= CITY OF AUSTIN, TEXAS MINUTES OF THE CITY COUNCIL CITY OF AUSTIN, TEXAS Regular Meeting July 25, 1968 9:00 Α.Μ. COUNCIL CHAMBERS, CITY HALL The meeting was called to order with Mayor Akin presiding. Roll Call: Present: Absent: Councilmen Janes, LaRue, Long, Nichols, Mayor Akin None The Invocation was delivered by REVEREND BILL COCHRAN, JR., of the Westminster Presbyterian Church. AQUA FESTIVAL Mr. Jack Polk, Commodore of the 1968 Aqua Festival, appeared before the Council to announce the commission of City Manager Robert Tinstman as an Honorary Commodore. Mr. Polk also noted that Ed McMahan of the Tonight Show would be a special guest of the Aqua Festival, and requested that Town Lake be named Ed McMahan on August 2, 3, and 4, 1968. Councilman Nichols moved the Council grant the request for the name change. The motion, seconded by Councilman LaRue carried by the following vote: Councilmen Janes, LaRue, Long, Nichols, Mayor Akin Ayes: Noes: None PETITION RECEIVED Mr. Barr McClellan appeared before the Council to present a petition regarding a proposal to put in a large country club in a residential "A" neighborhood. Councilman Long moved the Council note the receipt of the petition. The motion, seconded by Councilman LaRue, carried by the following vote: July 25, 1968 _ CITY OF AUSTIN, TEXAS- Ayes: Councilmen Janes, LaRue, Long, Nichols, Mayor Akin Noes: None FAIR HOUSING ORDINANCE Reverend David Hamrick appeared before the Council to express his support of the majority decision of the Council concerning the Fair Housing Ordinance. Mayor Akin noted that the matter was still under consideration. POLICE SPECIAL ORDER REVISION Mr. Frank Montgomery, representing the Grand Jury Association, appeared before the Council to express opposition to the proposed amendment of the Police Special Order concerning the use of firearms. Chief Miles noted that in the revised wording of the Police Special Order the words "automatically suspended without prejudice" were substituted with "automatically placed on limited duty with pay pending an investigation". Councilman Long moved the adoption of the revised section of the policy of the Police Department as presented on page 13 of the Order. The motion, seconded by Councilman Nichols, carried by the following vote: Councilmen Janes, LaRue, Long, Nichols, Mayor Akin Ayes: Noes: None PUBLIC NOTICE TO RECEIVE PROPERTY PROPOSALS Councilman Long moved the Council give public notice inviting proposals at 10:30 A.M. on August 1, 1968 for the purchase of properties at 5th and Lamar and 3rd and Lamar. The motion, seconded by Councilman Janes, carried by the following vote: Ayes: Councilmen Janes, LaRue, Long, Nichols, Mayor Akin Noes: None ZONING HEARING Mayor Akin announced that it was 10:30 A.M. and the Council would hear the zoning case scheduled for public hearing at this time continued from July 11, 1968. Presnal 4102-4108 Manchaca Rd. 2008 Bert Ave. From "A" Residence to "BB" Residence NOT RECOMMENDED by the Planning Commission July 25, 1968 _ CITY OF AUSTIN, TEXAS Councilman Long moved the Council uphold the recommendation of the Planning Commission and deny the change from "A" Residence to "BB" Residence. The motion, seconded by Councilman LaRue, carried by the following vote: Ayes: Noes: Councilmen Janes, LaRue, Long, Mayor Akin Councilman Nichols The Mayor announced that the change had been denied. ANNEXATION ORDINANCE Mayor Akin brought up the following ordinance for its third reading: AN ORDINANCE PROVIDING FOR THE EXTENSION OF CERTAIN BOUNDARY LIMITS OF THE CITY OF AUSTIN AND THE ANNEXATION OF CERTAIN ADDITIONAL TERRITORY CONSISTING OF 75.15 ACRES OF LAND, SAME BEING OUT OF AND A PART OF THE JAMES P. WALLACE SURVEY NUMBER 18; 6.43 ACRES OF LAND, SAME BEING OUT OF AND A PART OF THE GEORGE W. DAVIS SURVEY; 18.97 ACRES OF LAND, SAME BEING OUT OF AND A PART OF THE J. C. ANNEXATION ORDINANCE SET FOR HEARING Mayor Akin introduced the following ordinance: AN ORDINANCE PROVIDING FOR THE EXTENSION OF CERTAIN BOUNDARY LIMITS OF THE CITY OF AUSTIN AND THE ANNEXATION OF CERTAIN ADDITIONAL TERRITORY CONSISTING OF 3.80 ACRES OF LAND, SAME BEING OUT OF AND A PART OF THE JOHN APPLEGATE SURVEY, AND 1.57 ACRES OF LAND, SAME BEING OUT OF AND A PART OF THE J. C. TANNEHILL LEAGUE, ALL LOCATED IN TRAVIS COUNTY, TEXAS, WHICH SAID ADDITIONAL TERRITORY LIES ADJACENT TO AND ADJOINS THE PRESENT BOUNDARY LIMITS OF THE CITY OF AUSTIN, IN PARTICULARS STATED IN THE ORDINANCE. -CITY OF AUSTIN, TEXAS July 25, 1968 Councilman LaRue moved that the ordinance be published in accordance with Article I, Section 6 of the Charter of the City of Austin and set for public hearing on August 8, 1968 at 10:30 A.M. Mullins, representing Mr. Warren and Mr. Harrison, owners of the Gondolier, appeared before the Council with a new request for release of option on property at I.H. 35 and Riverside. After some discussion, City Manager Tinstman suggested that a written evaluation of the new proposal be obtained from the State Highway Department and that he confer with Mr. Reuben Rountree and the City Attorney to prepare a report on the subject. RELEASE OF EASEMENT Councilman Janes offered the following resolution and moved its adoption: (RESOLUTION) WHEREAS, a certain easement was granted to the City of Austin for sanitary sewer purposes by instrument dated August 5, 1965 of record in Volume 3015 at Page 721 of the Deed Records of Travis County, Texas; same being out of and a part of that certain 10.13 acre tract of land out of the George W. Davis Survey Number 15 in Travis County, Texas; and, WHEREAS, the owners of the above described property have requested the City Council of the City of Austin to release the hereinafter described portion of said easement; and, WHEREAS, the City Council has determined that the hereinafter described portion of said easement is not now needed and will not be required in the future; Now, Therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That the Assistant to the City Manager of the City of Austin be, and he is hereby authorized to execute a release of the following described portion of said sanitary sewer easement, to-wit: A strip of land ten (10.00) feet in width, same being out of and a part of that certain 10.13 acre tract of land out of the George W. Davis Survey Number 15 in Travis County, Texas, which said 10.13 acre tract of = CITY OF AUSTIN. The ordinance was read the first time and Councilman Long moved that the rule be suspended and the ordinance passed to its second reading. CONTRACT AWARDED Councilman Long offered the following resolution and moved its adoption: (RESOLUTION) WHEREAS, bids were received by the City of Austin on July 17, 1968, for the installation of 1,479 feet of 8-inch concrete sewer pipe in Quail Run from + 100' north of Hearthside Drive, southerly to Peyton Gin Road; and, WHEREAS, the bid of Austin Engineering Company, in the sum of $18,696.30, was the lowest and best bid therefor and the acceptance of such bid has been recommended by the Director of Water and Sewer Department of the City of Austin and by the City Manager; Now, Therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That the bid of Austin Engineering Company, in the sum of $18,696.30, be and the same is hereby accepted, and that R. M. Tinstman, City Manager of the City of Austin, be and he is hereby authorized to execute a contract on behalf of the City, with Austin Engineering Company. =CITY OF AUSTIN, TEXAS July 25, 1968 The motion, seconded by Councilman Janes, carried by the following vote: Ayes: Councilmen Janes, LaRue, Long, Nichols, Mayor Akin Noes: None PIPELINE AGREEMENTS Councilman LaRue offered the following Resolution and moved its adoption: (RESOLUTION) BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That the Assistant to the City Manager be and he is hereby authorized and directed to enter into a Pipe Line Agreement on behalf of the City of Austin, with Missouri Pacific Railroad Company, for the installation of an 8-inch sanitary sewer pipe line crossing at a point 2904 feet south of Mile Post 184, in accordance with specifications and standard plan (as covered by Form 20021, Exhibit "A" to Form 20021) and also in accordance with the terms and provisions of a certain license exhibited to the City Council; and, BE IT FURTHER RESOLVED: That the City Clerk is hereby directed to file a copy of said Agreement in the permanent records of her office without recordation in the Minutes of the City Council. The motion, seconded by Councilman Janes, carried by the following vote: Councilmen Janes, LaRue, Long, Nichols, Mayor Akin Ayes: Noes: None Councilman LaRue offered the following resolution and moved its adoption: (RESOLUTION) BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That the Assistant to the City Manager be and he is hereby authorized and directed to enter into a Pipe Line Agreement on behalf of the City of Austin, with Southern Pacific Company, for the installation of an 8-inch sanitary sewer pipe line crossing at a point under its Llano Branch main track at Engineer's Station 267+40, Mile Post 6.49, in accordance with specifications and standard drawing (as covered by Form C.S. 1741) and also in accordance with the terms and provisions of a certain license exhibited to the City Council; and, July 25, 1968 CITY OF AUSTIN, TEXAS. BE IT FURTHER RESOLVED: That the City Clerk is hereby directed to file a copy of said Agreement in the permanent records of her office without recordation in the Minutes of the City Council. Mrs. Enola Washington, 2416 Hildalgo The motion, seconded by Councilman LaRue, carried by the following vote: Ayes: Councilmen Janes, LaRue, Long, Nichols, Mayor Akin Noes: None CONTRACT AWARDED Councilman LaRue offered the following resolution and moved its adoption: (RESOLUTION) WHEREAS, bids were received by the City of Austin on July 16, 1968, for the installation of 14 linear feet of 4-inch cast iron, 116 linear feet of 6-inch cast iron, 2,430 linear feet of 8-inch cast iron, 1,074 linear feet of 12-inch cast iron water mains and 269 linear feet of 8-inch concrete sewer mains in Anderson Lane and Northcrest Boulevard; and, WHEREAS, the bid of Walter Schmidt Construction Company, in the sum of $32,715.20, was the lowest and best bid therefor and the acceptance of such bid has been recommended by the Director of Water and Sewer Department of the City of Austin and by the City Manager; Now, Therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That the bid of Walter Schmidt Construction Company, in the sum of $32,715.20, be and the same is hereby accepted, and that R. SALE OF HOUSES Councilman Long offered the following resolution and moved its adoption: (RESOLUTION) WHEREAS, bids were received by the City of Austin on July 17, 1968, for the sale of nine (9) houses that Urban Renewal has turned over to the City for disposal; and, WHEREAS, the bids of Southwest Wrecking Inc. in the sum of $224.00 for the house located at 906 Wayne, and in the sum of $655.00 for the house located at 2504 New York; the bids of A. M. DeBerry in the sum of $1,226.88 for the house located at 2219-A Rosewood, and in the sum of $507.92 for the house located at 1183 Singleton; the bids of Weldon Johnston in the sum of $41.00 for the house located at 2805 Walter, in the sum of $13.00 for the house located at 1008 Wayne, and in the sum of $37.00 for the house located at 1136 Lowe; and the bids of August Heyer in the sum of $77.85 for the house located at 2904 Kuhlman, and in the sum of $31.40 for the house located at 1166 Hargrave, were the highest and best bids therefor, and the acceptance of such bids has been recommended by the Building Official of the City of Austin, and by the City Manager; Now, Therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That the above enumerated bids of Southwest Wrecking Inc., A.M. The motion, seconded by Councilman LaRue, carried by the following vote: Ayes: Councilmen Janes, LaRue, Long, Nichols, Mayor Akin Noes: None CITY OF AUSTIN, TEXAS July 25, 1968 ACQUISITION OF PROPERTY Councilman LaRue offered the following resolution and moved its adoption: (RESOLUTION) BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That the offer of the owners and claimants of the hereinafter described tract of land to convey unencumbered fee simple title thereto to the City of Austin in consideration of the cash payment of $17,650.00 therefor be accepted, and that the City Manager or his designate be and he is hereby authorized to consummate purchase of the following described tract of land, to-wit: Lot No. Three (3), Block No. Four (4), in Herman Brown Addition, in the City of Austin, Travis County, Texas, according to the map or plat of said subdivision of record in Volume 5, Page 98, of the Plat Records of Travis County, Texas. E. Tobey and wife to Agnes S. Burrows, dated July 31, 1946, recorded in Volume 813, Page 328330, of Travis County Deed Records, to which reference is here made for particulars. The motion, seconded by Councilman Janes, carried by the following vote: Ayes: Councilmen Janes, LaRue, Long, Nichols, Mayor Akin Noes: None July 25, 1968 CITY OF AUSTIN, TEXAS Councilman Nichols offered the following resolution and moved its adoption: (RESOLUTION) BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That the offer of the owners and claimants of the hereinafter described tract of land to convey unencumbered fee simple title thereto to the City of Austin in consideration of the cash payment of $14,800.00 therefor be accepted, and that the City Manager or his designate be and he is hereby authorized to consummate purchase of the following described tract of land, to-wit: Lot No. Six (6) and the West five (5) feet of Lot No. Seven (7), Block Three (3), Herman Brown Addition, an addition in the City of Austin, Travis County, Texas, according to the map or plat thereof, recorded in Plat Book 5, Page 98, Plat Records of Travis County, Texas.
