_ CITY OF AUSTIN, TEXAS MINUTES OF THE CITY COUNCIL CITY OF AUSTIN, TEXAS Regular Meeting April 15, 1971 9:00 Α.Μ. COUNCIL CHAMBER, CITY HALL The meeting was called to order with Mayor Pro Tem Price presiding. Roll Call: Present: Councilmen Gage, Janes, MacCorkle, Johnson, Price Absent: Mayor LaRue The Invocation was delivered by REVEREND RALPH L. HOLLAND, retired Church of Christ minister. PROPOSED INCORPORATION - VOLENTE Mr. Roy Yenawine, Volente, represented a group of people who are asking permission to hold an election of incorporation of the 1.84 square mile area of Volente, which is in the five mile jurisdiction of the City of Austin. This group is interested in pollution and zoning controls. He stated there were 45 people on the petition, and the required 20 registered voters necessary to call an election. The area has the conveniences of the city telephone, paper delivery, garbage pickup, incentive to improve and beautify the area was pointed out by Mr. George Milton, and they are trying to get away from the city turmoils. The people there are happy and want to be left alone; however they were not aware of this matter's being before the Council today and there was no notification. Mr. Marvin Cruse, active in the Fire Department, did not know of the meeting Mr. Yenawine had mentioned; nor did he know who composed the committee. As to any over-development mentioned by Mr. Yenawine he stated there was plenty of room for the next 100 years. He pointed out the State Health Department was working with these people on eliminating any pollution. Mr. E.A. Faulkner expressed opposition stating this movement was brand new to 80% of the people living in the area. Mr. Lou Babayak, Secretary-Treasurer of the Church, was against incorporation stating if these people would not support their own church, how could they support a city. _ CITY OF AUSTIN, TEXAS April 15, 1971 442 The Council heard all who wanted to participate in the discussion. Mr. Yenawine made a rebuttal to the opposition, and concluded the group wanted permission to call an election to determine whether or not they wanted to incorporate. Councilman MacCorkle saw the necessity of more thought and consideration, and stated this area was being served now as well as it would be under incorporation. He brought up the subject of a sanitary sewer system. Councilman Gage would not be willing, he stated, to act on this matter this morning, as he would want more information from the Staff, and from the Planning Commission, as to how this would relate to the City of Austin. He called attention to the several bills pending in the Legislature which probably would resolve their problems without incorporating. Councilman Johnson stated also that zoning was not a complete control, pointing out the State had precluded recently a community from building homes as they did not have a sewer system. He would not vote to encourage incorporation of a city until he was certain it was within its power and its intent to build a sewage treatment system that would not further pollute Austin's drinking water. He stated Mr. Yenawine was talking about a water supply for 217 or 218 people, but his concern was a quarter of a million people in the City. He agreed that the problems of Volente were on theêr way of being resolved through State provisions. Councilman Gage stated it was necessary, that people shoulder up to this responsibility as just recently one city nearby was cited as not providing the kind of service that cities had to provide. Councilman Janes stated there was no need of the Council's taking action, as the discussion did not merit continued consideration, and he was not prepared to relinquish any of the City's extra territorial jurisdiction. No formal action was taken. PAVING ASSESSMENTS ON ANDERSON LANE Mayor Pro Tem Price opened the public hearing in connection with paving assessments to be levied on Anderson Lane under Contract 70-Pa-133 covering 12 blocks. Mr. Joe Perrone testified that property evaluation would be increased far more than the value of the assessments. He stated that if the change went into effect the school district would have to anticipate a tax rate on debt service@alone of 51-52c rather than 49c. Councilman Johnson moved that the Council instruct the City Manager to move in a direction of developing a forecasting type of tax re-evaluation, and to continue to explore the possibility of revising the quadrant system. PARKING AT THE AIRPORT Councilman MacCorkle inquired about parking at the airport. City Manager Andrews stated more signs would be installed which would help solve the present problem. STRAY DOGS Councilman MacCorkle inquired about the problem of dogs running at large. City Manager Andrews reported the Council recently contracted with the Humane Society. Prior to that time, there was not sufficient room, but now the facilities are being expanded. The Council went into executive session at this time to consider appointing election officials. order.
