28th for the purpose of raising funds which will be used in various youth programs to make better citizens of the boys and girls. He asked that the Mayor and Council members purchase a ticket and encourage these people who are sponsoring this undertaking. Mayor Pro-tem Palmer thanked Mr. Sanders for his coming before the Council in this respect. MR. DAVID BARROW, Chairman of the Planning Commission, appeared before the Council asking that the Planning Department be notified of the date of hearing on the Austin Development Plan, so that the Department and Commission could have all information available. After discussion, Councilman Perry moved the Council set the dates of May 5, 1961, at 7:30 P.M., and May 11, 1961, at 2:00 P.M., as the two dates for public hearing on the Austin Development Plan and that both hearings be held in the Auditorium. Mr. Dick Baker represented the applicants in their request for "C" Com mercial, so as to permit them to develop the area as a Motel. He pointed out the advantages of the location for a motel, and that the location would not affect the landscape of the drive into Austin. He displayed pictures of the area. He said at the time people purchased in the area, they were aware of the Expressway and its development. He pointed out disadvantages of apartment development along the expressway and other developments, and stated again the motel was the most suited for this area, as it would beautify the area, develop an undeveloped piece of property not suited for residential, and add tax values. He said it was planned to have 98 units at present. The Director of Planning pointed out the type of development and number of units in "0" Office 2nd Height & Area. Opposition to "C" Commercial was expressed by MR. JACK ANDREWARTHA, but not for the motel construction; by MR. GARRIE BRAY, on the grounds there are three acres out of 150 acres; and if this one tract goes "C" Commercial the rest of the property would be jeopardized; by MR. H. T. BURLEIGH who objected to a change of classification, as well as to a motel; by MR. EDWARDS, Woodland Avenue, who stated the motel would have a flashing sign. Finally, after much discussion, Councilman Bechtol moved that the entire tract be changed to "0" Office, 2nd Height and Area, this to include the portion that is now zoned "LR" Local Retail. Mayor Pro-tem Palmer announced this would be an additional discussion of the taxicab application for rate increase. MR. CHARLES HERRING represented the Yellow Cab Company and Checker Cab Company. Mayor Pro-tem Palmer stated the Council was requesting strict enforcement of the taxi-cab ordinance, and it wanted to discuss some improvements that could be made. MR. FRANK DENIUS represented ROY'S TAXI. MR. RANDOLPH HAWKINS represented his Company. The Council discussed the insurance coverage that is now required to see if possibly it should be increased. MR. JESSE BARTLETT submitted information on insurance on taxi-cab operations, stating he did not believe the additional coverage could be obtained; and if it could, the operators could not pay the premium. No action was taken on changing the required insurance at this time, and the Mayor Pro-tem stated this would be something that the Council should investigate and study. Discussion on amendments to the Taxicab Ordinance, covering uniforms and appearance of drivers, and the removal of taxi-cabs if the driver were not complying with the ordinance. Councilman Bechtol emphasized that the franchise holders were to be the ones responsible, and that the Council was going to demand strict enforcement which would include taking a cab out of service. The City Attorney in discussing Article 31.44 asked that "April" be added during the time which a cap and shirt are required. Mayor Pro-tem Palmer introduced the following ordinance: AN ORDINANCE AMENDING SECTIONS 31.29 AND 31.44 OF CHAPTER 31 OF THE AUSTIN CITY CODE OF 1954 PERTAINING TO THE PHYSICAL CONDITION AND APPEARANCE OF TAXICABS AND DRIVERS, EFFECTIVE JUNE 1, 1961; AND SUSPENDING THE ORDINANCE RULE REQUIRING THE READING OF AN ORDINANCE ON THREE SEPARATE DAYS. It being apparent that the public is deserving of a little better taxicab service, and the franchise holders are entitled to a rate increase, Mayor Pro-tem Palmer introduced the following ordinance to become effective May 2, 1961: AN ORDINANCE AMENDING THAT ORDINANCE ENTITLED AN ORDINANCE REGULATING TAXICAB SERVICES IN THE CITY OF AUSTIN AND PRESCRIBING RULES AND STANDARDS FOR THE OPERATION AND CONTROL OF SUCH SERVICES IN THE PUBLIC INTEREST; PROVIDING FOR THE GRANTING OF FRANCHISES FOR TAXICAB SERVICES AND CREATING THE TAXICAB FRANCHISE COMMISSION; REQUIRING THE REGISTRATION OF ALL DRIVERS OF TAXICABS; REQUIRING THE INSTALLATION OF TAXIMETERS ON ALL TAXICABS AND FIXING MAXIMUM FARES; PROVIDING FOR ADMINISTRATION AND ENFORCEMENT OF THIS ORDINANCE; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; PROVIDING A SAVING CLAUSE; PRESCRIBING PENALTIES FOR VIOLATION OF THIS ORDI- CITY OF AUSTIN, TEXAS 337 337 NANCE; AND DECLARING AN EMERGENCY," WHICH ORDINANCE WAS PASSED BY THE CITY COUNCIL JUNE 8, 1950, AND IS RECORDED IN BOOK "P", PAGES 321-345, OF THE ORDINANCE RECORDS OF THE CITY OF AUSTIN, BY AMENDING SECTION 34, THEREOF; AND SUSPENDING THE ORDINANCE RULE REQUIRING THE READING OF AN ORDINANCE ON THREE SEPARATE DAYS. The City Manager submitted the request of MR. G. A. SMITH, resident of Lake Austin Estate, and owner of 35' replica of a Mississippi River Boat, for permission to take passengers and parties from the City Park and use the docks for loading and unloading passengers. Mr. Smith had stated those who patronized the park were not boat owners and would like to make cruises on the lake. The request included permission to start a towing service for skiiers. The Council took no action. The City Manager submitted the recommendation of the Director of Recreation for concessionaire at Lake Austin Park. MR. J. GARLAND NELMS had presented a proposal. The Director of Recreation recommends that Mr. Nelms be given the food and drink concession and rent boats for 10% of the gross receipts for one year. The City Manager stated he too recommended this concession, and reported on total receipts of the past year. Councilman Perry moved the Council approve the recommendation. The City Manager reviewed figures for the cost of the Public Address System in that the city's cost was $5,000, and it would take 10 years to amortize it at $41.00 per month without interest. There is a service contract plus cost of parts which would make $64.81 which the City would be out on the Public Address System. He recommended that the Airlines pay $24.00 each for their use of the system. He stated this would provide enough to amortize the system and leave a certain amoünt for spare parts. Councilman Perry moved the City Manager be authorized to enter into a contract with the Airlines as recommended. RENTAL SPACES: Rent already established at $4.25 per sq. ft. per year. Recommend Director of Aviation be authorized to rent these spaces to approved types of business on month to month basis. Examples of approved types: Fixed base operators, Cosmetic shop, Candy Shop, Office for real estate, general insurance, etc. Any type shop not in conflict with exclusive contracts given others. NOT APPROVED: Liquor store, sandwich shop. In any case where percentages are involved, proposals will be submitted to Council for approval. CAR RENTAL AGENCIES $250 per month minimum guarantee or 10% of gross, whichever is greater, plus $4.25 sq. ft. per year for all space occupied in building in excess of 48 square feet. Another question to consider is in the event of paving, since it is a local street which services only the property owners, should CITY OF AUSTIN, TEXAS 346 346 the property owners pay the whole cost or not. The City Manager suggested another solution in that all of the property owners could get together and request that the drive be vacated, and the City could sell them its part and let them work out a joint parking lot with limited access on Lamar. GENE GUTHRIR. He stated in the meantime the City Attorney had contacted their attorney and worked out something that would take only a few days. The City Attorney read a letter he had written, stating the letter was the final offer; and if the Brown Securities had not indicated its willingness to accept $50,000 for the property on or before April 24, 1961 at noon, it would be necessary to commence an action in eminent domain to acquire the property for public use in connection with its service center and electrical and water departments.
