Council Chambers 301 West Second Street The meeting was called to order with Mayor Friedman presiding. Roll Call: Present: Mayor Friedman, Mayor Pro Tem Snell, Councilmembers Himmelblau, Hofmann, Lebermann, Linn, Trevino Absent: None APPROVAL OF MINUTES Councilmember Linn moved that the Council approve the Minutes for September 23, 1976. The motion, seconded by Councilmember Lebermann, carried by the following vote: Ayes: Mayor Friedman, Mayor Pro Tem Snell, Councilmembers Hofmann, Lebermann, Linn, Trevino Noes: None Abstain: Councilmember Himmelblau EXECUTIVE SESSION ACTION Mayor Friedman announced that the Council had met in an Executive Session earlier to discuss some legal matters, land matters, and some board appointments as well as a personnel decision. Brackenridge Hospital Board Councilmember Himmelblau moved that the Council appoint MR. MIKE WILLATT to the Brackenridge Hospital Board. Mr. Forrest Cook accepted the proclamation and thanked the Council for this recognition anddnoted that they would do their best in trying to make October their biggest month for Big Brothers/Big Sisters. ANNUAL FIRE PREVENTION WEEK Mayor Friedman read and then presented a proclamation to Mr. Hal Hood, President of the Austin Fire Safety Board, proclaiming the week of October 3, 1976, as "Annual Fire Prevention Week" in Austin and invited all residents of Austin to join the Council in making out City and homes safer through the elimination of fire hazards. Mr. Hood thanked the Council for the proclamation and noted his appreciation for what the Council as well as the citizens had done for the Austin Fire Department and the other things done in order to make Austin a safer city to live in. He congratulated the Council for the good job and for the fine Fire Department that Austin possesses. SURVEYORS WEEK Mayor Friedman read and then presented a proclamation to Mr. Ralph W. Harris, Convention Chairperson, and Mr. George Sanders, FSA-Capital Chapter President, proclaiming the week of October 3, 1976, as "Surveyors Week" in Austin and asked all citizens of Austin to join the Council in acknowledging and commending the Texas Surveyors Association and other members of the surveying profession for their valiant efforts and contributions to the growth and development of our City and our state. One of the gentlemen thanked the Council for the recognition. EXECUTIVE SESSION ACTION Mayor Friedman noted that also discussed in Executive Session was a land acquisition matter and it was decided that before the Council would take any action, it must have a públic hearing to receive public input as to the acquisition of the MKT right-of-way as potential park land. Mayor Friedman moved that the Council set a public hearing on the acquisition of the MKT right-of-way as potential park land for October 14, 1976, at 11:30 a.m. The motion, seconded by Councilmember Lebermann, carried by the following vote: Ayes: Councilmember Trevino, Mayor Friedman, Councilmembers Noes: Himmelblau, Hofmann, Lebermann, Linn None Not in Council Chamber when roll was called: Mayor Pro Tem Snell Mayor Friedman stated that notices would be sent out with the assistance of the Planning Department and the Parks and Recreation Department. 2121 _ CITY OF AUSTIN, TEXAS September 30, 1976 PRESENTATION OF A CHECK MR. BILL PETRI, Chairman of the Board of Commissioners, Austin Housing Authority, appeared before the Council and presented a check in the amount of $21,368.54 in lieu of taxes. Mr. Petri noted that this amount is lower than previous years due to the cost of utilities. At this time, Mr. Petri introduced the Assistant Executive Director of the Austin Housing Authority, Mr. James Mitchell. Mayor Friedman thanked Mr. Petri for the check and stated that Deputy City Manager Homer Reed would process it. APPEARANCE TO DISCUSS SHUTTLE BUS SYSTEM MR. HUNTER ELLINGER, Coordinator, Citizens for Safe Streets, appeared before the Council to discuss the Shuttle Bus System. Mr. Ellinger pointed out that his information being presented was based on information from the newspapers and informal conversations with students and shuttle bus drivers. He stated that his group was not asking the City to take sides in the current strike; but that the City take responsibility for protecting the interests that the public has in the way the shuttle bus system is run. Mr. Ellinger then reviewed what he felt made the buses unsafe and felt that the buses are much noister and more polluting than they need to be. He felt that all of this is a City matter since the shuttle buses are running on City streets by virtue of a franchise granted by the Council. Mr. Ellinger noted that only the City government has the power and the broad outlook necessary to reconcile often-conflicting viewpoints. In an attempt to solve the problem, he stated that direct City administration of the shuttle bus system would provide proven management that would also be sensitive to the interests of the general public. If private ownership is continued as an interim measure, it should be under the policies that the City has found successful. steps: In conclusion, Mr. Ellinger urged the Council to take the following 1. That the Council acknowledge its responsibility to set policy on this matter. 2. As soon as possible, that the Council require that private bus companies operating under a City franchise be required to meet the same standards used by the City for bus safety, driver training, driver wages, noise, and pollution. 3. That the Council call hearings, either before itself or the City agency or committee that it thinks appropriate, in which all interested and concerned parties can testify as to the condition and needs of the shuttle bus system. 4. In anticipation of those hearings, that the Council direct the City Transportation Department to prepare a report comparing TEI operations with those of the Austin Transit System, and explaining the reasons for City policy in the places they differ. _ CITY OF AUSTIN, TEXAS 2/22 September 30, 1976 Mr. Ellinger asked that the City Council start the process of putting Austin's largest bus system under public control. Mayor Friedman stated that the Urban Transportation Commission has been established to hear these type of things and pointed out that the Council could not direct them to call a public hearing. He suggested Mr. Ellinger get on their next agenda and request the Urban Transportation Commission to have the hearings. He also pointed out that several years ago when the City took over the transportation system, one of the questions that was discussed was would there ever be one unitary bus system. Mr. Ellinger commented that he would follow the suggested procedure. PARADE PERMIT Councilmember Linn moved that the Council approve a request from Mr. Jimmy R. Raines, teacher, requesting a parade permit from Anderson High School Student Council on October 7, 1976, from 5:00 p.m. to 6:30 p.m. beginning from the north parking lot of Anderson High, north on Tallwood to Hyridge Drive, west on Hyridge, south on Silver Ridge, circle Emerald Hill Drive back to Silver Ridge, east on Steck, return to south parking lot of school. The motion, seconded by Councilmember Trevino, carried by the following vote: Ayes: Mayor Friedman, Mayor Pro Tem Snell, Councilmembers Himmelblau, Hofmann, Lebermann, Linn, Trevino Noes: None PHIL HALSTEIN, Co-president of Anderson High School, felt that this parade promotes unity and spirit at Anderson Nigh School and thanked the Council for granting the parade permit. Councilmember Hofmann felt that if the City started exempting the entire Austin Independent School District, then the purpose of the licensing would be defeated. Mayor Friedman suggested that the Council could amend the policy to non-profit educational institutions above the secondary level. Motion Mayor Pro Tem Snell moved that the Council adopt a resolution amending the policy on the licensing of encroachments to exempt non-profit educational institutions from the payment of annual fees. Friendly Amendment to Motion Councilmember Linn offered a friendly amendment to the motion whereby the policy be for institutions above the secondary level. Mayor Pro Tem Snell accepted the amendment. Councilmember Linn seconded the motion. In response to Councilmember Linn's question, Mr. William King Brown, Administrator of Brackenridge Hospital, stated that this would include approximately 8 to 9 man-days per month of management engineering. Mr. Brown noted that several departments would be examined to see just how they are being operated from a management engineering point of view. Councilmember Linn inquired as to the input from the Hospital Board, and Mr. Brown commented that the Board would be furnished with copies of all reports, recommendations and etc., on the program. Mr. Brown stated that there would be ample opportunity for the Board to make suggestions to the people doing the study. Councilmember Himmelblau moved that the Council adopt a resolution for authorization to extend an Agreement with the Texas Hospital Association Management Engineering Services to provide Brackenridge Hospital continued productivity Management Reporting Systems and a 12-month eontinuing Improvement Program. PUBLIC HEARING ON STREET NAME CHANGE FROM F.M. 1325 TO BURNET ROAD Mayor Friedman opened the public hearing scheduled for 10:30 a.m. to consider authorizing a street name change from F.M. 1325 to Burnet Road, and extends from U. S. 183 to 7,000 feet more or less north of Kramer Lane, or to the new City limit line. CITY OF AUSTIN, TEXAS 2129 September 30, 1976 MR. NORRIS KURIO, representing the Balcones Research Center, a part of the University of Texas, and several tenants and landowners along this thoroughfare, appeared before the Council in support of this street name change. He listed his reasons for the support as follows: 1. It will give a more meaningful address. 2. Many of the business establishments have stated that truckers bringing supplies to Austin have difficulty in locating F.M. 1325 and just where it ends. 3. Most of the people along this thoroughfare would like to become a part of the City and felt this change is justified. Mr. Kurio submitted a petition supporting this street name change. MRS. FRANCIE BREYFOGLE noted that this agea was in the geographic boundary of the North Austin Civic Association and supported the name change. Councilmember Linn moved that the Council close the public hearing and authorize the street name change from F.M. 1325 to Burnet Road, and extending from U. S. 183 to 7,000 feet more or less north of Kramer Lane, or to the new City limit line. REPORT PRESENTED BY THE ENERGY CONSERVATION COMMISSION Mayor Friedman noted that the Council had received two volumes from the Energy Conservation Commission entitled "Energy Performance Guidelines." He noted that Mr. Francisco Arumi, University of Texas School of Architecture, had been working on a program with the Energy Conservation Commission which is the basis for this report. Mr. Lonnie Davis, Director of Building Inspection, introduced another member of the Commission, Dr. Archie Straiton, and then presented the report to the Council. Mr. Davis noted that the study presented to the Council has developed a theoretical model for building design, materials, and construction for commercial buildings which can result in energy efficient construction. He stated that the Commission recommended that a year's time be devoted to gathering information on existing buildings, buildings under construction, and proposed buildings so that statistical information can be gathered to compare with the model and validate the findings. When the analysis is complete, the Commission will return to the Council with specific Building Code Amendment recommendations. In the meantime, the Commission requests that the Council accept and approve the report for use as general guidelines in the construction of commercial buildings. Mr. Davis stated that he was in agreement with the recommendation. ☑ CITY OF AUSTIN, TEXAS 7 September 30, 1976 Mayor Friedman stated that the Conservation Commission and the Building Inspection Department would continue to monitor this program and would return to the Council with recommendations as they are developed. Councilmember Linn moved that the Council accept the report entitled, "Energy Performance Guidelines" and would anticipate additional update in the future. MAC HOLDER, Chairperson of the Energy Conservation Commission, stated that for the past two years the Energy Conservation Commission has been working on a proposal relating to the individual metering of all living units in the City of Austin. He requested that the Council consider the Ordinance that the Energy Conservation Commission has written which includes individual metering of all electric service going into apartment complexes; it includes all types of living units from a duplex to a high-rise building. After working with engineers, architects, and personnel from the City, Mr. Holder felt that this Ordinance, as written, was very good. Mayor Friedman commented that all the Council could do today would be to set a public hearing and have the Ordinance discussed. Councilmember Linn moved that the Council sep a public hearing on October 28, 1976, at 3:30 p.m. to discuss an individual metering Ordinance.
