TEXAS April 23, 1970 In regard to RANDY DEVELOPMENT COMPANY'S request for utility refund contract in Perkins Park, Section 3, MRS. GRACE SCHMIDT, President, League of Women's Voters, inquired about a new policy concerning refund contracts, noting a reduction in cash refunds, and asking that the same reduction policy be followed on the refund contracts. Mayor LaRue reported the Council has been concerned about the refund contract policy and had asked the City Manager to come in with a solution. PARADE ORDINANCE The Council reviewed a re-draft of a proposed parade ordinance, and discussed the various sections making inquiries, and offering suggestions. The discussion was opened to interested parties. MR. CHARLES HOWE, American Civil Liberties Union; MR. DON ALFORD; MR. CHARLES CAIRNS; MR. DAVID PRINCE, Socialist Workers Party; MR. CAMERON CUNNINGHAM, attorney representing the Chuckwagon Defence Committee, the SNIC Breakfast Program, the Rag, Committee for GI Rights, Austin Welfare Rights Organization, the People's Committee to save Waller Creek, Lucha, the Economy Furniture strikers, and the Student Mobilization Committee; MR. DANNY DAVIS, law student at the University, each speaking in opposition generally to the requirement of liability and charges to be paid for police supervision, and on the constitutionality of the Ordinance. MR. JAMES DAMON spoke out of order. Sealed bids were received until 11:00 a.m., Wednesday, April 9, 1970, at the office of the Design Engineer, Webberville Service Building for the installation of approximately 1,566 linear feet of 30-inch C.S.C. Pipe, 4,862 feet of 42-inch concrete lined cylinder pipe, 66 feet of 16-inch C.S.C. pipe, 140 feet of 12-inch C. I. pipe, 110 feet of 8-inch C.I. pipe and 90 feet of 6-inch C.I. pipe in the Mesa Drive. The bids were publicly opened and read in the Webberville Service Building Auditorium. The purpose of this project is to expand the Northwest Booster System and provide for adequate service for a rapidly developing area. This phase of construction was coordinated with the Consulting Engineer and Developer for the subdivision involved. Mayor LaRue opened the continued hearing on the annexation of 40.38 acres out of the Henry P. Hill League. (Requested by owner's representative) It was pointed out there was over-lapping jurisdiction in annexation, but that Rollingwood had agreed. Mr. Tom Bradfield asked that the Council and administration intercede for the individuals in these extra territorial jurisdiction matters. Councilman Gage moved that the hearing be closed and the administration be directed to institute annexation proceedings on 40.38 acres of land out of the Henry P. Hill League. Councilman Price moved that the hearing be closed and that the Council direct the administration to institute annexation proceedings to annex the following: 21.986 acres of land out of the T. J. Chambers Grant - proposed Northwest Hills Cat Mountain Section. 0.05 of one acre out of the T. J. Chambers Grant - unplatted land. 13.04 acres of unplatted land out of the William Barton Laborproposed Barton Terrace Section 7. FINANCIAL ADVISORY SERVICES AND BOND LEGAL COUNSEL The Council had before it consideration of contracting for financial advisory services and bond legal counsel with regard to $60,000,000 Utility System Revenue Bonds and $21,500,000 General Obligation Bonds authorized March 28, 1970. The Finance Director, MR. NORMAN BARKER, stated the administration recommended a continuation of the existing contract as opposed to a new contract, explaining how a continuation would be of advantage to the City. (FIRST SOUTHWEST COMPANY OF DALLAS, Fiscal Advisors) and (DUMAS, HUGUENIN AND BOΟΤΗΜΑΝ, Legal Counsel, Dallas). The services applied for the bonds voted on March 28th, and would be on the total bond issue. Discussion on the contract wording was held. Councilman Janes moved that the Council authorize the City Manager to redraft and execute the contract. Kleiman's Attorney asking to withdraw his appeal from the decision of the Planning Commission on denial of a special permit. Councilman Price moved that the Council grant his request to withdraw the appeal (Dr. A. Kleiman and Della Griffin appeal). The motion, seconded by Councilman Gage, carried by the following vote: Ayes: Councilmen Atkison, Gage, Janes, Johnson, MacCorkle, Price, Mayor LaRue Noes: None HUMAN RELATIONS COMMISSION The Council recognized DR. JOHN BARCLAY, Chairman of the Human Relations Commission. Dr. Barclay reported three more members were needed on the Human Relation Board - one from each race. INFORMATION TO PRESS MR. JOHN O'BRIEN asked that the press be provided copies of supporting data along with the agenda. The Mayor asked that the City Clerk make up eight packets of agendas with enclosures for the news media. Councilman Janes suggested that the agenda without supporting data could be mailed to interested ! April 23, 1970 _ CITY OF AUSTIN, TEXAS organizations; and if any had a particular interest in the supporting material one could come by the City Hall and secure the data. In this particular, Mr. O'Brien was interested in the Parade Ordinance. MODEL CITIES APPLICATION 2:00 Ρ.Μ. 456 MR. ANDREWS, City Manager, reported a Model City program had been prepared; the Council finds such program necessary to improve the living conditions in the Model Neighborhood, and a Resolution had been prepared for authorization of submitting this program to the Housing and Urban Development for funding. MR. DON DILLARD and MR. JIM MILLER, Consultants, along with tremendous help from governmental sources, HUD, State organizations, and others had accomplished a tremendous job in getting this program underway for submission. MR. DON DILLARD summarized the Model City document, and the funding. The supplemental funds of Model City can be used in funding the projects or in matching other federal sources. Other funds will come from local sources -- City, Chamber of Commerce, and other local means -- some in kind and some in cash. He listed the City's responsibility as $46,600 in administration in kind or in cash. Through Model Cities, the City exercises certain priorities. Administration of the Program was discussed. Also discussed were how the expansion programs of various departments through Model Cities would relate to the present respective operations, and if they would come under the existing departments. The City Manager explained, that there would be no additional levels of government created. MR. JOHN SHANAHAN, representing the Governor's Office, MR. JERRY MABE, Department of Housing and Urban Development, spoke and answered questions. The Council was assured the individual projects as approved would still come back before the Council; and at that time the Council could modify the requests or approve them. Before a contract is signed, the Council has to approve it. MR. HUB BECHTOL, Real Estate Board, and representative of property owners, commented he was not in favor of going into this Model City Program as presented, stating the area should be scaled down, and pointing out disadvantages. DR. J. J. SEABROOK, MR. WALTER RICHTOR, Community Council; MR. JOHN CANDELLOS and others spoke, endorsing the Model City Program application. After the Council discussed the many facets of the program presented, Councilman Johnson moved that the Council continue this meeting until 2:00 P.M., Friday, April 24, 1970.
