PETITION PRESENTED Maurice Angle appeared before the Council to present a petition filed under Article 1181. The petition questioned the "granting of an ambulance and transfer vehicle franchise to the Austin Ambulance, City of Austin as provided by law". City Attorney Eskew noted that it would take several days to verify the petition. ANNEXATION HEARING Mayor Akin opened the public hearing scheduled for this time on the following annexation. CITY OF AUSTIN, TEXAS September 14, 1967 ZONING HEARING POSTPONED The Council agreed to postpone the zoning hearing of Dr. S. J. Clark Estate until October 5, 1967, due to a matter concerning a parking problem. MEADOWBROOK CODE ENFORCEMENT RESOLUTION Councilman Long offered the following resolution and moved its adoption: (RESOLUTION) APPROVING AND PROVIDING FOR EXECUTION OF PROPOSED GRANT CONTRACT FOR CODE ENFORCEMENT PROGRAM, NUMBERED CONTRACT NO. TEX. E-3(G), BETWEEN THE CITY OF AUSTIN AND THE UNITED STATES OF AMERICA, PERTAINING TO THE PREPARATION OF CODE ENFORCEMENT PROGRAM NO. TEX.E-3 WHEREAS, under Title I of the Housing Act of 1949, as amended, the United States of America (herein called the "Government") has tendered to the City of Austin (herein called, the "Public Body") a proposed Grant Contract for Code Enforcement Program, hereinafter mentioned, pursuant to which the Government would extend a Grant of Federal funds to the Public Body to aid in financing the cost of the preparation of a Code Enforcement Program, designated Code Enforcement Program No. Tex. E-3 (herein called the "Program"), and WHEREAS, this Public Body has given due consideration to said proposed Contract and has found it to be in the interest of this locality to execute such Contract, and WHEREAS, this Public Body is duly authorized, under and pursuant to the Constitution and laws of the State of Texas, to undertake and carry out the preparation of the Program, and BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN AS FOLLOWS: Section 1. The pending proposed Contract, designated "Grant Contract for Code Enforcement Program, Contract No. TEX. E-3(G)," consisting of Parts I and II, under and subject to the provisions, terms and conditions of which the Government would make a Grant of Federal funds under Title I of the Housing Act of 1949, as amended, to this Public Body to aid in financing the cost of the preparation of the Program for the locality of the City of Austin, Texas, is hereby approved in all respects. The City Manager of this Public Body is hereby authorized to file requisitions, together with necessary supporting documents, with the Government, from time to time as Grant funds are required, requesting payments to be made to it on account of the Grant provided for in the Contract, and to do and perform all other things and acts required to be done or performed in order to obtain such payments. M. Tinstman, City Manager, be and he is hereby authorized and directed to execute and deliver, on behalf of the City of Austin, that certain Grant Agreement with the United States of America, acting through its Federal Aviation Agency for the reconstruction of Taxiway "N" at Robert Mueller Municipal Airport, identified as Project No. 9-41-078-C809, Contract No. FA 68 SW 5001, a copy of which Grant Agreement is attached hereto and incorporated herein by reference as fully as if same were set forth herein verbatim, except that the City Clerk shall file said Grant Agreement in the permanent records of her office and shall not reprint the same in the minutes of this meeting. Gray Construction Company in the sum of $18,131.26, was the lowest and best bid therefor, and the acceptance of such bid has been recommended by the Director of Public Works of the City of Austin, and by the City Manager; Now, Therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That the bid of Robert C. Gray Construction Company in the sum of $18,131.26, be and the same is hereby accepted, and that R. M. Tinstman, City Manager of the City of Austin, be and he is hereby authorized to execute a contract on behalf of the City with Robert C. Gray Construction Company. S. He further stated that the purpose of the hearing was to allow citizens to appear before the Council to express their views and for the Council to have the same privilege, noting that it was the Council's responsibility to adopt a balanced budget and set the levy for the property tax by September 21 or 28. City Manager Tinstman then presented to the Council the contents of the Budget in terms of the combined total amount to be expended. He then expressed his reluctancy, as well as the Director of Finance's, to have any increase in the wage and salary of City employees above 6-1/2% until such time as the revenue would be available. Irish Matthews of the AFL-CIO appeared before the Council to suggest that they consider an across the board raise of at least $40 to $50 which would bring up the salary of the lower income group. Former Councilman Louis Shanks also appeared before the Council and stated that the first and foremost provision that should be considered in the budget was a fair and competitive wage increase over and above the already recommended 6-1/2% increase in the proposed budget. Mr. Tinstman then stated that he and the City Auditors planned to meet the following morning to compile all the budget data in a form which the Council could review and reach some definite conclusions. LAND ACQUISITION Councilman Nichols offered the following resolution and moved its adoptiont (RESOLUTION) BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That the offer of the owners and claimants of the hereinafter described tract of land to convey unencumbered fee simple title thereto to the City of Austin in consideration of the cash payment of $20,431.83 therefor be accepted, and that the City Manager or his designate be and he is hereby authorized to consummate purchase of the following described tract of land, to-wit: September 14, 1967 - CITY OF AUSTIN, TEXAS The South portions of Lots Nos. Thirty (30), Thirty-one (31) and Thirty-two (32), in Block "B", in Royal Oak, subdivision in the City of Austin, Travis County, Texas, according to the map or plat of said subdivision recorded in Volume 4, Page 287, of the Travis County Plat Records, more particularly described by metes and bounds as follows: BEGINNING at the southeast corner of said Lot No. Thirty-two; THENCE, North 67° 57' West 148.03 feet along the south line of said Lots Nos. 30, 31 and 32, to the southwest corner of Lot No. 30, in the east line of Winsted Lane; THENCE, along the line between said Lot No. 30 and Winsted Lane, said line being a curve having a radius of 186.6 feet, a chord which bears North 4° 07′ West 83.71 feet, a curve distance of 84.6 feet to an iron stake; THENCE, South 70° 19' East 88.9 feet to an iron stake; THENCE, South 60° 44' East 99.55 feet to an iron stake in the east line of said Lot No. 32; THENCE, South 24° 16' West 66.35 feet along the east line of said Lot No. 32, to the Place of Beginning.
