CITY OF AUSTIN, TEXAS 862 MINUTES OF THE CITY COUNCIL CITY OF AUSTIN, TEXAS Regular Meeting August 31, 1972 10:00 Α. Μ. COUNCIL CHAMBER, CITY HALL The Meeting was called to order with Mayor Butler presiding. It was noted that Councilman Handcox was absent. Roll Call: Present: Councilmen Dryden, Nichols, Mayor Pro Tem Love, Councilmen Absent: Lebermann, Friedman, Mayor Butler Councilman Handcox The Invocation was delivered by REVEREND TERRY WHITE, University Christian Church. MINUTES APPROVED Councilman Nichols moved the Council approve the minutes of the Regular Meeting of August 10,1972. The motion, seconded by Councilman Dryden, carried by the following vote: Ayes: Councilmen Dryden, Nichols, Mayor Pro Tem Love, Councilmen Lebermann, Friedman, Mayor Bulter Noes: None Absent: Councilman Handcox APPOINTMENT OF CITY MANAGER Mayor Butler made an announcement in which he stated Councilman Handcox was in complete agreement. The Mayor stated the Council had been for some time interviewing prospective City Managers for the City of Austin, and had narrowed the field of applicants down to four of which Acting Manager Dan Davidson was one. Three top-flight applicants from out of State were interviewed, and all presented outstanding credentials. After thorough, careful investigation and consideration, the Council felt that already in Austin it had the best Manager for Austin on the job now. Mayor Butler announced that it was a pleasure for this Council to present the new City Manager of Austin, Mr. Dan Davidson. There was a standing ovation in the audience. City Manager Davidson stated he considered this appointment a distinct privilege to serve under each of these men in representing the programs they had designed for Austin and their ideals for continuing Austin as a - CITY OF AUSTIN, TEXAS August 31, 1972 863 quality City in this nation. He commended the staff for performing during this interim period and keeping the wheels at least of the administrative side of Austin in motion. He expressed gratitude for the interests and consultations and support of the citizens who are interested in what happens to Austin. He thanked the Council for its expression of confidence. Mayor Butler noted the presence of the family of Mr. Davidson who introduced his wife, Phyllis; daughter Dana; sons Mike, Douglas, Jeff and Matt. PROCLAMATION Mayor Butler proclaimed the week of September 3rd through September 9th as "HIRE A STUDENT WEEK" and read a proclamation, presenting it to Mr. Frank Campbell and Ms. Teresa King. PROCLAMATION Mayor Butler read a proclamation designating the week of September 4 through 11 as "AMERICAN INSTITUTE OF BANKING WEEK" and urged all citizens to join with the Council in recognizing the outstanding contribution of this valued organization. The Mayor presented the proclamation to Mrs. Lindgren and Mr. Humphreys. ANNOUNCEMENTS OF APPOINTMENTS Mayor Butler, on behalf of the City Council, announced the appointment of the following by the Council to two very important Boards and Commissions: URBAN RENEWAL BOARD HUMAN RELATIONS COMMISSION - MR. MATTHEW EDWARDS, JR. MR. BILL MCMORRIS SALE OF REAL ESTATE Councilman Nichols moved the Council adopt a resolution approving the sale of real estate in the Brackenridge Urban Renewal Project No. Tex A-11-1 as follows: Parcel 14-C Oil Field Hauler's Association, Inc. & Texas Motor Transportation Association (Minimum acceptable sales price $21,500) - ITEM POSTPONED - "BUDDY SYSTEM" $21,500.00 The Council postponed any action on authorization of a payment of $764.85 to Harrison-Pearson Associates for City of Austin "Buddy System" insurance for the renewal policy effective August 28, 1972, until a report is made. ΡΑΥΜΕΝΤ ΤO AUSTIN TRANSIT Councilman Nichols inquired about the $35,000 seemingly still due. Mayor Butler stated this could be affected by the billing date and the date their payment is received. The City Manager wanted to check any accumulated charges, especially the end of the year, and said he would have that information. CITY OF AUSTIN, TEXAS August 31, 1972 Councilman Nichols moved the Council adopt a resolution authorizing payment to Austin Transit Corporation for transit services during July, 1972, in the amount of $17,845. ANNEXATION HEARING SET Mayor Pro Tem Love moved the Council adopt a resolution setting a public hearing at 2:00 P. M., September 4, 1972, to consider annexing the following: 15.53 acres out of the John Applegait Survey: 15.21 acres - proposed Quail Creek, PHASE IV, Section II. (Requested by owner's representative) 0.32 acres - portion of KEN STREET. (initiated by Planning Department) 17.24 acres out of the J. C. Tannehill Leagueproposed CREST HILLS, SECTION ONE and ONE-A and an unplatted tract. (requested by owner's representative.) 36.67 acres out of the Theodore Bissel League: 35.37 acres - THE VILLAGE, SECTION SIX, and CHERRY CREEK PHASE III, SECITON ONE. (requested by owner's representative.) 1.31 acres - unplatted land and portion of BERKELEY AVENUE. (initiated by Planning Department) 94.24 acres out of the George W. City Manager Davidson reported they had been able to reach agreement as discussed with the Council in that there will be assurance that any connections to that sanitary sewer line, Texas Instruments would comply with policy that the Council has now or will have in the future. The Director of Water and Waste Water said this line is an extension from their line to serve subdivisions in the area. The line goes across Texas Instruments property which necessitates the license agreement. M., Mayor Pro Tem Love, in the absence of Mayor Butler, opened the public hearing on the 1972-73 City of Austin Budget. City Manager Davidson announced this is an official advertised public hearing as required by the Charter in connection with the proposed budget for 1972-73. This budget provides for a grand total of $95,044,409 out of which municipal services call for $76,909,704.00. The remaining amount, $18,000,000, is required for principal and interest payments on debts which results in the total of the $95,000,000 figure. He stated several organizations were represented to discuss funds under the "Special Services" and filed specific information to document their request. The Council would have work sessions to review these requests, employee's salary increases, modernization of the approach to the Tax Department, increased crime prevention and control within the Police Department, major changes in the Parks and Recreation Department with regard to new facilities. For the first time, it is necessary to fund whatever is necessary to operate a modern municipal transit system. In addition, this Budget includes needs at Brackenridge Hospital, and reflects the requirements necessary for additional beds and personnel for 1972-73. City Manager Davidson called attention to Austin's being one of the fastest growing cities in the nation; and the quality of development and condition of the environment will continue to improve and the budget as recommended would provide the necessary resources so that all could respond to this challenge. Arts Council Mr. Lloyd Lockridge, representing the Arts Council, a coordinating body for the performing and visual arts agencies. He said the Arts Council has, after review of the various requests, endorsed and supported each of these requests as listed: KMFA Mr. Charles Wirght, Chairman of the Board of Capital Broadcasting Association which operates Station KMFA a non-profit, non-commercial radio station. Contributions for this calssical music 11 hours daily, seven days a week remain steady between $24,000 and $25,000, but expenses are up, this year showing a deficit of $2,000. Mayor Pro Tem Love stated the Council was aware of this extraordinary service being provided the community by this particular radio station. This funding would have to be received through the City Attorney's department, and the Council. Civic Chorus Mr. Forbes Hanson explained their first budgetary request of $9,000 was under contract with the Parks and Recreation Department which turned out to be $6,900 in monies and $2,100 in "in-kind" services. He would like to withdraw the request for a line item $9,000 service contract, and continue providing these services now being provided under sponsorship of the Parks and Recreation Department. He preferred items in the Parks and Recreation Department budget as set up by the City Manager. The Parks and Recreation Department has budgeted for them $6,900 and $2,100 of "in-kind" services. It was pointed out by the Recreation Director, that this would be under contractural services in the Parks and Recreation budget. _ CITY OF AUSTIN, TEXAS August 31,1972 877 Zachary Scott Theater Mr. Lloyd Lockridge stated the Zachary Scott was satisfied with the $15,000, and Mr. Lockridge was to supply a copy of their budget to the Council members. The Theater is requesting $15,000 for certain services and $3,000 ($250 permonth) providing the use of their building when needed on specific occasions by the Parks and Recreation Department - an $18,000 request. Austin Civic Ballet Mr. Ken D. Carr, representing the Austin Civic Ballet, stated this year they are asking for a budget increase or $3,500 due to rising costs and due to putting on more ballets. Austin Symphony Mr. Lockridge, representing Austin Symphony, pointed out they were asking the same amount as they had for a number of years and this is designed for a school children's program. LaGuna Gloria Mr. Albert A. King presented facts to substantiate their requested increase from $12,000 to $30,000. Their current budget last year with the same functions cost $30,000 as compared to 1962, $12,000. Their art classes were accomodating 40 to 50 people wheras they serve 250-300 people. Ten years ago 12,000 people visited LaGuna Gloria, last year there were over 40,000. They requested the City to supply $30,000 out of a $90,000 budget. He listed the things they had done which would require additional funds. They furnish 15 scholarships to school children, are renovating the existing museum facilities, and initiating a library to complement the museum. Councilman Friedman inquired about the maintenance of their grounds included under an $18,000 item. He asked if he had asked the City for "in-kind" services, in keeping up the grounds. Mr. King was to explore this suggestion; Mr. Stoltje mentioned other activities -- landscaping underway by University classes stating the City could help maintain 15-20 acres of park area. Mr. Seagert spoke for LaGuna Gloria. Bicentennial Mr. Rod Kennedy saw nothing in the budget for preparation of the Bicentennial in 1976, and suggested that the City take a position as the capitol of Texas to get a Bicentennial Commission. Councilman Lebermann stated the City was at work on this, and had held meetings with the statewide organization. The Bicentennial Commission is at the time being put together. Austin Association for Retarded Children Mr. G. E. Williams was grateful to the Council for its support to the 155 youngsters who participate in the 1972 Operation Sunshine Camp, wherein the City budgeted $3,000 from the City Büdget and in cooperation with Parks and Recreation $5,000 from the summer enrichment program. He listed the increase of participants. His request was for a total of $8,500. _ CITY OF AUSTIN. TEXAS August 31, 1972 878 Horticulture Mr. Jack Dobie, County Agricultural Department Agent, representing the Texas Agriculture Extension Service of Texas A & M, in reference to the Ornamental Horticulture position stated the City participated in the program for $3,500 a year. He asked for a $700 increase - $4,200. Austin Child Guidance Mr. Thomas Oakland stated this Center was created 20 years ago to provide services to children and youth in the community including the 18 year old youths. It works also with the parents, social workers, etc. He listed the various services the Center provided, including emergency services. They gave services to 100 children last year. Austin Travis County MH-MR Mr. Louis Demoll stated the Center is currently receiving $85,000 from the Austin Budget. They are increasing their services to include those suffering from problems related to drug addiction and the treatment of alcoholics. It was pointed out they have about 16 locations from which they operate. Councilman Dryden endorsed the $25,000 increase as this Center is receiving an increase of patients and the whole program is very important. The alcohol program is a greater problem than the drug problem. Veteran's Service Office Mr. John H. Crownover, representing the Veteran's service office, sent a note that he did not want to be heard unless the Council planned to cut the budget. Mr. Rusk was present, stating they submitted their budget of $44,635.00, of which the City pays half for this service. The total amount was $47,000. He noted that the majority of Veterans live in the City of Austin - something over 90,000 veterans and their dependents and survivors live in the City. He asked the Council to continue its support as it had done for some number of years. Personal Bond Program Councilman Friedman stated the Director of the Personal Bond Program had contacted him to say if the Council needed to talk with him, that he would try to be at one of the work sessions, as he had been out of the City. He wanted to explain the needs of the Personal Bond Program. Mayor Pro Tem Love announced that the list of citizens and organizations who requested to appear in reference to the budget was concluded. City Manager Davidson suggested that the Council schedule its work sessions. He also suggested that if the Council could consider the budget finally by September 21st, this would legally give time to have an adopted budget prior to the beginning of the fiscal year. She had applied for this vacancy some months, then had given her tenants notice to vacate at the suggestion of Urban Renewal. Since there was a delay, she wanted to know so that she would void her request for her tenants to vacate, as delays cost her rent money and further delay in developing her property. This matter was requested in connection with Urban Renewal. She requested that this application be withdrawn for the time being. Since her application was submitted almost a year before the vacancy amendment was passed, she asked the Council to exempt the street and alley abutting her property so that when it is vacated at a later date, she would not have to go through that ordeal again. She asked the City to lease her property for a parking lot for the amount of taxes to be assessed each year against her property. Since Urban Renewal might be able to get her some relief funds from HUD, she asked that the Council recommend to Urban Renewal that they do all in their power to obtain 35% interest on the amount that Urban Renewal offered her for her property until such time that the street is vacated and she receives her portion.
