Gas Rate Ordinance. A Mr. Robert M. Laczko, District Manager for Southern Union Gas Company, said that for the last three years they had worked closely with the City and the Central Texas customers regarding the gas supply problems facing Austin; and there had been numerous conferences, public hearings and sessions held to assure maximum protection of the public interest in the regulation of LoVaca by the Railroad Commission. temporary rate relief was submitted to the Commission, and on review a relief was granted primarily for costs of acquiring new gas supplies. The order permitted customers to reject the rate; however, both the City and Southern Union on approval from the Council accepted the terms; and they activated the purchase gas clause. The ordinance permits Southern Union to reflect purchased gas costs increased in accordance with regulatory orders, and they had flowed through cost increases by LoVaca, which :: - CITY OF AUSTIN, TEXAS... January 17, 1974 44. costs have increased considerably. The Railroad Commission was requested by the Court appointed supervisor/manager of LoVaca to permit an adjustment for purchased gas costs based on the current monthly expenses anticipated by it. At a hearing, LoVaca showed an improved gas deliverability amounting to 265 million cubic feet; weighted average costs of gas had increased from 29 cents to 45 cents. Despite required additions of capital funds to Lovaca from Coastal States of $27 million dollars, LoVaca could not meet the deficiency; and the Railroad Commission accordingly ordered further relief to update purchased gas adjustments from the average cost experienced 2 months before billing to the current month. This relief was effective for only 60 days pending further review. In conference with LoVaca in early January, they believe the major customers have concluded current month costs should be reflected during this gas supply shortage. The result is a substantial charge by LoVaca to Southern Union which they cannot recover absent appropriate approval. In conferences with the City Attorney regarding both LoVaca's supplier cost and adequate supply to customers in Austin, an ordinance is being submitted to balance these rights. Southern Union itself will receive no benefit from the proposal; it is not a rate increase by Southern Union but an adjustment necessary to meet the energy shortage. The ordinance has five basic features: 1. Based upon their rates as in 1971. 3. 2. Makes adjustment only for the current month's costs of purchased gas as they are billed to Southern Union. Balances the charge for bills in the next month. Has provision to permit gradual effectiveness of rate increases where extreme fluctuations result in order to minimize impact on customers. 4. 5. Requires full reports in advance of billing first to City and then to customers in their monthly bills. Mr. Bob Jebavy, Southern Union Gas Dallas office, discussed the under and over recovery that occurred with load decreases and increases and asked that Southern Union be allowed to reflect these changes within 5 days instead of the 30 days now in effect. He also reviewed the billing cycle. Mr. McClellan stated there was an urgency in bringing this to the Council. The increase in the cost of gas is happening to Austin and all of LoVaca's customers. After determining that the Council had received a copy of the proposed ordinance only at the beginning of the Council meeting, he asked postponement for one week. Mr. Larry Neiman, Austin attorney representing Austin Apartment Association, asked the Council not to adopt this ordinance, as their first notice of the hearing was via newspapers on January 15; and they felt that Southern Union was trying to get out of a contract with the City, entered into in October, 1971. He said they were unable to find out the percentage of increase and the total amount reported by a one-month period. Ile asked the Council to deny the request. Mr. Scotty McGroth asked that the contract be amended so that a person not pay anything if he doesn't use any gas. Mr. Jim Boyle, on behalf of Texas Consumer Association, stated his organization felt there should be adequate advance disclosure of the increase in rate, and 5 days notice would not be adequate. lHe asked that the provisions in the present ordinance be continued. |! CITY OF AUSTIN, TEXAS: January 17, 1974 45 Councilman Binder inquired if Southern Union had gone before any other governmental body in Texas to reduce the notice time, and it was determined they had not recently. Councilman Friedman inquired about protection for the customer if the ordinance was amended to allow only a 5-day notice of change instead of the present 30-day notice. Mr. Don Butler stated he had not approved the ordinance passed in 1971, and his objection to the ordinance is on file; but under the present circumstances, he recommended this ordinance be passed. Councilman Friedman moved that the Council deny the request. The motion was seconded by Councilman Binder. Councilman Dryden offered a substitute motion that the Council grant the delay as mentioned by the attorney for the gas company, and postpone it for one week. S. Department of Transportation, Urban Mass Transportation Administration. Mr. Joe S. Ternus, Director of Urban Transportation, introduced Mr. Bill Bullock, Transportation Planning Engineer, who in turn introduced Ms. Mary McInnes from his Department. Mr. Bullock made the following presentation: Transportation plays a vital role in the overall development of any large metropolitan or regional area. Realizing this, the City of Austin, the Capital Area Planning Council and the Texas Highway Department have cooperated in developing a comprehensive transportation planning process. This process and the transportation planning activities for the coming year are outlined in the Unified Work Program, which was developed jointly by these agencies. This is the first step in planning for the long-range transportation needs of the Austin Metropolitan Area and Capital Region. Austin is in the midst of revising its master plan through the Austin Tomorrow Program, which involves the citizens in the planning process. One of the key elements in this program is transportation. During the next twelve months, the transportation planning activities will focus on the development of a long-range transportation system which will become a part of the new master plan. The Long-Range Study will be multi-modal in scope, including pedestrian movement, bicycles, automobiles, rail transit, and bus transit. All modes will be studied to determine which should be selected and how these should be combined to develop an integrated transportation system. Some of the considerations involved in the long-range study are as follows: 1. Based on projected land use, estimates of future travel demand and future travel patterns by mode will be determined. 2. Community value factors will be considered, ensuring that the long-range system developed will be compatible with both existing and planned neighborhoods. 3. Citizen input concerning general transportation considerations for the City will be received through the Goals for Austin Program. 4. Any long-range transportation system developed must be environmentally sound from a noise, air, and conservation standpoint. The environmental integrity of our City can be enhanced through intelligent transportation planning. ) ) January 17, 1974 53 - CITY OF AUSTIN, TEXAS: 5. The end product of this study is the transportation development plan through which the different modes and modal combinations will be evaluated in developing the long-range transportation system. Major transportation alternatives that will be studied include: 1. A conventional street network (residential, collector, and arterial streets). 2. A major arterial and expressway system. 3. A street network (as in 1) and a conventional bus system. 4. A combination neighborhood and express bus system. 5. A busway system (exclusive right of way for bus movement). 6. A linear rail system. 7. A circular rail system. These system alternatives will consider the existing transportation network and will include, as appropriate, support facilities such as streets, sidewalks, feeder bus service, parking garages, and transportation terminals. This application to the Urban Mass Transportation Administration will complete funding for the long-range study as outlined in the Unified Work Program. This will include grants to the Capital Area Planning Council and the City of Austin. The City will receive $93,312, which will require $23,318 of in-kind services from the City. It is our pleasure to submit this application for your consideration. This is the first step in developing a truly integrated transportation system. Mr. Lyndon Henry, member Texas Association for Public Transportation, spoke for the application but thought the amount budgeted for consultant services for the Transportation Development Plan was tremendously inadequate. He compared consultant fees in other cities. It was his observation that the approximate cost of consultant fees for Electric Rail Rapid Transit alone would be $50,000; and he requested the Council to increase the amount budgeted for consultants, at least allowing $50,000 for the evaluation of the Electric Rail Rapid Transit and an undetermined amount determined by Urban Transportation Department for the remainder of the Transit Study. He also asked for a more detailed study. Discussion of amount of money to be requested in grant and type of study was held.
