CITY OF AUSTIN, TEXAS- • MINUTES OF THE CITY COUNCIL CITY OF AUSTIN, TEXAS Regular Meeting December 14, 1967 9:00 Α.Μ. COUNCIL CHAMBERS, CITY HALL The meeting was called to order with Mayor Akin presiding. Roll Call: Present: Councilmen Janes, LaRue, Long, Nichols, Mayor Akin Absent: None The Invocation was delivered by REVEREND W. A. IRVIN of the Austin Baptist Association. ENFIELD PARKING SIGNS PROTEST Dr. G. W. Cleveland appeared before the Council to protest a recent decision of the City Council which limited parking spaces located on Parkway at the entrance of Enfield Road. Dr. Cleveland, a dentist, stated that the parking restriction was curtailing not only his practice, but also the practice of two other dentists, Dr. Joe Peak and Dr. Wayne Hodges. Mr. Edward Ellison also spoke against the parking restriction and presented a petition filed by 76 tenants of apartments along Enfield Road. The petition stated that "We, the undersigned, respectfully request that the City Council to remove the No Parking signs on Enfield. The placement of these signs there will work an undue hardship on many residents in apartments along Enfield Road. We believe that there is no real need for the signs, and we feel that the parking space is definitely needed." After some discussion, Councilman LaRue moved the Council suspend the "No Parking" enforcement from Baylor Street to Exposition Boulevard on Enfield Road, and hood the signs until City Manager Tinstman reported back to the Council a study on the subject. The motion, seconded by Councilman Janes, carried by the following vote: Ayes: Councilmen Janes, LaRue, Long, Nichols, Mayor Akin Noes: None • December 14, 1967 _ CITY OF AUSTIN, TEXAS HEMISFAIR INVITATION Miss Susan Ramsey appeared before the Council to present them with HemisFair tickets as a token of friendship from the Mayor of San Antonio. ANNEXATION HEARING Mayor Akin announced it was 10:30 A.M. and opened the hearing on annexation of 3881 acres of land being out of the Phillip McElroy, M. Castro, Wm. Sanders, M. Wells, Reuben Hornsby and the James Burleson Surveys DECKER LAKE. No one appeared to be heard. Councilman Long moved that the hearing be closed. December 14, 1967 CITY OF AUSTIN, TEXAS: WATERSHED POLLUTION REPORT City Manager Tinstman appeared before the Council to report on the study of watershed pollution. Tinstman noted that the Health Department, Water and Sewer Treatment Department and others had reviewed the specific six recommendations submitted to the Council by the various citizens who had expressed concern about problems of pollution. The report listed the following recommendations: 1. That the Council reactivate the previous Citizens Committee to review the ordinance which was drafted pursuant to their previous committee report. Subject to whatever action they took after reviewing the ordinance, the Council would then consider such an ordinance which would establish additional regulations. 2. That the Mayor invite representatives of various public agencies, other governmental jurisdictions and other interested nonpublic agency organizations to meet and discuss this matter from an overall viewpoint. 3. That the Council authorize development of plans and construction of sanitation facilities and equipment at Walsh's Landing and also support minimum staffing at this location. City Manager Tinstman then stated that appropriate recommendations would be made for financing these facilities and providing personnel at that location, noting that through successful design, construction and operation at that location, the particular project might set a pattern and encourage similar private installations elsewhere. After some discussion, Councilman Janes then moved that the Citizens Committee be expanded to include three additional members: Mr. David Barrow, Mr. Werner Perlitz and Mrs. James Webb. The motion, seconded by Councilman LaRue, carried by the following vote: Ayes: Councilmen Janes, LaRue, Long, Nichols, Mayor Akin Noes: None Councilman LaRue then moved the Council approve the following current recommendations listed in Paragraphs 1, 2 and 3 of the Water Pollution Report: 1. That the previous Citizens Committee be reactivated by the City Council to review and update the previously drafted ordinance în anticipation of a public hearing and formal Council consideration. 2. That on behalf of the municipality, the Mayor invite representatives of the various public agencies and interested organizations to an informal meeting to discuss the situation and ascertain primary jurisdiction and responsibility, etc. 3. That the City Council authorize development of plans and construction of sanitation facilities and equipment at Walsh's Landing and also minimum staffing at this location. December 14, 1967 = CITY OF AUSTIN. TEXAS The motion, seconded by Councilman Janes, carried by the following vote: Ayes: Councilmen Janes, LaRue, Long, Nichols, Mayor Akin Noes: None JUNK YARD ORDINANCE REVISION City Manager Tinstman appeared before the Council to present the revised version of the junk yard ordinance. Tinstman stated that: 1. Yards for used or wrecked automobiles had been removed from the ordinance, and that the ordinance as amended pertained only to scrap metal type operations. 2. Such a yard must be adjacent to or across from a residential land use or major thoroughfare if the fencing were to be required. 3. The fence, if required, must be made of metal chain link and covered by some means of nontransparent metal backing or evergreen foliage. 4. The opening to the junk yard should not exceed 25 feet in width on every side of 150 feet or less. 5. The ordinance would not become operative until six months after passage. The City Attorney noted that a Junk Dealer as defined in Section 17.1 of the City Code referred to any person engaged in collecting, handling or selling any of the articles defined as "junk" and all persons engaged in the buying and selling of goods, wares and merchandise. The definition would include a collector as well as a seller. City Manager Tinstman suggested that the Council receive the ordinance in its amended form and continue the matter for an additional week. CITY LIMITS RESOLUTION Councilman Nichols offered the following resolution and moved its adoption: (RESOLUTION) WHEREAS, the City limit line of the City of Austin west of Lake Austin between Tom Miller Dam and Mansfield Dam is not presently so marked on the ground that its location is readily ascertainable at every given point; and, WHEREAS, the City of Austin has been asked to render certain municipal services which the City is capable of rendering to certain properties west of Lake Austin where previously surveyed and monumented boundary points make it feasible to ascertain said corporate limit line with certainty; Now, Therefore, December 14, 1967 CITY OF AUSTIN, TEXAS BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That the corporate limit line of the City of Austin be and the same is hereby confirmed and recognized as having been established at the location upon the ground which is depicted as a dotted and dashed line 10 varas from the old lake level upon that certain plat entitled "Survey of West Side of West Lake Drive at Yacht Harbor" prepared by the City of Austin Department of Public Works, approved by R. E. Beckham, Assistant Director of Public Works, over the seal and certificate of Marvin S. Shelton, Registered Public Surveyor, dated December, 1967; and, BE IT FURTHER RESOLVED: That said plat and certificate be accepted and filed in the official records of the City of Austin and that all officers and employees of the City of Austin shall hereafter take notice thereof for all purposes. The motion, seconded by Councilman Long, carried by the following vote: Ayes: Councilmen Janes, LaRue, Long, Nichols, Mayor Akin Noes: None RELEASE OF EASEMENTS Councilman Long offered the following resolution and moved its adoption: (RESOLUTION) WHEREAS, a certain easement was granted to the City of Austin for public utility purposes in, upon and across that certain portion of Lots 1 and 2, Block B, Plaza Place; said Plaza Place being a subdivision of a portion of the James P. Wallace Survey Number 57 in the City of Austin, Travis County, Texas; according to a map or plat of said Plaza Place of record in Book 4 at Page 84 of the Plat Records of Travis County, Texas; and, WHEREAS, the owner of the above described property has requested the City Council of the City of Austin to release the hereinafter described portions of said easement; and, WHEREAS, the City Council has determined that the hereinafter described portions of said easement are not now needed and will not be required in the future; Now, Therefore, KNOW ALL MEN BY THESE PRESENTS: That the City of Austin, a municipal corporation situated in Travis County, Texas, acting by and through R.M. Tinstman, its City Manager, hereunto duly authorized, has released and by these presents does hereby release unto the owner the following described portions of said public utility easement, to-wit: December 14, 1967 CITY OF AUSTIN, TEXAS Two (2) strips of land five (5.00) feet in width, the strip of land hereinafter described as Number One being out of and a part of Lot 1, Block B, Plaza Place; the strip of land hereinafter described as Number Two being out of and a part of Lot 2, Block B, Plaza Place; said Plaza Place being a subdivision of a portion of the James P. Councilman Long moved that the ordinance be published in accordance with Article I, Section 6 of the Charter of the City of Austin and set for public hearing on December 28, 1967 at 10:30 A.M. The motion, seconded by Councilman LaRue, carried by the following vote: Ayes: Councilmen Janes, LaRue, Long, Nichols, Mayor Akin Noes: None BRACKENRIDGE URBAN RENEWAL PROJECT HEARING SET Councilman LaRue moved the Council set a public hearing on January 18, 1968 at 10:30 A.M. on the Brackenridge Urban Renewal Project. The motion, seconded by Councilman Long, carried by the following vote: December 14, 1967 =CITY OF AUSTIN, TEXAS Ayes: Councilmen Janes, LaRue, Long, Nichols, Mayor Akin Noes: None HIGHWAY MAINTENANCE ORDINANCE Mayor Akin introduced the following ordinance: AN ORDINANCE PROVIDING FOR THE MAINTENANCE OF CERTAIN STATE HIGHWAY'S AND/OR PORTIONS OF STATE HIGHWAYS IN THE CITY OF AUSTIN, COUNTY OF TRAVIS, TEXAS, HEREBY REFERRED TO AS MUNICIPAL MAINTENANCE PROJECT AND AUTHORIZING THE CITY MANAGER OF THE CITY OR OTHER AUTHORIZED CITY OFFICIAL, TO EXECUTE AND AFFIX THE CORPORATE SEAL AND ATTEST SAME. A CERTAIN AGREEMENT BETWEEN THE CITY AND THE STATE OF TEXAS, PROVIDING FOR THE MAINTENANCE AND USE OF THE SAID MAINTENANCE PROJECT: AND DECLARING AN EMERGENCY AND PROVIDING THAT THIS ORDINANCE SHOULD BE EFFECTIVE FROM AND AFTER ITS PASSAGE. CONTRACTS AWARDED Councilman Nichols offered the following resolution and moved its adoption: (RESOLUTION) WHEREAS, bids were received by the City of Austin on November 29, 1967, for the purchase of 6,000 tons (estimated quantity) of aggregate for surface treatments for use by the Street and Bridge Division; and, WHEREAS, the bid of Trinity Concrete Products Co., in the sum of $25,320.00, was the lowest and best bid therefor and the acceptance of such bid has been recommended by the Purchasing Agent of the City of Austin and by the City Manager; Now, Therefore, December 14, 1967 _ CITY OF AUSTIN, TEXAS BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That the bid of Trinity Concrete Products Co., in the sum of $25,320.00, be and the same is hereby accepted, and that R. M. Tinstman, City Manager of the City of Austin, be and he is hereby authorized to execute a contract on behalf of the City, with Westinghouse Electric Corporation. The motion, seconded by Councilman LaRue, carried by the following vote: Councilmen Janes, LaRue, Long, Nichols, Mayor Akin Noes: None Ayes: REPORT ON DISPOSAL OF SURPLUS CITY PROPERTY City Manager Tinstman reported to the Council that the City owned about 900 parcels of property that could be disposed of. Tinstman stated that subject to the Council's approval, Department Heads would investigate the history of the various tracts; how they were acquired, whether by revenue bonds, tax bonds, or the office budget, and for what purpose, Maps would be drawn up indicating rights of way, easements and which parts of the property the City wished to retain. The Council would then authorize public notice for a reasonable period of time which would allow realtors, adjoining property owners and anyone interested to submit proposals. Tinstman stated that the adjoining property owner would be given ample notification that the property would be sold and informed of his opportunity to purchase the property. He further stated that the prospective plan for disposing of the property would not involve strict competitive December 14, 1967 _ CITY OF AUSTIN, TEXAS- bidding, but would merely be a public invitation for proposals to be submitted, and he emphasized the Council's right to negotiate. The City Manager then stated that he would submit the report on the surplus City property the following week. No action was taken.
