ST. JOHN'S NEIGHBORHOOD DEVELOPMENT PLAN At 10:00 A. M., Mayor Butler opened the hearing on the proposed St. John's Neighborhood Development Plan. Dr. Reynell M. Parkins, associate professor at U.T., recalled having requested of the Council on May 18, that the St. John's area be declared a Neighborhood Development Program under the guide lines of the NDP. He reviewed the organization since then and said negotiations in the area in conjunction with the people had been completed. Their first priority item for the first action year is improving Buttermilk Creek against flooding, gathering about three acres of land for a park site, and developing a commercial site as designated. H.U.D. had asked modification of the area by moving the western boundary from I.H. 35 behind the commercial development so that the present commercial strip would not be included; the rest of the boundary remining intact. The rear of the houses face on Bennett. Dr. Parkins pointed out one item of disagreement to be resolved by the Council concerning property at the corner of Bennett and St. John's, owned by Mr. and Mrs. Ricker, who want to establish a mechanic's shop at that location. They November 9, 1972 1090 ! _ CITY OF AUSTIN, TEXAS reapplied for a change of zoning this year. According to the plan, there is a high density of fourplexes to serve as a buffer around the residential. Dr. Parkins attended one of the meetings at which there were 65 residents present, and the people voted unanimously against the zoning. Some people who signed the petition giving their individual consent collectively voted against the very thing for which they had petitioned. Mayor Butler's copy of the petition showed 30 to 40 in attendance. Mr. Griffin stated 57 signed the petition. Dr. Parkins reported the residents were in complete agreement with the plans and program. Their memorandum of understanding has been signed between the residents, the students of the Graduate Planning Program of the University, and the Urban Renewal Agency as to what the goals and intnetions are for this area. There is complete agreement through the Planning Commission. Mr. Rodney Griffin, Chairman of the St. John's Residents Organization, reported the people in the area had input from the very first, to decide what they wanted for that area, and it is reflected in the plans before the Council. The residents on two occasions voted against having a garage in that area, as they want to preserve the residential area of the community. In addition to his organization, there is the St. John's Association, and the Housing Committee of St. John's Residents Organization which has entered into the memorandum of understanding along with the Urban Renewal Agency, the Graduate School of Architecture, and his Organization (two separate groups). He stated Mr. and Mrs. Ricker had met many times with him and others regarding the zoning. Mrs. Virginia Brown reviewed meetings and visits by the Rickers and made some comments as to the petition. She took a neutral stand, as she was working for the people - the Rickers and others. It was pointed out the Ricker zoning was being processed; and it would come before the Council in December, at which time there would be full discussion. Mr. Paul Jones, General Counsel for the Urban Renewal Agency, stated if the plan is approved as filed today, and the zoning were thereafter changed to reflect a difference land use, the Agency would have to come back and amend the plan. Noes: None Absent: Councilman Handcox Decker Power Plant Expansion The Council had before it the selection of a consulting firm to provide professional engineering studies and design services in connection with the Decker Power Generation Plant Expansion (Unit 2) - Capital Improvements Project No. 1050 0. Councilman Nichols stated he was not particularly a Brown and Root man, but he would have to move that this firm be granted this contract. In discussion, Councilman Lebermann asked for a week to review this matter. Mayor Butler stated the three firms who did part of the work were Brown & Root, Black & Veatch, and Gibson Hill from New York. In response to Councilman Friedman as to the status of the City with this firm, City Manager Davidson reported orally, and will prepare a memorandum on how a change of firms might affect the costs from a time standpoint, as a new firm would have to review the feasibility studies and construction, thus causing a delay in the project. The matter was postponed until the following week. Library Site Feasibility Study City Manager Davidson reported the first time this item of a feasibility study came before the Council, the Librarian, Earl Holt, and he, suggested that _ CITY OF AUSTIN, TEXAS November 9, 1972 1093 Council engage two consultants, one a librarian from outside of Austin, and the other being a planning firm. Now they have come back to the Council with two additional options if the Council chooses, as follows: No. 2 Option: This second option would be to request that the Council select a Committee of three persons, two from local marketing and research consulting firms, and the other being the Austin Public Library Director, Mr. Earl Holt, to study the potential site for a Central Library and come up with a recommendation. No. 3 Option: The City Council to consider the appointment of a local committee, non-paid, to work with Mr. Holt in considering the option of this down-town library site and determine the recommendation. Councilman Nichols looked with favor on Option No. 2; Councilman Dryden suggested that this could be accomplished by using a few local citizens, along with Librarian Holt's ability and probably Mr. Joe Morahan on the availability of sites, along with other local citizens who are interested in this project. He mentioned the State Librarian, Dr. Dorman Winfrey. After discussion, Mayor Pro Tem Love moved the Council accept Option No.2. Members of the Council wanted additional information about the two firms and the expenses incurred. CEDAR PARK WATER SUPPLY CONTRACT Councilman Nichols noted this contract apparently was to furnish 150 gallons per minute at the regular rate as opposed to 50 that the City now is committed. It was stated the contract is to be extended. Mayor Butler brought up a policy question for consideration and for particular through on charges to the out-of-town users of water, noting the City's utility, filtering, fluoridation, and other expenses are continuing to escalate. It appears through this procedure the City almost encourages people to develop outside the City limits to evade its services. As to charges, Mr. Rodger White, Water and Wastewater Department, stated the City had no maintenance or operation costs in these cases as it supplies the Corporation through a master meter. In January 1972, the bill was a little over $700, a minimum water use. In connection with Councilman Nichols' request for a factual report on November 16, the City Manager pointed out the Council would want to consider a provision for hcange in price of water consistent with any future change in the rate for Travis Williamson County Water Control & Improvement District. He reported a number of areas outside the City that are served at a rate the Council may want to evaluate, and that he could develop this information and submit a report covering all of these areas. Mayor Butler discussed the Jolleyville Reservoir which would serve Cedar Creek, and which is being enlarged to serve the citizens in the City limits. Besides furnishing the water and encouraging people to develop outside the City, he noted an advertisement by the biggest subdivision in that area - "No City Taxes." Mayor Butler recalling the Council's having looked into and establishing a _ CITY OF AUSTIN, TEXAS November 9, 1972 101 policy on sewer services outside the City, stated the Council should put these services on a paying basis. He said the Council never addressed itself to the water situation which is the only control of the outside development. He was concerned about the charges not being sufficient on today's market. Councilman Lebermann stated with a larger line to the Cedar Park Water District, together with stable rates, the district would be encouraged to develop. Mr. Frank Bolton, lawyer representing the Cedar Park Water Supply Corporation, presented information saying their present meter connections were approx imately 432, metered at the property site. Their rates include payments to the City plus amortizing their loan; and that is the basis for the 40 year contract, as they are getting a new FHA loan. In response to Mayor Butler, he stated that the interest rate on this loan would be 44% as is the existing loan and this loan is to pay for lines and storage facilities. Mayor Butler stated this interest is less than the City of Austin would be paying for its bond money to run the water out to this area. Mr. Bolton stated the existing contract has a provision that would not be changed in it, allowing the Council to come back and raise the rates to them or to anyone else in that Water Supply District. Mayor Butler stated it would have to be made across the Board. Mayor Pro Tem Love stated this District is charging $8.00 and collecting $3200. He inquired about industrial uses. was stated that there were several restaurants and a cabinet shop, but no industries. It General discussion ensued, Councilman Nichols noting the City is obligated to furnish 150 gallons a minute if the District needs it; if they don't need it, they would not sue it; nor would they pay for it. Mr. Bolton spoke of controlling the growth in Cedar Park listing several ways of controlling the development, although it was inadequate. He listed the commercial ventures under way in the area. Before Council action, Councilman Nichols stated the Council should have a report. Councilman Lebermann agreed, and he wanted included in that report some numbers on the Department descriptive of the fiscal situation. Mayor Butler added thaththe Council should be thinking about more than just the logistics on the costs to produce the water and its sale, making what percentage of profit necessary. Another point for thought is by the City's pricing it could be moderately punitive or it could be moderately discouraging to the prolific development of what will sooner or later be substandard housing. He emphasized the City had no controls except through the pricing of its product. Councilman Nichols suggested thinking about potential annexation. Mr. Bolton discussed the alternatives should the contract not be changed and the loan not go through; in that the developers would drill deep wells between Cedar Park and Leander. This is something they want to avoid; however, they could get those wells faster than they could use the THA funds and expand the present system using some surplus montes. Mayor Butler stated any incentive the City might have to encourage the growth of these developments would be overshadowed by the fringe ramifications which would be greater than the purchase and sale of water. Councilman Lebermann asked about the Organization and the geographical limits of the operation. Mr. Bolton said the Board of Directors are not salaried _ CITY OF AUSTIN, TEXAS November 9, 1972 1100 only the bookkeeper and maintenance superintendent. The geographical limits begin at the now Mental Health-Mental Retardation Center; and as well as he could define the limits, the first distribution point is the Hidden Valley Estates (20 houses); then the next point would be in the Hunt's Ranchhouse area; from there they have a line going west where they serve a fairly rectangular area; then a mile west of the Highway 183; four miles north parallel to the highway, back across 183 to about 50 connections. The limit down Jonestown Road is about a mile and 3/4 or two miles. Mayor Butler stated the entire operation is in Williamson County; none in Travis.. In response to Councilman Lebermann, Mr. Bolton stated they could not expand their service area due to their storage capacity and size of their distribution lines. Other than the mechanical or statutory reasons they could add customers. Mayor Butler stated the City Manager would keep Mr. Bolton informed on this matter and that the Council would be looking for his report. PETITION TO CLEAR QUAIL CREEK (LITTLE WALNUT CREEK) Mr. George N. Williams appeared before the Council, presenting a petition that requested the City to require immediate steps to be taken to clear out Quail Creek and to widen and/or deepen it. (He called attention that the petitim carried "QUAIL CREEK" when it should read "Little Walnut Creek".) City Manager Davidson reported as soon as he had read a copy of the petition, he inftiated a study through the City Engineer, Mr. Graves. His report has just been completed, and it will be necessary to have additional meetings as some of the responsibilities are the City's and some involve obligations of the developer of this area. He would meet with all involved and then submit a complete report to the City Council. He estimated it would take about two weeks to gather all facts, and Mr. Williams would be notified. AUTOMOBILE FOR OFFICIAL USE City Manager Davidson provided a report to the Council, and stated the City operates a municipal vehicle pool for use of municipal personnel in the City Hall and Travis Building, and when necessary, for the official use of members of the City Council. In order to improve this service, bids were advertized and sent to major automobile manufacturers to provide a rental car so that members of Council could have this vehicle to conduct official duties for the City. Bids were submitted to General Motors Corporation, Chrysler Corporation, and the Ford Motor Company. The Ford Motor Company bid was low, at $125.00 per month. They will lease the City a four-door Lincoln; provide the license; the insurance; and all maintenance and repairs. The vehicle will be on the City tax rolls. The City Manager stated they were extremely fortunate to obtain a vehicle of this type at such a low cost, it being more economical than to provide a standard City-owned car for Council use. The City will make its arrangements direct with the Ford Company of Detroit, Michigan, and not through the local deal er. The car will have the City Seal displayed on both sides.
