MCCABE, Catholic Charities. PROCLAMATION HEART MONTH Mayor Butler read a Proclamation proclaiming February as HEART Month and presented it to Mrs. Morris S. Shapiro, Mrs. Joe Atkison, and Mrs. Mary Alice Visage. POLICE OFFICERS RECOGNIZED Mayor Butler read proclamations honoring LT. MARTIN L. ANDERSON and LT. HORACE H. KULLENBERG upon their retirement giving recognition for their faithful performance of the many and varied tasks as a member of the Police Department for 40 years. The Mayor and members of the Council congratulated Lt. Anderson and Lt. Kullenberg, stating the proclamations are to be placed on the official Minutes of the City Council. Lt. Anderson and Lt. Kullenberg thanked the Council and introduced members of their families. Members of the Police Department were present. Councilman Nichols presented a letter to Police Chief R. A. Miles to be delivered to CAPTAIN TOMMY OLSEN wishing him a speedy recovery from his accident. Councilman Nichols stated this would be in the form of a proclamation. The motion, seconded by Councilman Dryden, carried by the following vote: Ayes: Councilman Handcox, Mayor Butler, Councilmen Dryden, Nichols Noes: None Absent: Mayor Pro-tem Love Not in Council Room when Roll was called: Councilmen Lebermann, Friedman COLLECTION PROCEDURES The Council had before it for consideration an ordinance appropriating $27,975 from the General Fund unappropriated balance to Finance Department accounts 00711000 and 00711010 to establish collection procedures; authorizing two (2) additional positions within the Accounting Division of the Finance Department. The City Manager stated although they were talking about 4 people, 2 of them would go in the Finance Department but 2 would be in this particular position which is not primarily as such a total collection job. The primary purpose is to assist all City departments in establishing effective collection procedures and to monitor the collection results to insure that sound procedures are utilized; to assist in the collection of delinquent accounts and take direct. action to assure the proper payments be made to the City in accordance with several hundred contracts which the City has entered into with concessionaires, developers and others. Mayor Butler felt it was incumbent to use good business practices and a need to agressively collect from the people who can pay and will not at Brackenridge Hospital. Councilman Dryden said the overall deficit was $4,000,000 with $2,800,000 of it being from the hospital; also part of the recommendation was already set up at the hospital. He felt they should let people pay something on CITY OF AUSTIN, TEXAS January 27, 1972 b a bill if they cannot afford to pay it all. Councilman Nichols stated he did not think they needed the hospital collection system and this one also. He asked about delinquent accounts for paving assessments and inquired how many employees would be required to catch up on these accounts. Councilman Handcox inquired if this would be permanent or if after the procedures were set up could it be divided between some existing departments. Councilman Friedman suggested that speci- fications be drawn, a contract let with some professional collection firm to let them centralize collection for every department and come up with good sound collection practices. He did not think 4 people could do this. Mr. Boyce Hornburg, Merchants and Professional Bureau, discussed with the Council the possibility of his company or some other private concern, collecting these accounts on a percentage basis. He felt they could get results with no ill will for the City. He reviewed accounts they had collected. Councilman Friedman inquired of Mr. Hornburg, as a professional, if he thought any firm would be able to coordinate all these activities along the lines the City Manager had indicated, recommend a procedure and operate it. Mr. Hornburg said he would like more information. The Mayor suggested they let the City Manager have the benefit of the Council's feeling in this area; that Mr. Hornburg and any others that desire, visit with the City Manager; and the City Manager report back to the Council with more information or some other approaches. All Council Members concurred. The Council decided to visit Brackenridge next Thursday, February 3rd, at noon and view their collection factors. He reviewed sales in the area, pointing out on the map the subject property and surrounding large acre tracts. The Tax Department felt $7,000 an acre was a fair value. It was brogght out that this was for city taxes only as the property is in the Del Valle School District. Mr. John R. Braziel represented Chevy Chase South Ltd. Mr. Braziel compared the assessment on this property with the property to the ease stating it had a beautiful view and only half of theirs had view and they were assessed at the same value. It was brought out that $8,800 an acre was paid for the property through the middle of the property. He stated he thought $6,000 an acre was a income from the property at the present; and consideration be given for drainage next Thursday, February 3rd. He said Capital Plaza and Sears were assessed at $1.25 a square foot and Delwood Center at $1.50 a square foot. He explained the deeper the tract the less it would be per square foot. 1300 East 38 1/2 Street (1.01 acres) and 1406 East 38 1/2 Street (.84 acres) get away from the influence of the Interregional Highway and were assessed on a $100 front foot unit. The .42 acre tract is drainage with no topping and was given a 25% discount by the Board of Equalization in 1970. Mr. Rogan Giles represented the owners. He stated this appeal was on land only and is on the 1970 and 1971 values as he never received an answer on his 1970 appeal. Mr. Giles thought $1.25 a square foot on the front tract would be fair. He discussed revenue and the Center being fully developed. The Council took this appeal under consideration with action to be taken next Thursday, February 3rd. At 12:30 P.M. the Council recessed until 2:00 Ρ.Μ. The Council resumed its business. BOAT DOCK Councilman Nichols moved the Council adopt a resolution authorizing the construction of a boatdock on Lake Austin for Mr. Howard Johnson on Lot No. 4, Block 24, Lake Austin Estates with condition the docks not be built out into the Lake more than 30'. The motion, seconded by Councilman Handcox, carried by the following vote: Ayes: Noes: Councilmen Friedman, Handcox, Mayor Butler, Councilman Nichols, Mayor Pro-tem Love None Not in Council Room when Roll was called: Councilmen Lebermann, Dryden LAND FILL AND RETAINING WALL The Council had before it for consideration the application of Mr. W. R. Coleman, as agent for Mr. Winston McIntosh, for land fill and erection of a retaining wall on the north side of Bee Creek with its confluence at Lake Austin. Mr. Steve Harris, Wroe Owens law firm, represented the property owner. He pointed out on a map the existing shore line and asked that they be permitted to extend this shore line, build a retaining wall and use fill from the lake to fill in this property. Recommendation of the Navigation Board was discussed. After clarification, Councilman Nichols moved the Council adopt a resolution accepting the recommendation of the Navigation Board to permit the erection of a wall following the shoreline as existing. Councilman Nichols inquired about the $4,800 fee. Mr. Eldridge, Construction Engineer, stated this was not in the nature of a design job but investigative, different from what would be expected to base a percent fee on. After discussion it was felt by the Council that they should talk with the officials of Brown and Root. The Council requested the City Manager to invite Mr. Webber and his superior, someone that is willing to take the responsibility of the consequences of whatever is decided, someone who has the authority to accept or decline for Brown and Root. The Council delayed consideration until next Thursday. MODEL CITIES PROPOSAL Mayor Pro-tem Love moved the Council adopt a resolution authorizing a contract between the Model Cities Department and the Austin Urban Renewal Agency for Relocation Services to be provided to families displaced by the Palm School funds. Mayor Pro-tem Love moved the Council waive the requirement for three readings, declare an emergency and finally pass the ordinance effective immediately. ($130 compensation for 2 months period Mr. Hammond could have rented the building). S. Highway 290E approximately 1/2 mile west of Decker Lane and 1000 feet east of Old Manor Road, requested by TEXAS URETHANES - Dr. Bill Davis - to change the designation of this area from Suburban Residential to a Planned Development Area. Mr. Dick Lillie, Director of Planning, located the subject property on a map and stated about 400 acres of land in the area was changed to manufacturing and related uses some 2 or 3 years ago with all of the rest of the land in the area being rural oriented land uses, farms, mobile homes, nursing home, some commercial uses on Highway 290 and 3 radio towers to the southwest. The north fork of Decker Lake comes up to within about 1/w mile of the south side of the 81 January 27, 1972 _ CITY OF AUSTIN, TEXAS tract. He said the Planned Development Area is one tool under the Master Plan by which specific industrial uses may request a site plan as required, and a set of performance standards are required. The site plan was submitted to the various departments and with the exception of the Water and Wastewater Department and the Health Department, the plan was recommended for approval. The Wastewater Department required that he be required to obtain an Industrial Waste Permit and abide by the Industrial Waste Ordinance. The Health Department indicated the area is not suitable for septic tank effluent, and it is recom mended that the developers submit a proposal with approximate volume and water to be used industrially and for sewage disposal and the number of employees. It was brought out that this building was already under construction and discussion was held on how these applications might be brought to the Council earlier, and why the construction continued. Also discussed was availability of water to this property. Mr. Lloyd Minnix, attorney for Dr. Davis, stated they had originally contacted the City in September, 1971, the application had been in Planning since that time. He said the property which was outside the City, next to a railroad track, was adjacent to an area zoned industrial, and nobody expressed a problem, consequently Dr. Davis went ahead with the building. Mr. Jack Peevey, contractor for the project, stated when they built within the City limits, they complied with city specifications but this was in the County and they did not need authorization. Mr. Bill Davis appeared in his own.behalf and answered questions regarding the sewage. He said the City-County Health Department told him to put in a septic tank of 750 gallons capacity minimum and 600 feet of lateral line. Approval of this change is recommended by the Planning Commission, subject to the following conditions: 1. A contract provision for no outdoor display. Outdoor storage would be permitted, provided a six-foot opaque fence is constructed for screening. 2. A 50-foot building setback line to be approved from U. S. Highway 290 and from residential development. 3. The proposed street is to be considered a private drive. 4. The tract shall never be subdivided into two or more parts for the purpose of sale or building unless and until a sub-division plat thereof has been submitted to and approved by the Planning Commission of the city of Austin, Texas. 5.
