Council Chamber, City Hall こ The meeting was called to order with Mayor Palmer presiding. Roll call: Present: Councilmen LaRue, Long, Shanks, White, Mayor Palmer Absent: None Present also: W. T. Williams, Jr., City Manager; Doren R. Eskew, City Attorney; Robert E. Beckham, Assistant Director of Public Works; Robert A. Miles, Chief of Police Invocation was delivered by FATHER CLEMENT MATHIAS, Holy Cross Church. The Mayor greeted and welcomed Councilman White's grandchildren and asked him to introduce them. Councilman White introduced Cherry Kay, Bill, Chris and Barry Meador, his grandchildren and Linda Lehman and Donnie Fowler, their friends. Councilman White moved that the Minutes of the Meeting of December 17, 1964, be approved. The motion, seconded by Councilman Shanks, carried by the following vote: Ayes: Councilmen LaRue, Long, Shanks, White, Mayor Palmer Noes: None MR. VOLMA OVERTON, President of the N.A.A.C.P., had requested 30 minutes to discuss appointment of a Commission on Human Relations and at this time the Mayor recognized him. Mr. Overton said seven months ago they had come before the Council urging the passage of an ordinance forbidding discrimination in Austin and the Council had passed an ordinance setting up a Commission on Human Rela- tions. He stated they had accepted this in good faith but they had been given a bad check and they were back today to redeem this bad check. He asked that the Council appoint a Commission that would work and has the desire to solve the problems of Austin. He introduced MR. WILLIAM C. WILSON, Professor of Sociology in a local college, and MR. GEORGE HAMMOND. Mr. Wilson said they came to petition the Council to implement the responsible action it took several months ago and to activate the Human Relations Commission that it established at that time. He discussed the passage of the Federal Civil Rights Act and the need for action and こ =CITY OF AUSTIN, TEXAS December 29, 1964 responsibility at the local level. He discussed the Commission that had been appointed and had resigned. He again urged the Council to appoint members to the Human Relation Commission. MR. HAMMOND spoke also urging the Council to appoint members to the Human Relations Commission and he also felt the problems should be resolved at the local level. Councilman Shanks said the Council had given a good check but it had been cashed in foolishly. Councilman Long said she had always been of the opinion that the Council should go ahead and try to appoint a Commission that would be available to hear the problems and work out any difficulties on the local level, and she had brought this up many times. Councilman LaRue said he thought the Council could not have appointed a more qualified group of individuals to work out the problems that existed at that time and in his opinion perhaps it was the finest committee ever appointed by the City Council since he had been on the Council. Mayor Palmer gave a summary of the requests of the different groups and inquired if this group was in agreement with the others. Mr. Hammond stated they were in agreement on one thing and that was the appointment of a Human Relations Commission. The Mayor asked the group if they would object to the appointment of the same Commission that was appointed before and they said they would have no objections to any one the Council appointed. The Mayor stated the Council had requests from other groups and they would hear them before any action was taken. Mayor Palmer brought up the following ordinance for its second reading: AN ORDINANCE AMENDING CHAPTER 34 OF THE AUSTIN CITY CODE OF 1954 TO REGULATE LIGHTING OF BOAT DOCKS AND TO ESTABLISH SPEED ZONES AT LAKE AUSTIN MUNICIPAL PARK AND IN BULL CREEK. The ordinance was read the second time and Councilman LaRue moved that the ordinance be passed to its third reading. Kay to vacate to adjoining property owners the street right of way presently held by the City for future extension of SHOALWOOD AVENUE from its present intersection with West 42nd Street southward some 170' to its proposed intersection with Shoalcreek Boulevard. The City Manager submitted the following: "TO: Mr. Bob Beckham, Public Works "DATE December 23, 1964 SUBJECT: VACATING SHOALWOOD AVENUE WEST 42ND TO SHOAL CREEK BOULEVARD "After a preliminary examination of the street system affecting the residential section between Shoal Creek Boulevard and Burnet Road in the area extending northward as far as West 49th Street, it is suggested that this portion of Shoalwood Avenue be retained as a street and not be vacated. Shoalwood Avenue affords the only direct access to the residential area mentioned above from Shoal Creek Boulevard without involving a number of right and left turns to reach numerous locations within the area. It is probable that Shoalwood will always remain a local residential street but will afford considerable service in withdrawing some of the anticipated traffic increase expected on Shoal Creek Boulevard. "Other than this, may I add that the City of Austin has met with some embarrassment relative to street vacations made in other sections of the city. "FROM: Traffic & Transportation Dept. s/ W. H. Councilman Shanks moved that the Council send a telegram to the team, Coach Royal, his staff and all members of the Athletic Department who contributed so much to the success of the Longhorns, wishing them well and may they be victorious, but win or lose the Council appreciates this entire group for what they mean to Austin. FRANK W. RIFFE regarding his tax appeal. He was pleased that the acreage was corrected and disappointed as to the value placed on this property. He also inquired about a refund on excessive taxes paid since 1946. The City Attorney stated as a matter of law he was not entitled to a refund and he explained the law. It was brought out that this .61 of one acre would not affect the value of the land as it was considered as a tract of land rather than on a footage basis. Councilman Long asked that he be notified of these facts. Letter from CLYDE LORENZ making an injury claim. ) - CITY OF AUSTIN, TEXAS December 29, 1964 Letter from DAVID CARSON suggesting that the City Council name the new lake created by the City for a new power plant, be named DOBIE LAKE to honor J. Frank Dobie. Letter from MR. I. W. DAVIS, President Austin Symphony Orchestra Society, Inc., commending the City Recreation Department in a truly outstanding performance of "Amahl and the Night Visitors" last week. Letter from MR. JOHN HARRIS, Urban Projects Director Office of Economic Opportunity stating that as part of the Office of Economic Opportunity, VISTA is authorized to provide volunteers to work in conjunction with Community Action Programs throughout the country. VISTA Volunteers can be funded as a component of an overall Community Action Program. Materials which explain the scope, nature and purpose of the program was enclosed. If the City is interested in sponsoring a VISTA project they were to return the letter of intent. The City Manager stated he had a letter saying that the U.S.S. AUSTIN would be commissioned in New York on February 6, 1965. The Council agreed that at the proper time they would send a congratulatory telegram. Councilman Long moved that the Council appoint MISS FRANCES MCCULLOUGH as Deputy Clerk of the Corporation Court. The motion, seconded by Councilman LaRue, carried by the following vote: Ayes: Councilmen LaRue, Long, Shanks, White, Mayor Palmer Noes: None The City Manager stated the Council had authorized the City Attorney to start negotiating for property on 51st Street and Airport Boulevard and the City Attorney said they were ready with 3 parcels of land. They were 125 x 52.15' av. of Lot 20, Ridgetop Gardens, 1105 East 51st Street; 10 x 125' and 87.7 x 55' approx. Lot 20 and 10.6 x 55' of Lot 21, Ridgetop Gardens, 1107-B East 51st Street; 50 x 125' approx. Lot 20, Ridgetop Gardens, 1107-E East 51st Street. (LEON BEAN) Councilman Long moved that the Council authorize the City Manager to purchase the property described by the City Attorney. RECESSED MEETING At 3:00 P.M. the Council resumed its meeting. : Councilman White absent. 3:00 Ρ.Μ. - CITY OF AUSTIN. TEXAS December 29, 1964 MR. HOYLE OSBORNE, Director of Planning, submitted to the Council "Outline of Major Goals in the 1965 Workable Program for the City of Austin" and "Requirements for Recertification Workable Program for Community Improvement Austin, Texas". He said the requirements for 1964 and set out in January 1964 following approval of the "workable program" at that time, were as follows: 1. To adopt an up to date Building Code. 2. Addition or review of the Plumbing and Fire Prevention Codes. 3. Expansion of plan of City wide housing code compliance activities. 4. Additional staff and budget necessary to administer and enforce the Minimum Housing Code. He said at that time the Council had just adopted a new Minimum Housing Code. 2 5. Keeping the public informed about the Master Plan. 6. Neighborhood analyses which is effectively the Community Development Program. 7. Housing for displaced families to show coordination between the various agencies to make sure that when a governmental action is taken, whether it is State or City or Highway Department, within the City limits that assistance be offered to those families that are displaced as a result of that governmental action. Urban Renewal Agency handles its.: own relocation assistance but Mr. Osborne said if the City widens a thoroughfare and acquires some houses and displaces some families, the City is required of offer assistance in helping those families find new housing. This is being handled through Dick Jordan's Office. 8. Sub-Committee for minority group housing should meet on a regular basis and participate in developing overall housing supply. This refers to the Citizens Committee Community Improvement and they do have a sub-committee on minority group housing. 9. Citizens participation. The committee should be reorganized in order to get wider representation of community-wide interests and groups. 10. And finally the names and addresses of the Chairmen of the various sub-committees within the Citizens' Committee for Community Improvement. These have been submitted. Mr. Osborne went over the status of the things to be accomplished in the immediate future. 1. The first four chapters of the Building Code has been adopted. It was his understanding that these were the really significant chapters, the enforcement provisions. There are ll chapters that were read the second time today. The other chapters are the detailed chapters. The Mayor asked if it would be helpful to finally pass the 1l chapters tomorrow and Mr. Osborne said he thought it would. _ CITY OF AUSTIN, TEXAS December 29, 1964 2. On Fire Protection Code, it has not been presented to the Council at the present. The first stage of the technical review has been completed, the Building Inspector's office and the City Attorney's office are looking at the Fire Prevention Code and this should be presented to the Council the early part of next year. He said he thought it would be satisfactory to say it was in the City Attorney's Office for preparation of the ordinance because the technical work has been finished and there has been 20 hearings over the past year on the Fire Prevention Code. 3. The Plumbing Code has been read the first and second times. Mr. Osborne said on these three they were satisfactory and in good shape. 4. On the appointments to the Citizens Committee for Community Improvement he said the Council does need to appoint some 10 or 12 additional people. He reviewed the status of the present committee and said the full committee had met six times and the sub-committees had met about 15 times during the past year. The particular concern at the present time is the matter of housing supply, in particular privately owned low cost housing. Secondly is the Glen Oaks General Neighborhood Renewal Program as to what they can do in that area to assist that program to be carried out. We need better contact with the people in the area, explaining what is going to happen out there and the time it will take. He thought the Council should meet with this Committee. This Committee is not a policy making organization but should be carrying the program of the City Council to the people generally. The Committee may have to develop some programs on its own. Discussion of low cost housing was held. Mr. Osborne said his impression was that the Council was thoroughly involved in getting these four accomplished at this time. It would be preferable on one or all of them to have them accomplished before the "workable program" is actually submitted but if you are not able to it can be taken care of as best as possible. Mr. Osborne went over the things to be accomplished during the coming year as follows: 1. Hearings and adoption of remaining chapters of the new Building Code. The Mayor asked if any one knew any reason why this could not be done. The City Attorney said he had all but a very small part of the chapters in his office. The committee has reviewed these and these should be ready for Council action around the middle of March. 2. Hearings and probable adoption of new or revised zoning ordinance. Mr. Osborne said there still remained complications of a complete new zoning ordinance and it might be the best course or alternate course to make revisions to the existing ordinance in the event they are not able to adopt a new zoning ordinance. He thought they should take a look at some parking and some other provisions. Mr. Osborne CITY OF AUSTIN, TEXAS December 29, 1964 said he had copies of the complete new ordinance. Councilman Long asked that the Council Members be furnished a copy so they could familiarize themselves with it. 3. Revision of minimum housing code to extend coverage to rooming houses) motels and hotels. The reason for this is the extensive use, particu larly in older motels, as apartment houses. Mr. Osborne said they had no real control on the rooming houses. He said this was not a Federal suggestion but a very strong recommendation from the Building Official who feels this is one area where the City is very weak. The Mayor inquired if this would be out of Mr. Jordan's office plus his present Minimum Housing Standards Committee and could they develop this and had they been asked to do this. Mr. Osborne said this had not been done as yet, they had written a provision into the original housing code that covered this partly. The Mayor stated that Mr. Jordan and his committee had pretty well adopted the Fire Protection Code, the Building Code, the Plumbing Code and he asked that the Council officially ask that they look into the matter of the possibility of extending coverage to rooming houses, motels and hotels. Councilman Long moved that the Council officially ask Mr. Dick Jordan and the Minimum Housing Standards Committee to look into the possibility of extending coverage to rooming houses, motels and hotels. The motion, seconded by Councilman LaRue, carried by the following vote: Ayes: Councilmen LaRue, Long, Shanks, Mayor Palmer Noes: None Absent: Councilman White 4. Continued expansion of Housing Code enforcement and review of problems of Housing Code administration. Mr. Osborne said at the present time Mr. Jordan has one man as full time housing inspector and another man for training. He discussed the level of enforcement stating that you had to be careful because if you went into widespread and intensive enforcement today you would run into relocation problems, and he thought the City should make sure that enforcement is accomplished and yet does not push people out into the street with no other housing to go to. Councilman Long stated she thought they were real interested in the enforcement of the Codes. 5. Revision of Health and Sanitation Code. Councilman Long felt if they could make an intensive drive at a certain period of the year and haul off a lot of junk, to them that would be real progress. Mr. Osborne said in talking with Dr. Primer and Mr. Hargis one of the problems seems to be in the area of enforcement, that the enforcement provisions in the Health and Sanitation Code are not com- pletely adequate. Another area that needed looking at was Lake Austin and the pollution of the lake area or the lake itself, what should be covered there, what sort of protection should be required in order to make sure that the water supply and the recreation facilities are protected. He said a suggested code should be ready to submit to the Council about the middle of the year. Discussion of cleaning off of lots was held. ) CITY OF AUSTIN, TEXAS December 29, 1964 6. Continued acquisition of park, recreation and open space areas. It is anticipated that the Open Space Program will be utilitized. The Mayor stated part of the 3000 acres would be open space and he asked if it would qualify. The City Attorney said they were not certain and the Mayor asked them to try. 7. Begin subdivision ordinance review. Mr. Osborne said this has a considerable amount of hearing on the matter of cluster subdividing, of subdividing for row housing, of other special types of subdivisions including experimental subdivisions, a number of which are not permitted under the present ordinance. In discussion it was brought out that a committee of 12 would be needed to review the Subdivision Ordinance. 8. Complete Austin Transportation Study. Mr. Osborne stated this was moving along rather well and he thought the completion date was scheduled for about July and most of the technical work should be com- pleted in about two or three months. This is a joint study with the State Highway Department. 9. Complete Community Shelter Program. Mr. Osborne said this should be complete about March. They are about 2/3 of the way through the shelter plan. He said they would report to the Council on that because it will involve notification to all of the people in the entire county of shelter locations and their assignment to the shelters. He said there were about 150,000 shelters now. The basic problem in Austin is the distance in the very outlying areas to shelter space. 10. Complete site plans for Medical Center development and begin architectural plans for expansion of Brackenridge Hospital. Also, review area as potential Urban Renewal Project. Mr. Osborne said the area would qualify for Urban Renewal. The City Manager reviewed the plan for acquiring property under Urban Renewal under the old plan but there is a new ruling and that is what they want to explore and he reviewed the new plan. The Mayor stated this was being studied and needs no Council action at this time. On the "complete site plans for Medical Center development and begin architectural plans' this should be completed this year. Mr. Osborne said in the recommendation for recertification was the matter of control of signs, etc. in the capitol area. The State is developing a somewhat larger plan than the City invisioned a year ago and had informed H. H. F. A. about, in turn the City is developing their plan to come over and meet the State Capitol plan and that result is that there are new plans being developed which will affect the question of architectural control, the land use control and sign control and he would not recommend during the coming year that the City go into special sign regulations in this area because what they are concerned about is developing the plans for the area. Discussion of signs and the Capitol area was held. Mr. Osborne said they had a recommendation from the special zoning ordinance committee.. - CITY OF AUSTIN, TEXAS December 29, 1964 11. Urban Renewal Action. Mr. Osborne said he thought the City was in a very good situation with respect to execution on the Kealing Project. On the planning on Glen Oaks and the GNRP this is moving rather slowly and he thought the planning time was 15 months. The Mayor stated on the proposal on Blackshear Urban Renewal Project the Council had already submitted this to the City Manager and his committee. The City Manager said this had to be studied first in connection with the Community Development Program. 12. Complete Community Development (Renewal) Program and submit to City Council. Mr. Osborne said this would be submitted in the latter part of the year but they would bring parts of this to the Council beginning sometime in the spring, probably in April. He said they had to prepare for the Council a series of reports ranging from the fiscal problems in the community, the fiscal inventory, economics, projections to the population forecast, social aspects, etc., this is kind of a priority list. The Mayor inquired about relocation and an agency being set up. Mr. Osborne stated the City had this agency, there is, in the Building Official's Office, a Renewal Coordinator and relocation is one of his jobs and coordination is another, and this was an agency for this specific purpose. He said it was growing quite a bit in terms of activity and this may have to be considered in the next budget. Discussion of relocation and number of families displaced that the City would have to help was held. In the Community Development Program there will be several items coming up in the immediate future, one being an Economic Consultant contract, probably in about two weeks. Discussion of funds was held. Mr. Osborne thought it was important to get the Economic Study as it is the basis on which housing supply is evaluat. ed. He said they would report back to the Council on an Appraisal Consultant. He thought the Economic Consultant would be the most interesting thing from the standpoint of business community and it is the long range forecast of the economic activity in Austin. He gave the duties of the Appraisal Consultant and gave the status of the Sociology questionnaire. The Council went over the requirements for recertification. Mr. Osborne said they had added one additional thing which has to be done in 1965 and that was the Sanitation and Health Code that the City has to commit itself to take a close look at that. It was brought out that if the City was not recertified the Housing Administrator, under the Act, is required to stop any additional funds, this includes open space programs, public housing, and the special F.H.A. programs, not the general F.H.A. home loans. Discussion of appointment and duties of the Citizens Committee for Community Improvement was held. Mr. Osborne said they would like to submit this to Fort Worth in the week of January 1lth, instead of waiting until the 20th and then it will go to Washington. The Mayor read a letter from the Housing and Home Finance Agency regarding recertification of Austin. The Council greeted and welcomed DAVID WILLIAMS and his mother who were observing the Council. = CITY OF AUSTIN, TEXAS December 29, 1964 The Mayor read a letter to the Governor's Advisory Committee on Mental Retardation Planning from HERMAN JONES, Chairman, regarding White House Correspondence "Pertaining to Planning Comprehensive Action to Combat Mental Retarda- tion." Councilman Long moved to pass a resolution asking our Senators and Congressmen to implement this program for the mentally handicapped and a copy of this resolution be sent to Judge Jones and our local committee. The Council discussed the Milwaukee Braves taking over this lease. Councilman Long moved that the Council authorize the transfer of the lease for Austin Senators, Inc. to MILWAUKEE BRAVES, INC.
