CITY OF AUSTIN, TEXAS MINUTES OF THE CITY COUNCIL CITY OF AUSTIN, TEXAS Regular Meeting July 24, 1969 9:00 Α.Μ. COUNCIL CHAMBERS, CITY HALL The meeting was called to order with Mayor LaRue presiding. Roll Call: Present: Councilmen Atkison, Gage, Janes, Johnson, Price, Mayor LaRue Councilman MacCorkle Absent: The Invocation was delivered by REVEREND J. W. LANGFORD, Episcopal Church of the Resurrection. APPROVAL OF MINUTES Councilman Gage moved the Council approve the Minutes of the June 5, 1969 meeting. The motion, seconded by Councilman Johnson, carried by the following vote: Ayes: Noes: Councilmen Atkison, Gage, Janes, Johnson, Price, Mayor LaRue None Absent: Councilman MacCorkle OPPOSITION TO AMENDMENT NO. 2 Mrs. Margaret Louise Hancock, representing the Committee of 1000 to Oppose Amendment No. 2, appeared before the Council to express opposition to a brochure endorsing the amendment having been placed in the Water and Light statements. She thanked the Council for upholding the policy of not mailing enclosures in the Water and Light Department bills. RECOGNITION OF RAYMOND CULP Councilman Gage offered the following resolution and moved its adoption: (RESOLUTION) July 24, 1969 -CITY OF AUSTIN. TEXAS WHEREAS, Raymond Culp is a product of Austin, its public school system and of various schoolboy baseball teams in Austin; and, and, WHEREAS, he is the son of an Austin City Fireman, Raymond L. Culp, Sr.; WHEREAS, he has gone on to become one of the outstanding baseball pitchers in the major leagues; and, WHEREAS, he has been chosen as a pitcher on the American League All Star Team for 1969, one of the great honors accorded by our national pastime; and, WHEREAS, Raymond Culp is the first native Austinite known to have been selected to a major league all-star team, bringing much honor and credit to the City, his family and all of his former Austin associates who coached or played with him in his Austin school years; Now, Therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That the feeling of pride of the citizens of Austin in this achievement and their sincere congratulations be conveyed to him by copy of this Resolution as well as their best wishes for his continued future success in his baseball career. He referred to the Supreme Court holdings on competative bidding and requested the Council authorize the awarding of the contract to Westinghouse. It was the will of the Council that the matter be held in abeyance until the members could receive information from Department heads and staff. AQUA FEST EXPANDED Mr. Clarence Saegert, Vice Commodore of the Aqua Festival, appeared before the Council to announce that three extra nights of festivities had been added to the event. July 24, 1969 CITY OF AUSTIN. TEXAS HEARING RECESSED Councilman Janes moved the Council open and recess the annexation hearing scheduled for 9:30 A.M. Johnson appeared before the Council to discuss the reorganization of the Police Department. ANNEXATION HEARING--FIRST AND SECOND READINGS Mayor LaRue opened the hearing scheduled for this time on the following (requested by representative for owners) annexation: (a) 9.18 acres of land out of the William Cannon League proposed FLOURNOY'S SWEETBRIAR, SECTION V. (b) 0.115 of one acre of land out of the "1969 Replat of Lot 15, Block B, NORTHWEST HILLS, SECTION FIVE". No one appeared to participate. Councilman Gage moved to close the hearing. The item was to appear on the July 31, 1969 agenda. SAILBOAT CONCESSIONS ON TOWN LAKE After some discussion, the Council continued the question of the sailboat concessions on Town Lake until further material could be gathered by the staff. July 24, 1969 CITY OF AUSTIN, TEXAS ΑΝΝΕΧΑΤΙON HEARING SET Mayor LaRue introduced the following ordinance: AN ORDINANCE PROVIDING FOR THE EXTENSION OF CERTAIN BOUNDARY LIMITS OF THE CITY OF AUSTIN AND THE ANNEXATION OF CERTAIN ADDITIONAL TERRITORY CONSISTING OF 249.72 ACRES OF LAND, SAME BEING OUT OF AND A PART OF THE GEORGE W. DAVIS SURVEY IN TRAVIS COUNTY, TEXAS, WHICH SAID ADDITIONAL TERRITORY LIES ADJACENT TO AND ADJOINS THE PRESENT BOUNDARY LIMITS OF THE CITY OF AUSTIN, IN PARTICULARS STATED IN THE ORDINANCE. Councilman Janes moved that the ordinance be published in accordance with Article I, Section 6 of the Charter of the City of Austin and set for public hearing on August 7, 1969, at 9:30 Α.Μ. The motion, seconded by Councilman Gage, carried by the following vote: Ayes: Councilmen Atkison, Gage, Janes, Johnson, Price, Mayor LaRue Noes: Absent: Councilman MacCorkle None HOUSE MOVER BRINGS GRIEVANCE Mr. Booker T. Moore, a house mover, stated that one month earlier he had been moving a house and the eaves of the house had brushed against a utility pole. His grievance centered around the bills he had received from the Electric Department for repair of the damage caused by the house hitting the pole. He felt that he had been charged for people who had not actually appeared to do any repairs and he thought that he had been charged for too many hours of labor. The total of his bill came to $174.02. Dick Jordan, Robert Tinstman, and Gene Higgins, speaking for the Electric Department explained some of the items on the bill to Mr. Moore. The Council members seemed to think that there had been some misunderstanding as to the extent of the damage and that perhaps the foreman had called out too many employees; however, they expressed confidence in the City employees. CASH SETTLEMENT FOR APPROACH MAIN Councilman Gage offered the following resolution and moved its adoption: (RESOLUTION) WHEREAS, the owners of Buckingham Place, Section 5, have installed a sewer approach main at a cost of $5,394.85, pursuant to a subdivision plan called Buckingham Place, Section 5, and have requested an 18%/82% cash settlement of the above amount in lieu of a refund contract; and, WHEREAS, 82% of the aforementioned $5,394.85 equals $4,423.78, which amount is agreed upon as the cash settlement value of said utility lines, in lieu of refund contract; and, WHEREAS, the Associate City Manager and the Director of Water and Waste Water Department have recommended said cash settlement in lieu of a refund contract; Now, Therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That Gene Higgins, Associate City Manager, be and he is hereby, authorized and directed to execute a cash settlement contract under the terms of which the City of Austin shall acquire title to the above described mains, from Buckingham Place Development Company, and to pay to Buckingham Place Development Company the actual cost thereof not to exceed $4,423.78. He also asked Gene Higgins to check on the progress of the Decker Lake recreation facilities. Councilman Johnson asked which wrecker service is authorized to change flat tires on police cars. Councilman Gage asked the City Manager to check the status of the July 3rd contract for an electric turbine awarded to General Electric. He said that the company had not yet received the contract. APPOINTMENT OF A TEMPORARY JUDGE The Council went into Executive Session to consider a temporary replacement for Judge Martin, who would be away from the 4th to the 15th of August. APPOINTMENTS TO URBAN RENEWAL BOARD Councilman Atkison moved the Council appoint the following people to the Urban Renewal Board: Mr. Jack Roach, Mrs. S.A. Garges, and Mr. Charles Sanflor.
