CITY OF AUSTIN, TEXAS MINUTES OF THE CITY COUNCIL CITY OF AUSTIN, TEXAS Regular Meeting January 04, 1968 9:00 Α.Μ. COUNCIL CHAMBERS, CITY HALL The meeting was called to order with Mayor Pro Tem Long presiding. Roll Call: Present: Absent: Councilmen Nichols, LaRue, Mayor Pro Tem Long Councilman Janes, Mayor Akin The Invocation was delivered by REVEREND B. C. SCHMIDT of the First Methodist Church. PERSONAL BOND PROGRAM Mr. Jack Darrouzet, representing the Travis County Bar Association, appeared before the Council concerning a proposed personal bond program. Under the program, a citizen could be released on his own personal recognizance bond without the necessity of a surety bond. Mr. Darrouzet stated that the University of Texas Law School under Dean Page Keaton had attempted to work out a program with a set policy concerning the use of the personal bond as distinct from the surety bond, and proved that such a system could work. Mr. Darrouzet explained that under the proposed program initial action would be taken by the Judge who would decide if the arrested citizen could be released on a personal bond or a surety bond. The program would provide: (1) a gathering of information concerning the arrested citizen such as his financial and job status, his family situation, and general background. This information would make possible a presentencing and would be referred to when the judge made his decision as to whether or not the man should be out on probation. The accused, if the judge deemed wise, could then make an application for a personal bond. January 4, 1968 =CITY OF AUSTIN, TEXAS trial. (2) notification of the time the arrested citizen's case was set for Mr. Darrouzet stated that the program would be under the supervision of Giles Gorman, probation officer of the Travis County Bar Association, and that the University of Texas Law School would furnish law students who would volunteer their services. As to the City's authority to pay for this service, Mr. Darrouzet referred to Article 42.2 section 10 of the Code of Criminal Procedure where a provision is made for an administrative, supervisory, clerical organization necessary to further conduct presentencing investigations. He further stated that the City has legal authority to spend funds necessary to satisfy a corporation purpose. After further discussion, the Council agreed to take the matter under advisement. INDEPENDENT AUDITORS REPORT After some discussion, the Council decided to postpone for one week the Independent Auditors Report for the fiscal year ending September 30, 1967. STREET VACATION ORDINANCE POSTPONED Councilman LaRue moved the Council postpone action on the item concerning the ordinance vacating Wade Avenue until the following week.
