=CITY OF AUSTIN, TEXAS MINUTES OF THE CITY COUNCIL CITY OF AUSTIN, TEXAS Regular Meeting February 06, 1969 9:00 Α.Μ. COUNCIL CHAMBERS, CITY HALL The meeting was called to order with Mayor Akin presiding. Roll Call: Present: Councilmen Janes, LaRue, Long, Nichols, Mayor Akin Absent: None The Invocation was delivered by REVEREND BILL MIDDLETON, St. Paul Cumberland Presbyterian Church. INTRODUCTION OF GENERAL CROSS Col. Vance Murphy introduced the new Bergstrom Base Commander, Brigadier General James U. Cross and Mrs. Cross. General Cross acknowledged the introduction and spoke briefly to the Council. NATIONAL RECREATION AWARD PRESENTED Mr. Rooster Andrews presented to the City of Austin the gold medal award for excellence in the field of park and recreation management, the Grand Award in Class II for cities of populations between 100,000 and 250,000. Mr. Beverly Sheffield, Parks and Recreation Director, accepted the award on behalf of the City of Austin. REPORT ON AUSTIN TEEN CHALLENGE REV. ROYCE NIMMONS Reverend Royce Nimmons, Director, Austin Teen Challenge, appeared before the Council to present a resume of the work being done by Austin Teen Challenge. He reported that the group had established a Coffeehouse at 105 West 4th Street which worked with young people in drug addiction, alcoholism, runaways and all other types who might be included in that area. February 6, 1969 CITY OF AUSTIN, TEXAS CITIZEN APPEARANCES Mrs. Charles Beightler, Dr. Harold Wolfe and Dr. Roger Shields appeared before the Council to request a rollback zoning change on property located on Far West Boulevard between Northledge and Edgefield Drives. Mrs. Beightler read and presented a petition containing the signatures of 254 area property owners who were opposed to the building of an apartment complex and shopping center on the subject property. After discussion among the Council, City Attorney Cortez and City Manager Tinstman, it was agreed that the group would meet with Mr. Tinstman and Mr. Cortez or the Building Official to discuss the matter in more detail so that the group would know what its options were. HEARING OPENED AND RECESSED Councilman LaRue moved the Council open and recess the hearing scheduled for 10:30 A.M. The motion, seconded by Councilman Nichols, carried by the following vote: Ayes: Councilmen Janes, LaRue, Long, Nichols, Mayor Akin Noes: None FINANCIAL REPORT RECEIVED Councilman LaRue moved the Council note the receipt of the Financial Statement for the three months period ending December 31, 1968. The motion, seconded by Councilman Nichols, carried by the following vote: Ayes: Councilmen Janes, LaRue, Long, Nichols, Mayor Akin Noes: None FRANCHISE APPLICATION HEARING TRANSPORTATION ENTERPRISES, INC. Mayor Akin opened the previously recessed hearing scheduled for 10:30 A.M. to consider the application of Transportation Enterprises, Inc. for a franchise to operate a charter bus service in the University of Texas area. Mr. Dan Felts, representing Transportation Enterprises, requested a one- or two-week continuance because the attorney who had been handling the matter was out of town on another case. Mr. Frank Denius, representing the Austin Transit Corporation, introduced several individuals who had an interest in the proceeding. He then clarified for the Council the position of Austin Transit Corporation. He did not object to continuing the hearing for one week, but requested that the Austin Transit rate hearing be postponed until February 20th. Councilwoman Long moved the Council continue the present hearing until February 13, 1969 and reschedule the Austin Transit rate case to February 20, 1969. The motion, seconded by Councilman Nichols, carried by the following vote: Ayes: Noes: Councilmen Janes, LaRue, Long, Nichols, Mayor Akin None February 6, 1969 CITY OF AUSTIN, TEXAS PARADE PERMIT GRANTED Mr. Grey Mujica and Mr. Frank Ramirez appeared before the Council to request a parade permit for a group of striking employees at Economy Furniture Company. The strikers requested to march from East Austin to Cambridge Tower at 18th and Lavaca Streets, the residence of Mr. Milton Smith, owner of Economy Furniture Company. After some discussion among the Council, City Attorney Cortez and Mr. Alford, who spoke also for the striking employees, it was agreed to revise the march route. Councilman Janes moved the Council grant the parade permit with the revised route from Christo Rey Church to Wooldridge Park. The motion, seconded by Councilwoman Long, carried by the following vote: Ayes: Councilmen Janes, LaRue, Long, Nichols, Mayor Akin Noes: None PARADE PERMIT GRANTED AUSTIN CITIZEN BAND RADIO CLUB Councilman Nichols moved the Council grant the parade permit for the Austin Citizen Band Radio Club on July 26, 1969, as requested. The motion, seconded by Councilwoman Long, carried by the following vote: Ayes: Councilmen Janes, LaRue, Long, Nichols, Mayor Akin Noes: None AIRLINE SERVICE CASE BEFORE CIVIL AERONAUTICS BOARD The City Manager stated that the airline service case was before the Civil Aeronautics Board for certification of additional service to Austin which would permit nonstop flights between Austin and Washington, D.C. and Austin and New York City. The resolution was an endorsement by the City that the application be granted. Councilman Nichols moved the Council endorse the request which was before the Civil Aeronautics Board for servicing Austin. The motion, seconded by Councilman Janes, carried by the following vote: Ayes: Councilmen Janes, LaRue, Long, Nichols, Mayor Akin Noes: None CONTRACT AWARDED Councilwoman Long offered the following resolution and moved its adoption: (RESOLUTION) WHEREAS, bids were received by the City of Austin on January 28, 1969, for the construction of a reinforced concrete box culvert on East 12th Street at Tannehill Branch of Boggy Creek, Contract No. 69-D-1; and, =CITY OF AUSTIN, TEXAS February 6, 1969 WHEREAS, the bid of Larson-Pugh, Inc., in the sum of $17,966.00, was the lowest and best bid therefor and the acceptance of such bid has been recommended by the Director of Public Works of the City of Austin and by the City Manager; Now, Therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That the bid of Larson-Pugh, Inc., in the sum of $17,966.00, be and the same is hereby accepted, and that R. M. Tinstman, City Manager of the City of Austin, be and he is hereby authorized to execute a contract on behalf of the City with Larson-Pugh, Inc. The motion, seconded by Councilman LaRue, carried by the following vote: Ayes: Councilmen Janes, LaRue, Long, Nichols, Mayor Akin Noes: None PUBLIC RIGHT OF WAY SPACE DESIGNATED FOR NATURAL GAS UTILITY Councilwoman Long offered the following resolution and moved its adoption: (RESOLUTION) WHEREAS, Southern Union Gas Company has presented to the City Council tentative maps or plans showing the proposed construction of its gas mains in the street in the City of Austin hereafter named, and said maps or plans have been considered by the City Council: therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT Southern Union Gas Company be and the same is hereby permitted to lay and construct its gas mains in and upon the following streets: (1) A gas main in MYRICK DRIVE, from Mesa Drive, easterly 477 feet the centerline of which gas main shall be 15 feet south of and parallel to the north property line of said MYRICK DRIVE. (2) A gas main in SHADYROCK DRIVE, from Myrick Drive, southerly 872 feet; the centerline of which gas main shall be 15 feet west of and parallel to the east property line of said SHADYROCK DRIVE. CITY OF AUSTIN, TEXAS February 6, 1969 be and the same is hereby granted and the Director of Public Works is hereby authorized to issue a permit for the construction of such improvements, said grant and permit to be subject to the following conditions; (1) The improvements shall be constructed and maintained in compliance with all ordinances relating thereto. (2) The permit shall be issued and accepted subject to all reasonable police, traffic, fire and health regulation as the City of Austin, now existing or hereafter adopted. (3) The repair or relocation of any and all utilities in the vicinity necessitated by the laying of these improvements shall be done at the expense of the Southern Union Gas Company of Austin, Texas. (4) The Southern Union Gas Company of Austin, Texas, will indemnify and save the City of Austin harmless from any and all claims against said City growing out of or connected with the construction or maintenance of said improvements. (5) That all backfill under street surfaces between existing or future proposed curbs and under driveways and alleys, shall be tamped with mechanical tampers in six (6) inch layers. Each layer shall be compacted to not less than 90 per cent of maximum density as determined by the Standard Method of Test for Compaction and Density of Soils, A.A.S.H.O. Designation T99-49. (6) The City of Austin may revoke such permit for good cause after notice to the Southern Union Gas Company, in Austin, and hearing thereon, and upon such revocation the owner of such improvements will remove the same and pay all costs and expenses attendant therewith. WILLIAM KREIGER as described in the Travis County Deed Records and known locally as Lot 2, Block C, Aqua Verde, and hereby authorizes the said MR. WILLIAM KREIGER to construct and maintain a retaining wall as described on the attached plan in compliance with all laws and ordinances relating thereto. Said permission shall be held to be granted and accepted subject to all necessary, reasonable and proper, present and future regulations and ordinances of the City of Austin, Texas, in the enforcement of the proper police, fire and health regulations and the right of revocation is retained if, after hearing, it is found by the City Council that the said MR. WILLIAM KREIGER has failed and refused and will continue to fail and refuse to comply with any such conditions, regulations, laws and ordinances. APPOINTMENT OF CHARTER REVISION COMMISSION AND DIRECT ELECTION OF MAYOR BY THE PEOPLE Mayor Akin brought up the matter of placing on the upcoming April ballot the appointment of a Charter revision commission. City Attorney Cortez stated that there was a Charter provision for a Charter Commission which may be submitted on a ballot to the public. Councilman LaRue read and stated that next week he would bring up an ordinance for consideration to place on the upcoming April Ballot the direct election of the Mayor by the citizens of Austin. The ordinance would be a Charter amendment request. There was discussion among the Council regarding the necessity of placing the Charter Revision Commission proposition on the ballot instead of merely appointing a Commission.
