COUNCIL CHAMBERS, CITY HALL 338 24 The meeting was called to order with Mayor LaRue presiding. Roll Call: Present: Councilmen Gage, Janes, Johnson, MacCorkle, Price, Mayor LaRue Absent: Councilman Atkison The Invocation was deliverd by REVEREND W.E. DENHAM, First Baptist Church. PARK REQUESTED Mr. Patrick 0. Higgins requested that the following petition be read into the record: "We the undersigned do hereby petition the City Council of Austin, Travis County, Texas, to establish an additional City public park to service the Austin residents of the northeast area, specifically those residents north of Highway 290 and east of North Lamar Boulevard. The reasons for requesting a park in the above area are listed as follows: (1) The trend of the City of Austin has been topplace a City park within reasonable distance to all Austin residents. A check of City maps indicates this trend has not been continued into the northeast area. (2) Plans are in the making with the City Parks and Recreation Department to add a park on the banks of Walnut Creek in the extreme north, outside the present City limits. This site is a fine location for a park but a large jump to the north, leaving residents in the northeast area covered by this petition still several miles from a recreational' facility. 339 - CITY OF AUSTIN, TEXAS- March 18, 1971 (3) The northeast area has acres of undeveloped property, some of which are not annexed into the City. These acres could be made available for recreational facility. (4) The northeast area is growing at a rapid rate and will continue to grow as evidenced by proposed elementary schools on Rutherford Lane, Braker Lane, plus a junior high school on Rundberg Lane. Bartholomew Park, the nearest park to the northeast area is approximately 5 miles. It is severely overcrowded, and an additional park in the northeast area will help to alleviate this problem. Northeast neighborhood streets now serve as a partial, unsupervised playground for children, and a safety hazard is apparent. We the concerned citizens of the area of Austin north of Highway 290 and east of Lamar Boulevard, feel a City park with complete recreational facilities will benefit all of Austin by promoting continued growth." Mr. Higgins then read the following memorandum into the record: "At the Regular Meeting of the Parks and Recreation Department, March 16, 1971, the Board heard a request from Mr. Pat Higgins and Mrs. Margaret McKenzie for a park in the northeast section of the City. Mr. Higgins pointed out the distance to Bartholomew Park and the distance to the future Walnut Creek park and graphically showed the need for a park in this area. The Parks and Recreation Department Director assured the Board that the location of a park in this area was desirable and would be included in an open space plan now being developed by the Planning Department. It was explained that funds have been recommended in the bond program for a district park in the northeast section.of the City. After listening to the presentation and discussion for the need of a park in this area, the Parks and Recreation Board voted to recommend to the City Council that a park site be purchased in accordance with the plan for open space." Mayor LaRue commented that he was confident that the park being requested would come to fruition. SENIOR CITIZEN BUS SERVICE REQUESTED Mr. Carl Edward Bock, Chairman of the Board of Trustees of the Nueces Activity Center for Senior Citizens, stated that the City was doing a magnificent job in providing a program for senior citizens in about 7 neighborhood centers, but one great drawback was a lack of transportation. He stated that many senior citizens did not drive and had no member of the family who could provide transportation. There were a number of problems with riding the busses: no service on week- ends or at night, high cost, circuitous routes, standing out in bad weather, no sidewalks and benches. He noted that on January 12, the Parks and Recreation Board had recommended to the Council the following proposal: that a Federal grant coming through the Governor's Committee on Aging and funds from the Older American Federal Act provide 340 CITY OF AUSTIN. TEXAS March 18, 1971 ! for the purchase of a $7,800 35-passenger bus. The total first year cost, including maintenance and payment of a driver, was estimated at $13,510. He stated that application for a Federal grant of 75% needed to be made by April 1, which would leave the City with a cost of $3,377. The Senior Citizens of the various Centers had pledged themselves to raise $1,000 of that, reducing the City's share to $2,377. He noted the costs there would be to the City for the second and third years of operation. If the City chose not to continue the program after the first year, they would be free to do with the buas as they wished. He explained how the bus routes would be scheduled to serve the neighborhood centers. Mayor LaRue questioned the use of the bus in the Model Cities area. He also wondered if some organization other than the City might assume the responsibility for operating the bus, and Mr. Bock was sure the neighborhood center boards would work with Parks and Recreation on this. Councilmen MacCorkle and Johnson also expressed reservations about the City having this responsibility. Mayor LaRue requested that the City Manager investigate the legal answers to the questions just raised and noted that this item would be placed on the next week's agenda. REQUEST CONCERNING GLISSMAN ROAD Mr. Jorge Guerra read a petition dated February 17, 1971, and signed by ten property owners on Glissman Road. It requested that the amount of footage required by the City to be given up for the paving of an industrial size street be reduced. It noted that Glissman Road from Airport to Shady Lane was entirely residential, rather than industrial, and requested the footage reduction to leave reasonable front yards and front porch and front room privacy. In response to Mayor LaRue's question, Mr. Guerra was uncertain if the petition was signed by 51% of the property owners. In response to Councilman Gage's question, Mr. Guerra stated that he had been told by the Public Works Department that in order to have a petition issued, the owners had to agree in advance to give up the property. Mayor LaRue stated that there had been some sort of misunderstanding. City Manager Andrews noted that the Planning Commission in 1962 or 1963 had recommended that this area be re-zoned from industrial to residential, but for some reason the City Council had never taken action. He recommended that a petition for paving the street 30' in width with a 50' right of way be filed if the owners were willing to give up enough property for the 50' rather than 70' right of way. He also recommended that the Planning Commission be asked to review the zoning of this area. Mr. Guerra stated that the 50' right of way was acceptable. Mayor LaRue noted that the City Manager's recommendations were acceptable to the Council. City Manager Andrews stated that he would personally hand the petition to Mr. Guerra. March 18, 1971 341 CITY OF AUSTIN, TEXAS SIDEWALK ORDINANCE DISCUSSED Mr. Cliff Dunn spoke in favor of the sidewalk vendors, noting that they were staying off the welfare rolls. He referred to a letter from the Mayor of Little Rock, Arkansas, empathizing with the vendors' situation. Mr. Bill Smith presented a proposed alternative ordinance which stated that a seller on public property should be extremely responsive to the wishes of neighboring property owners. If a law enforcement officer requested a reasonable shift of location, failure to do so would amount to violation of the ordinance. Mr. Roland Denoie believed that the proposed ordinance should be given three readings. He believed that the ordinance should be written in such a way that it did not completely prohibit mobile carts on sidewalks. In response to Councilman Janes' question, City Attorney Butler stated that the Council had the authority to license the vendors in some way. Mr. Rooster Andrews, President of the Travis County Grand Jury Association, noted the request of the Association for an ordinance that would control sales from Austin streets and sidewalks. He asked that action be taken and the requirement for reading on three separate days be waived. Councilman Janes requested copies of the most recent reports of the Association. Mr. Hub Bechtol urged that the Council pass the ordinance because he felt there was a vital public need. He believed that enough public hearings had been held. In response to Councilman Gage's question, City Attorney Butler noted that there had been officially no public hearing held. Councilman Price suggested a market square for the vendors. Motion Councilman MacCorkle moved the Council place the ordinance to regulate selling on sidewalks and streets on the agenda for March 25, 1971. There was discussion between Councilman Gage and City Manager Andrews as to the rationale for the current non-enforcement of ordinances on the book which would affect the Red River Street merchants. The motion, seconded by Councilman Johnson carried by the following vote: Ayes: Councilmen Gage, Janes, Johnson, MacCorkle, Price, Mayor LaRue Noes: None Absent: Councilman Atkison Councilman Gage requested that all parties who might be affected by this ordinance be notified that this item would be on the agenda. Mr. Cliff Dunn asked for a public hearing. Councilman Gage moved the Council set a public hearing on the proposed sidewalk ordinance at 9:30 A.M., March 25, 1971. TEXAS 342 Ayes: Noes: Councilmen Gage, Janes, Johnson, MacCorkle, Price, Mayor LaRue None Absent: Councilman Atkison ART FAIR REQUEST GRANTED Mr. Ross Blumentritt, President of Northwest Austin Sertoma Club, requested the use of City land west of Lamar Bridge running to the Butler tract between West 1st Street and the river for an "Art Fair". He stated that sanitary facilities would be provided at the Club's expense and that they would clean up afterwards. Councilman MacCorkle moved the Council grant the request for use of City land for an "Art Fair." The motion, seconded by Councilman Price, carried by the following vote: None Ayes: Councilmen Gage, Janes, Johnson, MacCorkle, Price, Mayor LaRue Noes: Absent: Councilman Atkison REQUEST FOR USE OF PARK GRANTED Mr. Martin Wiginton, on behalf of Mr. Cameron Cunningham, requested access to electricity in Pease Park for the People's Peace Treaty celebration. He stated that no fees would be charged and nothing sold. City Manager Andrews noted that a metar loop could be set up to determine how much to charge for electricity. He made the following recommendations: (1) That there be a contract for sanitary facilities. (2) That the location be Zilker Park rather than Pease Park. (3) That a cash bond be put up for cleanup, which would be about $200. Councilman Gage moved the Council grant the request for use of Zilker Park subject to the recommendations of the City Manager. Reda, of the Executive Board of the Austin Softball Association, requested approval of the City Electrical Department recommendation for re- lighting of three softball fields at cost to the City of approximately $2,500 and to the Softball Association of approximately $3,000. Mr. Tony Ojeda, Model Cities Director, discussed the personnel and equipment which would be involved in this program, noting that this would be an 11-month program operating within the Model Cities area. The motion, seconded by Councilman Johnson, carried by the following vote: Ayes: Noes: Councilmen Gage, Janes, Johnson, MacCorkle, Price, Mayor LaRue None Absent: Councilman Atkison CITY OF AUSTIN, TEXAS March 18, 1971 362 AGREEMENT WITH CARITAS AUTHORIZED The Council had before it for its consideration authorizing an agreement between the City of Austin and Caritas of Austin for the operation of Grants for emergencies - Total cost: $27,127 - 100% Model Cities funds. Mr. Tony Ojeda, Model Cities Director, stated that a number of people had been identified in the Model Cities area who were in need of emergency services. This program would provide primarily medical aid. He stated that Caritas would run the program under all of the Model Cities regulations for fiscal management. He discussed the procedures which would be followed in administration of the program. In response to City Manager Andrews' question, Mr. Ojeda stated that $20,000 would go for emergency aid and $7,127 for administration. In response to Councilman Johnson's question, Mr. Tom Spillar, Director of Caritas, stated that there was no seeking of bids for cooperating pharmacists and participating grocery stores who sold products at reduced prices. He stated that Caritas did not help the people who were eligible for drugs at reduced prices at Brackenridge Hospital. In response to Councilman MacCorkle's question, he discussed the procedures used to check the eligibility of persons being helped. Councilman Johnson expressed reservations that this program overlapped with Brackenridge's medical program and the County's food program. He believed that the latter programs should be expanded or discontinued rather than running another parallel program. Mr. Spillar stated that the program in question would fill in the gaps which existed in the Brackenridge and County programs. Councilman MacCorkle expressed reservations about the efficiency of the program in question. Motion Councilman Gage moved the Council adopt a resolution authorizing agreement between the City of Austin and Caritas of Austin for the operation of Grants for emergencies - Total cost: $27,127 - 100% Model Cities funds. Councilman Janes stated that his vote was predicated upon careful monitoring of the program by the City Manager's office to insure the value of the program was worth the cost. Griffin to the Mental Health-Mental Retardation Center Board of Trustees. REPORT REQUESTED Councilman Gage requested a report from the City Manager at the next week's meeting on the progress of the Northwest Park acquisition or agreement with the School Board. PARKS DISCUSSED Councilman Janes noted receipt of a letter from Beverly Sheffield regarding parks in the Montopolis area. He requested that the City Manager make some response to it. RECESSED MEETING ELECTION JUDGES AND CLERKS APPOINTED 1:00 Ρ.Μ. After a recess for lunch, the Council appointed Election Judges and Clerks for the April 3 Election.
