CITY OF AUSTIN, TEXAS MINUTES OF THE CITY COUNCIL CITY OF AUSTIN, TEXAS Regular Meeting May 29, 1968 9:00 Α.Μ. COUNCIL CHAMBERS, CITY HALL The meeting was called to order with Mayor Akin presiding. Roll Call: Present: Absent: Councilmen Janes, LaRue, Long, Nichols, Mayor Akin None The Invocation was delivered by REVEREND TOM NEWSOM, Assistant Minister of the Congress Avenue Baptist Church. HERMAN BROWN ADDITION COMMUNITY PROBLEMS Mr. C. T. Johnson appeared before the Council to call to their attention the existing traffic hazard at the corner of Taylors Drive and Scenic Drive. Mr. Reuben Rountree reported that an agreement with the property owner in that area was being worked out and that when weather conditions improved, the matter would be attended to. Mr. Johnson also requested that the community swimming pool be enlarged noting that other community pools were not only larger but in better condition. City Manager Tinstman stated that it would cost $35,000 and require staff time to draw up the plans, and that there were many communities with no pools at all. CITIZEN APPEARANCE Mr. Charles A. Betts appeared before the Council with a petition drawn up by the citizens of his community protesting the use of Northwood Road as an arterial route in the MoPac plan. Mr. Betts stated that to dissect a beautifully planned cohesive neighborhood where there were many children would be a violation of the principles of good city planning. Mayor Akin stated that there had been previous hearings on the subject and that the Master Plan had already been drawn up. No action was taken. • -CITY OF AUSTIN, TEXAS May 29, 1968 PROPERTY SETTLEMENT FOR MOPAC RIGHT OF WAY Mrs. Wilma Bengston appeared before the Council to express her dissatisfaction concerning the price settlement of her property at 5700 Fairlane regarding right of way for MoPac. The City had offered her $19,875 which she felt was below the average of appraisals. Mayor Akin expressed his concern for her welfare and the Council agreed to investigate the appraisals further. AUSTIN TRANSPORTATION COMPANY, INC. REPORT Councilman Long moved the Council note the receipt of the Austin Transportation Company Partial Report and request for an interim report. The motion, seconded by Councilman LaRue, carried by the following vote: Councilmen Janes, LaRue, Long, Nichols, Mayor Akin Ayes: Noes: None HEARINGS CONTINUED Councilman Long moved the Council continue the hearings on the following items from 10:30 A.M., May 30 to 10:30 A.M. June 5: Ordinance annexing 64.15 acres of land out of the T. J. Chambers Grant and the George W. Davis Survey proposed ALLEN PLACE, NORTHWEST HILLS, SECTION 11-A and unplatted tracts. Paving of Avenue B and other streets3 Nueces Street Alley; and Manor Road and other streets. The motion, seconded by Councilman LaRue, carried by the following vote: Ayes: Councilmen Janes, LaRue, Long, Nichols, Mayor Akin Noes: None DOCKING AND PARKING ON WALSH LANDING Mayor Akin introduced the following ordinance: AN ORDINANCE AMENDING CHAPTER 34 OF THE AUSTIN CITY CODE OF 1954 REGULATING THE PRIVATE AND COMMERCIAL USE OF CITY-OWNED DOCKS, WHARVES, AND OTHER LOCATIONS FOR THE LANDING OF BOATS ALONG THE SHORES OF LAKE AUSTIN; PROVIDING A SEPARABILITY CLAUSE; AND DECLARING AN EMERGENCY. CITY OF AUSTIN, TEXAS May 29, 1968 The ordinance was read the first time and Councilman Long moved that the rule be suspended and the ordinance passed to its second reading. The motion, seconded by Councilman Nichols, carried by the following vote: Ayes: Councilmen Janes, LaRue, Long, Nichols, Mayor Akin Noes: None Councilman Nichols offered the following resolution and moved its adoption: (RESOLUTION) WHEREAS, after an engineering and traffic investigation, the City Council has found that the free flow and expeditious handling of traffic under conditions existing at the locations described below require that no motor vehicle, trailer, or boat shall be parked or left standing for more than sixty (60) hours out of any period of one hundred and sixty-eight (168) consecutive hours upon any street or City-owned property bounded as follows: by the eastern shore of Lake Austin; by the south right-of-way line of Enfield Road and its westerly prolongation to the shores of Lake Austin; the east right-of-way line of Rockmoor Avenue; and Bridle Path and its westerly prolongation to the shores of Lake Austin; Now, Therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That the City Clerk be and she is hereby authorized and directed to record this finding in Section 33.13 of the Traffic Register. DAYWOOD 7101 Guadalupe St. From "A" Residence to "BB" Residence NOT RECOMMENDED by the Planning Commission Councilman Long moved the Council uphold the recommendation of the Planning Commission and deny the change from "A" Residence to "BB" Residence. The motion, seconded by Councilman Nichols, carried by the following vote: • CITY OF AUSTIN, TEXAS May 29, 1968 Ayes: Councilmen LaRue, Long, Nichols, Mayor Akin Councilman Janes Noes: The Mayor announced that the change had been denied. AMBULANCE PETITION SURVEY Attorney Maurice Angly, representing the City Ambulance Service, appeared before the Council regarding the Ambulance Petition Survey. Mr. Angly had submitted a petition of 975 names of citizens requesting that a franchise election be held. City Clerk Elsie Woolsey had sent out questionnaires or interrogatories to citizens who had signed the petition and received only 273 answered forms. Of the 273, only 173 were qualified voters. Mr. Angly suggested that the City could send out Notaries to canvas the people who had not delivered a response and thereby determine whether or not a referendum election would be held. Councilman Long moved the Council instruct the City Manager to send out second notices requesting the petitioners to fill out the forms. The motion, seconded by Councilman LaRue, carried by the following vote: Ayes: Councilmen Janes, LaRue, Long, Nichols, Mayor Akin Noes: None JUNK YARD ORDINANCE City Manager Tinstman recommended that the ordinance concerning junk yard operations be continued an additional week, stating that it was necessary to clarify further the definition of "funk". CITIZEN APPEARANCE Mr. William S. Thomas, an attorney with private firms in west Texas, appeared before the Council to suggest arranging further discussion of the Fair Housing Ordinance. Councilman Long stated that the ordinance had already passed through three readings and that the upcoming referendum election would give the citizens of Austin a chance to vote on the issue. RELEASE OF OPTION ON PROPERTY CONTINUED Councilman Janes moved the Council continue the item concerning the request for release of option on property at I.H. 35 and Riverside Drive until the following week. The motion, seconded by Councilman LaRue, carried by the following vote Ayes: Noes: Councilman Janes, LaRue, Long, Nichols, Mayor Akin None • May 29, 1968 CITY OF AUSTIN, TEXAS DATA PROCESSING SPACE REQUIREMENTS ALTERNATIVES The Council discussed the alternatives to Data Processing space requirements. City Manager Tinstman stated that relocating the Personnel Department outside City Hall was one alternative being considered. Temporarily renting buildings to accommodate the additional data processing equipment was another consideration, but it would cost the city approximately $30,000. Tinstman further stated that it was necessary to restudy the total office space available, and ther take the most economic route. Councilman Long then moved the Council accept the recommendation of the City Manager on the working out of the expansion of the data processing system. The motion, seconded by Councilman LaRue, carried by the following vote: Ayes: Councilmen Janes, LaRue, Long, Nichols, Mayor Akin Noes: None REGIONAL COMPREHENSIVE HEALTH PROGRAM Councilman Long moved the Council authorize the use of $8,500 from the unexpended contingency fund for the Regional Comprehensive Health Planning Proposal. The motion, seconded by Councilman LaRue, carried by the following vote: Ayes: Councilmen Janes, LaRue, Long, Nichols, Mayor Akin Noes: None WINDOW AIR CONDITIONERS BRACKENRIDGE HOSPITAL Councilman Long then moved the Council instruct the City Manager to make a study concerning window refrigerated air conditioners for Brackenridge Hospital East and to report back to the Council. The motion, seconded by Councilman Janes, carried by the following vote: Councilmen Janes, LaRue, Long, Nichols, Mayor Akin Ayes: Noes: None ANNEXATION HEARING SET Mayor Akin introduced the following ordinance: AN ORDINANCE PROVIDING FOR THE EXTENSION OF CERTAIN BOUNDARY LIMITS OF THE CITY OF AUSTIN AND THE ANNEXATION OF CERTAIN ADDITIONAL TERRITORY CONSISTING OF 47.45 ACRES OF LAND, SAME BEING OUT OF AND A PART OF THE HENRY P. HILL LEAGUE IN TRAVIS COUNTY, TEXAS; WHICH SAID ADDITIONAL TERRITORY LIES ADJACENT TO AND ADJOINS THE PRESENT BOUNDARY LIMITS OF THE CITY OF AUSTIN, IN PARTICULARS STATED IN THE ORDINANCE. The motion, seconded by Councilman Janes, carried by the following vote: Councilmen Janes, LaRue, Long, Nichols, Mayor Akin Ayes: Noes: None NATURAL GAS SPACE ASSIGNMENT Councilman LaRue offered the following resolution and moved its adoption: (RESOLUTION) WHEREAS, Southern Union Gas Company has presented to the City Council tentative maps or plans showing the proposed construction of its gas mains in the streets in the City of Austin hereafter named, and said maps or plans have been considered by the City Council: therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT Southern Union Gas Company be and the same is hereby permitted to lay and construct its gas mains in and upon the following streets: (1) A gas main in LITTLE ELM PARK, from a point 124 feet east of the east property line of Laurel Grove Drive, easterly to Milborne Drive; the centerline of which gas main shall be 6.5 feet south of and parallel to the north property line of said LITTLE ELM PARK. (2) A gas main in COLLINFIELD DRIVE, from a point 22 feet south of the north property line of Peyton Gin Road, northerly to a point 135 feet north of the north property line of Little Elm Park, the centerline of which gas main shall be 6.5 feet west of and parallel to the east property line of said COLLINFIELD DRIVE. (17) A gas main in RUSTLING CIRCLE, from Rustling Road, westerly 91 feet; the centerline of which gas main shall be 15 feet south of and parallel to the north property line of said RUSTLING CIRCLE. May 29, 1968 CITY OF AUSTIN, TEXAS • (18) A gas main in RUSTLING COVE, from Rustling Road, northerly 340 feet; the centerline of which gas main shall be 15 feet west of and parallel to the east property line of said RUSTLING COVE. (19) A gas main in MESA DRIVE, from a point 139 feet north of the north property line of Burney Drive, southerly to a point 108 feet south of the south property line of Paint Rock Drive; the centerline of which gas main shall be 35 feet east of and parallel to the west property line of said MESA DRIVE. Said gas mains described above and Number 1 through 19 shall have a cover of not less than 2 1/2 feet. THE Southern Union Gas Company is hereby put upon notice that the City of Austin does not guarantee that the spece assigned above is clear from other underground utilities, but is based upon the best records we have at hand, and that the minimum depth stated does not have any reference to the fact that greater depths may not be required at special points. When the Southern Union Gas Company requires definite information upon the ground as to elevations or working points from which to base the location of their assignments, they shall apply to the Department of Public Works not less than three (3) days before such information is required. The Southern Union Gas Company is further put upon notice that they will be required to bear the expense of repairs or replacement of any underground utility damaged during the construction of lines named in this resolution. AND THAT all backfill under street surfaces between existing or future proposed curbs and under driveways and alleys, shall be tamped with mechanical tampers in six (6) inch layers. Each layer shall be compacted to not less than 90 per cent of maximum density as determined by the Standard Method of Test for Compaction and Density of Soils, A.A.S.H.O. Designation T 99-49. AND THAT the work and laying of said gas mains, including the excavation in the streets, and the restoration and maintenance of said streets after said mains have been laid, shall be under the supervision and direction of the City Manager and under all the pertinent terms and conditions of the certain franchises granted to said company by the City of Austin. The motion, seconded by Councilman Janes, carried by the following vote: Ayes: Noes: Councilmen Janes, LaRue, Long, Nichols, Mayor Akin None May 29, 1968 =CITY OF AUSTIN, TEXAS CONTRACTS AWARDED Councilman LaRue offered the following resolution and moved its adoption: (RESOLUTION) WHEREAS, bids were received by the City of Austin on May 21, 1968, for the construction of a shelter and multi-use slab for Givens Park; and, WHEREAS, the bid of G & M Construction Company, in the sum of $9,597.00 was the lowest and best bid therefor, and the acceptance of such bid has been recommended by the Construction Engineer of the City of Austin, and by the City Manager; Now, Therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That the bid of G & M Construction Company, in the sum of $9,597.00, be and the same is hereby accepted, and that R. M. Tinstman, City Manager of the City of Austin, be and he is hereby authorized to execute a contract on behalf of the City, with G & M Construction Company. The motion, seconded by Councilman Long, carried by the following vote: Councilmen Janes, LaRue, Long, Nichols, Mayor Akin Ayes: Noes: None Councilman Long offered the following resolution and moved its adoption: (RESOLUTION) WHEREAS, bids were received by the City of Austin on May 22, 1968, for the construction of storm sewers in Richardine Avenue from the south property line of Sara Drive to Ledesma Road and in Ledesma Road from Richardine Avenue to Nichols Avenue; and WHEREAS, the bid of Jack A. Miller in the sum of $30,924.60 was the lowest and best bid therefor and the acceptance of such bid has been recommended by the Director of Public Works of the City of Austin and by the City Manager; Now, Therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That the bid of Jack A. Miller, in the sum of $30,924.60 be and the same is hereby accepted, and that R. M. Tinstman, City Manager of the City of Austin, be and he is hereby authorized to execute a contract on behalf of the City, with Jack A. Miller. TEX. R-94 WHEREAS, this Council has heretofore approved an Urban Renewal Plan for the Brackenridge Urban Renewal Project No. Tex. R-943; and, WHEREAS, the Council has pledged the cooperation of the City in accomplishing the completion of said project; and, WHEREAS, it is necessary that the Urban Renewal Agency submit to the Department of Housing and Urban Development as part of its application for Loan and Grant, an executed cooperation agreement whereby the City agrees to accept the dedication of certain park lands as shown in said Brackenridge Plan and agrees to maintain said park lands after dedication; NOW, THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That the City Manager be and he is hereby authorized and directed to prepare and execute a cooperation agreement with the Urban Renewal Agency of the City of Austin whereby the City of Austin agrees to accept the dedication of the park lands shown and provided for in the Plan for the Brackenridge Urban Renewal Project No. Tex. Heyer in the sum of $18.00 for the house located at 1120 Nile, and in the sum of $57.50 for the house located at 2906 Kuhlman; the bids of J.
