=C1TY OF AUSTIN. TEXAS= MINUTES OF THE CITY COUNCIL CITY OF AUSTIN, TEXAS Special Meeting December 08, 1975 10:00 A.M. Council Chambers 301 West Second Street The meeting was called to order with Mayor Pro Tern Snell presiding. Roll Call: Present: Councilmembers Himmelblau, Hofmann, Lebermann, Linn, Trevino, Mayor Pro Tern Snell Absent: Mayor Friedman CANVASS OF BOND ELECTION The Council had before it the canvassing of the results of the Bond Election held on December 6, 1975. The following precincts were reviewed: Precinct 125 and 126 - Okay Precinct 240 - Okay Precinct 129 and 130 - Okay. Precinct 423 - It was noted that there was a discrepancy of 1 ballot. Precinct 424 - It was noted that there was a discrepancy of 3 ballots. Mr. Sam Montgomery, Presiding^udge of the Central Counting Station, pointed out that in every election that is held, there are always some boxes where the tally count does not agree. After checking this problem, the only answer found would be the difference of people counting and a machine counting. Mr. Montgomery felt that there were not any serious discrepancies with the tally count. It was also noted that Precinct 333 had a discrepancy of 1 ballot and Precinct 332 had a discrepancy of 1 ballot. :CITY OF AUSTIN. TEXA! December 8, 1975 u u Mr. Montgomery stated that there had been considerable publicity concerning the masks that were used in the voting devices. It was found that the holes in the masks were punched in the wrong place, so the programs on the computer were altered to count the votes in the specific punches as the masks were shown. A verification of the program and a manual count was done and verified that the computer was counting them correctly. Due to this discrepancy, he recommended that in proposition number 8y that there be 63 votes added to the "for" votes; 69 be added to the "against". In proposition number 9, that 67 votes be added to the "for" votes; 65 be added to the "against." He commented that some of the masks in the voting devices were examined and he was reasonably certain that all of the masks that were in the devices were punched the same. Councilmember Lebermanu moved that the Council add the 63 votes to the "for" votes on proposition number 8 and 69 be added to the "against"; in proposition number 9, that 67 votes be added to the "for" votes and 65 be added to the "against". The motion, seconded by Councilmember Linn, carried by the following vote: Ayes: Mayor Pro Tern Snell, Councilmembers Himmelblau, Hofmann, Lebermann, Linn, Trevino Noes: None Absent: Mayor Friedman At this time, Mayor Pro Tern Snell Introduced Mr, Leroy Beck and Mr. Larry Murdock from the Election Division in the Secretary of State's Office. Mr. Beck stated that the Secretary of State has the authority to appoint election inspectors for the various counties throughout the state. He noted that a number of precincts were visited during the election, and no irregularities were found. City Manager Dan Davidson acknowledged all the additional effort that Mr. Montgomery had to expend in order to check out the error that occurred and expressed his appreciation for his work. He also complimented all the City departments that were Involved in the election in aiding to make certain that the result of the election would not be in jeopardy. The Mayor introduced a resolution canvassing returns and declaring result of an election held in the City of Austin on the 6th day of December, 1975. The resolution was read in full, and Councilmember Lebermann then moved that the resolution be finally passed and adopted. The motion was seconded by Councilmember Linn and carried by the following vote: Ayes: Mayor Pro Tern Snell, Councilmembers Hlmmelblau, Hofmann, Lebermann, Linn, and Trevino.
