TEXAS April, 3. 1978 MINUTES OF THE CITY COUNCIL CITY OF AUSTIN, TEXAS Special Meeting April 3, 1978 Council Chambers 301 West Second Street The meeting was called to order with Mayor McClellan presiding. Roll Call: Present: Mayor McClellan, Mayor Pro Tern Trevino, Councilmembers Snell, Himmelblau Absent: Councilmembers Mullen, Cooke, Goodman Mayor McClellan stated that this was a Special Called Meeting for the purpose of canvassing the results of the Special Municipal Election held on April 1, 1978. The following precincts were then reviewed: Mayor McClellan CounciImember Himmelblau Mayor Pro Tern Trevino Councilmember Snell CounciImember Himmelblau Mayor McClellan Precinct 322 - Okay Precinct 141 - It was noted that there was a discrepancy of 4 ballots. Precinct 3262- It was noted that there was a discrepancy of one ballot. Precinct 325 - It was noted that there was a discrepancy of one ballot. Precinct 239 - Okay Precinct 130 - Okay Councilmember Himmelblau moved that the Council adopt a resolution to verify the results of the Special Municipal Election held April 1, 1978. =C1TY OF AUSTIN, TEXAS: April 3. 1978 CHARTER AMENDMENT PROPOSITIONS PROPOSITION NO. 1 Amendment of the City Charter to increase the number of Councilmembers from seven (all are now elected by place from the City at large) to nine (eight of the councilmembers will each be elected from a district, in which the candidate resides, by the voters of the district and the mayor will be elected from the City at large) and to amend related provisions to (1) increase the number of Councilmembers required to constitute a quorum and to take official action from four to five (2) to increase the number of Council votes required to pass ordinances on an emergency basis from five to six (3) increase the number of Council votes required to amend or repeal an ordinance adopted by a vote of the people from six to seven and (4) to provide that, as to a Councilmember elected from a district, the voters of the district may exercise the power of recall by filing a petition signed by twenty per cent (20*) of the registered voters of the district, demanding the removal of the Councilemmber. Votes Cast For Said Proposition 6,976 Votes Cast Against Said Proposition 18,106 PROPOSITION NO. 2 Amendment to the City Charter to replace words of the masculine gender with words of both the masculine and feminine gender or with words which are not of the feminine or masculine gender. Votes Cast For Said Proposition 11,574 Votes Cast Against Said Proposition 11,700 PROPOSITION NO. 3 Amendment to the City Charter to provide that a Council candidate pay a filing fee of one hundred dollars ($100.00) or in lieu thereof submit a petition signed by a minimum of two hundred (200) registered voters residing in the City (and residing in the particular district if the candidate is running for a district seat) requesting that the name of such person be placed on the ballot. Votes Cast For Said Proposition 17,483 Votes Cast Against Said Proposition 6,971 PROPOSITION. NO. 4 Amendment to the City Charter to repeal the existing language which prohibits officers (board and commission members and couneilmembers) of the City from contributing money, labor, time, or other valuable thing to any person for election purposes pertaining to any City office or appointment and which prohibits said officers from exerting his or her influence to influence any other officer or employee to favor any particular person for office in the City. Votes Cast For Said Proposition 9,122 Votes Cast Against Said Proposition 15,690 =CITY OF AUSTIN. TEXAS= April 3. 1978 PROPOSITION NO. 5 Amendment to the City Charter to provide that a Coiincilmeraber must be eighteen (18) years of age or older on the commencement of his or her term; to provide that a Councilmember must have resided within the City for at least six (6) months and within the State of Texas for at least twelve (12) months next preceding the last day he or she could deliver a ballot application to the City Clerk and to delete the requirements that a Councilmember be a taxpayer of the City and that he or she not be in arrears in taxes or other liability due the City. Votes Cast For Said Proposition 15,084 Votes Cast Against Said Proposition 9,709 The motion, seconded by Councilmember Snell, carried by the following vote: Ayes: Mayor McClellan, Councilmembers Himmelblau, Snell, Mayor Pro Tern Trevlno Noes: None Absent: Councilmembers Mullen, Cooke, Goodman It was declared that Proposition Nos. 3 and 5 were duly adopted as of the date of adoption of the Resolution.
