• =CITY OF AUSTIN, TEXAS MINUTES OF THE CITY COUNCIL CITY OF AUSTIN, TEXAS Recessed Meeting of September 28, 1967 September 30, 1967 9:00 Ρ.Μ. Council Chamber, City Hall The meeting was called to order with Mayor Akin presiding. Roll call: Present: Absent: Mayor Akin, Councilmen Janes, LaRue, Long, Nichols None MAYOR AKIN announced this was a meeting recessed from the Regular Meeting of Thursday, September 28th, to 9:00P.M. September 30, 1967, for the purpose of canvassing the returns of the Election held this day, and for adopting the tax rolls of 1967. The City Manager reported each Precinct Box was in, and each Presiding Judge had certified as to the votes within his Precinct. Each return had been rechecked for accuracy by the Accountants and posted on the Board, and adding tapes had been run on both the individual precinct returns, as well as those on the Board. The returns show 11,781 votes in favor of the one cent sales tax, and 5,865 against. The total vote was 17,651. Councilman Long stated the Council would want to go through these returns and check them as it does, since the Council is charged with the duty of canvassing the votes. She suggested that each Council Member take a certain number and check them (the tallies) and initial the ones each checked. Councilman LaRue asked if there were another way this could be handled to expedite this. Councilman Long said this was the only way she would want it done. The City Manager stated the quickest way, since it is the responsibility of the Council, would be for each Council Member to take approximately an equal number of the summary precinct returns, and check them against the Board and make certain the tapes are run. Councilman LaRue hoped that because of the circumstances, there would be an easier way. Councilman Long knew of no easier way other than for the Council which was charged with the responsibility, to move in and do it themselves. Mayot Akin asked in whom had the responsibility been reposed up to this point. The City Manager replied that the Presiding Judge in each precinct has full authority and responsibility as to the election procedures and also to certify to the City Councl the election results within that precinct. The Accountants and Auditors have been present as each Precinct box cam in and have been keeping an accumulative total and have rechecked those totals. =CITY OF AUSTIN, TEXAS September 30, 1967 Councilman Long stated she would not certify those until she had an opportunity to look at them. FOR AGAINST TOTAL VOTES CAST 421 Grace Methodist Church 293 139 432 422 Travis Heights School 423 Allison School 359 155 514 46 46 92 TOTAL 11,781 5,865 17,651 Councilman LaRue offered the following resolution and moved its adoption: (RESOLUTION) 1, RESOLUTION AND ORDER CANVASSING RETURNS AND DECLARING RESULTS OF SPECIAL ELECTION HELD IN THE CITY OF AUSTIN, TEXAS ON SEPTEMBER 30, 1967, ON THE QUESTION OF ADOPTION OF A ONE PERCENT (1%) LOCAL SALES AND USE TAX WITHIN SAID CITY. WHEREAS, there was held in the City of Austin, Texas, on the 30th day of September, 1967, an election at which there were submitted to the duly qualified resident electors of said City, for their action thereupon, the following propositions: FOR adoption of a one percent (1%) local sales and use tax within the city. AGAINST adoption of a one percent (1%) local sales and use tax within the city; and, WHEREAS, there were cast at said election 17,651 votes, of which number there were cast: FOR adoption of a one percent (1%) local sales and use tax within the city 11,781 votes AGAINST adoption of a one percent (1%) local sales and use tax within the city 5,865 votes Majority FOR adoption of a one percent (1%) local sales and use tax within the city 5,916 votes as shown in the official election returns heretofore lawfully submitted to the City Council of the City of Austin, Texas, and filed with the City Clerk of said City; and, WHEREAS, only duly qualified resident electors of said City voted at said election, and said election was called and held in strict conformity with the laws of the State of Texas Now, Therefore, September 30, 1967 - CITY OF AUSTIN, TEXAS BE IT RESOLVED AND ORDERED BY THE CITY COUNCIL OF THE CITY OF AUSTIN, TEXAS: SECTION 1. That the election described in the preamble to this resolution and order was duly called and notice thereof given in accordance with law; that said election was held in the manner required by law; that only duly qualified resident electors of the City of Austin, Texas voted at said election that due returns of said election have been made by the proper officers; that said election resulted favorably to the proposition: FOR ADOPTION OF A ONE PERCENT (1%) LOCAL SALES AND USE TAX WITHIN THE CITY; and that a majority of the qualified voters of said City of Austin, Texas, voting at said election, have voted in favor of approving and adopting a One Percent (1%) Local Sales and Use Tax within said City. SECTION 2. That the City Council of the City ofAustin, Texas, hereby officially and affirmatively declares that said One Percent (1%) Local Sales and Use Tax within said City has been properly and lawfully adopted in accordance! with the provisions of Article 1066c, Vernon's Texas Civil Statutes (Acts 1967, 60th Legislature, Regular Session, Chapter 36, page 62). SECTION 3. That the City Clerk is hereby authorized and directed to transmit to the Comptroller of Public Accounts of the State of Texas, in Austin, Texas, in Austin, Texas, by United States Registered Mail, or by United States Certified Mail, a certified copy of this Resolution and Order Canvassing the Returns of Special Election, under the official seal of the City of Austin, Texas showing the approval of said Local Sales and Use Tax by the qualified voters of said City, together with a map of said City, clearly showing the boundaries thereof as of the date of said election. The motion, seconded by Councilman Janes, carried by the following vote: Ayes: Mayor Akin, Councilmen Janes, LaRue, Long, Nichols Noes: None ADOPTION OF TAX ROLL Councilman Nichols offered the following resolution and moved its adoption (RESOLUTION) WHEREAS, the Board of Equalization of the City of Austin has certified its approval of the tax assessment rolls and records of the City of Austin for the year 1967, and has forwarded the same to the City Council; and, WHEREAS, said tax assessment rolls appear in all respects to be in correct form and prior to their submission the valuations of property shown in said rolls have been examined and corrected in the manner provided by law and ordinances of the City of Austin by the Board of Equalization; Now, Therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That subject to such adjustments as may be found necessary by reason of appeals pending, the tax assessment roll, showing a total amount of $747,432,320.00 valuation for said year, be and the same is hereby approved and adopted. • CITY OF AUSTIN, TEXAS September 30, 1967 The motion, seconded by Councilman LaRue, carried by the following vote: Ayes: Councilmen Janes, LaRue, Long, Nichols, Mayor Akin Noes: None adjourn. vote: There being no further business Councilman LaRue moved that the Council The motion, seconded by Councilman Janes, carried by the following Councilmen LaRue, Long, Nichols, Mayor Akin, Councilman Janes Ayes: Noes: None The Council adjourned at 9:30 Ρ.Μ.
