Council Chamber, City Hall The meeting was called to order with Mayor Palmer presiding. Roll call: Present: Councilmen LaRue, Long, Shanks, White, Mayor Palmer Absent: None Present also: W. T. Williams, Jr., City Manager; Doren R. Eskew, City Attorney; Reuben Rountree, Jr., Director of Public Works; Robert A. Miles, Chief of Police The Council greeted and welcomed MR. FRANK BABINSKI, Deputy City Clerk, Dearborn, Michigan, who brought greetings from the City of Dearborn, a city of 115,000 population and the home of the Ford Motor Company. Mayor Hubbard, Mayor since 1942, sent a token gift of a replica of the 1966 Mustang, and a certificate designating Mayor Palmer as Honorary Mayor of the City of Dearborn. Mayor thanked Mr. Babinski. The As to The Recreation Director introduced "Women in Construction", MRS. JOHN NILL, MRS. C. T. WALLACE, and MRS. JOHN BARTON; and MR. JOHN NILL, Architect. The Recreation Director stated this group had a project for helping in the development of the Town Lake Plan, raising $6,000 or $7,000 to construct a gazebo on a small island or floating garden on the east end of the front of the Auditorium. It will take about two years to get the money and construction finished. MRS. JOHN NILL stated in keeping with President and Mrs. Johnson's "Beautify the Nation Program", they would like to do a program to beautify the City. Mr. Nill showed a sketch of a proposed gazebo on the island which could be developed into a garden, and access will be over a small foot bridge. the solicitation of funds of the gazebo, the City Attorney stated it would be necessary to have a solicitation permit. The Director of Recreation stated, in answer to the Mayor's questions, that this project did fit in with the overall plan and had been cleared through all channels. Councilman Long stated this was a wonderful idea, and she hoped it would be a starting point for other groups to help in the Town Lake's long range plans. Councilman laRue stated he likewise thought it was a wonderful project and accepted it with enthusiasm asking the City Manager to work and cooperate with them in every respect. Mrs. Wallace asked that they be permitted to place a plaque on the gazebo listing the names of the Architect, contributors of materials and labor, etc. The Mayor stated there would be no objections he knew of. He thanked the group and hoped it would encourage other clubs. _ CITY OF AUSTIN, TEXAS: November 9, 1965 Mayor Palmer publicly announced that bluebonnets had been planted at the airport in line with Mrs. Johnson's beautification program and her desire that they be planted at the airport. J. Chambers Grant Councilman long asked if these were all requested. It was stated there was one where half of the property owners had asked to be annexed and half had not. (ADELE ADDITION and HOBBS ADDITION) The Director of Public Works showed the plat of the area, and stated if one part of the area were taken in, it would leave a "hole in the doughnut", so property owners are being contacted to see if they were agreeable to annexation. The City Attorney stated one of the problems is the inability of these people to obtain water on their lots. MIKE ARNN explained this was a small piece of property only 40' wide, and not suitable for a residence. With the additional area, there would be 80' x 145' on East 12th Street and Alamo extra. His property has been condemned. He said if the Council would go look at the area, it would agree this site was not suitable for residential. The Planning Director stated the lot is not adequate for a residence under the ordinance. The size of the area was so small there would be serious limitations on parking. The Commmission had suggested that the individual owners try to block up an area, perhaps for apartments. Later in the afternoon meeting, after making an on site inspection, Councilman Long moved that the application be referred back to the Planning Commission with the request that they study the whole block. CECIL CABINESS stated the proposal for the Suburban Alcoholics Foundation was going under contract today for construction, and he asked if the Council would participate in the ground breaking ceremonies. The Council decided to meet on the site between 11:30 A.M. and 12 noon Thursday, November 11th. The City Manager had a report from the Recreation Director that MR. FIELDEN BERRY the Concessionaire at Zilker Park had requested an extension of his contract. The records of the operation show that Mr. Berry has provided more revenue to the City than anyone else since there has been a concession there. The extension of the contract for a five year term would provide the same percentages as before, which is 25% of the gross sales on food and drinks; 15% on other items, and 50% of the profits from vending machines. Councilman Long moved that the City Manager be authorized to enter into an extension of the contract for the concession. The motion, seconded by Councilman LaRue, carried by the following vote: Ayes: Councilmen LaRue, Long, Shanks, White, Mayor Palmer Noes: None The City Manager stated in connection with the new lake east of town, they had been working with the Highway Department regarding reconstruction of a little bridge just to the east of where the lake will go, along the Farm to Market Road. An arrangement with the Highway Department was worked out, whereby the Highway Department would do the design, let the contract, and do all of the work, and the City will reimburse them for constructing a larger size structure to take the place of the present one. The estimated cost of construction, including 10% for engineering, supervision, etc., is $60,000. He stated as far as the water permit was concerned, everything was cleared; now they need authorization to enter into the contract with the Highway Department to proceed with _ CITY OF AUSTIN, TEXAS November 9, 1965 the design and construction of the bridge. After discussion, Councilman LaRue moved that the City Manager be authorized to enter into this contract with the Highway Department. The motion, seconded by Councilman Shanks, carried by the following vote: Ayes: Councilmen LaRue, Long, Shanks, White, Mayor Palmer Noes: None The City Manager stated last week the Council asked that the Public Works Department flag the west boundary of the Missouri Pacific Railroad south of the river between the river and Riverside Drive. This has been done so that it is known where the right of way boundary is; also the route of the frontage road on the north side on Riverside Drive. It is ready for the Council to see how just where the boundaries are. The Mayor stated the Council would try to go by during the noon hour. Councilman Long inquired about any extension of West 12th Street to the Missouri Pacific Boulevard. The City Manager's plans called for 15th Street to go west and tie into Enfield Road in the area where Windsor turns off to the north. Ultimately 15th Street will be extended diagonally across Enfield and be tied into the Missouri Pacific Boulevard at 10th Street. The road would cut diagonally across West 12th Street which would not go any farther at this point; however it may pick up elsewhere. The first project is from Enfield Road East, but not all of the right of way for this part has been acquired. The route acquired does not require the destruction of any large apartment units already built. The City Manager reported a group of people around Creedmoor are concerned about a water supply, and they have organized a non-profit water supply corporation which wants to purchase water from the City, as there is no adequate source of water supply in that section of the county. The contract would be only a water purchase contract, not providing that the City read the meters or service the area in any way. They propose using plastic pipe, and they will have a 100,000 gallon storage tank which will provide storage for a five day supply. Water could be delivered to them at off peak times. They anticipated 150 customers. There will be a membership fee to join the corporation, and each member will pay $9.00 a month minimum water bill. The City Manager stated there would be another meeting with this group and their attorney wanted to bring the matter before the Council next Thursday. The City Manager pointed out some details that would be worked out before now and next week--rates, that they would not incorporate, that any subdivision would comply to the City's subdivision ordinance, etc. The City Manager stated the organization had no boundary limits set out. The Mayor stated the City Manager would pursue this further with representatives of the area, and that the Council would hear them next Thursday if they were ready. The Assistant City Manager reported the Down Town Merchants would like to have the Christmas lights installed and ready to turn on the eve of Thanksgiving. It will take the Electric Distribution Division about three and a half days to install these lights. The Police Chief stated the addition of 50 patrolmen on the street made an appreciable difference in the number of moving fines assessed and collected, being more this year than last. The Mayor stated the investigation on the dismissal of parking tickets was still under study. Mayor Palmer stated it would be very appropriate if the Council would take official action and adopt a resolution acknowledging appreciation to the press, radio, and television for the wonderful coverage of the U.S.S. AUSTIN, which was quite an event in the life of the City of Austin. Councilman Long moved that the Press, Radio, and T.V. be commended on their marvelous coverage of U.S.S. AUSTIN DAY. Mr. Barrow did not want to take each parcel separately, but said the main thing, that based on presentations he and perhaps others had _ CITY OF AUSTIN, TEXAS November 9, 1965 : made in the past to the Tax Department, Board of Equalization and to the Council, had resulted in the Tax Department's and Board's giving careful study to the two types of taxes that are severe burdens to developers. They are studying treatment of newly developed land. Proper appraisals and rendition of large tracts of land are being considered. A small tract brings a higher market value per acre than the large tract. Mr. Barrow stated his tax renditions should be combined, as all of these pieces of property are not more than two or three tracts that are contiguous. There is one subdivision of 18 lots in Northwest Hills, Section 3, that had not been developed--no utilities or improvements, and it is in the acreage stage. The taxes were rendered in lots; but if that has anything to do with the tax value, Mr. Barrow said he would cancel the subdivision and turn it back to acreage. This subdivision would be about six or seven acres; and rendition on a per lot basis would make the full value about $2800 or $3000 per acre, which is too high. The property across the street is assessed at $1,500 an acre and that land is more valuable than his. The Council discussed advantages of selling property next to subdivided land; a subdivision would have money already invested, although it were not finished; limitations on cancelling a subdivision; a question of whether or not this property was included in the Water District purchased by the City 90% of the land is outside the City and subject to the School tax and area influence. The Tax Assessor explained the basis upon which the appraisals were made, and there was a road cut through the area, the subdivision was filed and engineering had been done. The lots were not appraised as finished products ready to market now. The City Attorney stated the value of property on the already improved Bull Creek Road would carry back to the depth of the road pratically the same value minus the sewer and water costs. The Tax Assessor stated Dr. LeMond had used the wrong figures in the size of his lots and his land value was exactly the same as the others per foot. The second part of his request involved the building value, where he contends he filled in a court yard, and he claims the money was mainly maintenance and repair. value of his property was increased $5600. The Department felt the property should be increased and the value is about correct and very well equalized. Mayor asked the Tax Assessor to talk with Dr. LeMond about the land and explain that he was in error in his figures. The The The Mayor announced that the Council would like to take action on the Tax Appeals Thursday, November 18th, in an afternoon meeting. Mr. David Barrow made mention about Town Lake stating he did not think а bait house ought to be an architectural structure to blend in with the Auditorium, etc., that it ought to be a "bait house". He stated & bait house should be in that general location, it is a part of the Town Lake, a part of the use of the area, a benefit to the people, and it ought to go down there. Councilman Shanks reported two or three people live on the portion of Scenic Drive from Pecos Street to 35th Street and they would like to change the name of that portion of Scenic Drive to PECOS. The Director of Public Works stated he would have this ready for the Council by next Thursday. The City Manager brought up for discussion the addition to the barn at the Coliseum, stating the proposed building will be on the south side of the other addition, and he made an estimate of the cost. Councilman Shanks moved that the City Manager be instructed so that he will have the authority to contact Mr. Rex Kitchens and discuss the proposed Coliseum area to be constructed, and discuss the ways and means in which financial arrangements will be handled; and after an understanding has been reached as far as the building is concerned that Mr. Kitchens be asked to appear before the Council to finalize the plans. A point 268' west of WPL Sheridan Avenue NPL Reinli Street EGL Comal Street To A point 863' east of Watson Street WPL Sheridan Avenue WPL Cameron Road WGL Cameron Road WPL Sheridan Avenue SPL Clayton Lane WGL Chicon Street The City Manager discussed with the Council the paving of Anderson Lane stating there were drainage inlets, 44' curb basis on the west end and on the east end there is only a 60' right of way from Gault Street east. The joint traffic study made by the Bureau of Public Roads, the State Highway Department and the City Traffic and Transportation Department indicates there will be no need for more than 44' by the year 1982. It is recommended as right of way is acquired, that 90' be acquired so that the road can be widened beyond 44' later. From Gault to Lamar there is 70' right of way; and from there to Burnet Road the right of way varies from 70 to 90'. He discussed relocation of electric utility lines when the road may be widened to 60'; all water mains and drainage inlets are set now for a 44' street. The City Manager stated his recommendation now is for a 44' street unless the property owners would be willing to pay the difference in cost. The Director of Public Works stated if the wider right of way is needed he would recommend that Anderson Lane be deleted from this program and that they proceed with the other streets. They would have to do paving on Anderson Lane where streets are torn up now from the storm sewer construction. Coun- cilman LaRue stated the 44' would take care of the City for 20 years. The Director of Planning discussed the 90' right of way from Burnet Road to Balcones, and discussed proposed developments in this area. Councilman Shanks suggested getting an estimate on what it would take to construct this 44' street and how much additional expense it would take to make it 60' and how much the property owners would be willing to provide. Councilman LaRue expressed preference in going ahead with the 44' street now. After lengthy discussion Councilman Shanks moved that ANDERSON LANE from Burnet Road to a point 863' east of Watson Street be deleted. The Mayor announced that the change had been granted to "O" Office and the City Attorney was instructed to draw the necessary ordinance to cover. Mayor Palmer inquired about the status of the Health and Sanitation Ordinances and the timing. The City Manager stated the Council was committed to adopt this before the end of the year. The Mayor asked if this could be gotten under way where there could be some public hearings held, and suggested November 9, 1965 - CITY OF AUSTIN. TEXAS if some ordinances were ready, they could be taken up as they come in. The Council indicated it would like to take the ordinances under consideration and hear them as they are ready, rather than waiting for the whole group to be submitted as a whole. The City Manager had a communication from the L.C.R.A. indicating if the Council would like to have the lake lowered, they would like to suggest beginning December 20th or 27th for one month; or if this date is not acceptable they suggested after the last week in February. Councilman Long moved that the City Manager be asked to notify the L.C.R.A. that the Council would like to have the Lake lowered starting December 27th; and urge anyone who wants to do any type of shore line improvement to get their requests into the Building Official immediately. Judge Granger stated he would try to make the Court one that the Council and the people of Austin would look upon with pride. Councilman Shanks stated the Council, the last time it appointed a Judge of the Corporation Court, tried to raise the prestige of the Court, and Judge McFarling did a fine job of doing this.
