COUNCIL CHAMBER, CITY HALL The meeting was called to order with Mayor Akin presiding. Roll Call: Present: Absent: Councilmen Janes, LaRue, Nichols, Mayor Akin Councilman Long The Invocation was delivered by REVEREND LOYCE ESTES, First Cumberland Presbyterian Church. Mr. Chester Morris appeared before the Council to protest the payment of his utility bill. Mr. Morris stated that his electricity had already been turned off and that the utility department was continuing to send him a bill at the wrong address. City Manager Tinstman asked Mr. Morris to meet with him at his office at a later date to resolve the matter, and noted that the bill for the last ten days of service would have to be paid. PROPOSED MUNICIPAL UTILITY RATE STUDY Councilman Janes moved the Council authorize the City Manager to enter into a contract with Ebasco for $24,000 for the purpose of conducting a Municipal Utility Rate Study. INTRODUCTION OF NEW FIRE CHIEF, ED KIRKHAM City Manager Tinstman introduced to the Council the City's new Fire Chief, Ed Kirkham, formerly Fire Chief in San Angelo, Texas. Mayor Akin welcomed Chief Kirkham to the City and assured him that he would have the utmost in the way of cooperation and support from the City Council. August 29, 1968 =CITY OF AUSTIN, TEXAS "PRIVATE SECURITY BUSINESS" REPORT City Manager Tinstman noted that a report concerning the business of private security had been prepared following the discussion with both the Police and Legal Departments. Tinstman stated that a good part of the promotional material on private security agencies that he and Chief Miles had received indicated that a citizen should call the protective service first and then call the Police Department. Attorney Bob Smith remarked that quite a bit of publicity had been given to an agency which was advertising with such terms as "armed uniformed patrol". Mr. Smith stated that people were getting a false sense of security by thinking they were getting police protection under a private armed patrol licensed by the City when the private patrol didn't have any more power than the citizen whose house he was supposed to watch. He further stated that he would be in favor of some kind of State law that would be uniform having to do with private detectives and detective agencies permitted to carry weapons. Chief Miles said that he was primarily concerned with eliminating any possibility of competition between the various segments of the law enforcement agencies set up by the community. Mr. Norman Rylander, former owner of a private security agency patroling the northeast Austin area, appeared before the Council to inform them of the necessity of these private agencies and to answer questions from the Council regarding his own agency. Mr. Stanley Cavitt, resident of Northwest Hills, also supported the need for extra patrol in certain areas and noted that his neighborhood was trying to work with the Police. After further discussion, Councilman Long moved the Council request the City Manager to work out an acceptable plan which would do away with armed patrols and at the same time provide for some type of night watchman service. The motion, seconded by Councilman LaRue, carried by the following vote: Ayes: Councilmen Janes, LaRue, Long, Nichols, Mayor Akin Noes: None UTILITY PAYMENT OF ROBERT J. SIDEL Mr. Robert Sidel appeared before the Council to protest his not being credited for a bill he claimed to have paid. Mr. Sidel stated that on the same day he went to pay his bill he was informed of an additional bill left by his ex-wife, which he paid and which the City did record. Mr. Sidel questioned the fact that his bill was somehow transferred to a new address which would not be possible had he not paid the bill. City Manager Tinstman stated that the matter would be investigated and Mr. Sidel would be contacted later. DESIGN OF CITY PUBLIC BUILDINGS FOR HANDICAPPED PERSONS Councilman Janes offered the following resolution and moved its adoption: August 29, 1968 - CITY OF AUSTIN, TEXAS (RESOLUTION) WHEREAS, entrance and public areas of buildings owned by the City of Austin should be accessible for the handicapped; and, WHEREAS, the Building Code of Appeals Board agrees that the accessibility for the handicapped to buildings owned by the City of Austin is necessary for the esthetic and functional qualities of the building; and, WHEREAS, the City of Austin desires to continue designing its buildings giving the utmost consideration to the accessibility of the buildings for the handicapped; Now, Therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That all new City-owned buildings constructed in the future for public occupancy be equipped with a ramp to the first floor for easy ingress and egress, that the front and rear doors be not less than 28 inches wide, that all stairs have handrails on either side thereof, and that each floor contain toilets equipped with "grabs" and a door not less than 28 inches wide. Jones of TEC appeared before the Council requesting that additional improvements be made in the design of all buildings which would further benefit the needs of the handicapped. City Manager Tinstman suggested that Dick Jordan set up a meeting whereby the Building Appeals Board would review the Building Code. PERSONAL BOND PROGRAM Mr. Bob Smith, County Attorney, appeared before the Council to inform them of the Personal Bond Program. Mr. Smith stated that citizens jailed should be properly informed of the bond service, but that there was still a difficulty in determining who was eligible, since a good many of the cases were transients. Mr. Smith further stated that the agency that the County was trying to set up would be responsible for locating bond cases, tracing their background, and determining when they should appear in court. After further discussion, Councilman Long moved the Council adopt the agreement as outlined between the City and the County of Travis concerning the Personal Bond Program. The motion, seconded by Councilman LaRue, carried by the following vote: Ayes: Councilmen Janes, LaRue, Long, Nichols, Mayor Akin Noes: None STREET DEDICATION Councilman Nichols offered the following resolution and moved its adoption: (RESOLUTION) CITY OF AUSTIN, TEXAS August 29, 1968 WHEREAS, the City of Austin has acquired 293.62 acres of land for use as open space in accordance with the Development Plan of the City of Austin as approved by the City Council on June 8, 1961; and, WHEREAS, the City Council of the City of Austin finds that, due to prevailing conditions including the need for traffic circulation around said open space for public accessibility thereto, that the creation and dedication of a thoroughfare, street or road around the perimeter of said open space will enhance the usefulness and safety of said open space for public enjoyment; and, WHEREAS, the dedication of the hereinafter described tract for street purposes will be in conformity with the above stated finding Now, Therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That the following described tract of land owned by the City of Austin, a municipal corporation situated in Travis County, Texas, be and the same is hereby set aside and dedicated for use as a public street and thoroughfare in the City of Austin, said tract being described as follows: 0.56 of one acre of land, same being out of and a part of that certain 44.27 acre tract of land partly out of the S. The motion, seconded by Councilman LaRue, carried by the following vote: Ayes: Councilmen Janes, LaRue, Long, Nichols, Mayor Akin Noes: None CONTRACTS AWARDED Councilman Nichols offered the following resolution and moved its adoption: (RESOLUTION) WHEREAS, bids were received by the City of Austin on August 21, 1968, for the installation of 4,784 feet of 48-inch concrete steel cylinder transmission line from Rollingwood Drive to the intersection of the proposed Barton Skyway and Mo-Pac Boulevard, to provide additional water service from Filter Plant No. 3 to the South Austin Area; and, CITY OF AUSTIN. TEXAS August 29, 1968 WHEREAS, the bid of J. C. Evans Construction Company, Incorporated, in the sum of $268,310.40, was the lowest and best bid therefor and the acceptance of such bid has been recommended by the Director of Water and Sewer Department of the City of Austin and by the City Manager Now, Therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That the bid of J. C. Evans Construction Company, Incorporated, in the sum of $268,310.40, be and the same is hereby accepted, and that R. M. Tinstman, City Manager of the City of Austin, be and he is hereby authorized to execute a contract on behalf of the City, with J. C. Evans Construction Company, Incorporated. The City, after obtaining permission from the Texas Water Development Board, could apply for a free Federal study of the City's creeks to determine where flooding was occurring. Future construction in those flood areas would be controlled carefully by ordinance. After some discussion among the Council, Councilman Long moved the Council instruct the City Manager to investigate the problem and make recommendations setting out the City's creeks. The motion, seconded by Councilman Nichols, carried by the following vote: Ayes: Councilmen Janes, LaRue, Long, Nichols, Mayor Akin Noes: None TEXAS MUNICIPAL LEAGUE INVITATION City Manager Tinstman stated that the Council had been invited through the Texas Municipal League to participate and provide representation on the legislative study committees for the National League of Cities which would be meeting December 7-11 in New Orleans. Mr. Tinstman asked the Council to give the matter some consideration, since it would help to contribute to Urban Policy through the National League of Cities. August 29, 1968 _ CITY OF AUSTIN. TEXAS MOPAC BOULEVARD LAND ACQUISITION City Manager Tinstman recommended that the Council hold any decision on the property at 3012 Perry Lane until more information could be obtained. The Council agreed to hold any action of the purchase of the property at 1806 Northwood Road until the following week. Councilman Long offered the following resolution and moved its adoption: (RESOLUTION) BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That the offer of the owners and claimants of the hereinafter described tract of land to convey unencumbered fee simple title thereto to the City of Austin in consideration of the cash payment of $12,000.00 therefor be accepted, and that the City Manager or his designate be and he is hereby authorized to consummate purchase of the following described tract of land, to-wit: Lot No. Thirty (30), in Block "A", of Highland Park, a subdivision in the City of Austin, Travis County, Texas, according to map or plat of said subdivision of record in Book 4, Page 218, of the Travis County Plat Records.
