CITY OF AUSTIN, TEXAS: MINUTES OF THE CITY COUNCIL CITY OF AUSTIN, TEXAS Regular Meeting April 04, 1963 10:00 Α.Μ. Council Chamber, City Hall The meeting was called to order with Mayor Palmer presiding. Roll call: Present: Councilmen Armstrong, Perry, Shanks, White, Mayor Palmer Absent: None Present also: W. T. Williams, Jr., City Manager; Doren R. Eskew, City Attorney; Reuben Rountree, Jr., Director of Public Works; Robert A. Miles, Chief of Police Church. Invocation was delivered by REV. PAUL JOYNER, Central Assembly of God MR. TOM BRADFIELD, Austin Home Builders Association, on behalf of the Association and the people of Austin commended and congratulated the City Council for the fine work it had done during these difficult years, and for its sincerity and integrity. The Association adopted a Resolution of commendation and each member of the Council was presented a copy. Mr. Bradfield asked this Resolution be made a part of the official minutes. MR. DICK BAKER presented the Council also a Plaque as an expression of the Association's high esteem for each member and for the services each rendered. Each member of the Council acknowledged and thanked the Association for its vote of confidence. The Resolution is as follows "THE STATE OF TEXAS ( COUNTY OF TRAVIS "WHEREAS, healthy growth of a city is dependent upon good local government; and, "WHEREAS, the people of the city of Austin have been privileged to enjoy good city government for many years; and, "WHEREAS, the present Austin City Council has followed the tradition of maintaining good government in Austin, and has set an example and pointed the way for future municipal officials; and, "WHEREAS, councilmen unselfishly devote many hours of time and spend their personal funds without compensation for their time or reimbursement of funds expended: - CITY OF AUSTIN, TEXAS April 4, 1963 207 "NOW THEREFORE, "BE IT UNANIMOUSLY RESOLVED, by the Austin Home Builder's Association that the Honorable Lester E. Palmer, Mayor, Benjamin White, Edgar Perry, Louis F.j Shanks, and Robert Armstrong be commended for their unselfish and dedicated service to all the citizens of Austin, and their untiring efforts to make the best city in the world a better place in which to live; and, "BE IT FURTHER RESOLVED, that a copy of this resolution be recorded in the official minutes of the City of Austin, and that a copy be given to each member of the City Council as a reminder of the appreciation and gratitude of the membership of the Austin Home Builder's Association." MR WESLEY PEARSON made a report on the Urban Renewal Program, stating the Agency had held 20 public meetings reviewing plans on the Urban Renewal Program, and that the plans had been reviewed before the School Board, Planning Department, Recreation Department and other interested departments, and the plan is now ready to be submitted to the Council in final form. The Urban Renewal Agency had adopted a Resolution to approve the plan as being submitted. Mr. Pearson stated about 99% of the citizens in the community were in favor of the plan. He stated the Council must set a public hearing date to give every interested citizen an opportunity to see what is expected to be done in this particular area. He invited any interested citizen regardless of the section of Austin in which he lived, to attend the public hearing. He said the plan would be a real credit to all of Austin. Mayor Palmer thanked Mr. Pearson and the Committee for the splendid work it had done in developing the Urban Renewal Program to this point. Councilman Shanks offered the following resolution and moved its adoption: (RESOLUTION) RESOLUTION PROVIDING FOR A SPECIAL MEETING OF AND PUBLIC HEARING BY THE CITY COUNCIL OF THE CITY OF AUSTIN, TEXAS, CONCERNING A PROPOSED URBAN RENEWAL PLAN AND PROVIDING FOR NOTICE THEREOF. WHEREAS, the Urban Renewal Agency of the City of Austin has prepared an urban renewal plan concerning an area known as the "Kealing Project"; and, WHEREAS, the Urban Renewal Agency of the City of Austin has submitted such urban renewal plan to the Council with the recommendation that such plan be approved; and, WHEREAS, such plan has been submitted to the Planning Commission of the City of Austin for its consideration and recommendation; and, WHEREAS, the Council desires to set a public hearing, giving notice thereof in accordance with the Urban Renewal Law of Texas, to consider the plan and to give all persons an opportunity to be heard thereon; Now, Therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: 1. JAMES STRUHALL, South Austin Civic Club, requested adequate lighting from Congress Avenue Bridge to Williamson Creek, and filed a petition signed by 345 citizens, most of them being business people on South Congress. The group asked the City NOT to put a traffic median down South Congress--just light the sides of the Avenue. MR. GILES SPILLAR, MR. HILL GOSSETT, and MR. JIMMY CLAY favored lighting South Congress, but were opposed to the island down the middle. The Mayor noted the importance of lighting, and stated each year money was budgeted for street lighting and quite a bit of progress had been made on lighting, but street lights were expensive. Mr. Clay inquired if a lighting consultant had been contacted. The City Manager said Austin's electric utility had some lighting experts recognized as the best in the country. He told the group a mercury vapor light was now on display on 6th and Congress for the merchants to observe. Mr. Clay stated the main need was for lighting from Oltorf on out. MR. WESLEY PEARSON said Austin should have a "whiteway" entrance from the south to the Capitol. The Mayor thanked the group for calling this to the Council's attention and stated the request would be referred to the City Manager for study and for obtaining some cost figures. The City Manager distributed copies of the Electric Utility Monthly Progress Report for March. וי CITY OF AUSTIN, TEXAS April 4, 1963 MRS. FRANCES B. MAY, President of the League of Women Voters, stated the League endorsed the Kealing Project as proposed to the Council by Mr. Pearson and in its judgment the Kealing Project had been very carefully and thoroughly prepared to meet the needs of the area, and it should be put into effect as soon as possible. She said the League was glad the public hearing had been called for May 6th. Mrs. May urged the Council to appoint the Citizens Advisory Committee. The Mayor stated one phase of the Urban Renewal program was the Committee known as the Building Standards Commission, and he outlined briefly the work done in an effort to bring a number of homes up to the minimum standard. He stated private enterprise had done a lot of commendable work on this. MR. CONNOLLY, Austin Real Estate Board, invited the Council and City Manager to its monthly business meeting Tuesday, April 9, Driskill Hotel, at which time the Council would be recognized for its accomplishments during the past two years; and to recognize the "Realtor of the Year", Mr. S. P. KINSER. The Council accepted the invitation. MR. BILL BRYCE announced a report of the Citizens' Committee to Interview Firemen would be presented by REV. LESTER R. HAINES. Rev. Haines read the report which listed the questions asked the 152 firemen interviewed individually, and which pointed out the primary grievance as being the fact the State law prevented the City from requiring any firemen to work more than an average, during a calendar year, of sixty hours per week, and Austin worked its firemen 56 hours weekly, telling them they were getting four hours vacation weekly. The report included, "The City does not give its firemen a regular vacation. In order for a fireman to obtain a regular vacation, that fireman and all of his crew must agree to work eighty-four hours weekly for almost seven weeks. All firemen interviewed agreed that the solution to this primary grievance is the hiring of additional personnel by the Austin Fire Department so that each fireman may take a vacation without having to pay back the time." The Committee listed an additional grievance in that about half the firemen expressed worry and concern for the public because fire-fighting equipment which requires at least three men to adequately manage it, is occasionally dispatched to fight fires with only two men in control. The report was signed by REV. LESTER HAINS, REV. W. C. AHLRICH, and RABBI DONALD D. CRAIN. The Mayor stated the Council would take the report and look it over, giving it every consideration; and if there were questions, the Council would be happy to meet with this committee. He asked that the Committee continue to serve as a committee. The Mayor stated the question was a matter of men and money, and the Council would study the report carefully, and review it with the City Manager and see what it could come out with. MR. C. T. JOHNSON expressed concern over the swimming pool in REED PARK, stating it was given to the City many years ago by Mrs. Fagan Dickson, but the pool is now inadequate for that part of the City. He pointed out additional land adjoining this park was needed, and there is only one lot left that could be purchased. He compared the appropriations for Northwest Pool to that for Reed Park. He stated it was imperative that the City acquire the remaining lot on Pecos next to the park. The pool is only 90'x34'. The City Manager stated this was a neighborhood free pool, and Northwest was a District Park with a pay pool. He said Mrs. Dickson gave the land for Reed Park, and the City built the pool which was the same size as the other neighborhood pools which were constructed after World War II. The District Parks with larger pay pools serve large sections of the City. The Mayor thanked Mr. Johnson for his interest and stated the Council would do some checking on his request. _ CITY OF AUSTIN, TEXAS April 4, 1963 311 - The Mayor made inquiry about the property adjacent to the Country Club. The Director of Planning reported there was an annexation request, and zoning matters to be considered. The access to the area was under study, and he stated there were two possible situations before the Commission the possibility of extending Grover Boulevard and the possibility of access being provided over the Country Club driveway. The developer had obtained permission from the Board of Trustees of the Country Club for the access. MR. CONNOLLY submitted the document for this permission to the Mayor. The Mayor asked the City Attorney to check the document, and if all is in order, the Council would bring up the annexation next Thursday. The document was then filed with the City Attorney. Pursuant to published notice thereof, at 10:30 A.M. the Mayor announced a hearing on the improvement of portions of Alpine Road, Cumberland Road, Forest Avenue, Herndon Lane, Juanita Street, West Live Oak Street, East Mary Street, Parker Lane, South 5th Street and South 6th Street was open. No one appeared in the interest of the improvement of thest streets. Lockhart 8833-8843 (8823) North Lamar Boulevard From Interim "A" Residence To "C" Commercial NOT Recommended by the Planning Commission Representatives of the developers, in opposition to the application, stated they were advised by the loaning agencies that the lots adjacent to this proposed rezoned area would be penalized not only in value but also on credit qualifications; that even on the lot already sold, the value would be lowered when considered again for financing. Councilman Shanks stated the lots would be financed, but the purchasers would have to have better credit ratings. The representatives stated the builders could not make as much profit. Councilman Shanks inquired about the lots backing up to the developers' commercial property. It was stated the lots were sold, but FHA turned them down for financing, and any financing agency would put a penalty on them. Councilman Shanks said if Mr. Lockhart had to leave a buffer zone residential, his property would have the same penalty against it. The Director of Planning offered some suggestions to CITY OF AUSTIN, TEXAS April 4, 1963 3/3 Mr. Lockhart for developing part of his property commercial and leaving some residential. Mr. Lockhart stated he had no use for any residential property. Councilman Shanks asked Mr. Lockhart if he would be willing to sell the developers 50' or take a 25' buffer and use that for parking. ( CITY OF AUSTIN, TEXAS April 4, 1963 200 The City Manager made a report on the contract regarding using the space under the Interregional between 6th and 8th Streets for parking, stating the Bureau of Public Roads wanted two or three little changes, to which he saw no objections and that he had sent the contract back to the Law Department. The changes dealt with provisions that the City would not use air space eight feet below the bridges, and that any signs erected in the area would be subject to approval by the Highway Department. The City Manager explained the plans for parking, in that if space immediately adjacent to the Police and Courts Building could be set aside for employees, then space at the Police and Courts Building could be opened up for the public. The Chief of Police recommended that restrictions be made that trucks no larger than a pick-up be parked on this new parking lot. The City Manager stated specifications on the boiler for the new Holly Street Plant No. 3 had been mailed to the prospective bidders requesting that bids be submitted for opening on May 9th at 10:00 A.M. He explained the specifications as including boiler steel, or a take-out provision if it were decided to buy the steel from someone else, the amount for steel then to be deducted from the bid. In the general contractor's bid there is also a take-out provision for steel. He reported the specifications for the condenser are not quite ready, but it does not take as long to work up bids on these, and bids will be opened on the same day. CITY OF AUSTIN, TEXAS April 4, 1963 201 The City Manager stated he had a letter from MR. BLUESTEIN, District 14, Highway Department, submitting a contract he would like for the City to enter into providing for installation of directional signs on some of the streets. These "Trail Blazer Signs" will be installed on 7th, 1lth, and 19th Streets, in down town areas directing traffic toward the Interregional Highway. The Traffic Department and Public Works Department had checked this out, and pointed out there would be some occasions where there may be a conflict as to where the City may need to put some of its signals, but the Highway Department is willing to put a provision in the contract that they will move the sign to a different 10cation when these conflicts occur. He said 19th was to be widened, and Mr. Bluestein was asked to hold up the installation on 19th Street until after the widening is completed. The City Manager recommended this contract with the change concerning conflicts with City plans for traffic signals and with the understanding of Mr. Bluestein that the installation on 19th would be held up until after it is widened. Councilman Shanks offered the following resolution and moved its adoption: (RESOLUTION) BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: SECTION 1. That the certain agreement dated April 4, 1963 between the State of Texas and the City of Austin, for the installation, construction, existence, use, and maintenance of certain highway Route Markers (Trail Blazer Assemblies) as shown on EXHIBIT 1 at approximately the location(s) shown on EXHIBITS 2 and 3, said EXHIBITS being attached hereto and made a part hereof, in the City of Austin, be and the same is hereby approved and W. T. Williams, Jr., City Manager is hereby authorized to execute said contract on behalf of said City and to transmit the same to the State of Texas for appropriate action. SECTION 2. That this Resolution shall take effect immediately upon its passage.
