-CITY OF AUSTIN. TEXAS MINUTES OF THE CITY COUNCIL CITY OF AUSTIN, TEXAS Regular Meeting April 17, 1969 10:00 Α.Μ. Council Chamber, City Hall The meeting was called to order with Mayor Akin presiding. Roll Call: Present: Mayor Akin, Councilmen Janes, LaRue, Long Absent: Councilman Nichols Present also: R. M. Tinstman, City Manager; Glenn Brown, City Attorney Invocation was delivered by RABBI JUDAH L. FISH, Congregation Agudas Achim. Mayor Akin announced that Council Nichols would be absent during a part of the meeting. ORIENTAL GARDEN ISAMU TANIGUCHI Mayor Akin recognized MR. and MRS. ISAMU TANIGUCHI, their son ALAN TANIGUCHI, Department of Architect at the University of Texas, and MR. WARREN LEDDICK, Department of Recreation, stating at the dedication ceremonies of the Oriental Gardens he had read a special Resolution of appreciation for the Gardens created by Mr. Isamu Taniguchi, who wanted these Gardens to be a symbol of universal peace and beauty. The Mayor pointed out this extraordinary example of citizen contribution to the Municipality, and urged all the people to visit the gardens and view the work of this gifter person. MR. ALAN TANIGUCHI on behalf of his father, expressed gratitude for the attitude of the City in giving him an opportunity to express his ideas in this manner. Councilman Janes stated Austin was honored by Mr. Taniguchi's being here. Mrs. Taniguchi was recognized and welcomed. Councilman LaRue stated the citizens have been impressed and moved by this contribution. Councilman Long urged all to visit these gardens and note what one man had done for the enhancement and enjoyment of the people of Austin. Councilman Janes offered the following resolution and moved its adoption: (RESOLUTION) WHEREAS, the constant and urgent demands of life in today's city, wherein time is measured to the cadence of machines tend to desensitize one April 17, 1969 =CITY OF AUSTIN, TEXAS to the beauty and peacefulness of which may belong to any one willing to accept it; and, WHEREAS, it is through the devoted and patient efforts of Isamu Taniguchi that the City of Austin has been endowed with an oriental garden which, while providing a place for contemplation and respite from the hectic activities of modern life, is a symbol of universal peace and beauty; Now, Therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That the gratitude of the people of the City of Austin be, and is, hereby officially expressed to Isamu Taniguchi for his contribution to this City of the oriental garden located in Zilker Park, and that said garden be, in his honor, named the "Isamu Taniguchi Oriental Garden." The motion, seconded by Councilman LaRue, carried by the following vote: Councilmen LaRue, Long, Mayor Akin, Councilman Janes Ayes: Noes: None Absent: Councilman Nichols Councilman LaRue noted worlds of information in both of the documents, and stated they were very fine reports. Councilman Long asked why some of the data was based on 1966 figures. The Director of Planning explained this was the latest information in some cases; and the latest official records were the ones used in general. Councilman Janes noted the census tracts bore the 1960 date, but the current estimates are up to date. The motion, seconded by Councilman Long, carried by the following vote: Ayes: Noes: Councilmen Janes, LaRue, Long, Mayor Akin None Absent: Councilman Nichols POSITIONS OF DEPUTY POLICE CHIEF AND CHIEF PROSECUTING ATTORNEY The City Manager said the Council had asked at the time of the adoption of the Budget, that the Administrative Staff review the general law enforcement program and report back as to steps that might be taken in order to improve law enforcement in the community. He, the Chief of Police, and other law enforcement jurisdictions, had collaborated on the matter and reported to the Council in December. After extended consideration the Council generally approved the recommendation subject to specific implementation. In this report it was recommended by the Chief of Police and three City Attorneys, that the position of Deputy Police Chief and Chief Prosecuting Attorney be extablished. In answer to Councilman Long's inquiry, the City Manager said the duties for the Deputy Chief of Police of Operations included responsibility of the Uniformed Patrol Division, Service Division, and Criminal Investigation. The existing Deputy Chief of Police would continue with the Administrative responsibility. This would be analagous to Division of Operating and Internal Administration as existing in the Fire Department. The advantage is the emphasis given to Police Operations and Police Services throughout the community under the Deputy Chief of Police who reports directly to the Chief of Police. This would minimize the operations people from becoming unduly involved in administration allowing the operating command to function more effectively, and also the reporting would be improved. Councilman LaRue believed this would result in better administration and reduce the number of people reporting to the Chief. The City Manager added this program would be good from the standpoint of personnel development. He reported that this falls under a classification under the Civil Service Statute, but it would be an addqtional position in this classification. Councilman Long asked about the Budget provision. The City Manager stated it may be necessary to amend the Budget, depending upon the remaining six months of this year and whether or not there will be payroll savings; however, it may not be necessary April 17, 1969 CITY OF AUSTIN, TEXAS. for the Council to appropriate supplemental funds, and he would not recommend such at this time. Councilman Long asked how this would help the Legal Department. The City Manager said the two significant benefits that would be realized from the Chief Prosecuting Attorney in the Legal Department would be: (1) It would effect more effective prosecution of cases following the Police Department's action in handling the cases; and (2) by emphasing the prosecution, this would be significant in deterring criminal activity and a moral support to the men in the Police Department. The Legal Department and the Courts are following up on their efforts. Councilman Long said she hoped that this Chief Prosecuting Attorney could help in preparing ordinances with participation of the various departments involved. The City Attorney, MR. GLENN BROWN, stated this would provide stability and continuity in the handling of Corporation Court matters and other important matters. He emphasized the stability and continuity not only in the Police Department but for other Departments of the City that had enforcement powers. Councilman Janes asked on what level would the Chief Prosecuting Attorney be. The City Attorney stated he would be as a Division Chief, and responsible only to the City Attorney and would be in complete charge of the enforcement area. His rank would be slightly lower than the Associate City Attorney, but reporting to the City Attorney. Councilman Janes suggested a civil division and enforcement and let them both report to the City Attorney through the Associate City Attorney. After further discussion, Councilman Janes moved the Council endorse the recommendations contained in M & C #17-A. (Recommendation: It is recommended that the City Council approve and establish the positions of Deputy Chief of Operations and Chief Prosecuting Attorney. Supplemental appropriations may be necessary prior to the end of the fiscal year.) The motion, seconded by Councilman Long, carried by the following vote: Ayes: Noes: Councilmen Janes, LaRue, Long, Mayor Akin None Absent: Councilman Nichols TRAFFIC Parking Meter Zone, Speed Zone, and Speed Limits The Traffic Engineer reported the 30 minute parking meters were requested by Harrison, Wilson and Pearson due to long time parkers in this block on both sides, primarily due to the College in the area. The Traffic Department believed there was a need for shorter time limits of parking and they recommended 30 minutes zones. (300 block of West 6th Street south side) The "20" mile speed zone was requested by the Safety Committee at Simms Elementary School, and the Traffic Engineer concurred in their request. Councilman LaRue asked if it were not the normal procedure for the City to set the "20" MPH zones near the schools. The Traffic Engineer stated these speed zones were usually initiated by the City. (Vicinity of Simms School) The establishment of speed limits on I.H. 35 and U.S. Highway 290 was due to a speed limit survey by the Highway Department. The Traffic Department had requested the setting of speed limits along the east and west service roads, and the State Highway Department came back with a recommendation of increasing the speed on the services roads from 35 to 60 with variations at several locations. He pointed out the locations on a strip map. In answer to Councilman April 17, 1969 CITY OF AUSTIN, TEXAS Long's inquiry, the Traffic Engineer stated it had been several years since a study of the speed zone had been made along the entire service roads. Water and Waste Water Utilities stated the main was large enough, and the growth had been taken into account. MR. IRWIN R. SALMANSON stated this was a very important item and may bear on future development. He asked what size apartment development in this area could this line serve. MR. VIC SCHMIDT, Director of Water and Sewer Utilities, said this area is West of that in which Mr. Salmanson is interested. The City's primary concern is the truck main in Shoal Creek from Highway 183 to the river, and not the feeder lines, which are sufficiently large. Councilman LaRue pointed out that this is a matter of judgment of what future Councils will do taking into account the limitations of the sewer, streets, and everything else involved. Councilman Long stated the Councils would have to depend on the engineers and City Administration for consultation and advice. She expressed confidence in Mr. Schmidt as being very conscientious. Mr. Schmidt stated infiltration had affected the problem far more than density, and efforts were being made to cure the infiltration problems through construction. The City Manager erported their concern was the standards of construction, specifications and inspections on new lines, and it was hoped that the adverse effect of high infiltration furing rain fall on new construction could be prevented; but it is the old lines that are most difficult and more costly. Councilman Long asked about the new school to be constructed northeast of Manor Road, and noted Mr. Carrington had been permitted to put in a subdivision on reclaimed properties where the city knew at the time, were shifting and not even good enough to put in a street. Now he was trying to work out a plan whereby he would not have to build a street. The City Manager, at that time, agreed that they could put the street in and the subdivider would be responsible. She stated she hoped that the City would never allow something to be built on a piece of property that is shifting and eroding. Water mains in the area will have to be replaced, and the schools may have to abandon their sites. The City Manager reported that the developer had given a commitment to save the City any unusual cost; and if there is any expense in relocating the mains it will not be the City's. Councilman Long asked why these problems were allowed to develop. The City Manager stated it would be a basic question of telling someone they could not use their private property; or saying they could use it under certain conditions or compensating the individual property owner for taking his property. Councilman Long stated the City installed an expensive main and allowed a street that they knew would not stand up. The City Manager stated there was some concern; but at that time they did not know it definitely would not stand up. The motion, seconded by Councilman Long, carried by the following vote: Ayes: Noes: Councilmen LaRue, Long, Mayor Akin, Councilman Janes None Absent: Councilman Nichols ACQUISITION OF PROPERTY The City Manager stated the East 51st Street property was necessary for the Airport Development, and the staff had been in contact with the owners, but there is a considerable difference of opinion on the price. Councilman Long stated there was only a small portion needed, and she did not know why the owners would not sell a small portion of it, nor did she think it was necessary to condemn and buy the property. The City Manager stated the owners had not been willing to negotiate on any basis--partial or on the whole; and as far as the total Airport development is concerned in maintaining the safety on the runways, he recommended the acquisition of the whole tract. The acquisition also is recommended by the F.A.A. for clearance. Councilman LaRue discussed possible severance damages should only a portion be taken. Councilman Janes offered the following resolution and moved its adoption: (RESOLUTION) WHEREAS, the City Council of the City of Austin has found that public necessity requires the expansion of Robert Mueller Municipal Airport in the City of Austin; and, WHEREAS, the City Council has found and determined that public necessity requires the acquisition of the hereinafter described tract of land to provide for the expansion of said Robert Mueller Municipal Airport; and WHEREAS, the City of Austin has negotiated with the owners of said land and has been unable to agree with such owners as to the fair cash market value =CITY OF AUSTIN, TEXAS April 17, 1969 thereof; Now, Therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That the City Manager be and he is hereby authorized and directed to file or cause to be filed against the owners and lienholders, a suit in eminent domain to acquire fee simple title for said purposes to the following described tract of land, to-wit: TRACT I. C. REESE The Director of Public Works stated this was a 50 foot lot on which the City would retain an easement, and there would be only 15' of usable property left. Councilman Long questioned the amount to be received on this property stating it to be insufficient. Councilman LaRue suggested obtaining more appraisals on this property. The Council held the sale of this property over for further appraising. TRANSFER OF FUNDS In answer to Councilman Long's inquiry, the City Manager reported the transfer of funds from Airport account to Traffic and Transportation was due to the transfer of Airport employees to the Traffic and Transportation as Parkaidettes. By consolidating the Airport employees with the Parkaidettes, the Traffic Engineer can arrange a rotating assignment basis and maintain the necessary scheduling. Councilman Janes moved the transfer of appropriation of $2,120 from the Airport to Traffic and Transportation be approved. The motion, seconded by Councilman LaRue, carried by the following vote: Ayes: Noes: Councilmen LaRue, Long, Mayor Akin, Councilman Janes None Absent: Councilman Nichols CITY OF AUSTIN, TEXAS April 17, 1969 COMMENDATION Councilman LaRue moved the Council recommend a Resolution of commendation of the Department of Public Safety for cooperating with the City in staggering the working hours for their employees. The motion, seconded by Councilman Long, carried by the following vote: Ayes: Councilman Long, Mayor Akin, Councilmen Janes, LaRue Absent: Councilman Nichols Noes: None He stated this this move had been under way for many years. He suggested that since the City has 3,500 to 4,000 employees that a program be started to do the same thing, even more than what is being done now. ABATTOIR The City Manager stated in reviewing the Abattoir matter with the Staff, the City had no basis on which to take other action with respect to the present occupiers of the property. Their lease had expired, and they had been leasing on a month to month basis. Councilman Long asked if there were plans as it is the only processing plant in Austin; and once it is closed down, the operation will be ruined as well as the facilities. The City Manager reported three other meat producers had been contacted to see if they would be interested in the operation. The entire City staff is unanimous that the City should not attempt to operate a meat slaughtering and processing plant. He said they were planning to have someone there to operate it until the end of the month. Councilman Janes inquired about the situation in case it would be hard to obtain this approval again without a huge outlay of funds. The City Manager stated the meat slaughtering and processing industry has changed considerably in the last five to ten years. Councilman LaRue noted operations with half the number of people and half the expense could be realized with a new plant, and the City had been in the past losing $30-$40,000 a year. The City Manager said unless there was some present meat processing firm who wanted to come in and continue the license and operation, that the City should retain the property. In view of the present condition of those properties and the physical design, otherwise he probably would come back to the Council with a recommendation to raze the structure at least for the interim and keep title to the property. Councilman LaRue recalled that the public had voted on the Abattoir several years ago; at which time the people voted not to have the City operating an Abattoir. The City Manager stated he would not recommend it. At this time, he stated only Council action necessary now would be to acknowledge receipt of the notice from the Company which anticipates continuing in operation. He said he would try to have some personnel there 24 hours a day not only to protect the property and to be aware of any hazards, but to keep the refrigeration going. Councilman Long inquired about their financial status with the City--utility bills, etc. The City Manager said he would check this. Councilman Janes moved the Council note receipt of and accept notice of termination of lease from AUSTIN COMMUNITY LIVESTOCK PROCESSORS, INC., of the Abattoir property.
