JOHN BARCLAY, Central Christian APPROVAL OF MINUTES Councilman Gage moved the Council approve the minutes of the August 14, 1969 meeting. JOHN BARCLAY Councilman Johnson offered the following resolution and moved its adoption: (RESOLUTION) September 11, 1969 - CITY OF AUSTIN. TEXAS WHEREAS, the people of this City and Nation have always been greatly indebted to the members of the ministry that have constantly talked and reminded us of our relationship to God and to our fellow man, and; WHEREAS, such teachings have in great part found their way into the development of certain policies of government, and; WHEREAS, Rev. John Barclay has during his long tenure as a minister inspired many of the leaders of government through his ministry and has further been an extraordinary example to the community by actively lending his talent to the public by work on various boards and commissions, and; WHEREAS, the said Rev. Barclay is resigning from the ministry after an illustrious career which will leave its imprint on this City. Now, Therefore; BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That the gratitude of the people of Austin for public service rendered over many years is hereby officially expressed to Rev. John Barclay that he might have tangible evidence of the regard and respect which he has earned. He also extended an invitation to the Council to be present at a luncheon that day. SUA PRESENTATION Mr. Russell Schlauniger, Project Director of SUA, appeared before the Council to answer any questions. In response to two questions, he stated that centralized maintenance of city vehicles and centralized administrative functions would save money in Austin. ANNEXATION ORDINANCE Mayor LaRue brought up the following ordinance for its third reading: September 11, 1969 = CITY OF AUSTIN, TEXAS AN ORDINANCE PROVIDING FOR THE EXTENSION OF CERTAIN BOUNDARY LIMITS OF THE CITY OF AUSTIN AND THE ΑΝΝΕΧΑΤΙΟΝ OF CERTAIN ADDITIONAL TERRITORY CONSISTING OF 14.24 ACRES OF LAND, SAME BEING OUT OF AND A PART OF THE GEORGE W. DAVIS SURVEY IN TRAVIS COUNTY, TEXAS, WHICH SAID ADDITIONAL TERRITORY LIES ADJACENT TO AND ADJOINS THE PRESENT BOUNDARY LIMITS OF THE CITY OF AUSTIN, IN PARTICULARS STATED IN THE ORDINANCE. The ordinance was read the third time and Councilman Price moved that the ordinance be finally passed. ZONING HEARING Mayor LaRue announced that it was 9:30 A.M. and the Council would hear the zoning cases scheduled for public hearing at this time. Pursuant to published notice thereof, the following zoning applications were publicly heard: AUSTIN GERIATRICS CENTER, INC. By Richard Baker C14-69-242 Tract 1 26.489 acres of land out of OLs 56, 57, 69 and 70, Division "0" Tract 2 An 80' tract of land which encircles the entirety of Tract 1 Tracts 1 & 2 23-41 Waller Street Rear of 41 1/4 Waller Street. 49 3/4 Rear of 1201-1205 Haskell St. 1207-1409 Haskell Street Rear of 1501-1511 Haskell St. Rear of 36-56 Comal Street 22 1/2 34 1/2 Comal Street From "A" Residence 1st Height and Area To "C" Commercial 4th Height and Area From "A" Residence To "B" Residence Mr. Richard Baker, representing Austin Geriatric Center, Inc., requested the Council to pass a zoning ordinance granting the application before his client granted the requested right-of-way. Austin Geriatric Center was willing to dedicate the required land but had to wait for permission from the Federal Government before the land could be released. The Federal Government was loaning Austin Geriatric Center $8,500,000.00 and had to be consulted every step of the way. In order for the loan to be made, however, the Federal Government had to be assured that the zoning was approved by the City. September 11, 1969 =CITY OF AUSTIN, TEXAS Mr. Paul Tovar appeared in opposition to the zoning application, stating that there was need for a recreational area for school children in the 10th ward, and that some of the Austin Geriatrics land could be better used for a park. Councilman Gage asked Mr. Baker, "Who could use the Center?" Mr. Baker answered that to the best of his knowledge, no resident would be required to pay more than 25% of his/her income for rent. To be eligible for acceptance into the program a person was required to have an income of $4050 or more. He felt the facility would serve persons with income too high for low-cost housing but too low for private facilities. Mr. John Trevino voiced the same sentiments as Mr. Tovar. In his opinion, the land in question was the only site available for a new school that could be built without relocating families. PUBLIC HEARING OPENED AND RECESSED Mayor LaRue announced that it was 10:30 A.M. and that there was a scheduled public hearing. Councilman Johnson moved the Council open and recess the public hearing. The motion, seconded by Councilman Atkison, carried by the following vote: Ayes: Noes: Councilmen Atkison, Gage, Johnson, MacCorkle, Price, Mayor LaRue None Absent: Councilman Janes CONTINUATION OF ZONING HEARING Also speaking in opposition to the zoning change were Mr. Mike Guerrero, Mr. Albert Vela, Mr. Longino Monrreal, Mr. Cecil Ramirez and Mr. Jorge deGerra. Mr. Al Rugeon asked the Council for a 30-day postponement to allow time for a statement from the Federal Government as to whether or not the land was available for another purpose. Mr. Luis Medina spoke in favor of the proposed geriatric center. Councilman Gage then moved the Council grant the zoning.change. The hearing was continued until July 10, 1969. The July 10, 1969 hearing was continued until July 24, 1969 and had not been brought up until this meeting. TRASH CLEAN-UP IN EAST AUSTIN Mayor LaRue announced that the Council would appear at the Oak Springs Library on Saturday, September 27th at 9:00 A.M. to add support to a trash clean-up program in East Austin. RECESSED MEETING 1:30 Ρ.Μ. September 11, 1969 - CITY OF AUSTIN, TEXAS BUS FRANCHISE ORDINANCES Mr. Dan Felts, attorney for Transportation Enterprises, Inc., requested that a TEI application for a franchise to operate the UT Shuttle Service be read before the Council. The application was filed September 10, 1969. Mr. Frank Denius, attorney for Austin Transit Corporation, announced that his client was also filing an application for a new franchise. There followed some discussion between Council members and the City legal staff about which ordinances should be read at the meeting and whether there would be time that day to draw up an ordinance for the Austin Transit Corp. franchise application. Mr. Felts said that he was asking for a first reading on his bus franchise ordinance because he was anticipating an amendment to the existing bus ordinance which would require that TEI operate under a franchise. At the present time, he stated, TEI was allowed by a court ruling to run a service for the University of Texas. The Council decided to postpone action on the ordinances until later in the Council meeting, at such a time as the City legal staff had drafted an ordinance for the TEI franchise. ANNEXATION ORDINANCES • Mayor LaRue opened the hearing scheduled for this time on the following annexation: 19.99 acres of land out of the John Applegait Survey proposed NORTHCAPE, SECTION THREE 0.05 of one acre of land out of the T.J. Chambers Grant additional lot area to Lot 8-B in "1968 Resubdivision of Lots 7, 8 and 9 of Block I, NORTHWEST HILLS, SECTION 6. No one appeared to participate. Councilman Gage moved to close the hearing. BUDGET HEARING, 1969-1970 BUDGET Mr. Norman Barker, City Manager, presented to the Council the City Manager's Budget for the consideration of the Council members. Mr. Ralph Hanna asked that the Council give his group $80,000 instead of the $75,000 allocated in the proposed budget. Councilman Gage asked if the parking lot at the Sanitation Department could be paved within the scope of the proposed budget. City Manager Barker said it could be paid for out of the $50,000 Council contingency fund. Councilman Johnson stated that he felt the City employee raise should begin in October 1969 instead of June 1970. Mr. Louis Shanks asked the Council to consider making Brackenridge Hospital a district hospital to cut the cost of maintaining the facility. Mayor LaRue replied that there was a committee being formed to study a 10-county health care plan. September 11, 1969 CITY OF AUSTIN, TEXAS CONTINUATION OF BUS FRANCHISE HEARING City Attorney Glenn Brown stated that he and his staff could not before the close of the meeting prepare the two franchise ordinances presented by Austin Transit Corp. and Transportation Enterprises, Inc. Therefore, these ordinances could not be passed on first reading that day. He also felt that the Council had mot had enough time to study the amendment to the bus ordinance. Mr. Denius asked the Council to adopt the two bus ordinances before the Council, one amending the existing bus ordinance and the other granting a franchise to Austin Transit Corp. Mr. Felts asked the Council to postpone action on both ordinances. Councilman Johnson moved the Council adopt the following ordinance and insert the date "February 1, 1970": AN ORDINANCE AMENDING SECTION 34-79(a) OF THE AUSTIN CITY CODE OF 1967 TO PROVIDE FOR EFFECTIVE REGULATION AND FRANCHISING OF BUSSES CARRYING PASSENGERS FOR HIRE; PROVIDING EFFECTIVE DATES; AND SUSPENDING THE RULE REQUIRING THE READING OF ORDINANCES ON THREE SEPARATE DAYS. EVANS CONSTRUCTION COMPANY For the installation of 2,250 feet of water main and 2,900 feet of sewer mains in Willow Creek, Section 1 $51,983.50 City Manager Barker asked the Council to postpone for one week consideration of a contract with the J.C. Evans Construction Co. for a water main and sewer mains. He said that there were mathematical errors in the resolution that needed to be corrected. EVANS METAL PRODUCTS For construction of a chain link fence located at Municipal Airport $9,264.70 The City Manager recommended that the contract with Evans Metal Products for construction of a chain link fence located at Municipal Airport be approved by the Council. Councilman Johnson questioned the need for a concrete curb along the base of the fence. Col. Murphy stated that the concrete curb was attractive, prevented children and dogs from digging under the fence, and made grass trimming easier. Councilman Johnson felt that these advantages did not merit the cost of the curb and he asked if the money could be spend for a taller fence. Mr. Barker said that he would withdraw the matter until next week and would look into Councilman Johnson's suggestions in the meantime. CONTRACT AWARDED Councilman Johnson offered the following resolution and moved its adoption: (RESOLUTION) WHEREAS, bids were received by the City of Austin on September 4, 1969, for the construction of an expansion to Govalle Wastewater Treatment Plant; and, WHEREAS, the bid of Ricks Construction Company, in the sum of $1,165,254.00 was the lowest and best bid therefor and the acceptance of such bid has been recommended by the Consulting Engineer and the Associate Director of Water and Wastewater Treatment Department of the City of Austin and by the City Manager; Now, Therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: September 11, 1969 CITY OF AUSTIN, TEXAS That the bid of Ricks Construction Company, in the sum of $1,165,254.00, be and the same is hereby accepted, and that Norman McK Barker, City Manager of the City of Austin, be and he is hereby authorized to execute a contract on behalf of the City, with Ricks Construction Company, subject to the approval of the Texas Water Quality Board and the Federal Water Pollution Control Administration.
