Since, according to the proclamation, the future is, to a large measure, dependent on the good health of our children and youth, and good dental health is an important part of total physical health, this week has been set aside in observance of children's dental health. Dr. Schneider thanked the Council for the proclamation. He said that Highland Mall and Westgate Mall will have booths set up during Children's Dental Health Week, where people can stop for a free oral cancer check, and a dental hygiene check-up. OFFICE EDUCATION ASSOCIATION WEEK A proclamation was read by Mayor Pro Tem Snell setting aside the week of February 6-12, 1977, as "Office Education Association Week." The proclamation stated that OEA, whose goal is helping to develop leadership abilities, competency in office occupations, and interest in the Americaunfree enterprise system, has 56,000 student members. Accepting the proclamation for the Office Education Association was Valerie Valdez, Chapter President, Travis High School. Ms. Valdez thanked the Council for the proclamation on behalf of all the Chapter Presidents who were present. They were: Roslyn Bishop, Anderson; Paula Gonzalez, Austin; Brenda Pitman, Crocket; Doreen Woods, L.B.J.; Esmeralda Reyes, Johnston; Sandy Hampton, Lanier; Debbie Daniels, McCallum; and Nathan Hale, Reagan. NATIONAL VOCATIONAL EDUCATION WEEK National Vocational Education Week will be observed February 6-12, 1977, according to the proclamation read by Mayor Friedman. The proclamation, which recognizes the growing need for Vocational Education, as provided by state and national governments, was presented to Mr. Gil Burrell from the Del Valle Independent School District. Mr. Burrell thanked Mayor Friedman for the proclamation on behalf of over 20,000 Distributive Education students in Texas. SER WEEK Councilmember Trevino reedda proclamation designating the week of February 3-9, 1977, as "SER Week." The proclamation cited the City of Austin as the designated Prime Sponsor for the Capital Area Manpower Program (CAMP), which sponsors the local SER program and supports its efforts to provide employment and training services to the unemployed, underemployed, and economically disadvantaged citizens of Austin. The proclamation was accepted by representatives from the SER Board. 152 CITY OF AUSTIN, TEXAS February 3, 1977 FREE ENTERPRISE WEEK Mayor Friedman read a proclamation designating "Free Enterprise Week" in Austin, February 7-11, 1977, for the DECA Chapter of Distributive Education at Crockett High School. He encouraged all residents to join in focusing attention on all of the business and distributive education classes that work together helping the free enterprise system benefit our community. Mayor Friedman presented the proclamation to Elouise Brewton, Coordinator for DE, Crocket High School. Ms. Brewton thanked the Council and accepted the proclamation on behalf of the participating students at Crockett. CITIZENS'S COMMUNICATIONS Mayor Friedman pointed out that he had talked to members of the Council individually and on reconsideration of matters concering William Cannon Drive and the boat races, in which the Council has been completely involved. He requested each speaker to present their case for reconsideration in two minutes. Mayor Friedman stated that this was not a public hearing, that everything that could be said, had been said, and that any further debate would be counterproductive. WILLIAM CANNON DRIVE Mr. Linn Murray, President, Whispering Oaks Neighborhood Association, spoke to the Council, requesting a vote of reconsideration on the alignment of William Cannon Drive, as cost as designed would be exorbitant; the taxpayers would have to pay; and he asked why no federal funds were asked for. Councilmember Linn moved that the Council redesign the drive to include a 14-foot median, with special consideration for a new utility design which would cheapen the cost. The motion, seconded by Mayor Pro Tem Snell, failed to carry by the following vote: Ayes: Councilmembers Linn, Trevino, Mayor Pro Tem Snell Noes: Councilmembers Himmelblau, Hofmann, Lebermann, Mayor Friedman WILLIAM CANNON DRIVE Mr. Bruce Shumate, President Pro Tem of the McCarty Lane Neighborhood Association, requested a vote of reconsideration on the alignment of William Cannon Drive, as by redesigning the Drive not to go through Oak Hill there would be less paving, less utilities, and they would save energy by eliminating the lights. He asked that they tie in at Boston Lane, which is alignment "B." Councilmember Linn moved that the Council change the alignment to "B." The motion died for lack of a second. Mayor Friedman said the decision of the Council to align William Cannon as previously decided upon will stand. CITY OF AUSTIN, TEXAS February 3, 1977 153 AUSTIN WOMEN'S CENTER SHELTER Barbara Black Miller, Director of the Austin Women's Center, asked for the Council's approval of the concept of acquiring property for the purpose of using it for a shelter for battered women and their children. This will be a shelter to offer women support in their emotional and physical problems. The County has set aside the sum of $18,000.00 to be used as a demonstration of their proposed program. They are not asking the City for any money but are asking for the Council's endorsement in helping the Women's Center to find City property that could be leased for a nominal fee for the one-year demonstration project. The motion, seconded Councilmember Lebermann moved that the Council approve the concept and instruct the staff to assist in finding suitable property. by Councilmember Trevino, carried by the following vote: Ayes: Councilmembers Lebermann, Linn, Trevino, Mayor Friedman, Mayor Pro Tem Snell, Councilmembers Himmelblau, Hofmann Noes: None PERSONNEL POLICIES Mayor Friedman told the Council that Mr. Joseph Pinnelli, representing AFSCME, requested to appear before Council to discuss Personnel Policies.. He said that two other items on the agenda would be included in this discussion. They were the consideration of Personnel Policies recommended by the City Manager, and the City Manager report on an Alternative Proposal for Personnel Policies. JOSEPH PINNELLI, Business Agent for AFSCME Local #1624, said that his membership had worked for 12 months to revise the Personnel Policies. He said he had heard that a workshop had been proposed to discuss the policies and that he would welcome a workshop. He said that as long as the policies were individually decided upon and stood upon their individual merit, he thought everything would work out wonderfully. Councilmember Trevino said, "I would prefer final passage of these Personnel Policies as soon as possible, but whileethe Council has heard much information about these policies, we still haven't had a chance, without the pressure of a very heavy agenda, to go over this book piece by piece, as a result, in order to examine the fiscal, legal and other questions involved." Councilmember Trevino meded that the Council postpone final action on these Personnel Policies until next week's Council meeting, and that a public, open work session be set for February 7, 1977, at 3:00 p.m. in the First Floor Conference Room at the Municipal Annex. February 3, 1977 154 _ CITY OF AUSTIN, TEXAS- Mayor Friedman said the public could listen; it was not a closed meeting, but it was a work session for Council discussion. Councilmember Linn also wanted to know if there would be staff there to answer any questions they might have. PARADE PERMITS Councilmember Linn moved that the Council approve the request for a Parade Permit from Mr. David Chase for Circus Vargas, from 3:00 p.m. to 4:00 p.m., Wednesday, February 23, 1977, beginning at Municipal Auditorium to the State Capitol, on Riverside Drive, to Congress Avenue and return the same route. The motion, seconded by Councilmember Krevino, carried by the following vote: Ayes: Councilmember Trevino, Mayor Friedman, Mayor Pro Tem Snell, Councilmembers Himmelblau, Hofmann, Lebermann, Linn Noes: None Councilmember Linn moved that the Council approve the request for a Parade Permit from Mr. John R. The motion, seconded by Councilmember Trevino, carried by the following vote: Ayes: Councilmember Trevino, Mayor Friedman, Mayor Pro Tem Snell, Councilmembers Himmelblau, Hofmann, Lebermann, Linn Noes: None BOAT RACES ON TOWN LAKE MR. JERRY MCPHERSON, Inkeeper at Holiday Inn, Town Lake, spoke for Mr. Curtis Raymond, President, Austin Boat Club, Inc. Mayor Friedman reminded him to keep his remarks to two minutes. He said that the boat races on Town Lake in their present form, represent a revenue of a quarter of a million dollars, which represents jobs. It was his opinion that the boat races are a real asset to our community. He feels that the benefits far outweigh the inconvenlences to some. MR. DANNY REED, representing the Austin Boat Club, asked that boat races remain at Town Lake. He said they had worked out a plan to keep the traffic out of the east area during the boat races. He said they would follow all environmental guidelines as they have in theppastaand will work with anyone who has recommendations. CITY OF AUSTIN, TEXAS February 3, 1977 155 Mayor Friedman asked Mr. Reed to state exactly what his request was. Mr. Reed replied that their request was to have three boat races at Festival Beach on Town Lake, which would include the one race during Aqua Festival. Mayor Pro Tem Snell asked what the preparations were to keep traffic out of East Austin. Mr. Reed said they had worked on a traffic plan to keep all of the traffic flow going directly from I.H. 35 directly on to Festival Beach. All streets going into East Austin will be barricaded and definite plans will be made to work with the people to keep the traffic out. Mayor Pro Tem Snell stated that this issue has become a very serious matter with him. He has talked with people in the neighborhood and he thinks that both factions should be able to get together and work out a solution. He said that he did not think this should be a political issue, and he thought Town Lake should be used by the people, but not to the extent of infringing on anybody's rights. Mayor Pro Tem Snell said that there should be a discussion between residents of East Austin and the Austin Boat Club. He sadd if the traffic can be diverted out of the east Austin neighborhood, and the litter problem taken care of, they should have the race, but if it can't be done, then there should be no race. After further discussion, Mayor Pro Tem Snell moved that the Council place this issue on next week's agenda, after a meeting discussing the traffic question has been held.. HIGH SCHOOL VISITORS RECOGNIZED Councilmember Lebermann recognized the large number of Johnsonn High School students attenging the Council meeting. They were Myron Bankhead's government class. ΑΝΝΕΧATION HEARING Mayor Friedman opened the public hearing to consider annexation of 52.49 acres of land out of and a part of the Theodore Bissel League. No one appeared to be heard. Councilmember Lebermann moved that the Council close the public hearing and authorize the administration to institute annexation proceedings to annex the following land: 52.49 acres of land out of and a part of the Theodore Bissel League in Travis County, Texas. Councilmember Linn inquired about the existing gas and water lines. Mr. Reuben Rountree said that there was an existing 8-inch gas line and 8-inch water main. MayorrFriedman asked who would be responsible for payment of any possible damage to the lines that might be incurred in construction of thepparking area. Mr. Rountree stated that if damage was done in the course of building the parking area, it would be the applicant's responsibility. Councilmember Linn wanted to know if this condition was in writing. Mr. Rountree said it would be in the license agreement, and if it was not in the agreement, it would be re-written to include this provision. Councilmember Himmelblau asked if the radius of the curb still met all of the safety requirements. Mr. Rountree assured her that it did. Councilmember Linn moved that the Council adopt a resolution authorizing the following License Agreement, to include a special clause that if the City has to repair the gas and water lines for any reason at any time, the applicant is responsible for payment of samet License Agreement permitting the use of a portion of the rightof-way on South Congress Avenue for parking and landscaping, which is contiguous to Tract "A" of Rebba Heights, a subdivision in the City of Austin, Travis County, Texas. PARKING AREA FOR UT STUDENTS The City Council had before it for consideration amending Section 21.31 (1) of the Austin City Code of 1967 by adding a new subsection (2) to section (1) as follows: (2) The City Manager may designate a separate area to be used by the University of Texas for university student parking subject to parking permit requirements of the University of Texas. Mayor Friedman asked how much the University of Texas was going to pay the City for the parking lot. City Manager Davidson replied that the University didn't propose to pay for the parking. Councilmember Trevino said he understood the hospital and neighborhood parking report is due on February 24th and proposed that the decision be delayed until February 24th, 1977, in order to alleviate any problems. Mayor Friedman said that he thought it should be made clear to the University that if they wanted to use the lot they should pay something for the use. Mr. Davis showed slides which pictured that the present drainage system is adequate to handle the design storm based on existing development; that overflow provisions are provided for the more intense storms; that there is a two-foot change in elevation toward the waterway, of the ground under the house; and that the natural drainage of the waterway isssomewhere between the house and the existing easement. Mr. Davis indicated the plumbing on the slide and stated that it was approved for above ground use. He showed several new structural members underneath the house and said all of the plumbing was new. Mr. Davis showed a slide of 1101 South 6th Street. The structure had been demolished and the area cleared. Mr. Davis said that in the report some reference was made to the handling of a notarized statement concerning a driveway. This was researched by the City Attorney's office and it was determined that no legal infraction was involved in the manner that notarization occurred. The notary did leave the acknowledger spot blank and did notarize the instrument without writing that in. Mr. Davis said that is not a legal infraction. He said the form was rather poorly drafted and had been in use for some 20-25 years. Prior to this incident the instrument was re-drafted by the City Attorney's office and is now in use. CITIZENS' TRAFFIC SAFETY COMMISSION On the request of the Citizen's Traffic Safety Commission, Councilmember Linn moved that the Council postpone decision at its scheduled Public Hearing on February 10, 1977, on Revisions to the proposed Driveway Ordinance. TEXAS 167 AFTERNOON SESSION 2:00 Ρ.Μ. POLICE PROTECTION FOR CITIZENS OF AUSTIN Mr. Louis Davis appeared before the City Council to express his concern for the safety of the women of Austin against attackers. He had several suggestions regarding the protection of women and what they can do to protect themselves. Mr. Davis also had suggestions for police surveillance in areas where he felt there was increased crime. The incidents which occurred during the robbery of a gasoline station of which Mr. Davis was manager in 1968, were recalled by him. He told how he had been shot by a policeman and suggested that payment for his pain and suffering was due him by the City of Austin. No action was taken by Council.
